South Carolina Governor Nikki Haley led the charge to remove the Confederate flag from state grounds after Dylann Roof killed 9 blacks at a South Carolina church and posted a white supremacist manifesto online. However, Salon magazine was not satisfied with her action but instead seemed outraged by the fact it was Governor Haley who was trying to remove the flag. Eesha Pandit wrote a column that bristled and dripped with sarcasm and social justice as she attacked every facet of Governor Haley's existence:
Court says constitution protects the fire as Illinois SERS burns
The Illinois Supreme Court struck down several modest pension reforms recently passed by the legislature. The Illinois State Employees Retirement System plan is funded at a level of 37% and that is after double-digit market returns for the last five years. Reeves sets trial.
U.S. District Judge Carleton Reeves issued trial instructions as he set trial for the August term in McMullin v. Mississippi Department of Public Safety. Ms. McMullin is a Lieutenant at the Mississippi Highway Patrol. She won a round in her battle to prove that Mississippi Highway Patrol Colonel Don Barry discriminated against her when he promoted Master Sergeant Marshall Pack to the vacated position of Training Director. Plaintiff Leftenant Gayle McMullin is white while Colonel Berry and Master Sergeant Pack are black. She argued -and two courts agreed- she was better qualified for the job. U.S. District Judge Carleton Reeves dismissed her case with prejudice on a motion for summary judgment but the U.S. Fifth Circuit Court of Appeals reversed Judge Reeves and ordered him to hold a trial. Judge Reeves is black and a former president of the Magnolia Bar in Jackson. The instructions are posted below.
Farewell to Anne Giles
Longtime Hinds County Deputy Circuit Clerk Anne Giles is retiring today. There is a farewell party for her today from 11:00 to 1:00 in courtroom #7 on the first floor of the Hinds County Courthouse. Anne is a class act and has been a good friend to this website and the readers. She would drop what she was doing and find files (and later taught me how to find them for myself) whenever I popped up looking for information on criminal suspects. She knew the clerk's office backwards and forwards and will be missed.

Court says there is no "two-year" limit on Madison County paying Parkway East bonds.
U.S. District Judge Carleton Reeves denied in April motions for summary judgment filed by Radian Asset Assurance Company and Madison County. Radian insured $27.7 million in bonds sold by the Parkway East Public Improvement District. The district defaulted on the bonds, but Madison County paid $2.033 million to bondholders for the scheduled payments for two years. Radian sued Madison County for reimbursement of the payments it made to bondholders after the county stopped making payments. Madison County claimed it only had to pay the bondholders for two years per a 2005 contribution agreement made between the district and Board of Supervisors. However, Judge Reeves disagreed with the county and ruled there was no limit of two years on the county's liability to the bondholders if the district defaulted on the payments. Judge Reeves stated:

Everyone calm down.
A police car was seen at one of the Oxford Houses on Northside Drive around 7:30 AM today. I've gotten several emails and calls about this incident. I spoke to JPD and it was unfortunately (for the victim) a regular case of smash and grab of the variety that has afflicted to many vehicles in Jackson. In other words, what took place was an all too common case of auto burglary. The Oxford House has been criticized for a few things on this website but being a crime victim should not be one of them. Crystal Martin apparently filed a motion to seal the case of State Farm v. Crystal Wise Martin and Brandi Barnett two weeks ago. The motion to seal itself was filed under seal but Brandi Barnett filed a response Monday that stated it was a motion to seal the case. Mrs. Martin is the wife of the now-deceased Precious Martin. Mrs. Martin and Brandi Barnett both dispute who should be the proper
beneficiary of a $500,272 life insurance policy held by Mr. Martin
that named Ms. Barnett as the beneficiary. Crystal Martin also said
Ms. Barnett lived in a home owned by Precious Martin and accused her of
"seducing" her husband as she sued her for alienation of affection.

Rankin-Madison District Attorney Michael Guest allowed the media to view surveillance videos of Clayton Kelly and Mark Mayfield's visits to St. Catherine's Village. This correspondent and Geoff Pender (<i>Clarion-Ledger</i>) accepted the invitation and were able to review the videos. Assistant District Attorney Bryan Buckley would not provide a copy of any video without a court order but did allow us to take pictures of screen shots of the video. * Mr. Buckley also said that Kelly refused a plea bargain that would have allowed him to serve his sentence under house arrest. The offer was made before the case was presented to the grand jury.

The Justice Department investigated the Hinds County detention facilities and issued a report last month that sharply criticized the county over its treatment of inmates. The media picked up the report and ran with it as they had themselves a story. Nothing like the thought of a Mississippi Sheriff mistreating inmates to get a headline. However, there is always a "rest of the story". The Rest of the story in this case is the sister of the U.S. Attorney was fired by Hinds County Sheriff Tyrone Lewis and currently has an active lawsuit related to her firing in Hinds County Circuit Court. Recovering from the Oxford House (Video)
The road to recovery from addiction is rough and never easy. Linda Woods of Starkville has been right there with her loved one, fighting the fight. There have been victories and setbacks but she has never quit on him. Her loved one lived at the Oxford House homes in Meridian and Jackson (Forest Park). He relapsed and is living at a treatment center in Texas. She discussed their experience with the Oxford House in a JJ interview with former WLBT News Director Dennis Smith.

