Mayor Recommends Garbage Contract

You WILL  get a 96-gallon garbage cart!!! 

The city of Jackson issued the following statement. 

In the interest of full transparency, we are releasing to the media the recommended bid for the city’s latest garbage collection RFP process. We understand this is unusual outside of the public records process, but we feel it is necessary due to the widespread interest and importance of this contract to our residents. This follows the release of this information earlier today to all council members. 


Please refer to the information and key points below: 

Two bidders: National Collection Systems, LLC. & Richard’s Disposal, Inc.

Evaluation committee recommendation: Richard’s Disposal, Inc.

Technical proposal – 15 percent

EBO Plan – 5 percent

Cost proposal – 80 percent

Contract summary 

  1. The Contract is for a term of six years, with four options of one-year each which can be exercised by the City. Section 2 
  1. Compensation under the contract is $891,000 per month, which includes the cost of purchasing and delivery of up to 45,000 carts to residents. Section 3.1
  1. Each year, the parties will meet to evaluate a monthly increase in compensation, which will be based on the Annual CPI for All Urban Consumers in the South Region. The increase shall not exceed 5%. Section 3.4 
  1. Customers can use the 96-gallon Cart provided by Richard’s, or any other Approved Container.Approved Containers shall be 35 gallons or less, nonabsorbpent, leakproof, and made of material such as molded plastic or metal. Section 4.1.
  1. Richard’s will replace one lost, stolen, or damaged cart at no cost to the City or customer.Richard’s will also repair damaged carts. Section 6.8 
  1. Richard’s will collect Residential Solid Waste, Yard Waste, and Bulk Waste. Section 5.1.  
  1. Regular service will be provided twice-weekly, Monday through SaturdaySection 5.2. 
  1. Richard’s will additionally pick up Bulk Waste once-weekly. Section 5.3.
  1. Richard’s will also pick up Yard Waste on the second regularly-scheduled collection day each week. Yard waste must either be in an Approved Container or yard bags. Yard bags are limited to ten in number and 60 pounds in weight. Tree limbs will be collected up to four inches in diameter and up to four feet in length, so long as they are bundled. Section 5.4 
  1. Richard’s will also assist with community cleanup and illegal dumping removal through quarterly pickups, providing collection bags and collecting bulk items along City roads, plus a Fall Cleanup Event, a Christmas Tree Recycling Campaign, and Spring Cleanup, and a Monthly Dumpster Day event. Section 5.6, 5.10
  1. Richard’s will additionally provide equipment and manpower to assist City employees and volunteers with cleaning up litter and dumping sites throughout the City. Section 5.6
  1. Richard’s will be required to maintain a local office, which will be open from 7 a.m. to 7 p.m., with office staff available during those hours. Section 4

Similar to past RFP processes, we will answer as many questions about the garbage collection process as possible. But we do ask residents and the media to refer to the recommended bid proposal as a firsthand source for your information.

If the Mayor truly wants to keep the cost to residents as low as possible as he claims, why the carts ? It would be much cheaper without the carts. The carts are going to cost the city and its residents another $83,000 a month or almost another $1,000,000 a year. What this guy is doing is so obvious, but yet he thinks we're fools and don't see it.

To the City Council, please, please do not accept this offer from Richards. Reject it, request another bid without carts, sign another 1 year emergency contract if you have to, but don't sign in effect a 10 year deal with Richards. If you have to pay the additional $525,000 EPA fine, so be it. This contract is going to scoo you another $1,000,000 a year.

“Contractor shall develop a public education and communication plan with oversight and input from
the City about the transition of services from twice weekly solid waste collection to once weekly
solid waste collection with a cart.”

Does this imply collection will switch to once weekly during the life of the contract?

You know, in Jackson our garbage pickup cost is on our water bill.
7,000 not paying water bill = 7,000 not paying garbage pickup either. Hmmm

Even the blind man knows the Mayor and his sister are running the garbage contract.

