William McHenry of Madison Timber fame is back in jail after he refused to move after he lost his home.
Wells Fargo foreclosed on McHenry's home and sold it to Daniel Johnson in December 2023. Johnson placed a notice to vacate on the door on January 19. The notice ordered the McHenry's to leave the premises within three days.
January 22 came and went without the McHenry's leaving so Mr. Johnson sued to evict the couple on January 24 in Madison County Court.
Johnson asked the Court to hold the McHenry's in contempt of court. County Court Judge Ed Hannan declared William McHenry was in contempt of court on April 22. Deputies arrested McHenry. The Court scheduled a hearing for him on April 29. Judge Hannan held:
The Defendant controls his own destiny. He holds the keys to his own freedom; he holds the keys to the jailhouse door. The Defendant must vacate the property and so inform the Court in writing that he has vacated the property at issue. The Court has provided the Defendant with a sheet of paper whereby he can write that he has vacated the property and inform the Court of same. Once Defendant has done so, he will have purged himself of contempt. If not, Defendant shall remain in the custody of the Sheriff of Madison County until further order of this Court.
The docket in Mills v. Billings et al stated on September 25:

The Court GRANTED [124] MOTION for Contempt against William B. McHenry, Jr. filed by Alysson Mills. Exhibits admitted for the purpose of the hearing: P-1, P-2, P-3, P-4, P-5, P-6, P-7. The Defendant was ordered to pay $31,450.00 to the Receiver and shall have until 5:00 PM to report to Madison County Detention Facility. The Defendant shall remain in the custody of the U.S. Marshal Service until the amount is paid in full.
Mills filed her motion for contempt on March 22 in U.S. District Court. The motion states McHenry filed bankruptcy in 2020 and listed the Receiver as a creditor. Mills had obtained a judgment against McHenry for $3,473,320 in the Lamar Adams case.
Mills objected to the bankruptcy, arguing he lied in his bankruptcy filings. The Receiver "examined" the defendant under oath at a debtor's exam in 2021. McHenry did not provide all of the records request and "could not identify the source of any deposit into his bank accounts and could not explain how he covers his monthly expenses."
The motion states:
For years, Bill McHenry has disposed or hidden assets and made his finances impossible to be scrutinized. The assets that McHenry sold or hid over the past four years emanate from the same source: proceeds of the Madison Timber Ponzi scheme. Indisputably, McHenry had no source of income other than Madison Timber commissions to purchase any assets.11 Those assets should have been turned over to the Receivership Estate to satisfy the final judgment for the benefit of Madison Timber’s victims. Instead, McHenry has engaged in a years-long campaign to evade enforcement of the judgment.
A federal grand jury indicted McHenry in 2019 for securities and wire fraud in the Lamar Adams case. A jury acquitted him after a trial in December 2019. Earlier post.

I seem to remember this same scenario about McHenry a few years ago on Jackson Jambalaya.
Maybe he didn't leave because he has cash hidden in the house somewhere.

I've said since this whole thing broke, and after he was found 'not guilty', that he is guilty as sin and has at least a million socked away safely (he thinks).
This is the first I've read that the receiver was on his case, had demanded a certain amount and had file further charges against him. If that's been covered here on the blog, I missed it.
The bankruptcy was fraudulently filed.
His mother, a Greenville resident, died in a Madison nursing home a few years ago. She would be devastated to see what he has become.
Today he is where he needs to be.
Just be sure a female jailer doesn't walk into his cell with a lunch-tray.

Perhaps some folks don't live in the same house, like you, for 80 years.
I'm 76 and we moved into a new house three years ago. With a mortgage (under the Trump mortgage rate). I didn't have $488 thousand in my checking account.

If you lived above your means on stolen money and were told by the courts you had to repay it is self explanatory, He owes more than his house is worth more than likely. Not everyone pays off their mortgage for various reasons @2:09. Some of us don't want to live in the same house for 50+ years and pay all the maintenance required or live in a dump in a rundown neighborhood ... some of us have plenty of money to move around as we please after retirement! Where does it say you have to "own" a house? Maybe you ought to recheck your financial advisor's advice. If it were your goal, great -- but don't assume it should be everyone's!

If your home can be seized, and sold for taxes, do you really own it? My definition of ownership is the only money spent on something is for maintenance.

7:28 No snide remarks but McHenry’s wife has been given ample notice to vacate their home. She can get a job like everyone else and or live with family and friends. Just like Lamar Adams wife had to do. No way they did not know what was going on with NO TIMBER LAND to lease or sale! They must be accountable also. Please google Madison Timber and read the reports from Ms. mills (the Receiver) from the beginning. Please, please do not be caught up! Each person and entity were given ample time to settle with the courts and in arrogance chose not to. Ms. Mills father is a Federal Judge or retired Federal Judge! Mc Henry had been in this since December 2001 & mentions Timber Land on his business cards. Remember Gina Henderson Palasini was indicted on Fraud and went to Prison! Everyone is accountable under US laws. Pray for them and be a friend but do not give $ to them. He was still finding & depositing money to cover living expenses without a job. Others also gave STOLEN money to family members hiding it. Greed is a sin and being an adult owning up as the Judge has allowed in paying a much smaller portion should have been done already.
Google Madison Timber Receiver then read what others have done to settle with each charge they received and read what prison time others got also to help with better understanding. Like the Grain Lawsuit that the Coleman’s? Were guilty of in stealing from farmers. I am not saying times are not hard but we must choose who we serve God or Satan!

So since McHenry has NO BOND, how long will he sit in Madison county jail before he is remanded to prison. Contempt of court with failure to appear as he has no money, no bond & etc . But, alas, the conversation is NOT about her knowledge (or not) of the foreclosure. It's about her (and other spouses) knowledge of the fraud as it rocked along for years - in contrast to the opinions of those who are praying for her and begging for kindness, etc.
So how long can he be held for contempt & failure to appear? Is he responsible for $50 per day or whatever Madison County charges to house him. Another driving force his wife should be seeking employment.
Well he isn’t listed on inmates in Madison County so maybe he has nicer accommodation's now or is assisting with the move. Lol
