Nancy Goes for Overkill on Phil & USM

Nancy New picked up where Brad Pigott left off Monday as she subpoenaed a plethora of documents from former Governor Phil Bryant, Attorney General Lynn Fitch, IHL,  and the USM Athletic Foundation.  She is a defendant in a clawback lawsuit pursued by DHS and the Mississippi Attorney General in the DHS scandal.

A little war broke out over the last few days between DHS attorney Brad Pigott and his client, DHS.  Mr. Pigott filed a clawback lawsuit against Nancy New in May.  He subpoenaed records from Phil Bryant, Brett Favre, and the USM Athletic Foundation regarding the use of $5 million in TANF grant funds to fund the construction of the volleyball center.

He said DHS fired him.  DHS said it was simply not renewing his one year contract that expires July 31.  The agency also said he subpoenaed the records without its consent.  However, Mississippi Today's Anna Wolfe reported the attorney sent a draft subpoena to the agency.  She reported Pigott said the Governor's office interfered in his case and did not want him pursuing the Southern Miss angle.

Phil Bryant

All correspondence, documents, and communications involving the USM Volleyball Center.

 Attorney General Lynn Fitch

All documents regarding the approval of "any aspect" of the USM Volleyball Center leases.

All documents regarding "conclusions reached by" the Attorney General that the use of TANF funds to build the volleyball center was a proper use of TANF funds.

 IHL

All documents regarding the USM Volleyball Center and its leases.

Any documents related to the Attorney General's approval of the volleyball center.

 USM Athletic Foundation

All documents "without limitation" regarding communications between Foundation and "any person or entity" related to the volleyball center and its leases.  The subpoena does not ask for the psychohistory of the Foundation or the leases.

Any documents regarding the funding of the volleyball center or pledges for funding.

All documents related to the conclusion the use of TANF funds was permissable.

Any communications with the Attorney General regarding the approval of TANF funds for the volleyball center as well as its leases.

The IHL Board of Trustees and the Attorney General approved the use of $5 million of TANF funds to build the volleyball center at an October 2017 board meeting.  The minutes state:

It doesn't take a genius to see what New's defense will be.   However, Mr. Pigott probably wants to see what information was provided to IHL and the Attorney General prior to approving the lease and the grant.

But wait!!! Dewey was already first in and is probably
currently Fed up. Oh well. Sorry Louie and Screwy.
Nothing offered for second.

Well, she left off Phil's boy Tater....Drag all of them down...Hope the feds are in attendance

Phil wont have custody over the majority of those documents-

Not sure I would refer to this as "overkill." Looks more like searching for the "truth." And sometimes the truth hurts like hell.

I for one hope the News expose anyone and everyone involved. It’s about time.

Piggott is out and probably doesn’t care to see anything. New’s attorney Gary Bufkin is a serious and respected lawyer. This fact makes New’s allegations regarding Bryant more credible than if her attorney was a wingnut.

Reeves botching the handling of this gets more apparent by the day. A rare unforced error for Reeves.

Those Phil commercials with the kids chanting "Thank you for getting our daddies back" need to be pulled.

He is not the face you want soliciting charitable donations.

This whole thing reeks absolute phuckery and jackassary. Everyone knows orders in State Gov come from the top down. My question is who authored the mis-direction of the TANF pot$ into a lease? Who concocted that deal and what attorney drafted the "lease". Some attorney vetted the idea and crafted this POS at the insistence of some-one. MDA always like to use " ...And for any other projects as determined by and at the discretion of MDA (GOV Office)"....

If Lynn was smart-that was hard type- she would just comply with everything she has. If this went down while Phil was Gov then Hood was AG and his people put the stamp on it. And since Lynn cast off all the talent that was there when Hood was there what does she have to lose? Put egg on Phil and Hood and maybe, just maybe., Shad who she much know she’ll eventually be in a primary with.
Again, IF Lynn was smart. She spent her entire career disproving that particular premise

"Phil's boy Tater?" Is there a CAPTCHA that tests for a minimal understanding of the political factions in Mississippi before allowing comments? 'Cause we could use one of those on this here blog.

Phil and Deb have "moved to the country" and maybe they can avoid being served out there.

I am a conservative Republican and it always upset me that Phil was constantly trying to cram "God" and Jesus down our throats while pulling fast ones with the state's money. He succeeded on both counts. We now have "God" on our license plates and we now have $50 million in taxpayer money missing and in the hands of one or more of his favorite friends.

I hope Anna Wolfe keeps digging and the attorneys are successful in digging further.

