Rankin Chancellors strike gay-marriage registration

Rankin County Chancellors Dan Fairly and John Grant threw out a gay marriage registration that was filed yesterday at the Chancery Clerk's office.  Jennifer Kelly and Anna Guillot filed a registration for a New York marriage license (see p.4 in the documents posted below.).   The court order states:


the filing of these documents was done without the personal knowledge and approval of the Clerk of Court....

the deputy clerk who accepted the validity of accepting and filing of the documents without questioning the validity or legitimacy of the filing.  Proper or improper filing of documents is not the responsibility of the Clerk or his deputies. ...

it is hereby ordered and directed by this Court that the clerk of Court shall not, unless otherwise directed by the Court or a Superior Court, in the future receive or accept any filing or attempt to file the recordation of any document which evidences, appears to evidence, or even attempts to evidence the sanction, recognition and or endorsement of same sex marriage.....

The Court stated same-sex marriage violated the Mississippi Constitution.  The court accused Kelly and Guillot of using "subterfuge and trickery" to make it seem Rankin County or Mississippi endorsed gay marriage.  The court ordered the clerk to strike the registration from the records.

Don't they see this as history repeating itself. This was done to interracial couples forty years ago. We can't pick and choose which marriages and from which states Mississippi declares valid. Equal protect clause and all. How about for once Mississippi not being last and under Supreme Court order and choose the right side of history.

notwithstanding the subject matter of the order, I question the authority of these judges, sua sponte, to strike any documents from the general index in the office of the Chancery Clerk. assuming, arguendo, that they do have such power to strike or regulate the contents of the general index, doing so without notice is probably going to be a problem and give these persons a forum to air their concerns. they made a mistake for the long run.

The language of that Order is disgusting and fitting for a State that refuses to leave an 19th Century way of thought.

Disagreeing with gay marriage is one thing. Describing as "abhorrent and repugnant" the effort by a couple to have their marriage respected is hateful and unnecessarily forceful.

Mississippi gleefully wills itself into last place now and forever. It will get what it deserves until the public demands better.

On first impression I believe the order of the chancellors is void, as an unconstitutional judicial encroachment into the affairs of the executive branch, in violation of the separation of powers doctrine found in the Mississippi constitution. The order may have deprived the due process and equal protection rights the persons filing their certificates, giving rise to an action by them under Section 1983.

Looked at the statute. The legislature says the Chancery Clerk SHALL file instruments tendered to the general index. This order will not survive the challenge that is surely coming.

Compare and contrast: merits of a suit vs. the sua sponte ruling of these judges VERSUS Chrissie McDenials specious election challenge. Lesbians will prevail, Chrissie gets bitch slapped.

To those of you who are ranting against these two upstanding and moral gentlemen, please be advised that we really could care less about your immoral ideas.
Homosexuality is a sin. God said so and he is the ultimate authority. Here again, some of you probably don't believe that either. That is your problem, not ours.

I would have thought there would need to be an actual case before the court for them to make a ruling. I have never heard of judges wandering around the Chancery Clerk's office and checking the records for "errors" and then issuing an order. That would appear to be far outside their nomal judicial duties.

McDaniel should have filed in Rankin. He would not have a hard time convincing the judges "those people" should not be allowed to vote.

BTW, that is the most irresponsible judicial order I have seen since the 60's when the state was clinging to the last gasps of segregation.

Looks like the ACLU will have another case on its' hands. Their lawyers wrote a letter to Harrison County for not accepting the filings. I suspect they will have a field day with this idiocy. What is wrong with people that they need to make others feel "less than" - there is No reason for this.

According to the timestamp on pg. 4 of the document, as well as a couple of websites, this couple actually filed the document in Rankin back in March. Apparently, the chancellors' fine Christian morals were so disturbed by this incident they decided to let this sit on the books several months until they could take advantage of the media coverage of other couples filing in other counties. And they accuse the lesbian couple of subterfuge and trickery?

oh my, about 3500 same sex couples in the state, 7000 out of over 2M, yes this is our big issue, after man caused Climate change. i accept same sex marriage is going to be legal Nationally, legal verses right/correct or wrong. glad the Judge threw this out, only adds to the confusion, may the other 5 or 6 that got filed also be tossed.

Here's a news flash...if you want to attract industry to the State , you do not want to make it unfriendly for corporations and businesses with gay employees. All corporations and businesses have gay employees now.

We're trying to get the film industry interested again.

Being the " Gays aren't welcome" state will make that impossible and I could see Hollywood leading the charge for a boycott of our state.

Fundamentalists, you have lost on liquor and gambling and you held our state back economically in the process of fighting those battles. This is the same, only worse, because while your family might be tempted to gamble and drink, they are not going to turn into homosexuals if they aren't already inclined!

It's fine for you to share the " good news" but please, stop trying to insist it's your way or the highway for all of us. Not all Protestants share your interpretation of Christianity!

With the implementation of the Religious Freedom Act, gay couples that are members of the United Church of Christ should sue the state for infringing on their religious beliefs. Since 2005, the United Church of Christ has told their congregations to consider "wedding policies that do not discriminate based on the gender of the couple." It would be great if LGBT groups used the Religious Freedom Act against the idiots that passed it.

So if you buy a house in Rankin County and record the deed with the Chancery Clerk, a judge could just go tear the page out of the book and do away with your property rights without a hearing or any formalities.

Why do you think these guys want to discourage Lesbians from living in Rankin County? It's generally the Lesbians in the family, who make a big stink about the molestations that some Rankin County menfolk find convenient, normal, and even somehow 'biblical'.

I imagine it's about like when the Lesbian Aunt in the movie 'Bastard out of Carolina' raised a ruckus, when she discovered that the little girl's stepfather had been brutally beating and raping the child (while the girl's own mother had been turning a blind eye to the situation). Without that meddlesome Lesbian, Ol' Step-Dad could have kept right on a doin'-it with impunity.

Just because you drive a brand-new Infiniti SUV, and live in a brand-new $400,000.00 Arcadian-style MacMansion, with "full granite" and "stainless-to-the-max" appliances, overlooking the 'Rez', that doesn't mean you don't still "cleave unto the Old Ways", when the lights are out.

I'm thinking that a good many pawn-shop-ownin', every-word-o'the-Bible-is-true-believin', daughter-diddlin', "prominent" big men up in Rankin County Churches, are breathing a sign of relief! The rejection of that filing will surely mean that tidal waves of meddlesome Lesbians will now NOT descend upon their little corner of Heaven, to disrupt 'Family Values: NIKNAR-style'.

There are many old subdivision covenants recorded in the clerks' offices that prohibit sales of lots to racial minorities. Those racial restrictions are clearly unenforceable. I know of some in Hinds County, and I bet there are a few in Rankin County. Will these judges also proactively, without the need for motion by any aggrieved party and without a hearing or testimony, order those covenants removed from the land records?

This is the sort of animus that causes laws to be overturned.

Marriage is a legal contract and there are requirements for being able to enter into a contract!
No one is forcing churches to marry those their religion finds should not marry!
These women didn't ask a church to marry them! The filed for a license to marry with the county. They didn't even ask to be married in the state, for crying out loud!
In case you haven't noticed, we aren't arresting those polygamists in Utah even though there are laws against polygamy because politicians don't want to be accused of violating their religious freedom!
They are arrested for child abuse!

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all?