City Counsel---just saying, the legislature has been in session for 3 months now. You knew this was going to happen. At what point did it NOT occur to you to talk to legislators about getting wording changed so you wouldn't be in this shit hole...again. And please don't say no lobbyist.

Was this scheme shrewdly orchestrated by Lumumba, or is this a result of his taking advantage of evolving circumstances? In either case, the city council is between a rock and a hard place, and the citizens are screwed. How much will it cost to citizens per month? And if they cant pay their water bills how arey going to afford increased garbage fees? Is he going to advocate and have his organizations march for free/reduced water service but not free garbage pick up. If the city council votes against Richards, the city will again be without garbage service and subject to fines. Richards will again sue. No reputable company would submit a proposal under these circumstances. As to the submitted contract ... if people can still all use their own trash cans, why include the purchase of 96 gallon cans in the contract? Its a real MESS caused by an inept mayor.

I have my own 96 gallon cart, and don't need another. and I see this as only a way to keep a funnel of cash flowing towards a entity that probably does not even exist but on paper

Exactly. Most of the people on my street have 64 gallon Toters. That will wind up being $100 per cart wasted if he has his way. Toter makes a 32 gallon cart but I've yet to see one on the street. Sometimes a 48 gallon. They know exactly what they are doing. They can say oh, we give you choice, but then set the limits to something no one uses. You still have to take the 96 gallon cart.

Still goes back to my original question in another post, how can the Mayor negotiate a contract that requires us to "buy" something w/o a ordinance that was fully vetted and approved.....

My concern is that my council person is Virgi Lindsey, and well, she will probably vote in favor of a contract negotiated by this Mayor

I'm not all that competent with contract language. Does it require them to pick up the tons of garbage, old tires, couches, mattresses and thrown out furniture scattered from the Clinton city limits all the way to Highway 49, on Cynthia drive. How about the trash Richards scatters out the back of their trucks all the way up and down I-220? who picks that up. I apologize to the readers here for not videotaping the three incidents of this I have seen. Twice a full white kitchen sized trash bag, tumbling out the back of a truck because no one hit the switch to compress it back into the truck.

Unfortunately, whether or not he is re-elected hinges on who/if anybody credible or better will run against him. To find someone with a good business sense, good leadership skills,the ability to get along with and not alienate those in a position to help the city (not the mayor's agenda),and whose motivation is to serve, not be served, will be challenging. So citizens who wish him gone, may not have a choice. Yes, he won his last election, but with a small percentage of people voting. This time around however, many are disgusted with the state of the city and its impact on their quality of life. They just need a viable choice to offer positive change.

At least Jackson residents will be allowed to use alternate garbage cans if they wish. In rural Hinds County, we're stuck with the Waste Management-provided carts and must buy another one if we need it. They won't pick up anything not in their bins.

Interesting waste mgt just said forget it . Did not even submit a proposal. I think we will see more and more of this in the future. Soon, if not already companies will just avoid doing business with the city .

Can residents use their current non-96 gallon cart? Are residents required to use a 96 gallon cart (there was reference to smaller carts).

Please explain.

Let’s put this down where the cows can reach it. The Mayor of Jackson has the power to do whatever he wants with the garbage contract. The only way to end this insanity is at the ballot box. Does anyone care enough? It’s not as hard as most people think. A marginal increase in turnout would do it. Door to door canvassing only requires money but time is running out. He’s vulnerable but getting less so every day.

4:27 - Good catch. Section 5.2 specifies twice a week collection, but I couldn't find anywhere else except section 8 where the "normal" residential collection schedule frequency is enumerated. This is suspicious.

The total cost of 45,000 carts at $96 per cart equals $4,320,000. If this contract with carts is only $83,000 more per month than the existing contract without carts, how is Richard's going to afford 45,000 carts? Finance them? That would explain the fact that Richard's owns the carts for the first 6 years, then, if the city extends the contract, ownership changes to the city.

