Beaten but not broken, Jackson Mayor Chokwe Antar Lumumba promised to fight for his right to veto no-votes of the Jackson City Council.
For his part, Lumumba said he is looking at appealing the decision. “You’ve now had two different justices interpret the law in a different way,” he said. “That, in and of itself, makes it clear that this issue is a complex one, and one in need of ultimate determining from the highest body in the state.”
The mayor was referring to an earlier decision handed down by Justice Jess Dickinson, who was appointed by the Mississippi Supreme Court to determine whether the Richard’s contract was valid. WLBT
"I disagree with the court's opinion," Lumumba said after the hearing. "We will be looking at the possibility of an appeal and want to make it clear that the issue here is a complex one," he said.
Similar cases have been met with different rulings in different courts, Lumumba said. Clarion-Ledger (So why weren't they cited in court yesterday?)
“The failure to look at the complexity of these arguments, I think, has led to what I believe to be an error decision,” said the mayor. WJTV
"You can expect the possibility of us appealing this matter," Lumumba said. WAPT
Yes, go ahead and appeal.

Keep running up the legal meter Charlatan Lumbubbles, as it's free taxpayer money, right?
You Jackistan sheeple have the mayor that you deserve.
Y'all need to grow a pair and veto his ass out of office.
Might as well go ahead since Jackson's population seems to have no problem financially supporting the naked emperor tilting at legal windmills.
He can veto the council’s one year moratorium on new Capitol Street bars. That’s within the mayor’s power. Meanwhile, Farish Street remains largely boarded up. The venerable People’s and Collins funeral homes aren’t busy, either.
The mayor is simultaneously a lawyers worst nightmare and favorite client. On one hand, he insists on expensive pursuit of a hopeless case which makes no sense. On the other hand, he is willing to pay no matter what it takes.
Goes without saying, he is spending other people's money.
How much is his nonsense costing us?
You lost hizzoner... go away!
Ol' Judge Dickinson gave him a little rope. Now he thinks he's Roy Rogers. Home, Home on the range...
Dang. His donation from Richard’s must have been huuuuuge
Stokes Radio tomorrow morning oughta be on FI-ER! Kenny needs to get over his past aversion to the cost of special elections and get on with what is needed to recall the Mair. Problem with that is that the Mair would veto any measure taken to get rid of him! See what happens when you put a Devout Marxist in power? He gotta go! Say it Kenny, HE GOTTA GOOOOOOOOO!! I should think the vast majority of Jackson voters at this point would support Enoch Sanders for Mair over King Tootanuncommon (really, he's not "black enough" whatever that means and he's a Marxist which thankfully so far is pretty uncommon).
King Toot! He gotta go! HE GOTTA GOOOOOOOO!!!
SANDERS SPEAKS!!
Thankful for Mayor Lumumba standing up for the injustice and racism by the city council. I fully expect the possibility of appeals in this complex matter.
@1:03
If they had half the sales tax dollars they've pissed away by letting the town sink to the level it has and running off businesses and customers they could all get in a circle sue each other til the cows came home. LOL
Someone needs to put his picture next to the word Narcissist in Wikipedia.
He has to bump it upstairs to the Supremes to keep the knee cappers from paying a visit. Maybe this is why he stays out of state so much.
So has Richards said they are continuing to pickup trash?
Brave Sir Antar tilting at windmills, endlessly. A fool obsessed with "winning" at limitless taxpayer cost. Onward, Antar!
i wonder how closely harvard is looking at their award winner...
Yo Chowke, I'm not happy unless you're not happy.
Mel Brooks and Monty Python could never match the comedy of Jackson government!
Why would MS SC even take the case? Lil Choke is merely stalling his total defeat and calling this pie simple case "complex" is just to pretend to Richard's Disposal that he's a wizard instead of a lying loser who's hornswoggled them for months costing them a million+ in losses.
Maybe Richard's will tie him to a Cypress tree in an alligator bayou. Ever seen a gator, jaws open, use its tail to propel the whole front half of its body out of the water to snatch a meal? Split second and the giant lizard is eight feet up onto a bank slamming those toothy jaws on a duck, turtle, dog or a nasty grifter.
@ 1:58 Whatever your drinking, it must be some good stuff.
The people could kick the kid out and have a new election next week for mayor and they would elect him again. Take a real good look at the voters in Jackson.
Well, the Council did send a notice to RD that it would not pay for any work done as it never authorized a contract with the company. It's one thing to do work and ask for payment. There is law on that issue and the contractor generally gets paid. However, the notice throws a wrinkle into that scenario.
Food for thought. Suppose RD sues the Mayor's insurance if the emergency contract was illegal. Possibility?
Oh, Belhaven was picked up this afternoon.
KF, true, because of the letter to RD "quantum meruit" may not hold any water.
The mayor took action that was clearly illegal to all except Jess Dickinson. I'd like to see Richard's go after him personally to pay its bill.
@KF, illegal acts are not covered by insurance. Also, what insurance does the mayor carry besides the insurance the city has? His elected official bond? At this point, his delusions of grandeur are clinical. This is the exact reason you never elect someone running on a “progressive” platform.
I went around Jackson and picked up trash in my pick up truck and took it to the dump site. Who do I need to send the bill to. I did not have a contract, but I was told I will get paid.
RD Sue Mayor? Is that a possibility?
This is a dang hot mess. I truly hate it for Jackson and the residents.
Would insurance even cover illegal acts?
@156, and all the others here ---
THERE IS NO SPECIAL ELECTION, RECALL ELECTION, Whatever to remove an elected public official in the State of Mississippi. Unless the public official gets convicted of certain felonies (not all felonies would provide this result) then they cannot be removed.
