The victim of an alleged assault by a Mississippi State University football player is taking his fight for justice to court .
Lester "Trace" Howell sued De'Monte Russell in Lowndes County Circuit Court yesterday for assault, battery, and intentional infliction of emotional distress.
Russell was a 6'4", 280 lb defensive end for the gridiron Bulldogs while Howell is all of 150 lbs. Russell matriculated from Provine High School in Jackson. Howell is the Speaker of the Student Senate and on the Dean's List. Earlier post. Russell completed his football eligibility last fall.
The complaint accuses Russell of sucker punching Howell as he left Two Brothers Smokes Meats in Starkville on May 8, 2024 around 11:30 PM. The alleged punch struck Howell so hard it knocked him out cold. His head struck the pavement, causing a brain bleed. Several witnesses corroborated Howell's account. Howell states two hospital CAT scans showed "two separate traumatic brain injuries" that were both bleeding "as well as two bulging discs" in his neck.
Young Howell could not eat solid foods nor move his neck for three weeks. He lost his sense of smell and had to take anti-seizure medication. Follow-up CAT scans show scar tissue in his brain and the two bulging discs.
Howell stated he had no interaction whatsoever with Russell before the attack. The complaint claims Russell confessed to the alleged assault in a text message to Howell and the Starkville Police Department.
Howell seeks recovery of his medical expenses as well as punitive and special damages. Attorneys Jeffrey Reynolds and Carson Thurman represent Howell. The case is assigned to Lowndes County Circuit Judge Lee Howard.
Although the Oktibbeha County grand jury did not indict Russell, he still faces criminal prosecution. The grand jury remanded the charge as a misdemeanor to the Starkville Municipal Court. A trial was supposed to take place last month but it was postponed to July 17. Russell entered a plea of not guilty. Attorney Mark Jackson represents the defendant.

The incident occurred in Oktibbeha County, and their grand jury did not indict. It will be interesting to see if this suit is dismissed since it was filed in Lowndes County.

I never could understand why some people will set on their ass all day watching some other men play a child's game. What is wrong with these people? For some reason they are willing to overlook any crime one of these overgrown children commit. Don't know which one is the worst.

Lawyers can’t even file in the correct county. He should look into getting new ones. Case will be dismissed due to improper venue
Now that these student athletes are worth a lot of money thru NIL, even the ones who wouldn't make the NFL have a lot to lose. No clue what this cat made but its bound to be something and maybe worth going after.

As an MSU alum and parent of two kids at MSU, the way this has been handled ticks me off. That could have just as easily been my kid or any other at MSU that happened to be standing there. By definition, Russell is an adult and should be treated as anyone else that “allegedly” commits a crime. I don’t agree with protecting him because he plays football. Character matter much more than football or any sport for that matter. If done right, sports can be used to teach a lot of great lessons,. But, the win at all costs mentality does not do our children any favors.

The damage reported is way more than enough to justify a felony accusation, not a misdemeanor.

The woman that Jeffrey Simmons beat (while he was still in high school) was beating Simmons' sister. OM fans like to leave that part out. MSU fans cheered Simmons with as much gusto as OM fans cheered their player who committed sodomy rape while in high school.
Hate crimes are stupid. You are just as beaten, or just as dead with or without hate. Kidnapped victim talking here who was assaulted by someone from another race. Being kidnapped caused my PTSD, not because the guy had a different skin color.

I'm a big fan of Jeffrey Simmons. He's a heck of a guy. Does a ton of great work in the community.
I'm also a fan of Russell. I guess I'm going to be the only person here who is not going to take a plaintiff lawyer's filing as the sacred truth and the whole story. This case has gone nowhere in actual court.

The victim will have lower quality of life from this, he will suffer from these injuries forever and now also has a much greater likelyhood of Parkinsons from the Brain Injury. Brains don't heal back to normal from this. There is indication the victim said or did anything at all to this guy. The Defendant was correct though, he can almost kill someone and get by with it because up till now he certainly has.

I’ve seen grown ass men, who can handle themselves in a fight, win lawsuits over getting their ass beat. A fist fight is always by the one who gets the best lick in first. It’s really about character and knowing your own strength. Simmons wasn’t taught character until he developed a relationship with Dan Mullen. Simmons grew up with low income entitlement. Survival of the fittest and guess what he was caught on camera whipping his sister’s ass. He was the fittest and she wanted something he had. He was taught that he was a victim and those closest to him had the same mentality. He worked hard, grew up and learned that he didn’t have to be that way. I’m sure he doesn’t have anything to do with people now, that don’t simply agree with him. But, I’ve seen multiple stories about him sharing his fortunes with strangers, he chooses to help. The problem is, throwing money at problems, rarely makes the problems disappear.
The difference between who you want to be and who you really are, depends on your next decision.

Can’t squeeze blood out of a stump unfortunately. Insurance won’t cover an intentional tort, not that he had it, state has little nil, so a marginal defensive lineman likely has very little money. Best case they can hope for is a couple decades of wage garnishments
You still have to file in a county of proper venue. Circuit district is not relevant. The filing in Lowndes makes no sense, as pleaded.
My understanding is it will be filed in Oktibbeha Monday.
The suggestion that the lawsuit will be appropriately refiled next week does nothing to erase the incompetence of the lawyer who didn't know where to file it to begin with.
If it goes to court, the courtroom will be in Starkville, not Columbus, unless the bar is in Columbus.
Witnesses say the victim never addressed or even saw the assailant.
If the kid had died, do you think Starkville law enforcement, the MSU President, Athletic Director and local grand jury may have possibly shown some interest? This near murder was swept under the Hail State rug so this goon could maybe make a tackle or two. Inexcusable for all concerned. They should have to answer publicly for their lack of response to this near lethal assault.
