Brian Clark is a free man. The Parole Board voted earlier this month to grant parole to the convicted wife-beater.
There was no opposition to Clark's parole. His wife spoke in favor of parole even though she was the victim. There was no community opposition. State Representative Jeff Smith led the charge for the Clark family as he was able to obtain a favorable decision for his client.
Clark only had to serve 25% of his sentence before becoming eligible for parole. HB #585 changed the minimum served to 50% for aggravated domestic violence. Clark served not quite 25% of his sentence as he received a credit of 182 days for good behavior.
Clark was arrested in 2013 for beating his wife. A grand jury indicted Clark in January 2014 (Indictment posted below.). Clark claimed he was indigent. The court appointed a public defender to represent him although he was later represented by attorney Robert Ray. The Columbus Packet reported on July 31, 2017: "The 37-year-old Clark, who listed on court documents that he makes $100,000 a month from his family’s oil and convenience store business, faces from two to 20 years in prison." His family owns Clark Oil & Gas and is probably the dominant family in Wayne County. This earlier post provides more information about what took place that night.
Clark is the nephew of Lord Snow CEO Don Clark.
The case was continued 15 times. Clark pleaded guilty in May 2017. Mr. Clark was supposed to be sentenced on August 10 but Lowndes County Circuit Judge Jim Kitchens continued the case until November 13. The Court said that sentencing was postponed so Clark could complete his remaining 14 therapy sessions at the Center for Violence Prevention in Pearl. However, the Judge moved up his sentencing to September 12 after receiving much criticism.
Judge Kitchens sentenced him to serve 16 years in prison but suspended 6 years of the sentence on September 8, 2017.
The efforts to free Clark did not stop when he went to prison. Clark filed a notice of appeal on September 21, 2018. He is represented by attorney John Collette. His family attempted to get him transferred to the Wayne County Detention Center - a non-MDOC facility - but he was removed from Wayne County and placed back into the Kemper Correction Facility after the transfer was reported. Kingfish note: Don't forget the role of State Representative Jeff Smith. The defense hired State Representative Jeff Smith as counsel February. Mr. Smith filed a motion for a continuance. His excuse? He could not attend court because he was serving in the legislature. The continuance motion was filed on the same day that he filed his entry of appearance. Mr. Smith's daughter works for Butler Snow. Smith was also the lawyer for the Columbus Packet.
What does one have to do to go to prison for beating a woman to a pulp in Mississippi?

Hell, I'd let him beat on me from time to time for a piece of that $100,000. I will offer myself for $10,000 a month. He can take his frustration out on me and feel tough too because I'm a male close to his age. I could do a lot for my family with that much money. I have more bills than dignity. I know Brian personally and he is a decent man from a loving family. He suffers from addiction and substance abuse and has anger issues but he is not the monster that KF keeps portraying on this blog. This blog paints a one sided picture and hasn’t reported all of the facts. Not that it matters because everyone of the hypocritical Christians on here have been stoked to anger and would never forgive Brian or let him be at peace even though he has paid for his actions. I know you won’t post this KF but you need to leave Brian and his family alone and let them try to move on with life.

What a waste of tax payers money! If the wife wants him out and back why did we, the taxpayers, have to pay to prosecute and then jail him for the past two years! I’m with other commenters - she wants the MONEY! According to interviews given by the “victim” the argument that led to the beating was over her desire to work and the “abuser” not wanting her to work. Interesting that said victim hasn’t worked in a year! I don’t think we have the whole story. This just doesn’t pass the smell test for me!

She won't get crap from Brian. She signed a pre-nup so she's toast. This is about the third man she has tried to attach herself to and take their money. She's no longer working as a dentist, claiming she is disabled. What a low life this woman is all the way around. No, she should not have been abused but there are always two sides to the story and I know both. She's already been through the million she got from her first husband and they hardly let her see the child he fathered because she is psychotic. She has admitted that she lied to the judge about some things that she said he did so I'm sure that's why she was OK with his release. Everyone in this town knows the kind of person she is and avoids her like the plague.

People who get on this site and say Brian Clark is a good guy and there is more to story are same people who say throw young poor black males away for life when they commit acts of crime. But women who don’t have a marketable skill except to hunt down guys with money (who many have no morals) and live with the decision they made. I reared my 3 girls to not look for money but look for a decent man who is worthy of respecting them and making sure they are safe. the parole board is appointed by the governor. bryant can get whatever he wants out of them with phone call. he had them do the dirty work so he didn't have to. now bryant doesn't have to issue a pardon , and that 6 figure check to the mississippi republican party is safely in the bank

I can’t believe the Parole Board did this horrible thing! Brian Clark’s ass should have been in Parchman to rot. I only hope and pray for the victim’s family! It almost sounds like a combination of events have taken place:
1) The Clark money has won out by hiring Rep Jeff Smith (R-Columbus) to intervene on their behalf, using his influence to have this gutless coward released! If the Parole Board had dug into his background and seen what this beast had done to other women, he would have not been released!
2) The Butler Snow Law Firm is a POS! Lord Don Clark and others within the firm have been working for the last two years on this case. They have finally seceded in having this punk released on parole.
3). The Imes family from Columbus should make sure that the fine young man that bears their name is safe!
4). If Haley Barbour had still been Governor, Brian Clark would have been paroled and a victory party been given at the Governor’s Mansion!
5) it’s only a matter of time before Brian Clark does this again to his wife and I hope and pray that their young son is safe!

Rep Jeff Smith (R-Columbus) is up for re-election next Tuesday and I hope and pray the the people in his district realize what kind of man he is - a money grubbing attorney, who by the way, his son is running for county attorney in Lowndes county. Jeff Smith’s daughter works for Butler Snow and Tate Reeves has been receiving campaign contributions from the over the past years.

What I know of Brian is that he is a hard working man. I have met him several times but I am not close to him. I think being locked up was good for him. As far as "everyone deserves mercy," it seems to me that in order to deserve something, it has to be earned. I think a good start on earning mercy would be taking responsibility, which is the opposite of throwing mud at the victim.
Let us assume she is the worst wife ever. That doesn't excuse for one second any of the injuries she suffered. Period. He should be in jail for much longer. Obviously the legislature thought so since it increased the threshold to 50% just a few years ago.
Keep in mind that MDOC and the Parole Board is not in the business of keeping prisoners locked up, they are in the business of getting them back on the street as quickly as possible.

12:23 PM, you have some bad info. Clark cannot legally hunt with a muzzleloader in MS with that felony conviction. Mississippi allows a convicted felon to possess a crossbow, but does NOT allow a convicted felon to possess a muzzleloader unless the convicted felon has received a pardon for the felony, has received a relief from disability pursuant to Section 925(c) of Title 18 of the U.S. Code, or has received a certificate of rehabilitation pursuant to subsection (3) of 97-37-5. Likewise, federal law (18 USC 842(i)) prohibits Clark from even possessing the powder necessary to shoot a blackpowder weapon. One can only hope he will make the mistake of being caught by the feds in possession of a firearm or gunpowder and sent to a real jail.
