More on the Frazier collapse: Claiborne Frazier's 341 Exam

When I first posted about the Frazier Construction debacle, I honestly had no clue what take place on this site. Simply put, this story received more traffic than anything related to Heather Spencer, Karen Irby, or Richard Troy Jones. However, once I began to dig into this story, its easy to see why this is the case. Numerous failed partnerships and real estate ventures. High-flying lifestyles where Aspen, the beach, and expensive hunting lodges were considered home. Child support lawsuits for an unclaimed child. Multiple multi-million dollar judgments the bankruptcy court refused to discharge. Prominent Jackson businessmen and families victimized. Lawsuits charging fraud and embezzlement. Banks claiming payments meant for them instead went into the Fraziers' pockets and so on. Here is Mr. Harris Claiborne Frazier's Chapter 7 341 meeting. Such a meeting is required under bankruptcy law. The creditors and trustee meet with the debtor in order to determine his true financial situation. I'm still reading through it but it contains some interesting information. Read on.

I am shocked that this is news. For the most part it is old news if you know these people.

This isn't even the good stuff. Lots of stuff out there that the best soap writers could not come up with.

Austin and Claiborne never had a chance. Given too much without having to earn it. I bought my first car for $1,200 at age 18 and drove it to Ole Miss. In the same freshman dorm parking lot, Austin and Claiborne had FOUR vehicles between the two of them (Ford Bronco and Sterling for Claiborne; Convertible Mustang 5.0 and Buick Park Avenue with mud tires for Austin). Some "responsible" adult is the root cause of all of this.

12:45 - when they're talking? Sounds like he almost enjoyed throwing out the "Mom and Pops". I have known one of them for years and they are just salt of the earth good people that didn't deserve the treatment they got.

These two sound like they grew up with people feeling sorry for them for being from a divorced home and let them get away with and have anything they wanted.

Old news? Quite a few people did not know how bad it was. Several people have told me they thought they knew what these guys had allegedly done but didn't realize the scope of it until they read these posts. Keep in mind fraudsters usually find more victims until they are put in jail; thus another reason to write about this story on JJ.

Mr. Frazier had answered a number of questions related to hunting club membership, lodges, and land. Only one gun is exempt under bankruptcy. An avid hunter would likely own more than one gun. Just like the boat and four-wheeler questions, I'm sure the banker was trying to establish if Mr. Frazier had any undeclared assets.

It appears that BXS doesn't know where the money from the condo sales went. Since they were the lender, they were due loan repayments (aka releases on the deed of trust) when each condo sold. BXS appearantly never saw the money....thus the $1.2MM lawsuit of the earlier post.

Either BXS doesn't know how to account for loan payments...or some money went missing

These boys have stolen from, cheated on, lied to and swindled almost every person they have ever encountered. They have done so while laughing at the misfortune of others and having no regard for those they took advantage of or anyone else in their path of greed and destruction.

The enablers that have helped along the way have also been good at turning a blind eye to anything resembling the truth of what total sacks of s**t these boys are.

Pretty interesting that Claiborne has never paid a dime to the child proven to be his. The deposition was done in 2009 and to this date, he STILL has not paid a dime. Interesting how he manages to continue with his worthlessness, but still continue to be out at bars and other spots professing his remorse. Wonder what dear old Mom would say if she knew of the other little Frazier children out there that neither one of the boys have claimed, seems to be a pattern with these guys. And to know that these children were all fathered while the boys were married to the Mothers of the only children Mom claims as "Fraziers."

Being 2011 now and seeing that NOTHING resembling justice has happened with these two, I am sad to say I think Madame Justice must truly be blind!

Why do laws seem to only apply to those who follow them? It appears that once you cross over to the OTHER side, the rules no longer apply. Claiborne and Austin have been living a fancy lifestyle as long as I have known them. They stopped following the rules and laws a long time ago.

It insults me to see the promises of paying back and making restitution made over two years ago and not one step toward accomplishing this has been made.

According to the notes from the meeting Claiborne had, under oath, he plainly stated he had not filed a tax return since 2005!! Wonder why? Possibly he has been hiding from those he needs to make restitution to and be able to finance the carefree lifestyle to which he has become accustomed? All because he follows no laws or rules. He was seen driving a very large, very nice boat in the Destin Harbour this summer that I heard he had bought with a commission he made. I'm sure it's in someone's name other than his. What about those he so badly wants to "get right with"? PLEASE.

Where is the IRS in all this? I thought the only two things in life one HAD to do was pay taxes and die??? Apparently not, if you are a FRAZIER.

It is not illegal to not pay your taxes.

It is illegal not to file your taxes.

I was surprised he admitted under oath that he had not filed taxes in over five years. Not sure if that is common practice, but thought I would put it to the experts out there.

It is easy to play Monday morning quarter back and lay blame without ever knowing the whole story. Jackson, MS is largest small town, where rumors can easily can and usually get out of control. The Frazier family has been known for years for there business accomplishments and investments. Why suddenly when some of their projects not work out are they deemed fraudulent.

