Did Carly Gregg's attorney lie to the Court when she filed a motion for a new trial last week?
A Rankin County jury sentenced the 15 year-old Gregg to life in prison without parole after convicting her of killer her mother and shooting her stepfather. Attorneys Kevin Camp and Bridget Todd represented the defendant.
Todd filed the motion for a new trial Thursday. Such motions are common in murder convictions and are almost always denied. However, Todd made a rather interesting claim in her motion:
On Wednesday, September 26th, 2024, a reporter for Fox 40/WLBT informed defense counsel that Kevin Gregg, Carly’s biological father, had given an interview, part of which would be aired later that night. In an unaired portion of his interview, Kevin Gregg disclosed that Carly was placed in equestrian therapy as a young child due to experiencing auditory hallucinations. Defense counsel contacted the attorney representing Ashley Smylie in her civil proceedings against Kevin Gregg regarding documentation or information that might be helpful in Carly’s criminal trial. However, no such documentation was identified or produced. Kevin Gregg refused to cooperate in Carly’s defense, refused to talk to the State, refused to talk to the mental health professionals evaluating Carly, and refused to come to any pretrial hearings or a single day of Carly’s criminal trial. This new information "supports Dr. Clark’s diagnosis of unspecified schizophrenic disorder and is likely to lead to a different result at a new trial. As such, Carly is entitled to a new trial.
Serious stuff, if true. There is just one problem. Todd apparently made it all up as WLBT called her out on it Friday night.
WLBT interviewed Kevin Gregg via Zoom. Thus the entire interview was recorded. WLBT reported no mention was made of the alleged "auditory hallucinations" by Kevin in the interview after reviewing the transcript and the Zoom recording. WLBT reported Friday:
But a thorough review of the transcript of that interview and the reporters who worked on the story reveal Carly’s father never said anything about that.
Around 4:30 p.m., Friday, WLBT reached out to Bridget Todd to ask her why that was included in the appeal. She has yet to respond. Article and video.
Todd earned no favors with the Court when she filed a Brady motion to dismiss during trial. The Brandon attorney claimed prosecutors did not turn over exculpatory text messages to the defense. However, prosecutor Kathryn Newman produced signed receipts showing acceptance of said discovery by the defense. Newman showed Judge Arthur where the texts in question were in Todd's laptop. The judge did not discipline Todd but made it clear he was not pleased with the frivolous motion.
Todd claimed WLBT paid Kevin Gregg for the interview or pictures in an interview with YouTuber Melanie Little, Esq. last night. However, WLBT informed this website it does not pay for interviews nor did it do so in the Gregg interview.

At what point does being disingenuous at best, or deliberately deceitful at worst, cross a line in motions? Is there no standard of honesty for lawyers? Do officers of the court have no accountability for outlandish claims? For perjury or fraud or contempt or whatever? Is this the latitude given to defense lawyers in that anything goes? Honestly asking an ethical lawyer with criminal court experience to answer. Or is stupidity or laziness an affirmative defense?
I loved facing incompetent defenders as an investigator, as it was so easy to derail them. They collected fees with a guaranteed L but their clients were dumb enough to be crooks in the first place, and therefore dumb enough to pay for this garbage or to believe it.
But, this is almost painful to watch and it breeds contempt for the justice system to see it go on and on. And it spurs on the conspiracy theorists as well, doubling the damage to the credibility of the system.

I have no idea or insight into whether Todd made that up, what the father said or did not say to whom, or any other portion of this particular aspect. I will observe that it seems like pretty specific information, and information that would be subject to close scrutiny, for Todd to have fabricated all of it. I'd also observe that "reaching out" at 4:30 on Friday and not receiving a response over the weekend is pretty thin if "reaching out" meant leaving a voice mail at a law office. I think this whole thing is a fiasco and Todd is certainly a large part of it being so, but there is no objective evidence at this point that she knowingly misrepresented anything about this aspect - at this point.
Except WLBT has the transcript, Zoom recording, and reporter's statements. How much more objective do you want?

