Danks keeps Kelly's bail at $100,000. Police want to speak to "other individuals".

Madison Municipal Court Judge Dale Danks kept bond at $100,000 for Clayton Kelly at his initial appearance today. Attorney Kevin Camp represented Mr. Kelly. Madison Police charged him with the exploitation of a vulnerable adult.  Mr. Kelly stands accused of entering Rose Cochran's room at St. Catherine's Village and taking photos of Mrs. Cochran that were later published in a Youtube video critical of Senator Thad Cochran.  Mrs. Cochran is the wife of Senator Thad Cochran.  The video of the entire hearing is posted below. 





Mrs. Cochran suffers from advanced stages of dementia and has resided at St. Catherine's Village since 2000.  The video was removed from Youtube after a few hours.  Mr. Kelly publishes a blog, Constitutional Clayton. He has posted several anti-Thad Cochran messages on his Facebook page and has a Youtube channel with the same name as the blog.

Madison Police Investigator Vickie Curry (10:00) said MPD received information on May 15 of a possible case of exploitation of a vulnerable adult. She said they conducted an investigation and "determined  that Clayton Kelly gained entrance to the grounds of St. Catherine's Village where he also gained entrance to the room of one of their patients there and took photographs of her."  Mr. Kelly shook his head sideways as she spoke. She said "after that happened at some point, Mr. Kelly made a video blog for his video on Youtube." Investigator Curry said the video was online long enough for others to record copies of it and that was how MPD learned of the video.  Curry said the investigation is "ongoing and there are other individuals we wish to speak to."

Madison Police arrested Mr. Kelly Friday night after it investigated a tip.  Judge Danks set a preliminary hearing date for Thursday.  Mr. Kelly remains in custody at the Madison County Detention Center in Canton.  Mr. Kelly is 28-years old and a resident of Pearl.  Judge Danks kept bond at $100,000 after Mr. Camp asked him to lower it to "$25,000 or $10,000."

Kingfish note: There is no evidence at this time linking this guy to any campaign.  If I have to make an educated guess, any such evidence will come out soon enough as the police probably have his cellphone and computer.   Asking if he indeed received assistance or provided assistance to a campaign is a valid question and the police are investigating to see if such is the case.  Translation: The police want to know if there is a conspiracy.  However, no evidence has been released at this time.

Crazy ass political stuff is Shawn " O'Hara's forte.
He sat at the defense table with Travis Buckley during the Sam Bowers trial, even after Buckley left the table to take a ten- minute telephone call;Judge Pigmeat McKenzie allowed Assistant DA Helfrich to continue without interruption of the trial.

O'Hara, the judge, prosecutors and the press witnessed Mike Moore go to the jury room door and lie down on the floor to peer in at the jurors--making eye contact with them- during deliberations.

O'Hara did not, however, attend the Judge's "hospitality & pork barbecue" throwdown party--hard liquor was serve,too-- conducted at the judge's home. Those attenting were Buckley, the prosecuting attorneys, East Coast reporters, and prosecution witnesses... including Big Jim Ingram and FBI agents. The editor of the Hattiesburg-American was at the party. Hood's brother at the Ethics Commission was sent down to whitewash the event weeks later. The omnipresent O'Hara sat with Jimmy Dukes and Precious martin at the H'burg mayorial trial back in August.

I know, 8:02, my point was that using the picture of "some old lady in a nursing home" is something of great value in this case given who her husband is, and that is why the state charged him accordingly under the vulnerable adults law.

I checked out Constitutional Clayton's website. The guy's well informed and well spoken on US foreign policy...not the average booze/buffet/ballgames Mississippi Bubba. I'd rather a Clayton Kelly whispering into my Senator's ears on US foreign policy and immigration laws, rather than a Lawrence Korb, an Alan Dershowitz or a Robert Kagan. And that's what we'll have if Cochran returns to Congress. Forget all that bitch-slapping between Cochran and McCain on the Senate floor...it's all theatrics for public consumption. Cochran will support John McCain's immigration bill and his bill creating a twenty-member war powers board, bypassing Congress. There is also an Al Sharpton video at the website on those "Greek homos."
That aside, I cannot explain Kelly's alleged conduct at the nursing home. So bizarre.

While this was a disgusting thing for someone to do to try and gain political points, it seems the bail set was pretty high. Any legal opinions as to why? If it is just because of who Thad Cochran is, that is not a good reason.

Contrats, Kingfish, on braking a national story. You did it right-- reported what you had-- but made it clear enough that anyone checking a detail or two would have seen what you meant. Within 20 mins of you reporting the arrest, I knew it must have involved Mrs. Cochran.

So, now we know that Thad Cochran continues to care well for a wife who has left him in all but body through the misfortune of health.

