Revoked!

Despite the pleas of his wife to set him free. Todd Mardis will remain in jail after Rankin County Court Judge David Morrow revoked his bond yesterday.  Mardis was arrested and indicted for aggravated domestic violence after allegedly brutally beating his wife in October 2022.  Judge Morrow ruled Mardis violated his order prohibiting any contact between the husband and wife.

 

Flowood police arrested Mardis for aggravated domestic violence on October 7, 2022 after he beat his wife.  A Flowood detective testified at his preliminary hearing that Mrs. Mardis suffered a lacerated liver, fractured wrist, fractured cheekbone, fractured ankle, two broken ribs,  strangulation (marks), and widespread bruising.  Video cameras allegedly showed him dragging an unconscious Kim Mardis by her hair across the driveway to the home. He did not take her to the hospital that night but instead flew to Tampa the next morning.  Her daughter took her to St. Dominic Hospital for treatment.  Flowood deputies arrested him at the Jackson airport when he returned.  

Rankin County Court Judge David Morrow set his bond at $750,000  and issued a no-contact order between Todd Mardis and his wife.  The bond and its conditions remained in place when he was indicted for the offense in December.

Madison County K-9 Deputy Connor Smith stated in an affidavit submitted on March 29: 

 On March 5, 2023, at approximately 7:00 PM I was dining at Bill's Creole and Steak Depot, located at 471 Railroad Avenue in the City of Flora, MS, when I observed a male, who I know to be Jason Todd Mardis, and a female who I believed to be his wife, Kimberly Mardis, also eating at the restaurant. I later viewed a photograph of Kimberly Mardis and can confirm she is, in fact, the female that was with Jason Todd Mardis on March 5, 2023, at Bill's.

Rankin County Assistant District Attorney Mary Jane Lemon filed a motion to revoke his bond last week.  Circuit Judge Steve Ratcliff approved the motion.  Deputies arrested Mardis on March 29.  

Judge Ratcliff could not attend the revocation hearing yesterday so Judge Morrow substituted for the Circuit Judge on the bench.   A shackled Mardis entered the courtroom clad in a yellow jumpsuit*, represented by attorney John Collette.  Attorney Andy Sumrall observed the proceedings for Todd but did not participate.   The Mardis children sat immediately behind their father through it all. 

The hearing opened with the testimony of Madison County Deputy Conner Smith. K-9 Deputy Smith is a ten-year law enforcement veteran.  He said he and his wife went to Bill's Steakhouse in Flora around 6:30 that evening.  He said he recognized Todd but said he "could not place" how he did. The deputy's friend told Smith he saw Todd and Kim eating together.  However, Smith did not know the couple was under a no-contact order and did not report the incident. 

Smith said he later ran into District Attorney Bubba Bramlett while conducting dog training at Liberty Park.  They discussed cases and John Collette's name eventually came up in the conversation.  He mentioned to the District Attorney he saw the Mardises dining together at Bill's.  He said the D.A. did not direct him to file a report.  Collette argued no one seemed to be upset about the contact for awhile. He said an investigator later contacted him about the incident.  

Smith left the stand as Rankin County Master Sergeant Jordan McCrary took his turn on the hot seat.  The Master Sergeant operates the jail call system that monitors all phone calls.  ADA Lemon produced a jump drive that was a collection of three jail phone calls between Mardis and his daughter on March 30 and March 31.  Collette heatedly objected to the introduction of the evidence as he argued he had no notice of the phone calls before the hearing.  Judge Morrow overruled the objection and allowed the recordings to be played in court.  ADA Lemon said the calls showed Mardis continued to have direct and indirect contact with his wife. 

Todd did not speak to his wife on any of the phone calls. He asked her to bring clothes to him at the jail as he was "freezing" and to deposit money into his commissary account.  He referred several times to Kim Mardis as "mom."  The daughter once asked him if he wanted to talk to her mother but he said "no."  However, he asked his daughter on one call to get "mom" to work on her speech "to get me out of here."  That sentence later to proved to be part of his undoing.  

Once the hearing of the phone calls concluded, a smiling and smartly dressed Kim Mardis took the stand (Her testimony is included in the video posted below but JJ turned the camera away from her during her testimony.).  She said the couple was married 33 years and had four children.  

Kim Mardis admitted she hired lawyers that asked Judge Morrow and the District Attorney to lift the order. She claimed she needed to speak to him about serious issues about one of their children as well as their business.  The requests were denied.  

