The Backdoor: Part Deux

Did Anna Wolfe's star source in the Back Channel series violate a gag order to leak information to the reporter?  Tis a question that must be asked after former Governor Phil Bryant's team obtained phone logs between paralegal Darra Woolman and the Mississippi Today reporter showing the two women spoke on the phone over 700 times.  Woolman worked as a paralegal for the attorney representing former MDHS Director John Davis. 

Wolfe's publication of the text message of Brant, Brett Favre, and Jake VanLandingham in 2022 stunned Mississippi.  The revelations became the foundation for Mississippi Today's Pulitzer-Prize-winning Back Channel series. 

The former Governor sued Mississippi Today, Editor Adam Ganacheau, Publisher Mary White, and reporter Anna Wolfe for defamation on July 26, 2023 for Wolfe's reporting and comments made in podcasts, online, and in public forums.  Earlier post with thorough coverage of lawsuit.

Madison County Circuit Court Judge Brad Mills threw out the lawsuit after the defendants filed a motion to dismiss.  However, the Mississippi Supreme Court reinstated the lawsuit in April.  A rejuvenated Phil Bryant became much more aggressive in discovery.  



Bryant's team obtained phone logs between Woolman and Wolfe in discovery after the lawsuit was reinstated. The logs show calls between the two began on February 19, 2021, two weeks after Hinds County Circuit Judge Adrienne Wooten issued a blanket gag order oh the case: 


Wolfe and Woolman spoke on the phone no less than 342 times between the first gag order and a second one issued on January 14, 2022. Undeterred by the order, Woolman and Wolfe (Sounds like a band or a law firm) spoke for 21 minutes that afternoon even though the order still barred attorneys and their staff from discussing the case with the media.  Indeed, Wolfe herself reported on the gag orders in a February 4, 20222  and in earlier stories so there is no question she was aware of it. However, the order didn't stop Woolman from transferring copies of the text messages obtained in discovery by Mr. Coxwell to Wolfe, thus violating John Davis's attorney-client privilege.   

The phone calls began to taper off after the Bryants filed their lawsuit on July 26, 2023 although  Woolman and Wolfe spoke on the phone July 27 (15 minutes) and July 28 (22 minutes).

The phone calls curiously stopped on September 16, 2023 - the day after this website reported the former Governor subpoenaed Wolfe's communications with Jacob Black, attorney Brad Pigott, and attorney Gary Bufkin. Earlier post. 



An analysis of the call logs (thanks to the magic of AI) now in the court filing shows that all five of The Backchannel series that won Mississippi Today a Pulitzer had a very high and curious correlation with communications with Woolman.

Kingfish note: The implications of these logs are serious.  Was a court order violated? Mississippi Today will no doubt argue it is protected by the First Amendment. However, Bryant's attorney is no fool and is no doubt going somewhere with this new line of attack. If the reporter knowingly ran with information that violated attorney-client privilege, can that be used against her in a defamation suit? Stay tuned.

Just hypothesizing but I suspect the reporter was allowed to receive calls from the paralegal. Perhaps the reporter could be deemed as facilitating a violation, but I think not. First Amendment, you know.
I hope the reporter skates on this one.

Seems to me that a Gov's text messages would be considered public records and, as such, accessible by the public. Seems to me a smart Gov would understand that fact when composing text messages and avoid any that might prove embarrassing if brought to the public's attention.

IDGAF about Phil or Brett one way or the other, but Wolfe and company have a real problem on their hands. There's no way that everyone in the building (white, ganuche and probably even mama barksdale) didn't know that what they were getting was stolen data from an active criminal case. And this clearly was not a one time thing.

Why wouldn't such esteemed journalists as Anna Wolfe & Adam Gancheau just request Bryant's cell phone records via Public Records Request instead of risking at a minimum the appearance of breaching attorney/client privilege? Lazy?

If it can be proven that the reporter had a prior relationship with the person giving them the information, then the reporter could be in hot water, too. That makes it much easier to prove the reporter knew she was getting information illegally, or from a person who violated certain laws to give it to her. It's a safe bet the motivations of both were the same - both just wanted to get Phil Bryant. And you may or may not like Phil Bryant, but next time it may be someone close to you. They need to nail this down.

Davis might, but where does Phil have any attorney client privilege in this case. At the time, Phil was not involved - thanks of course to his former campaign manager getting this out in public the day before Phil took the stock in Vanlandingham's company, but I digress. Davis might have a privilege issue here but the Guv was nothing but sitting on the sidelines in this case until after Wolfe's articles hit the fan.

