News to Plead Guilty

Nancy New and her son Zach filed petitions to enter guilty pleas in Hinds County Circuit Court this afternoon.  Once pillars of Mississippi society, the News will serve time in prison after they plead guilty guilty to  bribery of public officials, defrauding the government, RICO, and wire fraud. However, the sentences are not as harsh as one would expect.  Nancy New will serve no more than ten years in prison while Zachary will be incarcerated for no more than five years. 

The News will receive sentences equal to or less than their federal sentences.  Zach's petition states: 

I understand the cumulative recommended sentences of the plea offer made by the State is a recommended  seventy-five  (75) year sentence with seventeen (17) years of that sentence to be served.  I  understand  that  under  the  plea agreement  I  will  fully  cooperate  with the  State  in  the prosecution  of  my  Co-Defendants  and  that  I  will  provide  truthful  testimony against  my  Co­ Defendants. I understand that the State will recommend that the Court withhold sentencing in this Cause  until  after  I  am  sentenced  in  Criminal  Cause  Number 3:21-cr-00028-CWR-FKB  in  the United  States District  Court for the Southern  District of Mississippi.  I understand  that the State will recommend that all of the State sentences will run concurrently  with my Federal sentence in Criminal  Cause Number  3:21-cr-00028-CWR-FKB. It has  been negotiated  between  myself  and that State all of the time I will serve incarcerated will be served in the Federal prison system.

 Towards that end, the State's recommended sentence concerning all of the time to serve in this Cause is equal to or slightly less than the minimum time I will serve incarcerated in the Federal prison system in Criminal Cause Number 3:21-cr-00028-CWR-FKB. In the unlikely event that at the  time  of  my  Federal  sentencing  in  Criminal  Cause  Number  3:21-cr-00028-CWR-FKB,  I actually receive a Federal sentence requiring me to serve less prison time than the State sentences herein, so long as such Federal sentence is not a wholly probationary sentence, the State has agreed that on the date of sentencing in the within Cause that it will amend its recommendation regarding the State prison time required in this agreement to be equal to my Federal sentence such that all o the  time  I  will  be  required  to  serve  in  prison  will  be  served  in  the  Federal  prison  system. Additionally, The State will recommend that I pay restitution in the amount of $3,656,000.00.

Nancy's petition mirrors most of the same language: 

 I understand the cumulative recommended  sentences of the plea offer made by the State is a recommended ninety-year year sentence with twenty-five (25) years of that sentence to be served. I understand that under the plea agreement I will fully cooperate with the State in the prosecution of  my  Co-Defendants  and  that  I  will  provide  truthful  testimony  against  my  Co-Defendants.  I understand  that the State will recommend  that the Court  withhold  sentencing  in this Cause until after  I am sentenced....  in the United  States District Court for the Southern District of Mississippi. I understand that the State will recommend that all of the State sentences  will run concurrently  with my Federal sentence in..... It has been negotiated between myself and that State all of the time I will serve incarcerated will be served in the Federal prison system.

Additionally, The State will recommend that I pay restitution in the amount of $3,656,000.00.

Nancy New faces a federal prison sentence of ten years or less while Zachary faces incarceration of up to five years.  

The petitions state various acts performed by the Krewe of New as it repeatedly broke the law to held the favored few: 

* Nancy & Zach used DHS grant funds to buy a GMC Yukon for Davis on March 23, 2017.  The funds were meant for MCEC. (Count 11)

*  Zach & Nancy acted with John Davis to hire Brett Dibiase at an annual salary of $250,000 and provide him with a travel allowance for squiring with Davis around the country with DHS grant funds awarded to MCEC. (Count 12)

* Nancy & Zach allowed Davis to use a MCEC American Express card with no limitations from February 2019 to June 2019 (Count 13)

* The News hired Austin Smith with grant funds  even though he wasn't qualified for the position.  Smith is Davis's nephew. (Count 14)

* News transferred $1.2 million in grant funds to Paul Lacoste's Victory Sports Foundation. (count 27)

* Zach & Nancy transferred $4 million in TANF funds to USM for construction of volleyball center.(Count 28)

* The News & Davis transferred $500,000 in grant funds to Prevacus (Count 34)

* News & Davis transferred another $250,000 in grant funds to Prevacus (Count 35)

* News & Davis transferred another $400,000 in grant funds to Prevacus (Count 36)

* News transferred $3,000 in grant funds to Davis in form of cold, hard, cash. (count 37)

* News spent another $500,000 in TANF on a virtual reality center at City Center in Jackson.  The expenditure was disguised as a lease. (Count 38)

* Nancy New paid Jesse Pearce the costs of the lease for his personal training business with grant funds at behest of Davis. (Count 36 in Nancy New petition)

*  Nancy New spent $40,000 in grant funds on children's books (Count 38 in Nancy New petition)

* Nancy New acted with Davis and others to wire grant funds to Rise Malibu, a drug rehab center in California (Count 45 of Nancy New petition.).  

* Nancy New paid $365,000 for a virtual reality program with grant funds. (Count 28 in Nancy New petition)

Note: Zach New's petition is posted below.  Nancy's is not because it is grossly inaccurate.  Apparently someone copied and pasted Zach's sentence into the sentencing section for Nancy. Hence the confusion and errors on my part in the earlier editions of this post. 

Kingfish note: The News apparently flipped.   A little bird said a certain former Hinds County deputy is seeking legal counsel of the out of state variety.  Stay tuned.

