Dobbs Overturns Casey

The expected abortion earthquake struck America today as the Supreme Court upheld Mississippi's abortion law and overturned Planned Parenthood v. Casey on a 6-3 vote. Mississippi's law bans abortions after fifteen weeks except for medical exceptions.  Highlights of the opinion are: 

 The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives  

Guided by the history and tradition that map the essential components of the Nation’s concept of ordered liberty, the Court finds the Fourteenth Amendment clearly does not protect the right to an abortion. Until the latter part of the 20th century, there was no support in American law for a constitutional right to obtain an abortion. No state constitutional provision had recognized such a right. Until a few years before Roe, no federal or state court had recognized such a right. Nor had any scholarly treatise.  

The doctrine of stare decisis does not counsel continued acceptance of Roe and Casey. Stare decisis plays an important role and protects the interests of those who have taken action in reliance on a past decision. ...  But stare decisis is not an inexorable command, Pearson v. Callahan, 555 U. S. 223, 233, and “is at its weakest when [the Court] interpret[s] the Constitution

Roe conflated the right to shield information from disclosure and the right to make and implement important personal decisions without governmental interference. See Whalen v. Roe, 429 U. S. 589, 599–600. None of these decisions involved what is distinctive about abortion: its effect on what Roe termed “potential life.” 

The Court emphasizes that this decision concerns the constitutional right to abortion and no other right. Nothing in this opinion should be understood to cast doubt on precedents that do not concern abortion.

But the opinion (Casey) concluded that stare decisis, which calls for prior decisions to be followed in most instances, required adherence to what it called Roe’s “central holding”—that a State may not constitutionally protect fetal life before “viability”—even if that holding was wrong

* Casey threw out Roe’s trimester scheme and substituted a new rule of uncertain origin under which States were forbidden to adopt any regulation that imposed an “undue burden” on a woman’s right to have an abortion.11 The decision provided no clear guidance about the difference between a “due” and an “undue” burden.

* The State of Mississippi asks us to uphold the constitutionality of a law that generally prohibits an abortion after the 15th week of pregnancy—several weeks before the point at which a fetus isnow regarded as “viable” outside the womb. In defendingthis law, the State’s primary argument is that we should reconsider and overrule Roe and Casey and once again alloweach State to regulate abortion as its citizens wish. On the other side, respondents and the Solicitor General ask us to reaffirm Roe and Casey, and they contend that the Mississippi law cannot stand if we do so.

* Ordered liberty sets limits and defines the boundary between competing interests. Roe and Casey each struck a particular balance between the interests of a woman whowants an abortion and the interests of what they termed“potential life.” Roe, 410 U. S., at 150 (emphasis deleted); Casey, 505 U. S., at 852. But the people of the various States may evaluate those interests differently. In some States, voters may believe that the abortion right should be even more extensive than the right that Roe and Casey recognized. Voters in other States may wish to impose tight restrictions based on their belief that abortion destroys an “unborn human being.” Miss. Code Ann.  41–41–191(4)(b).Our Nation’s historical understanding of ordered libertydoes not prevent the people’s elected representatives fromdeciding how abortion should be regulated.

Governor Tate Reeves issued the following statement. 


Mississippi has led the nation to overcome one of the greatest injustices in the history of our country. Our state’s historic case before the United States Supreme Court was the catalyst for overturning Roe v. Wade and has made the nation safer for children than it was just a few short hours ago.
 
Let’s be clear: this decision will directly result in more hearts beating, more strollers pushed, more report cards given, more little league games played, and more lives well lived. It is a joyous day! Tomorrow, we will wake to a new world, enthusiastically prepared to take on the challenges ahead and to take every step necessary to support mothers and children.
 
We must remember that our work is not yet over. The pro-life movement must dedicate itself to ensuring mothers and their babies receive the support they both need during pregnancy and after.
  
Despite what some may claim, Mississippi’s objective was never simply to win a court case – it’s been to create a culture of life across the country.
 
Our state seeks to be pro-life in every sense of the word – supporting mothers and children through policies of compassion and working to ensure that every baby has a forever family that loves them.
 
Mississippi will work relentlessly to accomplish these goals and will continue to build a culture that supports mothers and children, valuing the inherent dignity of every individual. This is our new pro-life agenda.
 
I applaud the Supreme Court Justices for their courage in issuing this well-reasoned decision. It took bravery to stick to the courage of their convictions, especially amidst an unprecedented leak that was aimed at threatening the integrity of the Court, an assassination attempt, riot threats, and attacks on churches and pregnancy centers. No matter one’s party or ideology, we should all be able to condemn these acts.
 
