EPA Bayonets the Jackson Wounded

The old adage about auditors bayoneting the wounding remains true at JXN Water.  WLBT reported: 

A federal judge is voicing frustration over a change in EPA policy that could slow down how quickly contractors working to restore Jackson’s beleaguered water system can get paid.

At a status conference on Monday, U.S. District Judge Henry Wingate said he is considering handing down a notice to inform contractors working on behalf of JXN Water that it could take longer to be reimbursed for work after the EPA gave notice that it would no longer provide up-front money for infrastructure repairs.

“We apparently had some bureaucrats in D.C. do something else without any real explanation as to why they’re doing it,” he said. “We have made a lot of progress here. We’re just trying to keep that progress going, and we can’t keep it going if we don’t pay the vendors.”....

On Monday, he told the judge he has about $10 million in outstanding invoices, with just $2 million in cash on hand.

“It may not sound like much, but I have to review the invoice, forward the invoice to the EPA... If they have a question, I have to [research] it, and I have to pester them week after week on when I will see money to pay my contractors,” he said. “We’re going broke with $450 million in the bank.”

At the heart of the matter is how quickly Henifin can access $115 million in federal emergency grant funds awarded to Jackson under the Safe Drinking Water Act....

A compliance assistance team visited in November to find out why so much had been spent. At the time, the agency was concerned that Henifin could not tie every drawdown to a specific invoice.  ....

Following the February hearing, Henifin and Wingate thought the matter had been resolved, with EPA depositing $10 million in the account to allow Henifin to pay current bills.

However, on March 15, the EPA Office of Grants and Debarment notified Henifin that the agency was switching to a reimbursement program, effective immediately.

“I was out of money the first week of March. Now, there are $10 million in outstanding invoices in the Office of Water, and they’re asking questions. If they decide to dispute the invoices or not pay, I have no reserves to pay,” he said. “I put contractors in the field, told them to do the work, and have nothing to pay them.”... Rest of article.

There is a smaller lot for sale in NE Jackson for $325,000 in meadowbrook highlands. Of course the minimum HOA requirement would mean you’d still have to spend about 800-900k on the construction of the home.

That bureaucrat wouldn't by any chance be named Kristin Clarke, would it?

It's very difficult for me to believe the EPA is really concerned about misspent funds, when the whole operation is overseen by a long-time federal judge, who has been very hands-on.

Now perhaps the media can see first hand all of the malarkey Lumumba blew up about this being only about racism was a way to deflect of how neglectful he was with allowing water and sewer services to reach his state. This is not about racism & never has been. Let EPA get paid in the same manner they want to dictate to the workers fixing Lumumba’s failings. Let each EPA person involved do their jobs without pay while someone else checks their punch list & after questions are asked & further reviewed get paid 30, 60 or 90 days later. This is the way they want soldiers treated after fighting our battles while living in deplorable conditions and filth on OUR bases. Yes the taxpayers are paying the EPA and all of Congress to do Better. November can’t come soon enough and the Taxpayers in MS and throughout the US will b heard! One of the factors causing the water system collapse was the mayor's failure to ensure contractor invoices were paid. Years of slow pay or no pay resulted in competent contractors refusing to do any work for the city. They knew they wouldn't be paid timely, if ever.

EPA will achieve that same result for a far bigger price tag if they continue the current approach. Contractors are THE ONLY thing keeping the ball rolling now. Years of Chowkie's mismanagement culminated in all competent water department employees leaving and never being replaced, hence the reliance on contractors.

No competent employees + no competent contractors = no water.

USCOE, MDOT, FHWA, USDA, Etc. require payment to contractors before reimbursement. Why should EPA and this large amount of taxpayer money be different??? I thought this was a conservative small government website!

11:14: Those agencies you mention are not a bankrupt water system. They also aren't in a federal receivership due to a complete failure to provide a necessity of life for an entire capital city just 18 months ago, or for dumping millions of gallons of raw sewage every month into an interstate river.

In other words, this is an emergency situation that poses an immediate threat to lives and livelihoods. But you'd rather play clever games.

Let me say this. If I was a Contractor and knew I wasn’t going to get paid or have a delay in payments I would roll up the carpet and leave until payment is made. But, here is the issue. From the very beginning Henifin had authority to pay the contractors and was he and the contractors were making significant progress. This shows embarrassment, self centeredness and pettiness on the person or persons involved in collaborating this procedure with the EPA when the first arrangement was made for Ted to pay the contractors. We are 27 years into this issue of the former and current city leadership not taking care of the water and sewer system. When and if this massive undertaking gets finished, then and only then can you say jackson is the Bold New City. Until then, it’s just an another case of urban blight that has occurred time after time when socialist minded leaders take control when their main concern is giveaway programs and funding radicals issues. Case in point. Look at the JPS system. Schools have been shut down and if you want to see neglect, go inside one of the schools that are left to operate and compare it to the ones they are shutting down will see what I am talking about. You can’t just mop the floors and sweep a little here and there you physically have to take care of the physical aspect. No pride whatsoever. It’s sickening.

I think Henifin is doing a good job, so this is not a shot at him. But it's a sign of life in Jackson that people continue to sit around and plead for someone else to bail them out. I need my $450 million! I need Uncle Sugar to send me my free check!

You want oversight on how tax dollars are spent,right?

It seems to me, that finding the invoice should be an easy thing to correct...just call the person you paid for a copy if you've lost your own.

Ladies and gents we got ourselves a good ole fashioned “measuring” contest. Lumumba just 1-upped ole Ted.
He wants control over those contracts and is using connections at the EPA to do his dirty work.
This is gonna get good. I say hennifin gets frustrated at goes back to VA eventually.
He’s getting a good lesson in Mississippi politics.

After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online).
