State Auditor Investigates Professor's Strike

Professors fire back at Shad White.

Our favorite Ole Miss professor surprisingly generated some more headlines.  Professor James Thomas made quite a name for himself with his bullying ways in Oxford a couple of years ago:



A true warrior, he has never once backed down but instead managed to achieve tenure and the Chairmanship of the Chancellor’s standing Academic Freedom and Faculty Responsibility Committee at Ole Miss.

Professor Bully joined a national "scholar strike" for two days recently to promote his version of social justice. That little act caught the eye of State Auditor Shad White. He warned Ole Miss last week:


A group of Mississippi professors protested Mr. White's actions yesterday:

We, the undersigned members of the professoriate in Mississippi and beyond, urge that you immediately and publicly express support for the besieged faculty member, J. M. Thomas. We urge you, as institutional leader of the Faculty of University of Mississippi, to support the principle of academic freedom, helping to articulate to the public an understanding of Dr. Thomas’ action as a direct expression of academic freedom and as an expression of the human values in the University’s statements of mission and philosophy.

To begin, we believe that any conduct of Dr. Thomas that falls within his profession as a professor is the purview of his colleagues, department chair, and dean. If his experiences are like the rest of us, professors give countless uncompensated hours and days to our institution, discipline, and the public.

Professor Thomas has exercised his constitutional right of freedom of speech in acknowledgement and support of ScholarStrike, a national action to voice opposition to police violence against African Americans. Dr. Thomas’ participation in ScholarStrike constituted, as he has suggested, his teaching activity on September 8-9, 2020, declaring his support of humanistic values that are at the heart of the academic enterprise. Rather than being threatened by forces of the State for his action, he should be honored for helping to advance the values espoused in the University’s own Mission Statement, including enriching opportunities outside the classroom and a sense of global responsibility.

The executive director of ACLU-MS is quoted by AP as saying that Dr. Thomas “was not demanding improvements in his own work conditions but was trying to draw attention to other issues” and therefore his action was well within his rights as a citizen. Furthermore, we assert that if Dr. Thomas has not violated anything within the University of Mississippi faculty handbook, there is no merit to what his critics have to say about his recent activities. His style of community activism may not be the approach some of us would choose to use. On the other hand, tenured professors are protected from the whims and tastes of the public or individual politicians.

We realize that many politicians and members of the public have found professors to be easy targets in these polarized times. One speaker said before a national audience that professors “don’t have pride in our country and because they no longer ask what can I do for my country, only what the country should be doing for them, they don’t have pride in themselves.” This antipathy towards higher education is mirrored at the state level. Given recent negative comments about professors in American society, we find it particularly worrisome that many in the public and politics know so little about academia, what a professor is, or how tenure works besides what they may read in a few media accounts and on social networking sites. Sadly, Dr. Thomas has become fodder for such sentiments.

We view higher education as a cornerstone ideal in a well-functioning democracy. Dr. Thomas practices his discipline faithfully by recognizing that personal issues are linked to larger social forces. The social sciences and humanities tradition that many professors like him follow centers on critical thinking and sound research and teaching. That tradition also involves exposing social injustice and providing solutions. Indeed, this is the point that Martin Luther King made when he argued that social sciences should be the “molders of consensus.” Lastly, the ethics we abide by as learned members of our disciplines often requires us to give voice to empower those we study and teach, and the ways we practice community building. Like Dr. Thomas, we the undersigned, are guided by those ideals.

We, the undersigned, urge you to stand publicly with Dr. Thomas in exercising his disciplinary values and constitutional right to free speech. Your public support is urgently needed.

@7:11. Actually, legal genius, there is no first amendment violation. The first amendment does not prevent governor employers from creating rules for employment. In this case, the rule says that no employee can strike. Just because the professor claims a political reason for violating the rule, this doesn't protect him from suffering the consequences of said violation. Another example would be an employee dress code. If my employer has a dress code, I can't show up one day in flip flops and a tank top and say I dressed this way to protest for black lives matter. As long as the rules are enforced equally against everyone, regardless of political affiliation, there's no first amendment issue.

As is always the case with the left, the ends always justify the means. Laws are for those who are not in the right. The left considers itself to always be in the right on issues, so there should be no further discussion. Just like their claims to global warming (now, Climate Change): The science is settled. There shall be no further discussion, especially from the "deniers" (which is a further implication that THEY are right, and ALL others are wrong.)

I hope Shad and others with authority IN the law show some backbone and don't back down. It would be nice, for once - and hopefully moving forward - that the people charged with enforcing the laws actually enforce them. Otherwise, the lawbreakers - and even people like me - will soon enough just start ignoring the laws they don't like.

No, professor, if you feel the laws are wrong, work to get them changed; however, in the meantime, I hope they blister your ass!

As someone who has five degrees, I believe we should not de-fund the police. I do think we should de-fund social sciences. Funding of Social sciences are nothing more that subsidies to produce worthless degrees which produce no job skills.

Those citations to authority in Mr. White's letter are to the Mississippi Code, i.e., the law of the State of Mississippi, not an employee handbook. It seems to me either Professor Thomas can challenge the law on constitutional grounds, and seek to have it struck down, or he can accept the punishment for breaking it.

