Mayor Wants to Veto Court Veto of his Veto

Beaten but not broken, Jackson Mayor Chokwe Antar Lumumba promised to fight for his right to veto no-votes of the Jackson City Council.  


Special Chancellor Larry Robert ruled yesterday in Hinds County Chancery Court that Mayor Lumumba can not veto negative votes of the City Council.  Hizzoner didn't like the decision and told the media he will appeal: 

For his part, Lumumba said he is looking at appealing the decision. “You’ve now had two different justices interpret the law in a different way,” he said. “That, in and of itself, makes it clear that this issue is a complex one, and one in need of ultimate determining from the highest body in the state.”

The mayor was referring to an earlier decision handed down by Justice Jess Dickinson, who was appointed by the Mississippi Supreme Court to determine whether the Richard’s contract was valid. WLBT

"I disagree with the court's opinion," Lumumba said after the hearing. "We will be looking at the possibility of an appeal and want to make it clear that the issue here is a complex one," he said.

Similar cases have been met with different rulings in different courts, Lumumba said. Clarion-Ledger (So why weren't they cited in court yesterday?) 

“The failure to look at the complexity of these arguments, I think, has led to what I believe to be an error decision,” said the mayor. WJTV

"You can expect the possibility of us appealing this matter," Lumumba said. WAPT

The mayor is simultaneously a lawyers worst nightmare and favorite client. On one hand, he insists on expensive pursuit of a hopeless case which makes no sense. On the other hand, he is willing to pay no matter what it takes.

I should think the vast majority of Jackson voters at this point would support Enoch Sanders for Mair over King Tootanuncommon (really, he's not "black enough" whatever that means and he's a Marxist which thankfully so far is pretty uncommon).

Why would MS SC even take the case? Lil Choke is merely stalling his total defeat and calling this pie simple case "complex" is just to pretend to Richard's Disposal that he's a wizard instead of a lying loser who's hornswoggled them for months costing them a million+ in losses.

Maybe Richard's will tie him to a Cypress tree in an alligator bayou. Ever seen a gator, jaws open, use its tail to propel the whole front half of its body out of the water to snatch a meal? Split second and the giant lizard is eight feet up onto a bank slamming those toothy jaws on a duck, turtle, dog or a nasty grifter.

Well, the Council did send a notice to RD that it would not pay for any work done as it never authorized a contract with the company. It's one thing to do work and ask for payment. There is law on that issue and the contractor generally gets paid. However, the notice throws a wrinkle into that scenario.

Food for thought. Suppose RD sues the Mayor's insurance if the emergency contract was illegal. Possibility?

@KF, illegal acts are not covered by insurance. Also, what insurance does the mayor carry besides the insurance the city has? His elected official bond? At this point, his delusions of grandeur are clinical. This is the exact reason you never elect someone running on a “progressive” platform.

I went around Jackson and picked up trash in my pick up truck and took it to the dump site. Who do I need to send the bill to. I did not have a contract, but I was told I will get paid.

THERE IS NO SPECIAL ELECTION, RECALL ELECTION, Whatever to remove an elected public official in the State of Mississippi. Unless the public official gets convicted of certain felonies (not all felonies would provide this result) then they cannot be removed.

And, FWIW, Enoch Sanders would not be the one that got elected. Substituting dumb, ignorant and don't give a shit attitude for someone that is dumb, ignorant and gives a shit about all the wrong things is not the only choices available.

If the mayor is able to get an appeal heard by the Supreme Court his best defense may be to argue Richard's won the bid process fairly as the lowest and best bidder, they have proven their ability to do the job, and that the vote by the council to deny them the contract was discriminatory and illegal. I am not saying necessarily he would win that argument, but it seems like a better defense than bickering over whether the veto was legal.

I feel so sorry for the residents of Jackson that have not fled this Third World Country. Unfortunately, you can’t get rid of any of the City Council or Mayor in particular because in elections only about 10% of the residents vote. Property values have plummeted and will continue to do so until this thing literally implodes.

What a horrible site for a State Capitol, but just look around the nation. This is absolutely typical of Democrat run cities, decay, filth and corruption.

745, that's an interesting argument to make to the Supreme Court except for two glaring problems

1) Richard's contract, the one they are operating under today with two day a week pickup and no carts was NOT the lowest or the BEST bid submitted. That honor belongs to WM. But, nice try carrying the Mayor's bs - similar to the idiots that continue to argue that Trump got more votes. No meat on that bone.

2) Even if you had been correct about Richard's being lowest and best - that argument was not raised below. The Supremes do not listen to arguments that were not raised in the lower court.

Now - give us another argument that Baby Chock can make.

@7:45, the problem with that defense is the facts don't support it. Waste Management had the lowest and best bid for 2x per week trash pick up without carts. Their bid was slightly lower than RD's, and WM always had exemplary performance... unlike RD, who no-shows 1/2 to 1/3 of my pick up days since this fiasco started. These facts are why the council was so angry with Chowke and why his actions were so inexplicable. When RD finally realizes they've been had, maybe the mayor will get the knee capping he so richly deserves!

12:29 - the workers were hired by a corporation - Richards. The workers have no connection to Jackson. Richards has to pay them whether or not the company gets paid.

You can bet your bottom dollars that the workers have been paid every week since this idiocy started - otherwise, they wouldn't be working today but they would have a FLSA case filed against Richards.

The company is the one not getting paid. That has nothing to do with the workers check. But the real question to ask is - who is footing the bill for Richards during this three plus months of operation? Not just having to pay the workers, but also the rental payment on all those trucks he obtained on short notice (rentals all); the nasty diesel fuel that they are burning; and the rent, assuming he was paying anything, for his use of the airport property? More behind this deal than picking up garbage; somebody has other reasons to be pushing this hard over picking up trash.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online).