I'm not a fan, but to be clear Anna Wolfe isn't/wasn't bound by the Suppression Order. It only extended to the attorneys, parties, and witnesses in THAT case (and law enforcement officers and court personnel). I'm not sure. The paralegal may have been bound by and violated the Order, but not the reporter.

What is the connection between Anna Wolfe's sources and Bryant's defamation claim? I see no connection here.

The statements wete either defamatory or not. If anything, the texts support a non malicious intent for the allegedly defamatory statements. This is an abuse of the discovery process for retribution, it seems.

When will justice come for poor poor Phil. Something must be done about these reporters. What gives them to the right to report on corruption of public funds? What gives them the right to drag these poor old Mississippi boys through the mud. That money were for a good "cause" you see. 'Cause they wanted it. If Anna wants a story she should look at the special favors Dept of Mental Health is issuing to their friends and family. Funding going to certain non profits, employees of whom are married to senior execs in the department. Investigations are about to be underway so stand by. The level of dishonesty and misuse is disturbing at best. This agency seems to be adept at doing photo ops with politicians and celebs or concert appearances-or better yet in some cases getting severely inebriated at "professional" conferences! The legislature should take a harder look under the tent at this quagmire before it bites the whole state in the derriere!

Seems all of Bryant's friends and family are out to get Wolfe, personally and hatefully. Odd that a competent and effective reporter would be so skewered and stoned. She not only did her job but did this state a favor by exposing the puppeteer.

Fact: Bryant, Favre and DiBiase boys are all guilty of taking money from the poor and using for their own personal satisfaction. The TANF money was never intended for that purpose and their REAL texts exposed their guilt. The one that plead guilty will get a slap on his wrist and the rest will be celebrated.
PREDICTION: Bryant, Favre and DiBiase boys will never pay for the true nature of their crimes. Instead the punishment will be paid by the paralegal and reporter that could not take the corruption anymore. Was the paralegal wrong for what he did? Yes but you have to thank him for showing us the light. Sorta like Luigi Mangione? United Healthcare would have never gotten the attention for change to occur.

Maybe I'm missing something, but it seems a bit of a stretch that texts between Bryant, Farve, etc., which Coxwell obtained in discovery (with Davis as the client) and were allegedly transmitted to Wolfe (or anyone else) by his staff have anything to do with "attorney-client privilege" in litigation in which the owner of the privilege (Davis) isn't a party. Plus, Davis can waive it and if he discussed it with others, Bryant or anyone else, he likely did waive it. I've just glanced at all this nonsense, but for whatever reason the privilege thing caught my attention.

As a secondary consideration, if Bryant's texts are "public record," it would make the privilege argument a bit difficult even if the texts were provided by Bryant to his own attorney and then given to Wolfe, et al, rather than obtained by Coxwell representing Davis and given to someone.

An important point buried in this. Truth is a complete defense and and a public figure cannot be "defamed" with factual information. Wolfe could acknowledge (or Bryant could convince a jury) she held deep, long-standing animosity, malice, and even burning hatred toward Bryant when she gleefully reported a verifiable fact that caused him grief, and it would not be "defamation." For example, you could not "defame" Lumumba or Owens by publishing the fact that they pleaded guilty to a crime no matter what your feelings about them might be.

Conversely, if she knew it was false, that's the end of the inquiry. She could convince a jury that she had warm and cordial personal feelings about Bryant, but the knowledge of falsehood is all that matters.

The case against Dibiase was weak. What criminal law did Brett Favre break? You might get an indictment for conspiracy but then do you have enough for conviction. The texts look pretty bad but what law was broken? The volleyball stuff was all approved by the state. Three agencies actually : IHL, DHS, and AG. What remains is that contract for speaking. Bad contract and he didn't perform all the work. Is that criminal though? Is there some evidence he and Nancy cooked up that contract to defraud DHS? Texts? Emails? Recordings?

What's the crime in Favre helping USM gain an athletic facility? Didn't both the governor and the A.G. agree with it? And didn't the black school president raise the first silver shovel of dirt? How is any of that a crime of personal enrichment to begin with?

Maybe Ole Phil never fired a shot, but in every instance, he drove the getaway car.

You conveniently left out the part where he paid the money back. He was initially told by his agent he could make the appearances or was not required to. When challenged, he ponied up. The interest was never settled in a court of law. But to answer your last four ????. No. If there were, you don't think they would have surfaced? Your speculative imagination is marginal.