We know he has been discreet in seeking companionship and not flaunted out of respect for Rose.

This seems not just a desperate political strategy and a sleazy one, but one sure to backfire.

Were there any doubt this campaign is filled with people who are mean spirited zealots and the mentally unstable, all doubt is removed.

Interesting that Erick Erickson from RedState is making the claim on Twitter and on his site that the Madison Police department was somehow involved with the Cochran campaign because this was the PD's first press release of the year. Obviously he was basing this on their website. All he had to do was check JJ to see other press releases on other matters.

My question is why is Lisa Shoemaker Employee of Mississippi Cable Telecommunications Association editing for the Clarion Ledger writers? Also what is the exact date that this incident happened? The rumor is that this happened weeks ago and the Madison PD just received a report. Is Ms. Cochran in a dementia unit? If so how did Kelly gain access to the unit?

Interesting observation, 7:22. Are you suggesting that seeking discreet companionship is morally okay if your spouse is ill? I guess the vows should be modified to include "until death do us part or until you get too sick to understand what's happening." Further, if that's what happened are you saying that it was somehow out of respect to his wife? Thad was 62 in 2000 when his wife went into St. Catherine's. How long do you think he waited before discreetly seeking companionship? How is having your picture taken with your companion in obvious social situations - one usually doesn't wear evening dress to work meetings - not flaunting it?

This stinks. All of it. And if 7:22 is right then Clayton Kelly isn't the first person to take advantage of Rose Cochran.

How did you arrive at that conclusion, Anon? She's simply warehoused, like thousands of other Mississippi dementia patients, albeit in the most high-dollar of all possible facilities.

Word on the street has it that he never visits. So, again, where's the 'caring well' from the senator?

Thad has been bouncing around the planet with his social companion for two decades. The only way to have it at least appear (wink wink) professional is to keep her on payroll.

Now, back to McDaniel. He ain't got a damned thing to do with any of this.

12:48 - that is Cochran's address. He works in DC, so he lives in DC. While he works in DC, he has to have a place to live. He rents an apartment in that house.

Bill, the McDaniel campaign has said in its numerous explanations of the events this weekend that they 'are running' their campaign on the issues and made the absolute decision to keep 'personal issues' out of the campaign. This coming from the vary people that have been pushing a "Kay Webber" story to every news outlet, blogger, or social outlet for two weeks and have you and other supporters pushing the matter. Isn't there some disconnect there?

And to be running ads that "Cochran voted for abortion" and that "Cochran voted against veterans" - didn't you condemn the 527 group supporting Cochran for ads they ran that you felt were misleading or false? Have you made similar condemnations against your guy?

Bill the problem with your post is that it sounds alittle too self righteous. I am lucky to not understand what Thad and his family have gone through but I have a friend in the same situation. Yes you may be a saint who would be holding your wifes or significant others hand 24 hours a day but until you lived it you really cannot say. My friend did/does the same as Thad. His wife is and has been very sick but recently after many years started seeing another woman. I don't know if its disrespectfully but as with Thad his family was well aware and supports it. Its hard to be in their situation but its easy for people like you to throw stones. I really do not have a problem with it under the circumstances. I used to believe that things were black and white but as I live I realize that there is a whole lot of gray.

Watching the perp in slo-mo walking through the Madison courtroom....looked like a child. Mouthed "I love y'all", obviously to family members. Nervous, twitching, bedraggled, deer in the headlights look. While some are congratulating him for being a tech genius, he really looked like a dim bulb to me.

What's lost in all of this is why he is being held on $100,000 bond when the crime is a misdemeanor. If Dale thinks this kid is stupid and won't turn around and sue him after he gets out, he's dead wrong.

Considering that the max fine for exploitation is $5,000 and this offense is relatively minor, I would call $100,000 bail practicularly excessive and meant to inflict emotional stress upon him and his family. I'm sure Dale will try to throw him in the slammer for 365 and the sentence will be shot down on appeal. It's rather obvious that the Cochran Campaign held onto this until just the right moment to have the maximum affect and damage to McDaniel's Campaign. Which begs the question, which does Thad care about more, His wife or being reelected. Reporters need to do their damn jobs and never stop asking tough questions. Some of the reporting that I have seen on this has been all pro Cochran, anti McDaniel and no one has stopped to ask the other campaign why they waited 3 weeks to file charges.

@9:15 Judge Danks can set the bond at any amount he wishes without any possibility of civil liability due to absolute judicial immunity. Mr. Kelly's bond may be subject to a reduction by filing a petition for habeas corpus in a higher court. Otherwise the only mechanism for holding a judge accountable for regularly setting unconstitutional bonds is the Judicial Performance Commission.
