Will Epps Get out of Prison?

 Surprise, surprise. Disgraced former MDOC Commissioner Chris Epps wants to get out of prison.  Epps filed a motion for compassionate release last year.  U.S. District Judge Henry Wingate will hold a hearing on December 1.  The court docket states: 

NOTICE OF ORAL ARGUMENT ON MOTION in case as to Christopher B. Epps [124] MOTION for Compassionate Release (COVID-19) : Motion Hearing set for 12/1/2022 at 1:30 PM in Courtroom 6A (Jackson) Wingate before District Judge Henry T. Wingate. This hearing will take place via Zoom. Email to follow with Zoom information. (TDB)

The motion states: 

 Mr. Epps suffers from an array of illnesses, such as hyperlipidermia, hypertension, unspecified glaucoma, enlarged prostate, and gout. (See Exhibit 1, Medical Record). Most importantly, concerning this motion, Mr. Epps has suffered from a confirmed case of COVID-19.As the Court is well aware, the health risks associated with COVID-19 are grave and can be fatal. The hazardous situation caused by COVID-19, combined with the law analyzed below, justifies allowing Mr. Epps to serve the remaining months of his sentence on house arrest.

 18 months have passed and Mr. Epps is still with us in body and spirit. The Court taking such a long period of time to even hold a hearing on the motion is probably a strong hint on how the Court will rule.  Lamar Adams struck out when he tried to pull the same trick.

I have gout too. Take your dern Allopurinol and stop bitching. Every man over 60 likely has delt with worry about prostate cancer. If e was a free man, his doctor will likely tell him he will die of something else, so don't worry about your prostate. His other medical complaints are nothing more tan flim flam. He is where he took a chance on being when he violated the law. Leave him there longer and let him enjoy the fruits of his lawlessness.

He'll live just fine where he is. What I read is what many of us out here have but continue to work honestly day to day. Maybe he needs to get off his fat ass more and move around. I say that not knowing what his normal day in the Fed Med is like.

Don't think his problems are as much medical as they are reality. He sees his and Cecil's deal were peanuts compared to the ex-gov and crew. Wants a second chance at that state money to go along with what has been hidden from his first go round.

I hope you all are correct that Epps won't get out of jail anytime soon. I am sure he quickly learned that is sucks to be him when the tables are turned and he is the inmate. I have no one bit of sympathy for him. I hope he stays in prison for his entire sentence.

I do have a question though: Why is Ms. Abby filing this anyway? Doesn't she have an ethical obligation to assure that things she files have some merit? This certainly doesn't. As everyone above has stated, the "health" conditions are nothing unusual. Hell, he even survived having COVID, so how is that even a problem? Perhaps Wingate will get on her hard for filing a frivolous motion during oral argument.

I apologise to everyone here. This report continued to disturb me, so Mr. Google and I spent time together researching these complaints.

I am forced to assume the complaint actually ment Hyperlipidemia and not hyperlipidermia. In any case, Mr Epps has an imbalane in his "Good" cholesterol and his "Bad" cholesterol. In short, he needs to be more careful about what he eats and take his statin drugs. I had these same problems for years, then quickly corrected them through drug therapy utilizing cholesterol medication that is very cheap, and most likely available at Parchman. He needs to ease back from the table at mealtime and walk around the prison yard another lap or two, since exercise like walking can oftermake a noticable difference. Skipping whatever desserts they offer prisoners (Perhaps none), will also help, likely more than sending him home.

I also have unspecified glaucoma, which means my Optomitrist tells me "You have some hardening and cloudyness in your lenses, Too little to do catarac surgery on you at this time." If I can't/shouldn't get surgery as a free man, his doctor will likely tell him the same thing if he is at home, rather than at Parchman.

I misspoke when I said prostate cancer and I apologize for that. His complaint actually says he has an "enlarged prostate", which means he has trouble taking a piss and ay nt be able to "get it up". Sorry if that stateent offends, but it describes enlarged prostate pretty accurately. Neither of these "requires" treatment outside the fences of Parchman Prison.

I will stick to my statements concerning Gout. I understand there is a new gout study at UMMC he could probably enter that might actually benefit humanity more than sending him home early.

I feel better now, simply having a more accurate understanding of Mr Epps complaints and how they have no bearing on his inability to complete his prison sentence.

The motion says his lawyer is a princess, can you believe that!? Princess Abby. I ain't even knowed we had no princesses in these parts. That's a slick move on his part though because princesses are known for generally getting what they want. The prosecution better get them a Duke or an Earl or some such to lawyer for them in opposition to it.

Judge Wingate will be honored when he leaves the bench. But his inability to move a case has caused repeated injustice.

Another apology from me to the readers. I have no idea why I didn't read this is a Federal facility and he is there on feberal charges. IMO, very few federal prisoners get time off. Whatever the federal judge gives you is usually what you serve. At least that is my understanding. Thinking this, I am uncertain why the judge agreed to hear the appeal and also believe he stands little chance for sympathy from the bench.

We'll see what happens (what I change) the next time I read Mr. Kigfish's post.

Can counsel for the appellant tell the court how home confinement would improve or correct any of the stated medical issues faster, better or more sensibly than will continued imprisonment with the treatment available and being received through MDOC?

If he's to be kicked back in a recliner watching the Nicks and Buffalo, he'll be a diabetic within a year. Leave that banana-puddin'-head where he is.

Thanks to the federal courts, excellent medical care is available in prison. He will live to serve his sentence in full.

Judge Wingate's dilatory ruling on the case has nothing to do with Epps' or anyone else's cases. That's just how he conducts his court. Some of y'all remember when the Fifth Circuit was forced to take cases away from a couple years back because of his backlog?

He almost died from COVID once and has had it again recently. If the BOP is so great, why are nurses and social workers filling in a correction officers. Trust me, the healthcare and facilities aren't rated A+ the way people assume. If he stays, hopefully he'll welcome Phil, Shaz, and Tater Tot along with all of our state's other "good, Christian" politicians and help them get acclimated the prison environment. Their brewing scandals put his to shame. What a bunch of hypocrites.

Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
