The prosecution and defense are going to war in the Todd Mardis case as the October 30 trial approaches. Mardis asked Rankin County Circuit Judge Steve Ratcliff to throw out all videos and move his case to another jurisdiction due to pre-trial publicity. A Rankin County grand jury indicted Mardis for aggravated domestic violence last year.
Flowood police arrested Mardis for aggravated domestic violence on October 7, 2022 after he allegedly beat his wife. A Flowood detective testified at his preliminary hearing that Mrs. Mardis suffered a lacerated liver, fractured wrist, fractured cheekbone, fractured ankle, two broken ribs, strangulation marks, and widespread bruising. Video cameras allegedly showed him dragging an unconscious Kim Mardis by her hair across the driveway into the home. He did not take her to the hospital that night but instead flew to Tampa with another woman the next morning. He was arrested at the Jackson airport when he returned.
Rankin
County Court Judge David Morrow set his bond at $750,000 and issued a
no-contact order between Todd Mardis and his wife. Judge Morrow revoked the his bond in April after finding he violated the no-contact order. A Madison County deputy testified he saw the couple dining together at a Flora restaurant. Recorded phone calls at the Rankin County jail showed Mardis passing messages to his wife through their daughter.
Todd's attorney, John Collette, is known as a battlin' brawler and this case is no exception as he is determined to win or die trying. The attorney filed motions to suppress various videos as well as a motion to change venue on October 13.
Motions to suppress videos
A major piece of evidence in the case is the security camera at the Mardis home. Camera footage allegedly shows Mardis assaulting his wife. Mardis children J.T. and Morgan met a Flowood investigator at the Mardis Flowood home on the evening of October 6.
The investigator searched the premises as well as Todd's Dodge Ram truck in the driveway. He noticed the residence had security cameras and asked J.T. if there was a hard-drive with the camera footage. The son said there was but it was in his truck at the home of his uncle, Morgan Mardis. He followed J.T. to the home. J.T. gave the hard drive to the investigator upon demand even though he never produced a search warrant.
The police obtained a search warrant on October 7 to obtain the surveillance footage, obtain DNA evidence of blood inside the truck, and Todd's DNA. The motion argues the warrants did not "cure" the improper search, thus tainting the evidence while violating the defendant's 4th amendment rights. Mr. Collette argued:
Undersigned submits Investigator Messer was not "invited" into the residence as it is clear from the hospital video (on the evening of October 6, 2022) that Deputy Shivers tells the victim...... ''we have our investigator headed to your house" while the victim was on pain medication not totally aware of what was transpiring. Defendant's son and brother were told to meet Investigator Messer at Defendant's residence, but, never instructed by the owner to allow him inside to do an extensive search of same, and nor to turn over the surveillance tape, Investigator Messer demanded he be given the surveillance tape without a warrant on October 6, 2022 (the Defendant's son, J.T., is a fulltime student who resides in Starkville, MS, and did not possess common authority nor control over the residence or the items therein).
The Defendant submits this was an illegal search and seizure of defendant's residence, truck and surveillance tape. No "voluntary'' relinquishment occurred. The ''tape" was turned over at the request and demand of Investigator Messer on the evening of October 6, 2022 at Morgan Mardis' residence, the day before a search warrant was applied for and received.
The defendant also asked the Court to suppress a video of an interview of Kim Mardis at UMMC on October 6.
Flowood police officer Brennan met Rankin County Deputy Wes Shivers and Todd's daughter, Logan Mardis Crain, at UMMC on the evening of October 6 at Kim's hospital room. The motion claims the victim "told them she had just received a shot for pain." The group helped her with her memory as the shot impacted her recollection. Mr. Collette argues the video should be suppressed since there is "inadmissable hearsay throughout the video."
The motion includes Mrs. Mardis' account of the alleged assault. She said she placed her foot on the guy sitting next to her at the dinner table, angering her husband.* After berating her, Todd allegedly punched her over and over, squeezed her neck, and "drug me around by my hair." She eventually went to bed but found the next morning she was unable to move around and had severe pain in her abdomen. There was blood on her sheets and pillow. She could not stand on her right foot. Her daughter took her to St. Dominic but the hospital transferred her to UMMC.
Investigators interviewed Mrs. Mardis and her daughter, Logan, on October 14. Only an audio recording of the interview exists. The motion to suppress urges the Court to quash the recording since it "contains inadmissable hearsay and opinions (by the investigator) that taint the answers.
The District Attorney's office said two can play at this game as it promptly filed responses five days later that provide more information about what took place the week of October 4.
