The Jackson City Council was supposed to vote on JPD Chief Rashall Brackney's contract Tuesday but the Horhn administration pulled the item from the agenda. The contract curiously included a severance package.
Highlights of the contract are:
* The contract begins on April 1
* Relocation assistance of $1,000 per month for three months.
* City reimburses relocation expenses up to $15,000
* The Chief's salary is $150,000 (Unprecedented for the position)
* If terminated in first twelve months of her employment, she receives compensation through the date of termination.
* If terminated without cause after her first twelve months, the city will pay Chief Brackney for another 12 months (At least it's not $54 million).
The severance pay clause drew criticism from some Council members.
The clause is rather curious. JJ reported several years ago CMU paid Kenny Wayne Jones $75,000 upon his leaving CMU. The State Auditor issued a demand against Mr. Jones and the Attorney General actually took the case to Court. The insurance company for CMU paid the demand. The company in turned sued Mr. Jones.
Article 4 Section 96 of the Mississippi Constitution states:
The Legislature shall never grant extra compensation, fee, or allowance, to any public officer, agent, servant, or contractor, after service rendered or contract made, nor authorize payment, or part payment, of any claim under any contract not authorized by law;
Chief Brackney's contract includes a provision for severance pay. Since it is included in the contract, it is probably legal under the Mississippi Constitution .
Kingfish note: Should the contract include severance pay? Hell no.

If the mayor or the city had any shame this would be embarrassing. She shouldn’t have gotten the job in the first place and she has contract demands? Also if she wants to be taken seriously can she trade the pants suit for some form of uniform shirt.