Here be the problem that the cowboy boots deputy has. In order to plea guilty to bribery of a public official, said public official was bribed. John Davis was not a public official.

You would be surprised how many state agencies are currently under investigation by the feds. My firm was recently asked to do some data analytics for the VA Inspector General and it was shocking

That is really great for federal law and cornel. But this is state court. Mississippi Coder Ann Sect 97-11-53, the statute that sets forth the crime (the one that is referenced in the indictment and plea package) provides the following definitions:

As used in this section the following words shall have the following meaning:
(1) Person: individual, firm, corporation, association, partnership or other legal entity.
(2) Public official:
(a) Any elected official of the State of Mississippi or of any political subdivision thereof, or
(b) Any officer, director, commissioner, supervisor, chief, head, agent or employee of:
(i) The State of Mississippi,
(ii) Any agency of the State of Mississippi,
(iii) Any political subdivision of the State of Mississippi,
(iv) Any body politic of the State of Mississippi, or
(v) Any entity created by or under the laws of the State of Mississippi or by executive order of the Governor of the State of Mississippi and which expends public funds.

Sorry you google law license didn't pick that up

I don't see any culpability for Brett Farve. He was seeking funds for volleyball court ($5 m) and the concussion remedy ($2 m +) and the 3 one-minute commercial ads for Nancy/FFM ($1.1 m).

Brett didn't care where the money came from and had no legal duty to inquire. Phil told Brett who to see regarding funds for the good doctor from Florida. Brett and Nancy already had a relationship from the USM athletic board.

10:09 is correct. No way indictments are forthcoming. As we have seen from the reporting the gov had direct communication on this fraudulent spending, and was involved in directing who got what money.. I’m not saying the gov did anything wrong the court will decide. But he was so close and involved he will face charges.

Ok! Sounds like the Feds have their act together!!! They got the Nancy and Zach in first to plea. Also, how many times has the DA gone back to the grand jury for more charges? I know the justice system works slow, but usually the Feds are pretty damn good. Just wonder what the Feds have coming in the future on this case? Wish I could predict the future, but will be sitting back eating my popcorn waiting!!!!

Guess Shad was not just sitting around waiting on Hinds Co. Guess he has things working with the Feds also!!! Smart move, Shad!!!

11:13. I agree. Seems that Phil and Shad tried to burn the News and Davis early on, hoping they would quickly fry and this would just go away (see Lamar Adams). This began with Phil's "whistleblowing", firing Davis, state indictments w/o federal involvement and such. Fed investigation quietly followed, the process seem to slow to a crawl, while actually moving (relatively) quite fast, for a federal investigation of PUBLIC OFFICIALS, some of which are elected. I have a knot in my stomach for both of them as this will be one of those things that just won't go away until they most likely do.

I’m not 11:13, but it seems pretty damn clear from all of the reporting that Shad knew or should have known (assuming he conducted a thorough investigation) that Phil Bryant was heavily involved in this ordeal. If Anna Wolfe has Phil’s texts and email, Shad’s staff should have them. He’s owned this case from the get go…..can’t pick and choose what parts of it you want credit for. This looks real bad for Shad.

6:41- obviously you have a very short bus dictionary. Yes, John Davis was a "public official". Not saying there might be other 'public officials' involved, and not limited to just one person that might have had an office in the Sillers Building.

But - Davis was definitely a public official, his salary was paid from public funds.

6:17 What did Marcus do illegally? He agreed to make speeches and appearances; wasn't his responsibility to know where the funds came from and what the requirements for their expenditure covered. That failure was on Nancy and John - not Marcus. Bret could have argued the same thing about his $1M speaking fees, if not for the volleyball building, the drug company stock, etc. etc.

Was Marcus's deal crap? Hell yes. But that crap falls at the feet of the people that approved spending the money for his participation, not for him taking it.

How many "STATE" agencies are under investigation by the feds, and you cite your firm being hired by the "VA Inspector General"? Maybe the IG needs to look into its decision to hire your firm, since you obviously don't understand that the VA is a FEDERAL agency, not a STATE agency.

7:46, Davis was an appointed employee. He was a person "holding a public office". You can make this argument hoping against all hope that the plea means something else (which it may very well do) ------- but Davis was a public official, by any definition of the term.

Any state employee is a public official. They take the same oath of office, just as federal employees do. Or any of the clerks that Shad has nailed for taking bribes or committing graft. They too are public officials.

Respectfully disagree KF……it looks like the News are cooperating with the Feds on what should be forthcoming indictments on others. Plus, I bet they go public at some point and expose and tell all. There are lots of “those known and unknown” to be exposed. I still don’t think they were calling the shots…..I’d like to know who was (I think we all already know).

What I said doesn't include cooperating with law enforcement. I assume they are. However, now that it isn't going to trial, there is no guarantee we will hear what we would have heard at a trial, especially if any other targets plead guilty

The Feds don’t make deals just to make deals. It appears to me that they have received evidence worthy of working a deal with Nancy and Zach. They’re not offering that deal and not going after other bigger fish….and John Davis isn’t a bigger fish. In other words, Phil is phucked (or at he least should be).

And the State case is garbage…..look at how everything is worded. Nancy moved money from A to B apparently at the direction of John Davis “and others”. What happened to the $96m she allegedly stole, Shad? Jody Owens doesn’t have the stones to go after the others, but I bet the Feds too.

Allow a plea. Seems to me it was a close and shut case. And John Davis is as guilty as they come. So why? What else? Who else? To allow for a plea. They have to have more to give up other than Davis???

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