The state's response states the Mardis's met Thomas and Michele Harris at McClain's Lodge for dinner on October 4. An angry Todd left the restaurant, with his wife in tow. He kicked open the door to his truck. He attacked the victim while driving home. The assault continued in the driveway as stated earlier in this post.
Mrs. Mardis called Logan at 1:00 AM the next morning. The victim awoke, barely able to move her broken body. As she suffered in her bed, Todd flew to Tampa with Amanda Fontenot on a private jet. Logan texted her father "She looks awful dad. I know whatever happened was her fault but holy shit dad." Logan and her husband took her mother to the hospital. Mrs. Mardis told medical staff she was injured in an ATV accident. However, Logan told UMMC staff her father assaulted her mother.
The response states the children were concerned the defendant might come home early and destroy the video footage of the assault. The response states:
The victim asked her son Jackson Todd "JT" Mardis ³ (hereinafter "JT"), the adult son of both the Defendant and the victim, to pull the surveillance camera from their family home [Ofr. Brennan's body cam video at 8:24]. Thomas Harris offered to walk JT through the DVR disconnection as Harris' surveillance system was similar. The DVR was in a common area of the home. At 2:59 PM, JT contacted Thomas Harris for assistance in disconnecting the surveillance system. This is documented by a FaceTime history between Harris and JT dated October 6, 2022, time 2:59 p.m. The Mardis surveillance system video also showed JT approaching the front door of his home and the surveillance video is disconnected approximately 3 minutes later. [Surveillance video, channel 3 around 3 p.m.]. JT removes the DVR and takes it to his uncle Morgan Mardis's house for safekeeping.Kim told Officer Brennan at the hospital that evening a camera would show "some of it (the assault)." The statement is recorded on his bodycam. The response states J.T. was an "adult occupant" of the home:
Lt. Messer meets JT and Morgan Mardis at the victim's home. JT, an adult occupant of the home, and Morgan Mardis showed Lt. Messer around the home pointing out pine straw, blood, and the location of the surveillance cameras. JT told the officer that he had pulled the DVR earlier and took it to his uncle's home. JT showed Lt. Messer where the DVR had been located in a common area near the front door of the house. JT also asked if any other cables were necessary. At approximatelyl0:25 p.m., Lt. Messer traveled to Morgan Mardis' home in Indian Creek Subdivision. JT retrieved the DVR and power cord and handed it to Lt. Messer.Logan sent Flowood police her father's flight information and tracked his flight for them. She later gave the police the username and password to the DVR.
Assistant District Attorney Mary Jane Lemon argued the search was consensual since Kim Mardis asked her son to remove the DVR from the home and then gave it to law enforcement, which he did. She discussed "the logistics of obtaining" the video with the police and said they would need to use her phone to download the video. Her daughter provided the password to the DVR, using the pronoun "we."
Even without Kim's consent, J.T. possessed "common authority, mutual use, and joint control" over the home. If he lacked the authority, the search would still be valid since the police officer reasonably believed J.T. had the authority to consent to the search.
The state says the video of the hospital interview should not be suppressed although it contains hearsay since it can be used to refresh the victim's memory or "impeach three witnesses."
Motion to Change Venue
Mardis asked the Court to transfer the proceedings to another jurisdiction, arguing he can not obtain a fair trial due to extensive publicity of the case. The motion cites nine "extremely biased" posts and 827 reader comments critical of the defendant on this website. WLBT and WJTV posted several articles on social media about the Mardis arrest.
The state said not so fast, my friend:
The Defendant is procedurally barred due to his failure to make a proper application for change of venue pursuant to Mississippi Code Ann.§ 99-15-35 and Rule 11.l(b) of Mississippi Rules of Criminal Procedure. Moreover, Miss R. Crim. P. Rule 11.l(c) requires that a motion for change of venue should be made at the earliest opportunity after learning of the cause for challenge. The Defendant filed his motion on October 13, 2023, yet the exhibits attached to the Motion refer to comments made in April 2023 and prior.
After responding to the barrage of motions, the Assistant District Attorney fired back with a motion of her own.
Motion in Limine
The motion asks the Court to bar any evidence or testimony that Todd Mardis "suffers from some sort of diminished capacity. The state does not recognize diminished capacity as a defense, thus any evidence of such is inadmissable.
Mardis still resides in the Rankin County detention center.
Kingfish note: Suppressing the videos would severely impact the state's case against the defendant. His wife testified at the bond revocation hearing that she sustained her injuries when he drove off the road while they were arguing. The near-accident slammed her into the dashboard. The medical evidence will probably contradict her testimony but it will have to carry the day for the conviction if the videos are suppressed.
Prediction: Judge says nope. Motions denied.

