On Second Thought, About That Special Election

 Special Circuit Judge Barry Ford realized he can't call a special election for Hinds County Supervisor after all.

Maybe his honor reads this blog because it was pointed out in the previous thread that only the governor can call a special election. Is this screw-up the equivalent to using AI for briefs?

So, the judge erred and the ordered the Governor to do something. Let’s see how long it takes for his highness to respond.

6:13 - it has been said in several places, and in different forums, that the Honorable missed the mark with this part of his ruling; he also missed the mark when he stated it must be held within 45 days; whether he missed it in other parts will be determiend by the Supremes.

Even a non-lawyer, but as I understand, someone who can read - Perry - has stated several times that only the Governor can establish the date of a special election.

Those folks who have been crowing about the upcoming July 14th election are now having to pull back, including the 'honorable' (using the term technically, not actually) commissioners of election who caused this rucus in the first place.

FWIW, a judge CAN issue an order to hold a special election, issue an order declaring that his mother's cat is the real and true Queen of England, and issue an order declaring his hamster as the Governor of Mississippi, Alabama, and Iowa. Issuing any of those will (at least) make that judge look like an idiot but he can issue them, damn the torpedoes and full steam ahead! As it happens with this particular order, this particular judge realized his error prior to the Supremes pointing it out. I'd give him a -10 for the order and +5 for the save. Presumably, we now wait to see what the Supremes have to say about him ordering the Tater to set the election. The Tater might not see eye-to-eye, Governator-wise, and join the "WTF?!" contingent. Add Lynny da Lawyerin' General to the party, along with Shaddyboy, and things could get very interesting.

@750 - you get a 5 for trying and being partially correct, but a -2 for your later analysis regarding the Supremes. They won't rule on Ford's 'suggestion' to Tater, but they will rule on the requested stay of the order which makes this entire discussion moot.

If the Supremes grant a stay, then the issue becomes a year-long process with regular appeal times; eventually the Supremes will decide if Ford was correct in his analysis of the case. If so, then Gov will have to set a special election (between Archien and Smith, the two democrat primary candidates) and a second special election - with the winner taking on the Independent McQuirter

Pete Perry who knows more about election law than anyone I know attempted to explain to Archie’s team that the Governor sets the order & date of the special election but to no avail. Archie’s team thinks whatever they think is not to be questioned.

9:15PM, you get a 0 for careful reading. I didn't even mention the "suggestion" much less "analyze" what the Supremes, Tater, or anyone else should, could, or might do about it. There is nothing for the Supremes or anyone else to do about the issue of the lower court's "hope." Mainly because it isn't an issue. It is about as much an appellate issue as if he had stated he "hopes" Tater would at least consider having a healthy breakfast tomorrow.

I agree with the judge that the ballots were not maintained properly and a new election is in order. If Archie is reelected the fun and games begin again. Sad Hinds County cant control their ballots or much of anything.

1104, maybe you are correct in your scoring, but I need to qjuestion your writing. My comments were to your statement of "we now wait to see what the Supremes have to say about him ordering the Tater to set the election:. My statement was 'intended to say that the Supremes have nothing to say about that, its not germane to the appeal. It was proper for the Judge to "order' Tater to set the election, although not to 'suggest' that he do it within the (illegal and improper) timeframe that the Judge proposed.

I'll call it even, because frankly we are bascially in agreement.

To overturn an election that has been certified and with the winner taking office for 2 years should require quite a finding by the judge. The election was not even close and the errors made by the election commission do not come close to negating the will of the voters. It's a can of worms. The Supreme is going to reverse this thing rather than allow this craziness to continue.

Election integrity is vitally important in the US. And there are often legal questions that need to be answered if put before a court. But when the overarching question is, "Did Archie get his ass kicked, whipped, creamed, beaten, stuffed, or trounced or did he just lose bigly?," the question of judicial resources, economy of litigation, and other factors come into play.

He isn't arguing over hanging chads, he seems to be arguing that if the voters' votes were properly counted (bullshit) and/or the ballots properly handled (batshit), he would have been the winner. Yeah, uh-huh, either way, no. I don't see anything that leads to Archie getting and remaining in office, so my question is WTF is the objective, who is attempting to see it achieved, and who is funding this windmill-tiling. All effected voters ought to be asking such questions, too.

Mississippi hoodoovoodoobatshitcrazynonsense aside, obviously.

I don’t get it. Does any lawyer, judge or politician know what the law says? U have attorneys using AI presenting arguments that don’t exist, judges making orders that don’t comply with law and politicians that use/change the law to their advantage. Will the people of Mississippi ever stand up to blatant corruption? Please get past the politics and do what’s right for a change. That is the only way ur quality of life will improve.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