I pray that Americans will come together, listen to one another, and debate this issue peacefully. Only by moving beyond our divisions and having respectful conversations can we begin to heal this nation's wounds.
 
We stand on the shoulders of giants. This win has been achieved thanks to the tireless efforts of so many over decades. Thank you to the lawyers who argued this case for us, passionate citizens who pushed this issue for years, and those who prayed for this day for many decades. I urge my fellow Mississippians to rejoice today and keep praying as the work is not done.

Most of the people commenting don't have a clue as to what this means. It takes the abortion decision from the Federal Courts and puts it back to states decision. In this case, Mississippi was banning abortions after 15 weeks except in the case of rape, incest, or medical conditions. It's not full on black or white, yes or no. Abortion was never a constitutional right as Roe V Wade suggested.

The ruling here actually allows local democracy to prevail. Both Roe and Casey took democracy and slaughtered it. At least - now - states have the ability to decide (though a form of democracy) how abortion should or should not work.

You should go check out the 10th Amendment.

I assume Tate will now call a special session to have the legislature expand Medicaid, and provide more funds for Pre K and K-12 education and other programs to help children. As this great victory for life won't mean much if after the fetus is born, there is no help. But I'm sure Tate and Co. will do these things to help, because otherwise, it would make their "Life is precious and must be preserved" stance a complete joke and nothing more than a way to get the rubes wound up.

Up here in Canton, in my 25 years of being here, haven't heard of what 943 described as actually happening. Most of the cases are taken care of by families who may not be happy with the situation, but they adapt. That's what the right thing to do is.

The whole point is not abortion. It is constitutionality. Roe v Wade was never covered in the constitution; therefore, the decision belongs to the individual states. As to rape, incest or the life of the mother, the Mississippi law makes exception for those circumstances. What it does, is stops the use of abortion as birth control. There are many other forms of birth control that do not entail the ending of a life.

Where does this exception for rape or incest business come from? Abortion is abortion, killing is killing if the rationale is moral/religious and not political. A child of a rapist is still a child is it not? If there are exceptions, the prohibition means nothing. Thou shalt not kill (exceptions are political, economic, discriminatory or just plain cowardly) Which child is it OK to kill? So if you are pro-life be pro-life!

This may be the right thing but the majority favor the right to an abortion. I am not sure about Mississippi but you will find out soon enough. More Women vote than Men already and trust me the majority want that right here in Mississippi just as much as any place else. Democrats will be making gains in all the population centers. The coast is going to be the first to turn. Walker just lost Georgia . Texas will fall in the next 2 cycles. North Carolina won’t be far behind either. The good thing for republicans is that they have successfully gerrymandered congressional seats so they should be able to block any pro abortion laws for the next 5 years or so. The Senate however is lost for the seeable future.

First- this whole issue has always angered me because nobody was forced to have an abortion… It’s A matter of choice – sadly too many people were threatened by that. Second -What men and women and boys and girls in Mississippi need to do right now is learn how to NOT get pregnant… Boys and men should think about vasectomies… Girls and women think about tubal ligations… Everybody might think about pills, IUDs, condoms. Learn how to be smart instead of whining!

Already, our maternal death rate has far exceeded the single digit numbers in Europe. Here the rate is 14.6 per 100000 for women under 25,23.4 for women 25-39 and 108 for those over 40.

You old guys need to know that a woman often mistakes a pregnancy for menopause. You might not be done "providing".

We once had " homes for unwed mothers" so more families than some of you realize, successfully kept the teen pregnancy and adoption a secret.
The pregnant teen went to " help" a family member who was ill ( with or without her mother) or went to " boarding school and didn't like it or later went to a real one" or had a serious illness that lasted for months. How do so many of you miss the few stories of " moms" and "dads" whose adopted children have found them ? You also missed the stories of unknown siblings being revealed with the advent of DNA,too? The stories have an interesting twist or be reported voluntarily to to make the " news" and so are the tip of an iceberg!

You can no longer deny a teen father's paternity, just delay the support. So, I hope Pro-Lifers will first " legitimize" their grandchildren, then support their teen child parents with childcare and financially until they can support themselves and your grandchild. You will quickly learn the limitations and frustrations of " welfare" if you can't do that on your own. You will find your welfare myths busted. But, please don't pretend your family is on Social Security. Only aid to the disabled has that " cover" and the truth is the recipient hasn't worked enough , it's welfare.

If your daughter has foolishly tried to abort on her own or has a "high risk" pregnancy, don't be surprised if you have no future grandchildren. Puberty is not the same in every female nor do many teen mothers even recognize they are pregnant when prenatal care matters most.( see deaths in childbirth in European royal family lines before there were safe abortions). Indeed, many first pregnancies are naturally aborted or miscarried but your daughter may not recognize it and if any vestiges are left, she could sicken and die with your blissful ignorance.
If her boyfriend murders her instead of facing life long responsibility for her pregnancy, well, that is just a risk you take. The 20% of pregnant women who are murdered in the U.S. are counted separately.