From everything I know about Todd, he is a jerk. I know folks who grew up with him in SoJack and they said he had absolutely no male friends. However, stating that a 50+ year old man who has never been charged with any previous crimes will eventually kill someone is just silly. So in his golden years, he's going to go on a killing spree? I had two clients who were, without informing me, suckered by Todd's phony tax-planning. Todd set up each with micro-captive insurance plans that we are still trying to unwind, as well as telling each they could take their entire office staff and spouses on multiple vacations a year and write everything off as "marketing." Try explaining to the IRS that an entire dental office and spouses needed to go to Destin for ten days for legitimate business purposes!
I know the AICPA doesn't really have teeth, but the vast majority of what Todd did would seem to fall under the Unauthorized Practice of Law. Any of you lawyers out there think the Bar should go after him? For that matter, I'm not sure how the Bar hasn't come after Dallas, Fontenot, and any of the other lawyers who helped him with his schemes. I wouldn't want any lawyer that couldn't see that a roid head with zero relevant licenses or tax/legal experience (I read above he just had an insurance license??) shouldn't be doing anyone's "planning," much less with blatantly obvious tax fraud.

1. People REALLY don’t like this guy. It’s almost like he’s dedicated his life to being the least likable person in every room he enters.
2. This area must have a LOT of dumb people with too much money (guess the Timber scam shows this, too) for so many people to have trusted a bankrupt insurance agent known for getting into public brawls to handle tax & legal work for them.

To the poster above, surely CPS is no longer a going concern, Kim admitted in the testimony several months ago that her ownership was nothing more than a front. I assume all the lawyers who congregated around him have fled by now. He, himself, sits in jail.
Regardless of how his business turns out, Todd deserves hard time. What he did was attempted murder which he then amplified by leaving his wife for dead, trying to hide the video evidence, then fleeing the state with some chick. As a former client of John Collettes I can say he will get every penny he feels like he has earned. Yet he will fight for you. After all that is his job. Love him or hate him it’s what he does. Everyone is considered innocent until proven guilty. Kinda hard for most people to grasp.

Narcissism is a serious mental disorder with evil consequences to those around. Sometimes it takes years for a family member to understand the behavior. By now his immediate family should know. Mardis will have a hard time with a plea deal. He thinks that he did no wrong and is above any form of right and wrong. These type people live in a fantasy with reality. Don’t ever do business with one… they are evil, sneaky, and of the devil…but are in church every Sunday.

I’ve known Mardis from his South Jackson days, even before he was scholarshipped out to Prep. This is how he’s always been. A strange mixture of superiority and redneck thug. He was never particularly bright, but always acted like he was brilliant, even though everyone just thought he was just a dumb jock who couldn’t go a week without punching someone.
He reemerged in South Jackson after Delta State and seemed to just hang out all day at Smith’s/Candlestick Fitness, talking about all the women he got and what a badass he was. Was juiced to the gills, even then. Had no idea what he did for a living, if anything. Also didn’t know until this broke that he was apparently already married to Kim at the time. We all thought he was just a single lunkhead trolling bars for women every night.
Never dreamed he would be seen as an expert in anything, much less finances and taxes, but I guess a sucker is born every day and Mississippi has plenty of them.
I did have NO problem seeing him as someone who could be violent, because that’s who he’s always been. Guess we’ll see next week if he finally pays the price.

You have assumed that the word counsel is there for the word lawyer, not so, for the man credited with writing the Bill of Rights, wasn't a lawyer, himself. That man was James Madison.
Mr. Madison considered himself a student of the law, as were several of the men that framed the Constitution. At that time, the legal profession didn't have the constriction of the current bar. The current legal system would have been considered a kangaroo court in that time. Should I go on?