Typically when you invest in large stake investments, combined with a sudden decline in the economy sometimes things do not go your way. The business turns exceptionally dirty when big lenders who invested in their projects realize they are not going to work. What people have to understand, this has happened to many business people in the Jackson area who have not recieved half of the same attention they have. Well known families like the Fraziers get an enormous amount of attention compared to others. The reality is when you swim with the sharks sometimes you can get bit. I do not agree, like most of these post lead you to believe, the sharks are the Frazier's. We all have to be responsible for our actions, investments, choices we make. Reading the court declarations and accusations from the creditors or even Plaintiffs lawyers will always be exagerated. In the end the judge will make a final decision.

Instead of anonymous posting as so many well wishers have done, you might be surprised who they really are! Hmmm could it be the lenders? Jealous people? Or just nosey people whose lives are just so plain boring, they have to focus on the life of others.

The spotlight is on the fraziers now because they always demanded it before 1:22. I agree one of the definitions of investments involve risk. I can not believe there is this much pro frazier support out there. Just surprised thats all.

There is a big difference in a real estate deal not working out and...

- drawing loans from a an LLC that you have partners in and using that money for other purposes
- selling property and not paying the banks for the loans they made on the property
- selling property you own with partners and not telling them...and not giving them their portion of the money
- submitting fabricated documents to banks in order to get money funded on loans
- lying under oath
- creating fictitious companies and bogus bank accounts to funnel money through
- writing bad checks for hundreds of thousands at a pop
- paying personal debts using money from a partnership with others

These types of things are not the "market risks" that real estate investors agree to take on. These are criminal acts.

I was going to sk the same question? Why all the negative posts? Although I know only one of the Fraziers, I have no question about their character and would trust them would my own finances. All the information posted lists the plaintiffs aligations. I would like to see the defense attorneys information. For those of us in the legal field, we always recommend our clients to resist public comments so not to fuel unfounded and unproven alegations. I would recommend the same to you. There are always two sides of the story, and then the truth which shall prevail.

In this country you can sue for just about anything. Mentioned in the headline there is a child support lawsuit against Claiborne. What this fails to mention, is this is the second attempt by the same women to collect money from him. A women who he met years ago, tried to file against him when there is no DNA proof that the child is even his. None! No DNA test was ever done. Infact the recent lawsuit is news because the woman recently moved to MS. She has remarried three times since then, and has refused up till now to allow DNA tests. She is a gold digger, and who only knows how many other guys she has tried to blame as well. Infact the first daddy, rumor has it already adopted the child. Still Claiborne has tried repeated attempts to speak with the women and still she has refused. Stay tuned for the third lawsuit, only after she gets another husband who will bankroll the legal fees. Are none of her husband atleast curious why she is so infatuated with him?

Claiborne went to high school with the lady in question, lived with here for over a year and only quit seeing her after she ended up pregnant at the same time his estranged wife did. Claiborne is the one that has avoided cooperating with the courts in the matter...as evidenced by the warrant issued by the local chancery court.

Explain this to me....in Rankin County a man gets arrested in less than a day for stealing the antlers of an 8-point deer. But people who have defrauded partners and banks of millions of dollars over a period of years are still on the on the street living a lavish lifestyle.

And how many DEFAULT judgments are there against the Fraziers? Its not like the Fraziers are fighting in court. There is a simple way for Mr. Frazier to fight that paternity suit: show a DNA test proving he is not daddy. To my knowledge, he has not done that at this point. Big friggin' deal if she was a gold digger. He hasn't denied sleeping with her and no one made his dick get hard. He's a big boy and like all real men, if its his kid, he should own up to it and take care of it instead of running away like a little girl. All he has to do is show she is not his kid instead of using claiming he didn't know or whining its not fair or calling mommy a gold-digger.

As for the other real estate issues. Sorry but many of of these "problems" took place BEFORE the recession. Take van buren. The F's can claim all day long they were screwed. Doesn't change the fact they kept the money when units were sold AND did not transfer title to the purchases. How Evans-like. That was back in 2003, 2004, 2005. Then Bancorpsouth obtained a non-dischargeable judgement against them in BK court. That means it was approved by a judge who had to make some findings of fact and wasn't just taking the bank's word for it. that was only one transaction. The pattern repeated itself over and over.

The fact is the Fraziers have rarely fought any of the lawsuits filed against them or contested the debts in bankruptcy court but instead have agreed in many cases these were valid debts and by agreeing to the non-dischargable nature of the debts, that some degree of fraud took place.

frankly, the defenses I'm seeing of the fraziers are the same ones I've seen in other fraud cases such as Steadivest and the Evans case. the only things that change are the names.

My company moved to Rankin county to get away from the Hinds county legal system. The Rankin/Madison district is supposed to be the best in the state. So this is the best Mississippi has to offer?

Well, when you have a DA that is more worried about prosecuting Tim Johnson's enemies or making money in the collection business or refuses to prosecute a woman giving a guy a blowjob while driving even if he hits another car and blinds someone for life, what do you expect?

