Supplemental response filed in Robbie Bell lawsuit

Elizabeth Hall filed a supplemental response to Robbie Bell's motion to dismiss the lawsuit Hall filed against her earlier this year. Ms. Hall filed her lawsuit in July, then Bell filed a motion to dismiss on September 11, the second anniversary of Heather Spencer's murder. Both sides then filed various responses and Judge Yerger held a hearing on the motion to dismiss on November 30. Earlier Post on hearing, Copy of response

Judge Yerger ruled he was converting the motion to dismiss to a motion for summary judgement and gave each party ten more days to submit additional information to the Court. Hall filed her supplemental response on December 11, 2009. The plaintiff argues there are "genuine issues of fact" that need to be decided by a jury, "no discovery has been conducted in this case", and that at a minimum, the Court should grant a "continuance on this matter until discovery has been completed and depositions conducted."

The plaintiff also claims Bell can be held "civilly liable" for violating criminal statutes and that under Mississippi Code section 97-37-13 someone can not "sell, give, or lend" to anyone intoxicated. Ms. Bell has not shown the guns were not hers and the police reports published on this website state they were her guns. Neither side has produced the paperwork on file with ATF that would show ownership. The question that also should be asked is where was George staying when he was released from rehab. If it was at Ms. Bell's home, one would think she had a duty to secure all firearms from a known druggie that was the subject of an active arrest warrant for a violent crime. The plaintiff hints at this by arguing Ms. Bell is liable under the doctrine of negligent entrustment. Hall also asks for an additional five days to address any issues raised by the defendant in any supplemental response she files.

It has also been learned by JJ that Robbie Bell filed a twenty-page memo in support of her Rebuttal to Hall's Response to the Motion to Dismiss. The memo does not appear on the docket but it was filed with Judge Yerger. It is standard practice for such memos not to appear in court filings. JJ requested a copy of the memo. The request was denied because Mr. Burwell, Bell's lawyer, objected to this site having a copy of the memo.

Seems to me all Judge Yeager has to do is read the police reports. Baby Bell left Momma Bell alone in the house with the dead body of a girl she knew he'd killed to go kidnap someone else. Judge Bell can't see that Momma has some 'splaining' to do?

If her memo supports the actions of an innocent and faultless woman, she and her atty shouldn't have such a problem with someone's request for a copy. Hmmmm?

Don't you just know that memo is one special serving of bs with extra sauce (and a side of self-pity), whipped up special for Judge Yerger? GAK so disgusting.

Robbie had a welcome home party for her son prior to the murder of Heather.

George was a FUGITIVE that was NOT arrested for the first assault on Heather. Robbie was obviously well aware of this fact. Shouldn't that be a real good enough to continue this civil case?

Isn't it illegal to harbor someone wanted by authorities?

The Bench Warrant, JPD Incident Report and JPD Narratives specifically lists George's address 4652 Trawick Drive. Robbie's home/murder scene.

This is of significant relevance.

Read the reports. Apparently he moved in with Robbie after leaving rehab. Keep in mind, there was an ACTIVE warrant against George the first beating.

Did Judge Bell act in the capacity of George's attorney, while being a witness?

Look at the time line based on the police reports, witness statements and answers to the civil lawsuits:

1. In the Francomb lawsuit, Robbie's defense team stated she arrived home the evening of 09/10/07 to discover her son had killed Heather

2. Elizabeth was awakened and kidnapped around 7:00 am on 09/11

3. Judge Bell stated Robbie called him (not the police) "At 10: 00 or 10:30 am on September 11, my sister in law Robbie Bell called me and asked me to
come to her house urgently" He later left the scene with Elizabeth (after almost 3 hours of captivity)

4. Judge Bell stated: "Then I received a phone call from Robbie and she told me that she and George had left the house because George thought I would contact the police".

SO, WHAT took place between 7 and 10 on 09/11? What happened between the evening of 09/10 and the morning before the kidnapping? Elizabeth was obviously held captive, then Judge Bell arrived and tried to convince George and Robbie to notify authorities. As the Judge stated, Robbie refused to leave her son. I believe the time of death was around 2 - 3 AM on 9/11. Robbie also had time to change clothes sometime between 7 and 11 AM. Did she ever give a statement to JPD? ed peters was her lawyer and delaughter (who will begin his 18 month sentence in less than a week) over saw the criminal case of Robbie!

There are simply too many reasons why this lawsuit should not be dismissed.

Too many arcane events... Makes you wonder why Mayor and Danks arrived shortly after the stand-off began...

I think the veracity of any statement made by Judge Bell has to be questioned.

JPD Sgt Wall reported that Judge James Bell (with Ms. Hall in vehicle) flagged him down at Ridgewood/Northside at 10:30 am.

Don't forget that Royals was at the BP standoff actively consulting Robbie. Who called him?

Royals' partner is Tommy Mayfield, Peters former asst. DA along with Bobby Delaughter and Cynthia Speetjens, all of whom were actively involved in this case in either as a legal representative of Bell or in a judicial capacity. Additionally, Peters was largely responsible for James Bell's county judgeship and in turn Judge Houston Patton succeeding Bell in that capacity.

Fish, how the hell is that memorandum of authorities not a public record?

I understand that in state court memos aren't filed in the court file, but are instead mailed directly to the judge. However, it still appears to be public record that would be subject to a public records request.

And I must say that an attorney objecting to publication of a memorandum of authorites authored by said attorney is quite bizarre.

So exactly WHAT TIME were the attorney's retained? Royals was at the stand off. How did the criminal case get steered to to felon delaughter way out in Raymond? Speetjens represented Robbie along with Ed Peters, how odd. She also filed to motion to return the guns back to Robbie. Elizabeth was held for over 3 hours with Heather's bloody body in the house and Robbie called a Judge/Attorney/relative??? Sickening.

I wish the US Attorney's office would look into this.

7:37 AM. Many smell the stench. It wouldn't surprise that Georgie's gun-to-the-head gas station act was orchestrated or, at the minimum, drawn out to buy time so that ducks behind the scenes could get lined up.

12:02 am... Let's not forget that Tommy Mayfields wife, Clara who worked for Peters for 20 +/- years, works for the current DA, Robert Smith, whos election was orchestrated by Mr. Peters hisownself (sic). All the while Ms. Speetjens, et al, have had pretty much free access to the DA's office.

Speetjens represented Delaughter initially in the federal prosecution in the Northern District of Mississippi. Speetjen's law partner, Cynthia Stewart, reprented Peters in the same matter. All that was goimg on during the State v. Bell criminal case.

9:33 PM you are totally right. BUT Speetjens got her ass served in federal court re: conflict of interest regarding future prisoner delaughter. Read the transcripts. She had no business in North Mississippi representing that corrupt crook.

Got to love the justice system in Hinds County.

I saw Robbie Bell getting off a plane on 12/28/2009- you would have thought MS. Astor had arrived and was awaiting her fans- NO CONSCIENCE!!! Living life to its fullest while Heathers family is still in mourning.

Is the "rehab" George attended still being sued? If so, in discovery, it is possible there are records, documents, payments to show Robbie was directly involved in the admission process. Of course, while an active warrant was present against her son. Who was paying for George's cell phone while he was "recovering"?

The police reports indicate his address was the same as Robbie after coming back from rehab. Creating greater liability...

Provided it is true, it is sickening that Robbie still lives in that house. How disgusting. Is she still working in advertising for the paper in Madison?

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.