Collette asked Kim if she was worried about her safety.  She confidently replied "No, I'm not scared of him.  I have no fear of him whatsoever."  She said he never suggested how she should testify.  Driving the point home, she said he did not intimidate her. The victim said she drove to Flora to meet him for dinner. 

She said the no-contact order caused numerous problems.  She needed help with family, financial matters, and tax returns. "He built a business I work at that I don't have a clue what he does.  Part of that is falling apart becaue we don't have the education or information we need to get that done.  That goes on forever and ever.  Then there's me.  I've been thrown into a world I cannot fathom.  I miss my husband immensely. I love him and he loves me.  We have one night that was a mistake.  I don't wish for him to be punished.  My anxiety level is huge.  I have panic attacks all the time.  I've probably lost 20 lbs.  I'm not eating.  I want him back, I'm not afraid of him," said Todd's wife. She later added he "calmed her down." 

Upon questioning by the veteran defense lawyer, Kim said she saw a counselor and went for treatment.  Collette asked if she thought her husband would hurt her. She responded " He would never touch me." The lawyer asked her what "triggered" the events of that violent evening.  

The couple went to have dinner at McClain's Lodge and ran into a couple with whom they are "good friends."  The two couples wound up dining together.  Kim Mardis tried to blame herself for what later took place: "It was me.  I was flirting.  A couple invited us to sit with them.  I flirted with the gentleman, I rubbed my foot on his ankle, Todd saw it. He told me how hurt he was about my actions.  He was angry." 

Collette asked her how she could "reassure the judge it won't happen again?"  She looked right at Judge Morrow and said "he would never hurt me.  I trust him.  We had one night and we royally messed up that night.  I was probably drunk when I got there."  The lawyer stopped her from continuing her answer as he turned her over to the prosecution for cross-examination. 

The prosecutor recited Kim's injuries to her.  She showed the victim several pictures of her injuries as she asked "do those pictures look like someone who knows how to be calmed down or left in good spirits by the other."  Kim replied "I don't remember much about that evening.  I didn't wear a seat belt.  We were arguing, he slammed on the brakes and hit a mailbox.  That is how my face received the injuries.:  She claimed her face hit his rear view mirror so hard it broke his rear-view mirror. She said she didn't remember how her ankle was fractured.  She admitted cancelling a meeting with a victim's rights coordinator.   However, her testimony included a rather sordid surprise (51:50).  She admitted under cross-examination her husband sent naked pictures of her to the other (unidentified) husband at the table.  She said under re-direct (55:20) That the unidentified husband sent naked pictures of his wife to Todd who in turn reciprocated the correspondence. 

Kim was asked why she needed her husband's help so much with the company when she was CFO and owned 95% of the company.  The victim replied she was not sure what her title was and continued to defend him "We don't want this.  We want to get out of jail right now.  This is the first time it happened."   She said she tried to talk the police out of taking a report but the officer told her it was out of his hands. 

Collette told the Court Mardis complied with all conditions.  He argued Kim was fragile.  Deputy Smith testified nothing happened at Bill's.   He asked Judge Morrow to modify the bond.  However, ADA Lemon pointed out the lawyer never filed a motion to modify the bond so "we are stuck with the (current) bond. The order is abundantly clear: no contact, directly or indirectly" as she asked the Court to revoke his bond. 

The prosecutor said the state made a ore tenus motion base on the jail calls that show he continues to have contact with her through their daughter on the jail call system.  She reminded the Court the defendant told his daughter to tell her to work on her speech for the hearing.

Judge David Morrow, the Rankin County Court Judge, pondered it all before he solemnly pronounced his decision.  The jurist said "It is a difficult situation."  The record of the preliminary hearing on October 11 clearly stated "there shall be no contact directly or indirectly" between the couple.  

He pontificated further "For this condition of bond to have any effect at all, the words have to mean things.  The jail calls were mostly innocuous but in one phone call, "have mom work on her speech to get me out."  The motion to revoke relies on a dinner the officer testified to and Mrs. Mardis confirmed.  I don't believe it's the only time it's happened.  The reason the no-contact order is provided is to there is severance of contact" between the parties.  

