The State Board of Education and the Commission on School Accreditation followed state law when they determined the Jackson Public School District was in a state of emergency that jeopardizes the safety, security and educational interests of the students in the district.
The Mississippi Department of Education (MDE) stands behind that determination. The Governor has made a decision not to declare a state of emergency and to form a coalition to pursue another way to address this crisis. As of today, the MDE has not been asked to be part of this coalition. The Jackson Public School District is still required to develop a corrective action plan to submit to the State Board of Education for approval.
The plan must clearly outline how the district will correct all accreditation violations in all 58 schools.

If you think 5:13 that the Legislature is going to have the tail wag the dog you are sorely mistaken. Bryant is stuck with no legal means to force his third option as a solution.

Where is the legal authority for this decision? The governor has the authority to authorize takeover, in accordance with state law. However, where do his handlers get off thinking he has the authority to enact and enforce this 'third option' out of blue and from where? Is the executive branch writing state law?

The only interested party to stop the Gov’s plan is MDE as COJ and Phil are happy. Kinda funny if they seek an injunction.
But in all seriousness, where is the legal authority to do what the Guv wants? It seems that the statute only allows Phil to either takeover a district or decline. Where is the legal authority that authorized this third option?
If the school district cooperates, it doesn't require Bryant to have legal authority... because he isn't doing anything requiring said authority.
He doesn't issue a emergency.
In return, they do what he asks... including working with these groups.
If they don't, he can always sign the declaration. There's no time limit.
The city will appoint a new school board with the advice of the Kellogg Foundation and Governor's Office.
This won't be a puppet board.

Now these lil' JPS angel scholars can't pick and choose which Madison, Rankin or Clinton public schools they could have invaded if the state had taken over JPS.
5:13, you have it backwards. MDE has a statutory responsibility to take the actions they have taken thus far, and what they have stated this afternoon. The Governor has tried to become a 'one man band' in doing what he wants with absolutely no authority for his 'third option'. How, pray tell, can this newly created group expend our tax dollars? Under what authority can they act to hfire any employees. Or conduct any business? And if you think the legislature is going to craft a new law to cover Feel's ass, after they passed a tough law dealing with this type problem just a few months ago, only to learn that the Guy doesn't have the balls to deal with tough political issues, you are wrong. Legislature, and MDE, will probably let zguv, Leland Speed, Jim Barksdale, Derrick Johnston, and Baby Chock twist in the wind together.

MDE still has full accreditation authority and the Legislature is not going to touch that. JPS still has to compete a corrective action plan.