Our legislature didn't write " good " legislation, they wrote ignorant legislation without the benefit of understanding the actual consequences.

Indeed, quite a few will be surprised that minorities will be having more children. The white babies expected will not be among the middle to upper middle class, it will be the lower classes. There won't be less welfare but more. You might should have considered the vaginal "wall" and not the impossible wall at our border!

The SCOTUS ruling DOES NOT take away your right to murder a viable fetus i.e. fully developed human being. You just have to travel to an immoral state (or DC) that allows for late-term abortions with no state-imposed thresholds.

It appears Alaska, Colorado, DC, New Hampshire, New Jersey, New Mexico, Oregon, and Vermont should be able to help you out with your evil. And there are plenty of other states (probably half or so of the US) that will allow abortions until 20 to 28 weeks.

To the ill-informed that want to know what all the fuss is about, it’s the same ole “any excuse will do” for leftist Democrats to begin acting like spoiled 5 year old’s and start screaming lies, making threats and eventually turning to violence. It’s what Democrats do when they don’t get their way!

Like perverts, druggies etc., leftist Democrats want everyone to be in the gutter with them, and giving states the right to make their own choices on rights not granted in the constitution does not fit their “control you to be like them” objective.

Of course leftist Democrats have no problem at all with “their” states taking away your rights guaranteed in the constitution (free speech, right to keep and bear arms), as was the case in New York where just about only the rich and famous could get a carry permit.

The Supreme Court has spoken: Roe vs Wade has been overturned. There are those whose position on the abortion issue is laudable. They appear to have based their pro life stance on an authentic belief that life begins at conception, and it should have priority over the mother's decision to choose for herself whether she should carry the pregnancy to term. However,there are those who appear to base their vehement anti abortion advocacy on a hypocritical morality that allows them to tout concern for lives of the unborn, yet vilify the women who find themselves in challenging circumstances that force a difficult choice. And last, but not least are the politicians ---those who have simply decided that being pro life is a valuable, conservative sound bite that garners votes, and is means to a successful political end. They support and enact laws that cater to both groups, with no concern or compassion for the mothers of the unborn, they claim they are protecting. To all those claiming defense of the unborn, consider it your christian duty to extend some grace, compassion and resources to those women who must live with your choice that has been legally forced upon them. Its what Jesus would do.

once republicans are in control, they could then pack the courts to get a conservative majority, after the democrats packed the court to get a liberal majority. democrats pack the court, republicans pack the court, and on and on it goes, where it stops, nobody knows.

every indication is that the republicans will take the senate and the house in november. and based on the job potato joe and his entire administration is doing, republicans win the white house in 2024. i hope you are as excited about the possibility of packing the court then as you are now. cause any sane person would be against packing the courts, regardless of which party is in charge.

All of Mississippi's Congressional delegation have commented on the SCOTUS decision except Guest. Other than Guest, none of the rest of the congressmen have commented on Omaha.

Today, Congressman Michael Guest (MS-03) released the statement below praising the Supreme Court’s decision to uphold the Mississippi law restricting abortion in the Dobbs v. Jackson Women’s Health Organization case and returning to the states the right to protect the life of an unborn child.

“After almost 50 years justice has been realized, and our nation celebrates a momentous win for the pro-life movement. For decades, millions of Americans have advocated for the right to life of our unborn children following the misguided Roe v. Wade decision; but today, the voices who speak for the voiceless have been heard. As a pro-life Representative for the people of Mississippi, I am proud that Mississippi led the charge in overturning Roe, and I will continue to defend the lives of the unborn through my work in Congress.”

Congressman Guest, in coordination with Republican Members of the Mississippi Congressional Delegation and the House Pro-Life Caucus, helped lead the amicus brief in support of Mississippi’s pro-life law before the Supreme Court. The bicameral amicus brief was signed by more than 200 Members of Congress.

Congressman Guest also addressed the Department of Homeland Security memo outlining the potential for violence following the Supreme Court decision.

“DHS must be ready to assist local law enforcement in protecting the lives and property of innocent Americans from violent extremism. Those who wish to cause harm to the American people or disrupt the peaceful judicial process through intimidation and violence must be held accountable for their actions. As Vice Ranking Member of the Committee on Homeland Security, I stand ready to assist law enforcement and government agencies quell any violence in response to this decision. Under no circumstances will violence towards Supreme Court Justices, elected officials, or the pro-life community following these decisions be tolerated.”

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time.
