While he is not the most eloquent in the jail video I believe he states the law on self defense. “If you attack me I will respond in defense of myself”. If these individuals are attacking him and have a weapon then he has every right to fire his weapon.

That context changes everything. Although, I don't necessarily believe her story that she wasn't beaten. It'd be interesting to know if she has any bruises. But that could only be found out though competent investigators and a functioning law enforcement, which Jackson doesn't really have.

This was a white guy in Jackson, so it will be interesting to watch these two cases play out, side by side. I suspect it will come down to competency of the police/DA/court, rather than race, but time will tell.

If he was in the act of causing harm to another (i.e. beating his girlfriend) and the deceased attempted to use force to protect the girlfriend from harm, as I believe the law allows, can Cummins claim self-defense in that situation? If an armed burglar breaks into my house and I confront him with a weapon, the burglar can’t legally shoot me and claim self-defense.

He never touched his girlfriend! She didn't have a mark on her from what I was told plus seen a photo of her the next day. Cummins had gashes on his face and you could clearly tell he had been hit more than one time in the photo right after he turned himself in. I also seen a post from a girl who was supposed to be with the crowd of guys she said that Cummins and his girlfriend were arguing but he didn't hit her at the parade and they had planned to follow Cummins to the car. The post got taken down. The police have video footage I know that for a fact I know someone who works for the security company that gave it to them. I was told you couldn't see the gun in the video footage but you see the trucks pull up on Cummins and his girlfriend who were switching seats in the car maybe when they were leaning over each other they thought he was hitting her. Also I wonder why they waited so long to charge him over 24hrs I thought. Also the video footage from the jail I have seen 3 of the videos its the same video but it cuts out the rest of the the stuff said and gets shorter in each one. I was told by a friend that it was a song by someone called NBA YOUNGBOY whatever that is. I love how WLBT always has to air news that they have not one fact about. They start so much drama in my opinion and notice that 12 and 16 channels didn't air none of the stuff WLBT did because they didn't know what happened and the police haven't said anything. If the cops thought he was hitting the girl and she had anything on her to show that they would have charged him in the beginning. I don't care what anyone says if multiple guys ran up and hit you for nothing and then pull a gun and pointed it at you... and you had your weapon in reach you would have shot too. If Cummins was firing in self defense the stray bullet hit the innocent person when he was firing to defend himself that's still self defense. They dont have an exception to the law that if you have to defend yourself and your a bad shot or someone is around and accidentally gets hit your not defending yourself all the sudden. That wouldn't make sense that's saying if you are in fear for your life only defend yourself if you know that nobody's around and you have a clear shot and wont miss if not you just die or go to prison. People are so quick to jump to conclusions and it's so sad really. I think that the boys who attacked him and had the innocent person in their vehicle should be charged for her murder and knew they had children and women in the vehicle. The text message says they pulled the gun to scare him. They did that knowing that he could possibly have a weapon and start shooting with a truck full of women and children behind you. Yeah they deserve to be held accountable if that's the case.

I also know that the one day left for downtown Jackson that was kid friendly is now scarred...And that bystander who lost her life.. was a person too. A daughter, a sister and its all senseless. It's been hard to believe that this was the whole story from the beginning. It always has seemed to me like there was something that all these rumors didn't have. Normally the police have something to say which hasn't occurred yet. If it was as simple as a intervention on domestic violence and double murder they would have said that and charged him with both. However that's not the case. I thought from the beginning why didn't they charge him for hitting the girlfriend too? Videos dont lie like humans and tell their version of things. Did some of yall not read the post before you commented? Why if he was beating her did his friend need to take the gun? I think more charges need to happen. People always want to make drama out of rumors not facts and get mad when the truth shows continuing to believe the rumors. Wake up! Cummins apparently fired in self defense. Sadly the innocent person was hit. If we punish him for that the others who put her in the situation need to be punished too. It's more than just Cummins to blame. Just my opinion.

No. IF (and it's a big IF), the perp was in the act of committing a violent crime at the time and someone was trying to stop him, he probably can't shoot them and call it self defense. That's like a robber shooting the cop who's trying to stop him and claiming it's self defense. He cannot be the criminal and the victim.