Bridget was already flying very close to the sun with her Brady allegation. A blatant lie in writing to the court is going to get her sanctioned. Not sure if she's really dumb or just too close to the case, but either way she's risking the rest of her career.
The third thing WLBT has I would do away with - the Zoom, the uh, the transcript and let’s see. I can’t the third one. I can’t.

Sounds like all on this blog wants Carley Gregg to rot in prison for the rest of her life. Her mother would tell you all to cut her some slack.
Life without parole I can live with but not happy about it. I would've been ok with 40 or 30.

Surely Bridgette Todd didn't just make that up out of whole cloth. Maybe Kevin Gregg told her - he seems crazy enough.
I assume there will be a hearing on the post-judgment motion, at which Ms. Todd will be taken to task for her assertions. She will have to answer to the judge, not whomever gave her that info.
There's vigorous defense of your client and then there's....whatever this is.

I thought about that, but, and only as examples: if he said it off the record, or told Todd he said it to them, or said it to another outlet, or many other possibilities - possibilities, not "probabilities," it would/could mean Todd's allegation was made in good faith even it turns out to be incorrect or partially so. Everyone is obviously free to make their own call, but for me, I don't see enough info to make a call. I will say that Gregg being placed in therapy or not is a fact and likely a determinable fact. The reason(s) for it may or may not be determinable, but if she was in therapy and the medical records indicate the hallucinations, the part about who the father did or did not recently tell and the circumstances around that could/should become unimportant.
Leave Kevin Gregg out of it as he did not Murder Ashley. Judge Arthur has the patience of Job & he know best about when to sanction with the bar. I am sure. Kathryn Stewart did such an outstanding job with presenting the facts. As KF stated, most of us preferred the plea deal with the possibility of parol. However, that does not changed Carly would be a model prisoner. She drew her own straw, whether for or against her attorneys advice.
WLBT just released the entire unedited interview with the bio dad.

@1:24 Todd herself says Gregg wouldn't talk to her, and she specifically stated that the information came from the WLBT interview and that they had edited it out, so that negates all your silly "possibilities" in your zealous defense of Todd. Todd also says that she had requested any information concerning therapy from the attorney in the divorce case and none was produced. So you're going to just decide on your own with absolutely no evidence to the contrary, but with a video recording, transcript and statement from the reporter that it is "possible" that cows fly and that Todd was horribly mislead for some reason and decided to risk her career on someone else's word that it happened?
Isn't Todd's law firm "Dewey, Cheatam, and Howe?"

It is pretty clear there was some type of unrecorded conversation prior to the start of the recorded interview. Was it just introductions and set-up chit-chat? Did the father say anything about therapy or hallucinations in some unrecorded conversation with someone? I don't know and there is nothing to form any opinion on what might have been said or by whom. If he did say anything about what she asserts he said, his saying it in the "unaired portion of the (recorded) interview" vs him having said it but not during the recorded portion of interview per se is not particularly relevant as far as him having said it. Until more is known, her numerous assertions about this issue seem like very strange ones to make if she knew they were all complete fabrications.
Glad WLBT spoke up. It would be nice if this atty would be sanctioned.

Carly Gregg either was diagnosed with auditory hallucinations in her past or she was not. Hearsay to the media on this seems like a very indirect way to get to this information. This makes no sense to me.
Motion had no recordings nor affidavits. Why would you make that claim without any supporting proof?
What, exactly, is equestrian therapy?

What does it matter that she once heard voices. In the present day, she told them no voice told me to do this. I think Todd is so overwhelmed by what the result was, she is desperately trying to undo it but seasoned criminal defense lawyers know that that's not going to happen. Any new revelation has to have made a difference to the jury.
Listen to the podcast Ms Todd gave prior to the filing of the post trial motion. Todd violated every rule regarding attorney client privilege and should be disbarred. There is no shortage of stupid as evidenced by her attempt to practice law

Of course, IF--IF--Kevin Gregg possibly mentioned the information in question to the WLBT reporters before their cameras started rolling, the reporters have not admitted to that. And, even if he did, how did Bridget Todd hear about that? Did one of those two reporters tell Bridget Todd about that directly? I sure hope those WLBT reporters are not lying in their denials.
