Trash Talk: It's War

 The Jackson City Council sued Mayor Chokwe Antar Lumumba and Waste Management in Hinds County Chancery Court today.  The case is assigned to Chancellor Tiffany Grove.  

The City Council voted 4-2 today to give Waste Management an extension on its current contract for thirty days at a rate of $10 per household.  City Council lawyer Roy Campbell said the Council should get a declaratory ruling from a Hinds County Chancellor.

Why sue waste mgt. ? This reminds me of the mark wagoner movie four brothers. Maybe this will catapult the right people to stand up for what’s right.

It’s a procedural issue….the court has to have all necessary parties in the lawsuit to be able to issue any type of relief as requested….the city needs WM in the suit is all.

If this is a complaint for declaratory judgment then WM would be a party with an interest in the outcome and be a potentially valid party. It is also a move to allow WM to participate in the declaratory judgment action. Not necessary a conspiracy between City Counsel and WM - just good lawyers being good lawyers.

Why would WM want serve Jackson for another month at a low rate if it is in legal do-do with the Council's lawyers?

I’m guessing you sue WM so they can turn over the goodies during discovery. Or, to avoid giving the impression of contract steering. Of to give WM some kind of grievance to sue Chokwe. Can you tell I’m no lawyer.

This is among those situations where internet lawyers need to realize the severe limitations of attending "Social Media Law School." Most attendees may be certain of their legal knowledge and abilities but MCRP and Mississippi case law says what it says and not having a familiarity with it all because of your choice in legal education doesn't change the need to include all parties. If you want to be an actual practicing lawyer, go to law school and pass the bar. Until then, you are welcome to an opinion but don't be surprised when it is completely incorrect. As king as Clinton is able to keep WM services, I don't care how much Hell Jackson raises in their fight against the corrupt mayor.

I doubt they will settle much in this current skirmish.

Roy is an excellent lawyer (and person) and I imagine he commands $500 per hour or more for his larger clients. I bet he is doing this work at a reduced rate of $250-$300 per hour.

The purpose of the litigation is to get a judge to confirm the councils actions if the council wishes to move forward under an emergency and contract with WM (or any other trash firm). This could save lots of money in future legal costs so this is a prudent use of resources in my opinion.

The larger issue is more onerous though. Mayors in years past have been able to move city business to friends (who were able to actually do the work) and provide massive shifts of money for generations. This mayor is attempting to do the same thing - except there is no firm who can actually do the work right now. Instead there is a middle person who get the contract and then that person marks up the price 20% and assigns the contract to a capable entity at the higher rate. The 20% excess goes to friends of the mayor who will likely call in a favor later.

This is not new. The city has operated as a graft machine for years. The method is new because there are no local giant waste management businesses owned by the mayors friends….yet.

Notice the state legislature has not taken action to amend the rules governing this behavior? It’s because the graft is engrained in small town business across the state.

Now that we can all see city business in close to real time and watch the money flow…..it will be interesting to see what if anything is done to try to lessen the theft.

Outrageous stunt by the City Council to make sure WM keeps the work, which is obviously what the Council wants. Why are they going scorched earth to steer the work to WM?

To answer one comment above, Balch and Bingham is an excellent law firm, and, like other such firms, charge high hourly rates. Who will be writing the big checks to Balch?

I saw Soc's commercial on repeat this morning.

Seemed rather racist.

75% of his argument (per the commercial) for him to get the contract appears to be based almost solely upon the fact that he is African American.

How is Hinds allowed to so blatantly champion against minority residents?

What I don't understand is Lee Bush, NCS, and Waste Pro.

Lee Bush has or had a company National Collections Systems located at 5520 Highland Dr in Jackson,

Waste Pro Jackson Office is located at 4517 Methodist Home Rd, and on google maps you can see the trucks.

"Waste Pro Partners for Pick-up in Jackson, Mississippi
The Hinds County, Mississippi Board of Supervisors, selected Waste Pro and its Jackson, Mississippi subcontractor, National Collection Systems (NCS) to provide solid waste collection for its 18,000 residents. “This is the way Waste Pro operates; they buy new equipment for new contracts,” said Lee Bush, one of the owners of NCS, the company responsible for a portion of the day-to-day collections. NCS has collected garbage for 13 years."


So, they have the trucks to operate this new founded business as of several days ago.

Canton had Waste pro for a number of years. Citizens were given nice, big and shiny new garbage cans with wheels....THEN BAM....waste management comes in. Waste Pro cans were confiscated and new smaller Waste Management garbage cans were delivered to homes. If you needed additional garbage cans you have to purchase to them.

Just saw a couple of all white, brand new garbage trucks on the interstate heading into Jackson. I guess Socrates is going ahead and making moves?

I cannot confirm for certain, but what a coincidence it would be if they weren't. I was following behind a string of them down I-55 from Madison into Jackson, but turned off the interstate around Northside Dr. to head home. They were all brand new, fresh paint, no markings, etc., as though they were being delivered to somewhere.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