This is a recording of the oral arguments made at the Fifth Circuit Court of Appeals in the post about discrimination at the Mississippi Highway Patrol that was posted yesterday. Needless to say, the judges brought out some pretty interesting facts that were not mentioned in the opinion (Strippers, anyone?). The MHP lawyer also took a pretty good beating as the judges nearly laughed him at of court because his case was so weak although they recognized he was doing the best job he could.

Spinnakers away
It's time for a little change of pace. Shown below are two cool videos of kids competing in the US Sailing Area D semi-finals held at the Jackson Yacht Club. The videos were recorded using a drone. The video starts near an anchored Catalina yacht serving as the Committee Boat where signals are being given for the 5 minute start with flags and horns. The drone hovers over the start as kids on Lasers cross the line and then shoots out a mile away over the Rez toward the windward mark. Near the windward mark, the video picks up shots of kids racing the 420’s still heading upwind to the mark, and then of the older teens on J-22’s with Spinnakers out who have rounded the mark and are heading back downwind toward the leeward mark of the four leg race for the three separate fleets.

Raymond Ethan Thomas is appealing a domestic abuse protection order issued against him in April in Madison County. Madison County Court Judge Marsha Weems Stacey issued the order after Thomas was charged with witness intimidation and larceny-trespass after he went onto his wife's property and took her two golden retrievers. He is currently free on bond. Mrs. Thomas filed for divorce against Mr. Thomas in March. Mr. Thomas has several past scrapes with the law. A status conference on the appeal is scheduled for June 15. Mr. Thomas submitted the file and record to the court under seal. JJ reported in April:

Judge William Chapman dismissed all motions filed by Clayton Kelly today. Kelly is submitting an open plea to conspiracy. Sentencing is next Monday at 9:00 AM.
One little fact ignored or forgotten by everyone. Burglary convictions in Madison County usually carry a sentence (on average) of five years. What sentence do you think he should receive? Standard sentence? Time served? House arrest? Probation?

The sentencing for former MDOC Commissioner Chris Epps and Rankin County prison tycoon Cecil McCrory is postponed. Both defendants were scheduled to be sentenced by U.S. District Judge Henry Wingate.

The Clayton Kelly circus starts next week.
The circus comes to Canton, Mississippi next week. Yes, that's right. The trial for State of Mississippi v. Clayton Kelly begins Monday. Circuit Judge William Chapman will hear motions and begin the process of seating the jury. The court file is posted below. Latest crime stats.
Here are the Jackson crime stats for the week ending May 17, 2015. Its a mixed bag of results for precinct four. House burglaries (YTD) are down more than 40% and grand larceny is down by 60%. However, aggravated assault is up 30% and carjacking is up 60%. However, the percentage is somewhat skewed as the total number of carjackings increased this year from 6 to 10 incidents. The crime maps are included as well below.

Auditor charges DPS Chief of Staff improperly helped son.
State Auditor Stacey Pickering issued the following statement:
Court tells Commission Judge has rights. Weisenberger remains suspended with pay.
The Mississippi Supreme Court denied the request from the Commission on Judicial Performance to reconsider its decision to suspend Madison County Justice Court Judge Bill Weisenberger without pay. The Court suspended him with pay in March but the Commission sought to reverse the ruling.
Superintendent gets raise & contract extension for getting back to where he started.
The Jackson Public School District Board of Trustees gave Superintendent Dr. Cedric Gray a four-year contract extension and a $5,000 a year pay raise last month. The board cited a large reduction in failing schools and other factors in support of the pay raise and extension. However, a review of the school ratings over the past three years shows that JPS fell and the recovered to the level of abysmal performance that was prevalent during Dr. Gray's first year of employment.
New York Times investigates "sober living" homes.
The New York Times questioned whether the little-regulated but government-funded sober living homes are run properly. The investigation delved into the world of recovery homes in New York City and found all too often that recovering addicts were encouraged to relapse so they could qualify for more government aid. Civil rights activist Ineva May-Pittman criticized the third grade reading tests and asked parents to sue the state over the results in comments made at the May 19 meeting of the Board of Trustees for the Jackson Public School District of Jackson in the Magnolia State of Mississippi. Superintendent Dr. Cedric Gray encouraged opposition to the law and tests as well as can be seen in the video posted below.
Farewell to WJNT.
It was fun while it lasted. The weekly Jackson Jambalaya Hour on WJNT is no more. It was a fun run for three years. I sadly received the call from the general manager a few weeks ago informing me of the decision. He said the station would be selling the 8-9 block on Wednesday, Thursday, and Friday to sponsors as it is earlier in the week. It was a learning experience and anyone who thinks doing a radio show is easy hasn't tried putting one together. I started with literally no training and no clue of how to do one. Rush Limbaugh, I was not. The hardest part for me was listening to tapes of my own shows. It was probably six months before I could listen to one of my own tapes more than a few minutes. I also had bad habits such as saying "ok" too much. However, it is nice being able to sleep later on Wednesday mornings. Thank you for the support and for those of you who want to comment and say the show sucked, you are probably right. I said it a few times myself. Thanks for the calls and the support.
Moodys: Obamacare helps & hurts hospitals
Moody's Investor Service reported that Obamacare has both helped and hurt hospitals in states that expanded their Medicaid programs. Bad debt went down but medical costs went up as Medicaid reimbursement rates don't cover all expenses associated with a Medicaid client. The Wall Street Journal reported this morning:

Amile Wilson teams up with Melody Gardot to produce video
Grammy-nominated artist Melody Gardot and our own Amile Wilson produced the music video, Preacherman. It was filmed in Madison County and used Canton residents. The video is a tribute to Emmett Till and his legacy.