Oh, and doesn't prosecute the largest real estate fraud case in Mississippi history that took place in his own county.

I totally agree the Rankin DA should be prosecuting but... The dude and the deer antilers.... He was speeding on 471 and when the BPD tried to stop him for it he ran. He was not arrested for stealing deer antilers but felony fleeing and the original BPD had no idea about any deer antilers until the RSO told him after it was all over. Dude has a lengthy record also. If dude would have taken his speeding ticket WAPT wouldn't have had near the internet hits... Flippin deer antilers is all WAPT can get out of it.

Do you realize the camps they were part of have more prominent Jacksonians than other organizations in town. You actually think the lawyers and doctors in their camps would allow this? Common? Let alone the judges and political elite. The only reason this information hit the tape, is Claiburne's brother had Travelers over a barrel with a wrongful firing lawsuit. Travelers then went on the offensive by going to the media and releasing all this information to dig up dirt. Do you really think all this information just pops up. This is no more than the strong arm tactics that debt collecting organization use on a larger scale. Step one embarass, step two put out false lies, and step three feed it to the public on media outlets. This is not personal Kingfish, I just hope you check your source!

PS: Travelers laying out their factual allegations in a lawsuit is not the same as "going to the media and releasing all this information to dig up dirt." Also, I see that the younger Frazier's wrongful firing lawsuit that you mention had Traveler's "over a barrel" in such a way that he (young Frazier) agreed to a non-dischargeable $5 million judgment in Traveler's favor. Traveler's must have been very, very scared ! !

Ahem ... you might want to read Claiborne's BR hearing transcript. I have no question about their character either, but I came to the opposite conclusion on that subject than you did.

The above transcript is from a hearing on March 11, 2009.

The Traveler's suit shows where Claiborne sold $10,000 of equipment on March 13, 2009 and then deposited the money in his wife's account.

Sounds like Claiborne left the hearing and made a bee line to Belzoni to sell the equipment. Probably wanted to beat Austin to the punch.

The case may settle, but there will not be a happy ending for the Fraziers. They will be forced to "settle" with their creditors; the business community will finally recognize these bone heads for what they are; Ergon will never partner with them again; and yes, they will work for someone else for the rest of their lives.

No more boats, condos, good looking women, etc. - unless all are provided by their mommie.

to all the dumbasses who think dirt moving equipment sticks out at a hunting camp that has thousands of acres of uh i dont know DIRT wake up. Hunting camps bring in the same equipment every year to repair roads update hunting quality, and simple move dirt. If you have no idea whats going on, SHUT UP!

Would a former prosecuter cut deals to avoid prosecution more than once? Would a local judge risk his career helping Scruggs? Would a Republican 2 time Gov pardon 5 convicted murderers? Would the CEO of one of the biggest tele-com companies in the country located here in Clinton risk his freedom to be corrupt? Would a cop in ridgeland try to destroy evidence and lie under oath? This is an ok story but REALLY????

This is a he said she said game. C Frazier claims that they were informed and Travelers says they were not. Let put it this way the 5th amendment right is good way to trip up the lawyer trying to prove a point which they might not agree on. Clearly C Frazier was not aware with everything going on. That is why he claimed the 5th or the I do not know. Think about that maybe he did not know, did that ever come to mind. Why is he not mentioned as much as the others. Although I can speculate, I can't speak for others. None of us can. but take the travelers lawsuit as a written bibke is another not fair either.

I respectfully disagree. It is a big game with sore losers who are out to destroy people. i do feel bad for the people who lost their jobs at Travelers over this. But the reality is sometimes loans go bad. They will do what ever they can get the money. they want to connect the mother because she has much more than they need. Goog luck. Maybe you misread, The 5th amendment was not to say something to incriminate. I can I say that i have used it when I just don't want to answer the question. This is not an attck against you, all I am saying is it is not as clear cut as the insurance companys says.

Let me see, let us count this up:

Bancorp South 1.2 million bucks. Kept money when condos sold instead of paying the bank

Hines lawsuits: Multiple judgments, Sold properties behind partners backs and kept money.

Hughes lawsuit: Had out of wedlock child, refused to acknowledge, did not provide any actual evidence disputing paternity. Judgment in favor of mom.

DUI for Clairborne in 2008.

$3.3 million dollar judgment by Regions.

Travelers $6.4 million DEFAULT judgment against Fraziers in North Mississippi.

Austin signs $5 million judgment against him by Travelers in BK court.

Numerous attorneys stiffed by Fraziers on fees.

Yet its all disgruntled partners, everyone else's fault, just deals gone sour. Yeah, heard same thing in Evans and Steadivest. The defenders need to try again as they usually do not debate specifics and just think everyone is jealous.

Jealous? Why would anyone be jealous of a drunk swinger who steals from half the town? John Gotti had a great lifestyle too but that doesn't mean I was jealous of him. Far from it.

Your post listing matters is indeed well said. I bet you already know this....but your listeners need to know that the list is only a peek under the covers. There are many other matters (of record) that are in addition to those listed.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