FYI, if Richard's could get a $4.32M loan at 6 years with 10% interest, payments would be about $80,000 per month.

Did I read correctly that once each week you can have 10 bags of yard trash…when the pine needles/leaves come down one can easily get ten bags…that is way too few also for spring cleanup…I hope this gets negotiated or there are going to be bags just along the curb.

I'm just guessing here but....The garbage company will use a specialized truck to pick up and dump the garbage cans it supplies to residents. There may only be one person on the truck, the driver remotely operating the lift arm to dump the contents. All waste must be in the can or it will be ignored.
Isn't it illegal for a contract between a private company and a municipality, state or elected official to sign a contract in excess of four years? Think College football coach's contracts.
I'm sure the mayor worded the bid to ensure that only Richard's bid would meet the criteria.

Someone asked why Waste Management didn’t submit a bid? My guess would be they don’t want to do business with the City. Most contractors I know avoid the City like a plague. They say it’s nearly impossible to do business with them, for starters. Also, folks need to be paid for their work in a timely fashion. With Lumumba at the helm, the City is notorious for not paying its bills. Lumumba’s excuse — software glitches. He’s so full of shit. In the past couple of years and pre-JXNWater, we’ve seen sewer pump trucks get repossessed for nonpayment of monthly leases; purchases of water treatment chemicals get overlooked or ignored; countless other invoices totaling tens of thousands of dollars get lost on someone’s desk or shoved away in a drawer. Incompetence and neglect are not software glitches.

Lumumba cannot or will not tend to the ABC’s of local government. He cannot work the most routine and rudimentary levers of city government. That’s pretty much the job description of a mayor in a nutshell.

I rolled my parents' 64 gal can to the street for them (they live in another city) and it was all I could do to handle that, and I'm a lot stronger and in better shape than they are. I cannot even imagine a 90+ gallon cart. It's going to be a nightmare.

The mayor claims to care most about cost and service to residents, yet it would be much cheaper to opt for a contract without the prescriptive cart requirements (having to either use the Richard's 96 gallon cart or a cart 35 gallons or less with a lid, etc. is essentially a requirement to use Richard's cart).

Everyone on my street has either a 64 gallon trash can or uses smaller trash cans (without lids) for limbs and yard debris. Does the mayor plan to roll out a recycling program for all of our now useless >35 gallon trash cans? If he truly cared about cost first and foremost, he would not have made carts a requirement in the RFP. No fully informed resident wants them, despite what he claims. Unless he's referring to his sister and her minions.

Didn't the RFP have some ridiculous requirement that all vehicles be less than 2 years old, or something to that effect? That and the other overly prescriptive parameters are likely what resulted in only 2 proposals... that and the fact that any reputable company could likely tell that that this RFP was rigged for Richards from the beginning. Why waste the time and resources on responding to an RFP like that?

I saw the article on WLBT today about this. There was a shot of Richards Disposal employees picking trash up off the ground. Calling total bullshit. There are times when they spill garbage and leave it there. They do a shit job and their guys have a shit attitude. I picked up Gatorades during one of the 100 plus degree days last summer to show support and I thought one of the guys was going to punch me out. I believe his words were "I don't give a fuck about no Gatorade". This company sucks just as bad as Lumumba does.

The people of Jackson are not worried about the trash. A drive down the streets of Jackson will show you there is trash scattered all over the city. They chose that way to live. If they want to let the mayor pocket all of the money the city has it is their own choice. Let them live in it.

Use of the carts are not required, yet they're included in the cost of the contract and subsequent increased costs to residents (who Lumumba claims to care so much about)? It makes no common sense,consequently it must be economic sense for some connected vendor. Is awarding the contract contingent on Richards dropping its current lawsuit? If not, David Archie's comment makes him the smarter person the room ... He's right. Who hires someone who is suing you?

After a four hour city council meeting the proposed contract was amended to remove the 45,000 96-gallon carts.

Chowke opposed that amendment.

Gee, I wonder why? Less grease?

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