Judge Morrow continued: Words mean things and shall is one of those words.  Shall means you shall.  I think the evidence is clear there was direct contact.  The testimony of Mrs. Mardis probably indicated there were probably other instances of contact."  The judge concluded the sermon as she said the rules allowed him to "craft a remedy protecting the victim.  The phone calls cause me concern in  that in the time the phone calls were made, he had already been arrested for having contact with his wife."  The Court said he made three phone calls while in jail that were messages to "mom."  He asked his daughter in the  third phone call to work on her speech to get him out of jail.  "I don't know what set of conditions I can craft that keeps the parties apart" as he explained the decision to revoke the bond of Jason Todd Mardis.  

Concluding the hearing Judge Morrow said he did not know how else to keep Todd Mardis from contacting his wife.  He said he "can't afford to pick up the paper one day" and read about him killing his wife.  

Collette heatedly argued over the use of the phone calls as evidence but his efforts were to no avail.  A deputy took Mardis back to jail.  

The defendant is scheduled to go to trial in May.  The case is assigned to Circuit Judge Steve Ratcliff. 

* Yellow jumpsuits are reserved for violent suspects.

Collette should appeal the judge's decision. Only a kangaroo court in Rankin County would allow this evidence to be used.

This will be dismissed. "Despite the pleas of his wife to set him free." The DA has said to many, in the past, that without the testimony of the victim we won't prosecute cases of DV. Heard this myself from investigators when we have to drop cases.

I said it from the beginning. Let them have each other. Make her sign a doc waiving all intervention from police. There’s no need for an officer to get shot trying to save her.

Let them battle to the death. You cannot save all women. Especially the ones that don’t want to be helped.

It’s no different than forcing a drunk into rehab when they don’t want to get clean.
So long as they don’t get innocent people hurt, drop the charges and stop wasting tax dollars on this.

KF, the hearing would not have gone differently with notice as apparently husband and wife had been working on the story.

Don’t really see the basis for Collette’s objection (I know, he has to do it for his client and the record), but jailhouse calls have been fair game for decades. When you enter jail, you are on notice that anything you say can and will be used against you.

Very troubling and I don’t understand it but do think the children should be placed with grandparents or relatives together to protect them from all of this. The parents toxic relationship will negatively affect all the children and then in my opinion the parents can have the relationship they desire. He will not get prosecuted because she will not provide testimony to convict him and will argue that it was all a misunderstanding. It will be a waste of taxpayer money. He just needs to post money to cover funeral cost so the taxpayers won’t have to pay for that when it happens. Can’t save people who don’t want to be saved.

Don't know if it works like that in small time Rankin County Court. I doubt an ER doc is going to testify he/she can for sure tell how an injury happened (whether her face struck the dash/windshield/rear view or fist). Likely he'll be sentenced to counseling, probation and get time served, especially if his wife/kids testify on his behalf.

Let's cut them a little slack. They have been married for over 30 years and and we've all got into fights with our spouse. I've known them for a while through the lifestyle community and they are passionate people. This one night emotions got the best of them. I'm sure a lesson was learned. It's just a shame this happened and they can forgive each other but most outsiders can't let them move on.

Initially I felt bad for the wife, but not anymore. To me, this is a prime example of how many of us poor folk see this crowd. Not just the Mardis', but this type in general. A huge house but you can't figure out what they do to earn the money, in this case the CFO doesn't even know, luxury SUV's and either an F250 or GM 2500HD, a "private" jet, they go to the "in church", the kids go to private school because of the thugs at public school (sarcasm intended), travel ball, cheer, whatever it takes to make them look like they give a shit about their kids when apparently all they want to do is screw each other.
It's really a sad world we live in.

I don't know what kind of business this guy has but putting a majority of your company in the name of your wife helps with minority participation. If he's a subcontractor, and his business qualifies as a "female owned enterprise", he helps fill the minimum quotas most government contracts require. She probably never sets foot in the door of the business. Happens all the time.

What has the DA done that you would not have done? His ADA's went for no bond. They went for bond revocation when he violated the order. They played hardball with the phone calls. Scheduled for trial in May although a continuance wouldn't surprise me as I suspect the defense will ask for one.

I thought he would plea out but now I'm thinking he will go to trial.

If your CFO does not know they are CFO or does not understand position said company might be in trouble

Sorry, in actuality most of the cases are dropped by the victims themselves.

Although discussed in court, I’m not allowing any comments discussing minor children. The friends of the Mardises were not mentioned in court. Unless they testify in court or are mentioned in court testimony or filings, not allowing their identification. They haven’t done anything connected to the alleged crime.

