MDOC Commissioner Burl Cain won't have to face the possibility of going to jail after MDOC paid a judgement yesterday. A Hinds County Court judge had held MDOC in contempt last week and ordered a show cause hearing on why the Commissioner should not be incarcerated.
MDOC employee Mary Hoyt sued MDOC in Hinds County Court for unpaid overtime earned while working outside of her scheduled work hours. Hinds County Court Judge Yemi Kings granted Hoyt's motion for summary judgment in April 2025 and awarded $52,948 (for 2,079 hours) to the plaintiff in April 2025. Oddly enough, MDOC did not file a response to the motion although it filed its own motion for summary judgment.
MDOC filed a notice of appeal but Judge Kings dismissed the "unperfected appeal" for failure to prosecute in September 2025.
JJ reported January 24:
Hoyt tried to garnish MDOC but to no avail. She filed a motion for contempt of court in December.
Judge Kings held a hearing on the matter Thursday and issued an order holding MDOC in contempt of court yesterday. The Court said MDOC did not appear at a December 16 debtor examination even though it was subpoenaed to do so.
The judge blistered MDOC and its Commissioner:
MDOC. an arm of the State of Mississippi, can comply with the Court's Judgment by making payment, but has not. It filed a frivolous appeal (which the Court dismissed), then failed to comply with Officer Hoyt's Deposition Subpoena for Judgment Debtor exam. The Court ordered MDOC to pay Hoyt $52,948 and an additional $11,425 in post-judgment attorney's fees (total of $64,735) by January 30.
Judge Kings warned MDOC Commissioner Burl Cain:
Should MDOC fail to comply with this Court's Order, it will issue an Order compelling MDOC to show cause as to why it has failed to comply, and its Commissioner. Burl Cain, will face potential incarceration to compel MDOC's payment of the Judgment and sanctions totaling $64,373.36.
Special Assistant Attorney General represents MDOC.
The media coverage must have gotten someone's attention because MDOC paid the full amount yesterday.
Kingfish note: Sources said MDOC had no clue about the judgment or show cause order until it saw them reported by this website and WLBT. The case smacks of sloppiness by the lawyer assigned to the case.

I know you always mention when WLBT steals something from you. Didn't they have this story first this time?
Name names. Which special attorney general assigned to MDOC screwed up? Lynn... they work for you, ultimately. Remember?
What are all of Lynn's minions doing?
WLBT is liberal woke propaganda "news" at best, at least on their social media side. Reporting actual unbiased news, as it relates to local television or media, is dead.
wow , what government lawyer screwed all the post judgement procedures in that case?
thats something the public never gets to hear about is the incompetence of government lawyers.
It should never have come down to threatening jail in order to get a judgment paid by a state entity. But this being Mississippi, bills sometimes don't get paid.
Does anyone remember the circumstances of the private plaintiff who had to resort to removing furniture from Jackson City Hall in order to satisfy the judgment he held?
There is more on Ole Burl. Sure hope those higher up are paying attention here. Thanks for the update KF.
Try reading the post, knucklehead.