He was an embarrassment and all roads lead to his further disasters.

Who is the smartest player in this mess? Anna Wolfe, then Nancy New.

Who is the dumbest? John Davis

Well tell Gerry Bufkin to send his staffing with their own copier to copy records which was done by DEQ in the past with the Beatrice Potter law suit that Johnny Cochran I believe was involved with back in the 1990’s. The law firm did this to cut down on cost when there were thousands of rolling files.

Willing to bet Lynn was the one who sign off!

Tater is on deck. Sure hope he had legitimate reasons to keep USM out of this investigation. Sure is odd that the Prevacus guys wanted Tater to be elected after Phil’s reign ended.

I would like to see the email correspondence between big brother New, little brother New, and Momma New.

You know big brother New did at all. He’s the brains in the family. Momma New and baby brother New had to run things past him. It will be interesting to see what his denial will be. Remind me, didn’t he owned buildings that weren’t being used and the company was leasing from him.

It is always a treat to see people like 4:36, who, in attempting to insult Lynn's intelligence, is too moronic him/herself to realize that this approval happened more than two years before Lynn became AG. The dumbest are always the most confident.

Do they have His & Hers prisons for Dewey & Deb?

Does Phil have to pay out of pocket for his legal fees during this litigation or does the state pay for it because this took place while he was in office? Regardless, please let it be the experienced and overqualified Joey... You know, the other guy in the room during Phil’s infamous interview with MS today.

Just think about it, at the beginning of Republican rule we had Haley pardoning folks left and right, now this mess with Tate and Phil. It’s just shameful they all misrepresent themselves .

Glad to see someone (5:39) finally point out the obvious that Jess New was the kingpin of so much of this fraud and somehow (perhaps the “lawyer privilege” that infects so much of life in MS) has escaped any major charges or fines. Mama New always stood out like a sore thumb among the big doctor and local business tycoon donors at JA running her “school” that graduated 10-15 kids a year and poor Zach New just wanted to know where the nearest plug was. The only sense in that family is Jess and, despite leading the board and serving as attorney for the sham school & owning the Madison County shed receiving hundreds of thousands in stolen tax dollars for “storage,” he remains largely above the muck his mom & brother are sinking in. His various no-show “board lawyer” appointments by Feel were an obvious quid pro quo.

He, Lacoste, Favre, Longwitz, and Feel are all skating WAY too easy on this.

A 'plethora' you say! Dayum them big words is throwin' me.

'Show us whatchu got' typically results in production of almost nothing. The way to have done this would be for federal marshals to show up and haul off boxes of records, computers and file cabinets.

On the other hand, Miz New and her associates have lots of stuff to produce that will tighten up even the loosest cowboy boots.

I told y'all months ago that Rodney's resignation, even though announced five months early, was connected to this volleyball fiasco. Everybody else said, 'No Way!' He had to find a new gig before his reputation, such as it is, got tarnished.

I also told y'all that Pigott had indeed 'forwarned' those who signed his contract that he was going to issue these subpoenas. The fact that he publicly announced it has not only protected the case, moving forward, but enhanced his credibility as he departs.

(I'm no attorney, but Ironsides was always my favorite show.)

So Nancy and her legal team who are very good lawyers by the way, are much like Anna Wolfe in doing the job Shad White should have done. I can’t help but wonder how long before he’s hit with an obstruction charge?

I love how the Anonymous peanut gallery that is JJ, of which I am so proudly a part, consistently knows so much about this matter and others of the day. Our beloved state does indeed give us much to render expertise upon.

Still would be more fun if everyone’s real name was required…….but, the site would probably get quiet and boring.

Perhaps if they look closely, Cuzzin Phil might have had sticky connections to the Corrections Scandal with Epps. "Field Marshall" Marshall Fisher and his successor OVERTIME PuhLeeza Hall should be looked at even though they came after the Epps Scandal in the role of commish of MDOC.

Shad needs a few subpoenas in his mailbox hole.

We need to see all his internal reports and his communications with Phil and everyone else in the mix.

It’s ironic that Bryant is taking so much heat the week of the Wildlife Ganza in Pearl. It wasn’t but a few years ago he led the charge against The Mississippi Wildlife Federation along with Gipson ,Polles, the former fairgrounds director , and the rich white fat cats on the MWFP commission and foundation. They thought by taking away the traditional show dates they could destroy the watch dog group. One by one their true colors are being exposed.

Conservative MS voter here and I hope they all get locked up.