And, FWIW, Enoch Sanders would not be the one that got elected. Substituting dumb, ignorant and don't give a shit attitude for someone that is dumb, ignorant and gives a shit about all the wrong things is not the only choices available.
KF - does insurance pay for deliberate acts, even the stupid ones?
I don't know if the naked Emporer's coverage would pay. But I bet he is hoping it will.
"You can expect the possibility of us appealing this matter,"....NO SHIT....the possibility of an appeal exisits in EVERY case....
SAANDERS FOR MAYOR!!!!
The Jackson Mayor is a number one Jackass
Chokwe's cheese is sliding off his cracker.
Who's going to pay Richards?
Who's going to pay Richards?
If the mayor is able to get an appeal heard by the Supreme Court his best defense may be to argue Richard's won the bid process fairly as the lowest and best bidder, they have proven their ability to do the job, and that the vote by the council to deny them the contract was discriminatory and illegal. I am not saying necessarily he would win that argument, but it seems like a better defense than bickering over whether the veto was legal.
I feel so sorry for the residents of Jackson that have not fled this Third World Country. Unfortunately, you can’t get rid of any of the City Council or Mayor in particular because in elections only about 10% of the residents vote. Property values have plummeted and will continue to do so until this thing literally implodes.
What a horrible site for a State Capitol, but just look around the nation. This is absolutely typical of Democrat run cities, decay, filth and corruption.
KF, tip of the hat to you on on the trash reporting. I don’t always agree with your opinions and I’m not even sure I like you, but I do visit your blog first before diving into the corporate local news.
745, that's an interesting argument to make to the Supreme Court except for two glaring problems
1) Richard's contract, the one they are operating under today with two day a week pickup and no carts was NOT the lowest or the BEST bid submitted. That honor belongs to WM. But, nice try carrying the Mayor's bs - similar to the idiots that continue to argue that Trump got more votes. No meat on that bone.
2) Even if you had been correct about Richard's being lowest and best - that argument was not raised below. The Supremes do not listen to arguments that were not raised in the lower court.
Now - give us another argument that Baby Chock can make.
So, how are the workers getting paid? There is no way they can go this long and get nothing. They couldn't survive this long without an income.
I predict one of the major news providers will eventualy put togethera ten part series on this political debacle. It will be a splendid opportunity to watch them try to sort out the ins and outs of this twisted tale. I like to listen to the creapy voice of the sliver haired Dateline host, so my vote is for them to fo the series. A wonderful coverage would include a lengthy interview of Mr. Kingfish.
What are the odds that any citizen of Jackson is following the news in Sri Lanka? You can remove an incompetent ruler without voting..........
@7:45, the problem with that defense is the facts don't support it. Waste Management had the lowest and best bid for 2x per week trash pick up without carts. Their bid was slightly lower than RD's, and WM always had exemplary performance... unlike RD, who no-shows 1/2 to 1/3 of my pick up days since this fiasco started. These facts are why the council was so angry with Chowke and why his actions were so inexplicable. When RD finally realizes they've been had, maybe the mayor will get the knee capping he so richly deserves!
The state needs to declare an emergency and take over jackson city services immediately
@1:58 Please enlighten me as to your comment regarding the City Council being "racist". It's 80% African American, Jackson is over 80% African American, the entire Jackson city government is majority African Americans.
So what's your point other than wanting to throw that word in?
You can remove an incompetent ruler without voting..........
So, rush the Emperor's palace?
If the mayor is able to get an appeal heard by the Supreme Court his best defense may be to argue insanity.
Veto Cornholio. The Godfather of Garbage.
9:15 AM Why should the rest of the state take over all city services? They made the mess and should be made to clean it up. The other cities in Ms. seem to be able to handle their city services. What makes Jackson any different?
12:29 - the workers were hired by a corporation - Richards. The workers have no connection to Jackson. Richards has to pay them whether or not the company gets paid.
You can bet your bottom dollars that the workers have been paid every week since this idiocy started - otherwise, they wouldn't be working today but they would have a FLSA case filed against Richards.
The company is the one not getting paid. That has nothing to do with the workers check. But the real question to ask is - who is footing the bill for Richards during this three plus months of operation? Not just having to pay the workers, but also the rental payment on all those trucks he obtained on short notice (rentals all); the nasty diesel fuel that they are burning; and the rent, assuming he was paying anything, for his use of the airport property? More behind this deal than picking up garbage; somebody has other reasons to be pushing this hard over picking up trash.
The men with the crooked noses and surnames ending in a vowel are paying Richard's, and they will soon be sending their "collectors" to Chowke's home, thus the reason he is never in Jackson, let alone Mississippi.
If only Chowke's father had kept his birth surname (Taliaferro) maybe they wouldn't break both of Chowke's legs.
Mr. Stokes is introducing a city ordinance requiring that Baby Chowke pay for any lawsuits that he files.
Go Mr. Stokes.
I totally agree with 3:08.
I hope Harvard grads in the Jackson area are contacting their alma mater. What a joke.
Highest US murder rate + hiding EPA letter about drinking water from the people of the city until after his latest primary + trying to veto a veto = an award from Harvard?
To quote my wife about the mayor…..”how fucking stupid can one man be?”
Money wasted which could be used on water issues and/or crime.
Lumumba should not be re-elected.
@8:44 I never thought I'd see the day that I thug I would agree with Stokes.
He's making a lot of sense lately.
Apparently Richard's Disposal did NOT submit a bid in New Orleans to continue their contract there. https://www.nola.com/news/politics/article_d53d1888-c804-11ec-97a6-2f887bc00679.html
Six thousand dollars a month is paid to JMAA. By RD for rent
There is no way that this can end well for the handful of poor people that still pay taxes and fees that live in Jackson.