I haven't looked them up to verify, but I strongly suspect none of the Phds that signed this letter also have J.D.s. From the letter it looks like the law is clear, as is the choice for Chancellor Boyce to make: either openly admit that he will not follow the law, or fire this chump. I say good riddance.

None of what these professors said matters (that the faculty handbook wasn't violated, that the prof striked not to improve working conditions but to advance equality for african americans, etc). The prof refused to work but wanted to get paid, a violation of state law. Don't like the law? Put in effort to get it changed.

Does anybody know if he requested PTO for those two days? Hmmmmm......If he did, then he's covered, and Oxford can't do a damn thing about it - nor the sell out climber Shad White. This shouldn't have even been on his radar....and he's ignoring whales of corruption he knows good and well are happening, but now that he is thick with the thieves, Mississippi corruption carries on in a big way.

Send your kids to a private Christian university where this sort of thing does

By looking at the alarming decreases in undergraduate enrollment over the last few years, it is very obvious damage is being done. The real benefactors of this anarchy at “Ole Miss”, excuse me, The University of Mississippi are Ms. State and Univ. of Southern Ms. Look it up. If you want to stop this stuff, you can vote it out by not buying sports tickets and quit contributing to the various clubs. Shad's decision to pursue this is transparently political. There is no reasonable financial justification to spend his office's time and resources pursuing two days' pay from one professor.

More importantly, his interpretation of the law is highly suspect. A strike, under Miss. Code 37-9-75, "means a concerted failure to report for duty, a willful absence from one's position, the stoppage of work, a deliberate slowing down of work, or the withholding, in whole or in part, of the full, faithful and proper performance of the duties of employment, for the purpose of inducing, influencing or coercing a change in the conditions, compensation, rights, privileges or obligations of public employment."

The professor's work stoppage, such as it was, was expressly performed to call attention to national issues of racial justice. It was not done "for the purpose of inducing, influencing or coercing a change in the conditions, compensation, rights, privileges or obligations of public employment." He has demanded no changes to the terms of his own or anyone else's employment with the state. It is simply not a strike under the law.

I actually had some hope that Shad was above this kind of stunt, but it seems he couldn't resist the chance to participate in a time-honored tradition of Mississippi politicians using their public positions, money, and resources to pursue politically motivated, ill-fated legal fights.

Um, 9:44, you can define strike however you want, but you do realize this professor SAID he was on strike for those two days, right? Now, he may not actually have known what he was doing when he SAID he was on strike, but if this were ever to go to court, I suspect the court would look at his intent and what he SAID he was doing, as he was absent from work for two days. Strikes are illegal. Simply being absent from work for two days is not.

Whether he was striking under the law seems to me to be immaterial in this instance if he believed he was striking by SAYING he was striking, then carrying through with it. Shad's not on a witch hunt. He's going after someone who knowingly went on a strike (again, evidenced by the fact that striking is what he claimed to be doing, while he was doing it), and he's intending to hold this professor accountable.....the same thing that would (and should) happen to you or me, were we to do the same thing. Like elections, actions have consequences.

I couldn't quite put my finger on it when this prof posted about fingers in the salad, etc., but his recent activity brought it into focus. This guy simply doesn't give a shit about the law or the rights of others. That isn't just some ad hominem attack. He advocated several illegal acts in the "fingers" post - disturbing the peace, theft of services, theft of property, etc.

In his latest stunt, he broke the law regarding striking. While citizens do have the right to protest, there are at least two more parts to that: the responsibility to protest legally and peaceably and that actions can have consequences. Had he suggested that people write letters, use their own time to protest and picket, or similar, he would have been on firm legal and civil ground. However, if you support the law, including the Constitution and its restrictions upon the government, then you must support it when it has reasonable consequences albeit ones you don't particularly like. In this case, I'm sure the professor would attempt to enforce his contract if Ole Miss tried to violate it detrimental to his interests so he shouldn't be surprised if Ole Miss attempts to enforce it when he violates it by his own willful conduct in violating the statute. He should be terminated if that is what the law mandates - not because of his belief(s) but because of his (illegal) conduct.

Spot on, @8:37. The kids aren't going to college prepared enough in critical thinking skills to challenge any thought, much less the thoughts of radical professors. Firsthand, my sister in law is majoring in psychology which is another subject area overrun with communist ideologists masquerading as professors. Well, suddenly, last year after watching an anti-meat documentary during one of her psychology courses' lectures(no idea what that has to do with psychology), eating meat is now going to end the world. It not once ever occurred to her that maybe, just maybe that just because she sees a documentary on a subject does not mean that the science on the particular matter or thought is anywhere close to being settled.

The impressive support of your educational institutions show why Mississippi, and red states in general, have such high levels of education, and such low levels of poverty, poor health, etc., when compared to the rest of the country. With the people most of you guys vote for in power, i.e., the guy who out-conservatived his opponent (and regardless of technical party affiliation, that’s been the case pretty much uninterrupted from the beginning), it’s no wonder MS is on the top of every good list. Right?

Keep doing what you guys have been doing from the beginning. It’s worked great so far!

Shad's desperate publicity stunt may end up in court. There is do doubt a court will rule that he has the right to protest and strike. This will open the door to every state employee being able to protest and strike any time they want to.

Trollfest '09

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