I hold no real hope for that because the elite (D or R) always skate into a golden parachute of retirement and overpaid speaking gigs. No matter how heinous they are criminally.

At this point, I'd rather have farmers and garbage truck drivers calling the shots. It cant be worse.

Where does Steve Pickering fall in this thing? From what I remember from my days at DHS, he ran MCEC or at least wanted everyone to believe he did. His name has been curiously left out of this thing so far.

I wonder if Phil will be kicked out of his church? I hear Christian’s aren’t supposed to steal from the needy so this could be an issue?

I think people underestimate how stupid all of these people are.

Step 1:
They literally were like "bub bubb buhhh that'll be a good idea for TANF fundszz"

Step 2:
"lets git an attorney general opinion on diss"

they get it approved by IHL. they think they are good.

they are so far removed from understanding what TANF funds are actually supposed to be used for and completely ignorant to how stupid of an idea it really is.

Anonymous said...

@8:26 - Steve Pickering is out there living his best life on the soccer field. He always seemed to be a nice enough guy and just on the outskirts of any real decision making for FF. But, like you, I’ve always wondered how his name has not come up.

Yall are getting off topic. This is a clawback proceeding, not the criminal trial. Nance is picking off the easiest one as the first one. Also happens to be the biggest. No way the News will be forced to make good on the $5 million that the AG and IHL approved. I assume they are going to end up bankrupt anyway, so maybe she is just making waves so she can claim to be a victim.

Anonymous said...

@11:53 on the contrary. It’s curious why Southern Miss and TeleSouth were left out of the original suit. Pigott is fired, apparently for subpoenaing Southern Miss. Then, Nancy’s lawyers double down and issue the same subpoenas, plus others. If the state is trying to hide anything, they’re screwed. Nancy was a pawn, a pawn who is about to expose a ton of bullshit. Good for her.

Anonymous said...

@11:53. Would you “claim” to be a victim if you did what your immediate boss and his boss told you to do and then got prosecuted (persecuted) for doing it ???

Kingfish. Overkill … really ? Your whole family is ruined financially, professionally, and every way imaginable and all you want is the whole truth to be told ?

Hoocoodanode?!

LOWNDES COUNTY, Miss. (WCBI) — The indictment of state Corrections Commissioner Chris Epps on a conspiracy to embezzle millions of dollars has raised questions about if someone was asleep at the wheel in state government.

But Governor Phil Bryant said today the nature of the crime helped it escape detection from him, his staff or anyone else in the administration or the Legislature. That’s especially true since Epps generally was highly regarded in the state Capitol and among his peers nationwide.

“It is difficult for us to determine when someone will take a wrong turn in life and because it’s often, it’s never done in the daytime, often done in areas that would not be suspected,” Bryant said Thursday following a speech to the annual Golden Triangle Link luncheon.

Epps resigned November 5 amongst claims he’d operated the scheme for years.

Just following orders? Nancy New pled guilty to "four counts of bribery, two counts of fraud against the government, six counts of wire fraud and one count of racketeering."

Let me guess, she only pled guilty for the children.

@9:05 all of which don’t amount to shit. The State gets nothing from her. Largest “scandal” in history and she doesn’t serve a day for the state. Makes you wonder why….what help is she offering? What really is the truth and who all is involved? It’s not the children. It’s Phil and company. This is big.

Anonymous said...

@9:05. What everyone leaves out when talking about the indictments she pled guilty to is the statement reads “AT THE DIRECTION OF John Davis AND OTHERS”……..

Anonymous said...

@8:27. That might be true for state indictments but not federal indictments which did not involve TANF money

Anonymous said...

I don't understand how more people aren't involved in this deal. Shad claims $90+ million dollars was stolen or misspent, but has nothing to show for it. Hinds County has 100 years worth of time stated in the pleas, but it all runs concurrent to the Federal charges. In other words, the state charges don't mean a damn thing. But for the Feds, Shad would have nothing to crow about.

I get John Davis is involved, and probably screwed, but what about all of the other DHS executive level suits (and blouses) that signed off on this stuff. How can they get overlooked? I would have thought more heads would roll from such a massive and historical "scheme".

@12:24 Just a thought. Who usually completes reports that the superintendent of a school system signs off on? Does the superintendent personally go to EVERY school and individually count EVERY child and teacher for the report? Or does said superintendent trust those under her to make sure the data is correct! Looks to me like Nancy was guilty of trusting her staff cough, cough Maybe the one hanging out on the soccer field? among others?. Just sayin’…

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
