U.S. District Judge Henry Wingate is bound and determined to find out what happened to the Siemens settlement funds as he subpoenaed more records yesterday.
The Court ordered those subpoenaed to produce within 30 days all records and communications regarding the settlement. Siemens settled a lawsuit with the city of Jackson over the failed water meter project for $89.8 million.
Judge Wingate decided to investigate how the settlement funds were used when JXN Water Manager Theodore Henifin asked him to approve a rate increase for water/sewer services recently.
The Court issued the subpoenas on July 9 to:
Lightfoot, Franklin, & White, LLC
Winston Thompson & Associates, PLLC
Barry Howard, Esq.
Ice Miller LLP
Ted Henifin, Third-Party Receiver
City of Jackson (Office of the Mayor)
City of Jackson Department of Public Works
Mississippi Department of Environmental Quality
EPA - Region IV
Justice Department, Environmental & Natural Resources Division
The lawyers subpoenaed received 30% of the settlement. Then-Jackson Mayor Chokwe Antar Lumumba repeatedly defended the massive fees, arguing they were paid on contingency because it was a risky case.
Judge Wingate decided to dig deeper and issued subpoenas for the same records to Siemens and a host of former and current city officials:
Siemans
Bob Miller, former Public Works Director
Fidelis Malembeka, CFO
David Gillis, former city engineer
Dan Galliet, former Public Works Director
Kishia Powell, former Public Works Director
Carla Dazet, former Deputy Public Works Director
The inclusion of Kishia Powell is curious as she served under Mayor Tony Yarber, long before the Siemens lawsuit was filed.
Those subpoenaed must produce the records within 30 days.

Once Wingate issued the injunction against MS anti-D.I.E. Law and in favor of NAACP & the evil SPLC, then I question his impartiality.

Question all you want…Wingate has always stood on the law and is as impartial as it gets. While you’re doing all that questioning simply do your research and the questions will be answered.
Welp there is blood in the water and the Shark called Wingate is going to have a feeding frenzy.
This merits an investigation, but a judge's order is not an investigation. I'm not quite sure what he can or will do if they simply say they don't have what he wants. This is what happens when you give court settlement money to a city administration rife with corruption.
Why in the hell doesn't the attorney general of Mississippi start an investigation. Is she comatose.

A federal judge conducting his own discovery is nothing to scoff at. I suspect all who received these subpoenas are taking them very seriously.
10:49, I think you mean that you question his politics. Of course, these days political affiliation has become a stand-in for so many things: bias, morality, religion, good v. evil, and so forth.
Wingate is very good. And fair.
Okay, but what does this have to do with the rate increase? Increase the damn rates and shut the the non payers off so the system can maybe have a chance to survive before the Jackson City Council and New Mayor get back ahold of it and ruin it again. There is zero evidence of corruption with the Siemens settlement. The City used the funds on anything but the water system. That is stupid but not illegal. So, sure go down that path if you like but get the rates increased asap. Each month without a rate increase is that much more revenue JXN Water has to make up somewhere. We can do two things at once.

Wingate impresses me yet again. Thank God he is over all the water/sewer stuff. I can't imagine the level of frustration.
"what does this have to do with the rate increase?" Judge had stated he wanted to know where that money went because if it had gone where it was suppose to, the bonds would have been paid off, the system would be generating enough money and there would be no need for increases.

I get your frustration. Folks not paying for water must stop. If the legislature had actually passed a bill in either of the last two sessions, then something would be set up and in place when Henifin's time is done (and the system wouldn't return back in the hands of idiots).

Why wasn't any of this brought up while the other mayor was still in office? Now, its all about the law and accountability?
$30 million went to lawyers. At least $14 million went to shore up the water system as it was losing over $10 million a year. Audit verifies it did. The rest of the money, I think, went to shore up reserves for bond covenants.
How much went to Chowke?
The Blossom Apartments had their water cut off, which affects 72 units. Over $400k is owed. It never should have been allowed to get to this point.
I hope water & sewer are NEVER turned back over to the COJ! No accountability & yet every other city in MS handles their finances. Jackson should LEAD by example as the capital city!

The COJ is incapable of running its own affairs. I don’t care who is to blame or when it started. I want it fixed and I want it done asap. The first person who points a finger gets shot. Get it done.
Many apartments are in this situation. Folks paying landlord, landlord keeping money. With each apt had its own water meter.
Hire a forensic accounting team.
Give them fully access to all financial systems for the City.
This would be over in a week.
