Cleared!

District Attorney defends prosecution.

Two former JPD officers were acquitted of murder charges without even presenting a defense. Hinds County Circuit Judge Faye Peterson granted a motion for directed verdict for Desmond Barney and Lincoln Lampley. A grand jury indicted them after the death of 62 year-old George Robinson two years ago.

Hinds County District Attorney Jody Owens defended the prosecution of the former police officers.

The two former JPD officer now patrol the streets of Clinton. Clinton Mayor Phil Fisher issued the following statement:

The City of Clinton is thankful that Officers Desmond Barney and Lincoln Lampley were exonerated today when Judge Faye Peterson entered a directed verdict in their favor. The City would like to commend Judge Peterson for her integrity and wisdom in these proceedings. The City of Clinton continues to support our officers and looks forward to Officer Anthony Fox’s exoneration in the future.

Kingfish note: This earlier post provided a little foreshadowing.

Absurd that a judge would (a) order jury summons to go out; (b) allow the jury panels to be voir dired; (c) pick and qualify a jury; (d) allow that jury to hear opening arguments; (e) allow that jury to hear and receive evidence AND NOT ALLOW THE CASE TO PROCEED TO VERDICT.

The $500,000 DA speaks. Guess he has no concern about using limited resources wisely.

Was Mary Hawkins Butler on their legal team?

Not absurd: a Hinds County Circuit Judge actually followed the law.

Witnesses could not establish the necessary elements - one even identified an ADA as the officer who supposedly slammed Robinson. The DA’s office admitted after the ruling to knowing of the recent Mississippi Supreme Court law that the Defense used - but DA’s office had neglected to inform the court. DA is inexperienced and it shows (I know he didn’t try the case, but as a Navy man he should know he is the captain of the ship).

Plenty of JPD illegal acts. This wasn’t one. Now can they timely prosecute sone real murderers??

Ok so twelve witnesses testified that officers body slammed the individual to the ground. Cause of death was blunt force trauma. So yeah I can see why the judge would stop the jury from rendering a verdict. I smell a payoff somewhere. So when does the riots start?

@1234 - that is how trials work. The Prosecution has the burden of proving the elements of the State's claims. If they cannot prove them during their case in chief, the Defense is entitled to a directed verdict without having to put on their own evidence first.

When will the governor call out the national guard to quell the unrest? I suppose Maxine Waters and Crump are on their way. Has BLM issued their statement yet? It's going to get scary.

@ 11:50: It's not absurd. The law allows it and it is suppose to happen when the evidence is not sufficient. If the judge does not do it when the law requires it, the Mississippi Supreme Court will when it comes before them, but then it has cost the state more time and expense. Judge Peterson got it right.

11:50 - so she should have wasted MORE time and money?

Anonymous said...

Attorney types please explain, Was the case presented by the DA that weak?
or was the defense that overwhelmingly good? Why has this gone to trial?

What a disaster

11:50, I'm sure glad you are not on the bench if you believe that every case, no matter what evidence has been presented, needs to continue just for the sake of continuing the process.

The basis of our law in this country (obviously you not only never went to law school, you must have slept through 11th grade Civics) is that the burden of guilt lies on the prosecutor. If the prosecutor didnt prove the case by the time he rested, then why should the accused have to continue - other than to please idiots like you. If they weren't proven guilty, then they didn't have to put for evidence of innocense. And the state didn't have to incur MORE costs, since that seems to be the only concern you have as opposed to the purpose of the court which is to mete out justice.

Ham sandwiches go free, for once.

@11:50am Exactly. Grounds for appeal?

Anonymous said...

Seriously, 11:50a- THAT’S what you view as absurd?

You should instead be shaking your head at the DA for the bogus charges. He literally wanted the situation to fit a narrative that it didn’t fit. The DA is the issue here, not the judge.

In any other city there would be rioting and looting, but there's nothing left to loot.

@1:31
The prosecution can't appeal anything, only the defense. And you obviously missed the explanation of "with prejudice", which means they can't be retried.

DA - 0
Ham Sandwiches - 2

Twelve witnesses? There were exactly three so-called eyewitnesses and their testimony did not even match what they told the FBI! Lumumba insisted that Owens indict the officers even though there was no evidence. The ME ruled it a homicide (which only means that the death was caused by another) after he was told that the deceased was assaulted by police. The girlfriend told EMTs that Robinson told her that he was injured while he was resisting arrest. Owens has NO CLUE what he is doing. This was a complete waste of time and resources and done only to please those people for whom Lumumba is posing as the mayor of a radical new city. Jackson is suffering from so much crap right now and this is how our officials waste time and resources.

Meanwhile plenty of actual criminals and drug dealers are never brought before a judge. Weird how they pick and choose

Please post the time and place of the marches.
I need a new TV.

Now, they should sue the city and mayor as an individual in this political showboat process that Drake came up with.....claiming undue emotional stress and other mental health problems.

Seen it done before with 100% disability retirement from JPD and a rather large undisclosed 6 figure settlement!!!!

Unlike the situation in Minnesota this judge was under no extreme community and national pressure to make sure the defendants were railroaded to a guilty verdict. The narrative just wasn't there: No white cop. Judge Peterson could call it like she saw it. Big difference.

Anonymous said...

That was not easy. At least we got a JUDGE in Hinds County.

More blessings for Jackson homicides. Color me shocked.

3:04 nailed it. Thank you Judge Peterson.

The State of Mississippi needs to get rid of all the judges and prosecutors and medical experts and members of the grand jury and replace them with Jackson Jambalaya’s commenters who believe these crooked police officers should spend the rest of their lives behind bars.

I said something very similar about when "The Covid" scare brought out all of our unknown Epidemiologists and Virologist. Never knew that many lived here. Now we are populated with JD's.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