Yes. That is the point - sort of. We women are only props: only the excuse for the men to be turned-on by each other. When we're involved, it isn't "Gay" or "Bi" action, for the men, you see. "Straight" men have a higher desirability status: thus, having women as the supposed center of it all, allows the men to maintain that status.

I have a very hot husband. I'm only so-so. We met in 'Weightlifting 101', in our first semester of college. He blossomed. I merely improved. But as long as I exist within the context of being married to HIM, you'd think I was the most desirable woman on the planet. We've been getting overtures from swingers, since we first moved to Jackson (Imagine a distant past, when people actually moved TO Jackson).

Because of HIM, we were qualified for the most selective 'Bodybuilders Only' swinger clique: not just ordinary bodybuilders, but guys exceeding a certain minimum I can't mention. Just at 'The Courthouse', you'd be surprised how many muscledudes exceeded that minimum. But from what I could discern, it mattered very little, what we wives and girlfriends looked like.

Considering the possibilities, I was like, "Him?", "Them", "ME?", "Woof!" But then, I was imagining the oogieness of having to look at other women in states of extreme nekkidity. And that was the deal-breaker: my ability to think-ahead. (I also foresaw, at the end of 2019, the inflation which seems to have surprised everybody else: allowing me to position us to profit from that, when there was still time). I would have been critiquing other women (their stretch marks, their cellulite, their skanky nails, their skanky makeup, their tacky jewelry...), which would have ruined my enjoyment of those magnificent men.

So, we demurred - which surely saved our marriage, our upward movement in the world, and our children's social prospects. And there's also the pressure, in "The Lifestyle Community", to drink, to do drugs, and to waste a lot of time. The Mardis Saga serves as a good illustration of where that trajectory can lead.

2:47 You are right. He’s a con-artist and it is doubtful he’s truly as rich as people think. I wouldn’t pay for any tax/investment advice from the guy. There is no telling what what would be found if authorities investigated the business. I’m not aware of any professional license he has. He’s not a lawyer or CPA and doubtful he’s passed the Series 7 or 63 exams.

Todd used to be FINRA Registered Series 6 but he voluntarily gave it up years ago because FINRA doesn't allow RR to run scams plus Todd's entire business is based on trade secrets he stole from TLS. Google TLS v Mardis
and see what that
judge thought of Todd and Kim. TLS won and Todd filed bankruptcy to get out of paying multi-million dollar judgement.

He was one punch away from killing Kim, and maybe a lot of the people on this forum are trying to save her because she has been under his thumb her entire adult life and has an advanced case of battered woman's syndrome. Kim Mardis is a good woman and anything she has done that was wrong is because Todd bullied her into it just like the ludicrous lie he concocted that her injuries were caused when he innocently slammed on his brakes because he was so hurt that she flirted with the man he had just sent nude pictures of her. She had strangulation marks on her neck. How did the rearview mirror do that or fracture her ankle? Look up what it means when a man strangles a woman. It is highly likely that the man will eventually kill the woman. #Save Kim!

I can even relate to your frustration, maybe even anger, at the destruction this family is suffering. Those emotions, though understandable, are misplaced. The people that should have set the defense of this family, are the very ones responsible for the destruction.

The children are the real victims in this sad story. I only hope they are not permanently damaged to the point they are unable to have normal relationships in the future.

It's newsworthy because of the brutality of the beating and it was directed at a man's wife, the mother of his kids. Too man shenanigans have happened on such cases in the past. Alston went to prison for what, 18 months thanks to the judge approving a sweet deal the good ole boy DA cooked up up there. Clark was convicted but got out after a couple of years or less since he was convicted under the old law that was a 25%'er.

In this case, no one is out to get the family. Had no clue the picture swapping would come up. Never heard of it until the ADA sprung that one on the wife. A wife testifying as she did is newsworthy as well as it highlights the problems of prosecuting domestic violence cases. The kids heard it all that day and it was undoubtedly very hurtful to them but you know what? They were also the ones sitting behind dad in solidarity with him and allowing his lawyer to say they wanted him free and home with the family.

It is finally becoming general knowledge that strangulation is a blaring siren that someone is about to be killed, and that it's been building for some time.

As for that Alston shit, I suspect we have heard the last of him, and his parents will probably have blood on their hands too.

When your own witness is talking off the cuff and not filtering her testimony, you cut her off and change the subject.

