Reed Tries to Use Tarrio's Death to Get Out of Jail

Chauncey Reed is trying to use JPD Sergeant Mike Tarrio's death as a get out of jail free card.  Reed's attorney Kevin Camp filed a motion to dismiss Reed's indictment for first degree murder and attempted murder of a law enforcement officer ten days ago in Hinds County Circuit Court.  

Camp argues in his motion to dismiss for lack of probable cause: 

the State has offered no evidence establishing Officer Tarrio had probable cause in his unreasonable seizure of the Defendant in this case, a seizure which led to the events that unfolded on May 9, 2018.

The motion claims the vehicle was parked at a gas station when Tarrio approached the SUV.  Since Tarrio is deceased, any prior statements made by the police officer are "hearsay." Any use of such statements violates Reed's Sixth Amendment rights.  Since no probable cause existed, then all evidence obtained during the stop, including the video of the shootout, must be dismissed.   


 District Attorney Jody Owens said the prosecution is "absolutely" going forward.  He said his office will "vigorously prosecute" those who try to take the lives of law enforcement officers. 

Synopsis of Case

Officer Mike Tarrio saw Elliot Reed driving erratically as he pulled into a gas station at 1 AM on May 9, 2018.  The alert officer saw several weapons in the car as he approached the vehicle and ordered Elliot to get out of the SUV.  Unfortunately for all, Reed attacked Tarrio and put him into a headlock.  Reed's brother, Chauncy, jumped out of the passenger seat to help his brother.  Elliot tried to take away Tarrio's pistol while he told Chauncy to shoot the police officer.  Elliot grappled with Tarrio while Chauncy began firing at Tarrio with a firearm.  Chauncy's rounds fortunately missed the officer.  Tarrio ran behind his cruiser for cover and returned fire.  Elliot was killed in the exchange.

 The two videos posted below show the entire struggle as well as the police officer's good fortune.



Unfortunately for Officer Tarrio, the case disappeared for several years.  MBI referred the case to Hinds County District Attorney Robert Shuler Smith in January 2019 for prosecution.  However, Smith only presented Tarrio to the grand jury for killing Elliot Reed while Chauncey escaped prosecution.  The grand jury refused to indict Tarrio. However, Reed kept catching breaks from the Hinds County criminal justice system. 

A Hinds County grand jury indicted Reed in October 2018 for aggravated assault and shooting into an occupied vehicle in March 2017.   Reed also dabbled in a little bit of drug dealing as a grand jury indicted him in May 2018 for four counts of possessing cocaine, meth, and marijuana with intent to distribute.  The indictment said he had 187 grams of cocaine.  He was also indicted for possessing a stolen firearm.  However, the Dope Boys' D.A., Robert Shuler Smith, blessed Mr. Reed. 

Smith's office remanded the aggravated assault and shooting into an occupied vehicle charges in September 2019.  Prosecutors dropped the firearms enhancement for the firearms charges as well.  Judge Adrienne Wooten sentenced Reed to serve 15 years in prison  but suspended five years and gave him credit for time served.  The drug charges are considered to be "non-violent" so Reed was probably eligible for parole after he served 25% of his sentence and paroled he was on August 10, 2021.
JJ reported  the lack of prosecution for the May 2018 charges in December 2021.  MBI sent a copy of the file to District Attorney Jody Owens after JJ inquired about the case. The District Attorney reviewed the case and presented the case to the grand jury at the next term a few weeks later.  The indictment states: 
To-wit,  Chauncey  Reed,  while  acting in concert  and/or aiding, assisting or encouraging Elliot Reed, did cause  Elliot Reed to be killed while in the commission of the felony of the attempted murder of City of Jackson Police Officer Michael Tarrio,who was there and  then acting in his official  capacity as  City of Jackson  Police Officer by shooting  at City of Jackson Police Officer with a firearm....
U.S. Marshals arrested Reed.  He resides at the Raymond Detention Center.  The case is assigned to Circuit Judge Adrienne Wooten. The District Attorney has not yet filed a response.

Require all death cases to go to trial within one year, then wend all the lawyers to Jail with the person they represent, if that person is found to be guilty.

If they use a public defender, drop the lawyer to jail requirement.

Am I accusing lawyers of missapplication of the legal process? Really sounds that way, doesn't it.

The Lawyer is doing what he is supposed to do for his client, Good or Bad, Guilty or not Guilty. None of us likes this, but it is a fact of legal life. I've known many prosecuting attorneys switch to defense attorneys solely for the money that criminals will, and can, pay and that the attorneys demand. First learn how to put them away then use that education to keep them out.

And please don't worry, they have no trouble going to sleep at night.

1. Effective assistance of counsel is required to incarcerate the guilty and keep them locked up. That's what the U.S. Constitution requires. If you don't like it, move to Russia, or China.

2. I don't know the procedural history of this case. But, if Officer Tarrio previously testified at a preliminary hearing, or otherwise, and Reed's attorney had a chance to cross-examine him, his testimony is admissible on the topics to which he testified. Miss R. Evid. 804(b)(1).

Just following the case since it was neglected by the media for so long and Reed nearly got away without being prosecuted. Camp is just doing his job.

well, bs. the video doesn't need to be authenticated by tarrio, as he didn't originate or maintain it. all pros. needs is a couple of folks to identify the animals in the nissan.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.
