The Dead Past is not Dead

Will a small dose of justice be served in the Emmitt Till case.  The AP reported: 


A team searching a Mississippi courthouse basement for evidence about the lynching of Black teenager Emmett Till has found the unserved warrant charging a white woman in his 1955 kidnapping, and relatives of the victim want authorities to finally arrest her nearly 70 years later.

A warrant for the arrest of Carolyn Bryant Donham — identified as “Mrs. Roy Bryant” on the document — was discovered last week by searchers inside a file folder that had been placed in a box, Leflore County Circuit Clerk Elmus Stockstill told The Associated Press on Wednesday. Rest of article.

67 years have passed since the poor lad was brutally murdered in the Mississippi Delta.  There are probably no witnesses remaining but for Donham.  The story asks whether the warrant can still be executed.  If she is arrested, is there enough evidence for an indictment or conviction? It's probably a safe bet Donham is the only surviving person directly involved in the case.  So the case will probably rely on court records, testimony, and media coverage.  Will it be enough?

@652 - yes, a lot different. There were witnesses still alive that could testify about the Nazi guards; from what is said here, there is no one still alive that could testify about this case.

The warrant was executed. All parties indicted were formally charged. Leave her be. Why is Tills life more important than a south Jacksonian?

1. No court records implicate her.

2. 'Testimony' from whom? Anybody who was over 15 at the time is now, if not dead, over 85.

3. Since when does 'media coverage influence a court case? Will Salter and Mitchell be called to the stand?

4. White- guilt and black-hate always result in leaps to errant justice. Try somebody. Anybody. Find somebody guilty. Anybody. It feels so good.

Feds looked at her 20 years ago.

The facts developed showed there were other black people involved who helped dispose of the body.

Moving forward on the ex wife of the acquitted murderer only to show other black people involved in disposal would cause serious harm to what’s left of this community.

Honest question because I usually tune out when half-century cases are dredged up, even notorious ones: are any of the victim’s immediate family members still alive or is it now just nephews and nieces and cousins? Justice is right for justice’s sake, but people tend to want certain types justice more than others.

Does not matter what I consider right, wrong, justice, the attraction of symbolic political trials is more popular than ever, the Till case remains a talking point. Surprised she has not been arrested and in jail unable to make the massive bail amount. Leading national level politicians can make a pilgrimage and talk about the massive racism and flawed constitution. Lots of TV value left. Daddy Till did not have a very nice ending either, hung by US Military in WW2. N mention of Democrats doing the murder, being on the jury.

Obviously, she wouldn't be convicted of anything direct even if it did go the distance - but could she be found guilty by association? found guilty of criminal conspiracy? found guilty of obstruction? found guilty of facilitation of a hate crime?

Not such a reach if you think about it. Circumstantial evidence abounds in our imperfect justice system, and what defense lawyer in their right mind would take the case in today's political climate? Judges would also be begging to recuse.

So I’ve read in several places that Till had been warned about “customs” in MS before he came to visit from Chicago. Till’s own cousin admits that he was there when Till whistled at Bryant. Bryant then told her husband about the whistle. Bryant’s husband and company then went and killed him. Even if she could be prosecuted what would it be for? Some lawyer types around here? Conspiracy if somehow they could prove she helped plan or encouraged the kidnapping? Accessory before the fact to murder?

While I don’t condone murder there is an element of “play stupid games, win stupid prizes” with the whistling episode…. Like when you have to keep telling a kid to “don’t touch the grill” and they keep doing it until they get burned.

@6:15 Till's cousin Simeon Wright died at the age of 74 in 2017. I think he was the last person present during the abduction when two white men and a black man came into the house with guns and kidnapped Till. Till's uncle Moses Wright famously pointed out the white men in court during the trial in what was at the time an incredible act of bravery.

Remember the myriad news stories that claimed she recanted her story about Till assaulting her?

The FBI looked into it and concluded (maybe not in so many words) that the civil-rights professor who claimed to have heard it made it up. It wasn't in any of his recordings or notes. Curiously that story barely made the news.

he did not whistle "at her" he had a speech impediment. Whenever he started stuttering, he would try to ease himself by trying to whistle to get to the next word

Hell they can't even indict the Colemans or the Lane's for all the people they screwed over. Doubt they will arrest and indict Bryant this far down the line. Also, for what? The only thing possible would be lying under oath I would think. Horrible situation that happened before most of our times, but sometimes people like the get the base stirred up. Sometimes people pay for their actions after they leave this earth.

How many millions of $$$ is the FBI and DOJ spending investigating and prosecuting those crimes? Is a 50+ year old case more important? Is it because Till was white on black crime? Ask the mothers and grandmothers of the dead Jackson boys which is more important. or ask yourself if you would rather see an 80 year old woman (who didn’t kill anybody) go to prison, or the Jackistan thug who may kill you, go to prison.

If the primary reason and call to arrest this woman is because this found warrant can be used to do it, there's the answer right there.

Would an objective prosecutor think and believe that he or she could convince an objective jury that the defendant was, beyond a reasonable doubt, guilty of the crime(s)? Would an objective judge find the law allowed the case to go a jury? Assuming an imperfect world in which one or more of the prosecutor, the jury, or the judge will not be objective, would (an) objective appellate court(s) uphold the conviction?

Just because you can do something doesn't mean you should do it. Look no further than Mississippi, Fitch and crew lurching blindly and foolishly into the quagmire of abortion law as a current events example.

The animals who committed the horrible act of hatred which ended Till's life will have to be judged by the highest authority. They among millions of other murderers face the one judge who is not limited by the human limitation of time. But time is our limitation. Sometime it renders our feeble efforts at earthly justice impossible. This is just one of those countless cases. Old lady Bryant can't be compelled to testify against herself and can only be charged with lying under oath, if that. Charging her with more will just be a futile gesture to satisfy a mob. The "family" wants the case and it's notoriety to go on forever but it ends. That does not mean Till himself or the historical significance is forgotten. It's not forgotten.

Rev. Wheeler Parker, Jr., Emmett's cousin, is still alive. He was at the house the night Till was abducted. Rev. Parker does not dispute the whistle. But Donham has also testified that she was groped, which did not happen, and she has admitted she made it up. If it was the groping lie that riled Till's murderers up, would she be an accessory?

Of the three primary industries in Mississippi in 2022 (food, music, and race), race may be about to eclipse the other two as being the most profitable. Likewise, since living conditions in MS have gotten so much better following the adoption of our new State flag (/sarcasm), it's about time we, collectively, find a new racial issue to jump into with both feet. Old race issues are always better than new ones, you know, because the ol' skool ones kinda seem more legitimate, so this one should fit the bill.

She claimed he whistled at her, not that he assaulted her and if that were recanted, there is always the fact that Em's cuz testified he was present when the whistle crossed the room.

Of course with Uncle Joe's regime being in charge, there's no way in hell to speculate as to what the Justice Department might do or which parts of our Constitution they might violate.

Think about the votes that could generate.

It's not a matter of "justice" anymore. That train has left and will never come back. It's just publicity and a media opportunity now. Most people get no excitement from watching frustrated people beat a dead horse, (no disrespect to the late Mr. Till) but the media keeps reminding us of the original crime and it's horror so they can just stir up a story.
The story of Mr. Till is about injustice and it's too late to change that. If there is justice God will have to render it.

Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.