When your own witness is under cross examination and running her mouth about —
(a) having flirted and played footsie with another man in the presence of her husband, thus
(b) provoking and justifying the near-fatal beating her husband gave her when they left the restaurant; and
(c) freely admitting that her husband and the other man exchanged nude pictures of her and the other’s wife during dinner; while
(d) not so much as wincing; and
(e) coming off as utterly oblivious to the absurd paradox of (a) and (c) —

you put your hand over your head, use your yellow legal pad as a prop on which you pretend to write furiously, and basically sweat bullets until the DA brings this shitshow to a conclusion. Collette was fairly masterful at both.

@April 7, 5:50 P.M, not gonna happen but I’ll gladly eat my words if it does. They’ve already had 5 months, and this is how they decided to spin it? More than once, she said words to the effect of “he would never lay a hand on me.” Raise your hand if you did not immediately think “lady, he already has.” She never said “he’ll never punch or kick her “again.” Okay, I don’t see any hands.

The way I see it, her taking full blame will go a long way towards his conviction. If I’m a juror and watch her say all that then see the security footage of the attack and the pictures of her injuries, I’m probably thinking the only way to save this woman’s life is to convict him and vote for the maximum sentence (unless it’s the judge who decides the sentence.) Doesn’t mean he won’t kill her when he gets out of prison, but you as a juror did all you could do.

She’s clearly chomping at the bit to have the no contact order lifted so he can walk right back into her open arms. She couldn’t even “keep count” of how many times they had seen each other before getting busted at Bill’s. Oh and the DA blew a golden opportunity right there. If it had been 2-3 times, she would know without “keeping count.” My guess is it was several dozens of times, so many she’d need a running tally. Whatever, he would’ve been on his best behavior with her. He seems like such a ticking time bomb of rage that sooner or later that best behavior will come to an abrupt halt. Imo, based on everything I’ve read and heard about him, he’s going to need a true conversion to not come out of this raging mad at her. After all, they both agree it was her fault.

He has been emotionally abusive to his kids as well. He abuses everyone in his path by trying to control them and when he can't control them he gets pissed and tries to destroy them. At this point, the cycle of abuse will only end if the kids do what's right, support their mother in separating herself from him forever. Kids, if y'all want to reconnect and have some sort of a relationship after his prison sentence is up, so be it, but let your mother move on and support her. If you continue down the path of supporting Todd and your mother's lies, it will end badly and you will NOT have any resemblance of a family anymore.

He has threatened her extended family more than once to the point that none will be around him at all. He forced her to isolate herself from them and would not let her have any girlfriends to open up to. She was inprisoned by him in every way: isolation, financial entanglement, and most importantly fear to leave...she knew what her fate would be if she left and clearly still does. If he ever gets out of jail, and he approaches her, I hope she makes the ending of this story a good one.

It is an agonizing situation to be in...wife of an abuser. And when he controls the finances it's worse. You feel hopeless, defeated and cannot see a way out. I know exactly what his wife is feeling. Her lying for him, the desperation that she feels. She's lost. And she's been totally manipulated to the point that she believes his lies. I was a shell of the person I was prior to my 18 years of marriage with an abuser when I finally left (escaped). I believed he would kill my family. He held a loaded gun to my head, beat me, slapped, kicked, head butted, spit on me and raped me. I stayed. Scared to death. I certainly don't judge Mrs. Mardis but I pray that she sees the light and her adult children help her get out of this. I started over at 45 with NOTHING. There is a great life waiting for her and I hope she gets the chance to live it.

Well there is definitely plenty to hate about Todd but some of the people here are more motivated by love and a sincere desire to save Kim. Many of us have witnessed one of Todd's violent rages and truly believe that he is capable of killing her but Kim can't see it because she is a battered woman with few career options who doesn't believe she can make it without him. Part of an abuser's methodology is to convince the abused person that they are worthless without them. BTW, Todd won't mean to kill her and he'll be real sorry that he did once it is over but she'll still be dead. The only thing that will save either of them is for Todd to have a nice long cooli ng off period in prison.

She will get basically nothing for it, but there may be some way to get some residual income off of some of this fine southern gentleman’s sales. My only fear is that I have to drive through Rankin county next month for an airplane flight. Why do I think the the expression “Rankin County redneck” comes to mind. I hope he is still in prison without the access of steroids. This will not cure his mental and physical problems, but it might help.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all?
