China won a round against Mississippi Attorney General Lynn Fitch. General Fitch sued the People's Republic of China in May 2021 for damages related to the Covid-19 pandemic in U.S. District Court.
The case has just sat there on U.S. District Judge Taylor McNeel's docket until the summons was finally returned on February 15.General Fitch had filed a motion for default judgement in July 2023. However, Judge McNeel denied the motion yesterday for a simple reason. The Court never entered default against Red China. Since the Court never entered the default, The Attorney General could not ask for a default judgment. Judge McNeel expounded:
Additionally, it is not clear from the Motion for Default Judgment what relief the State of Mississippi seeks from this Court. Though the State of Mississippi requested damages and injunctive relief from this Court in its Complaint [1], it makes no such request in its Motion for Default Judgment.2 Likewise, the State of Mississippi does not provide a proposed judgment to be entered or specify at all as to what it actually wants.

Just looking over the docket report, is it me, or did General Fitch serve a bunch of stale summonses?
If so, it will be interesting to see what happens when she tries to get an Entry of Default.
How embarrassing to omit a clerks entry of default. Looks like the AG has the recent law grads on this case.
Also, what is the point of this exercise? Even if a default was obtained, a dime won't be collected. This is a political grandstand and a complete waste of taxpayer dollars.
Like all her outfits and new furniture, everything about her is for show only.
Is there no end to this woman’s folly and vanity? Time, money and the talents of her long-suffering staff are used to sue China? Does Mississippi not have enough home-grown, self-inflicted problems to fully occupy the efforts of any conscientious public servant?
Ms. Fitch obviously sees a larger national role for herself. The problems, and now crises, she has brought the nation by her meddling in the life every American woman should give her pause. Nevertheless, she seems to struggle to become a big-enough fish in a very small pond.
If she is to continue to give us the benefit of her service, I suggest addressing the states’s immediate and obvious problems and leave law suits against China in more capable hands.
There is enough folly here; taxpayers shouldn’t have to pay for more.
I do not pay her salary to pursue a career in international law. I pay her to address legal issues in this State.
Sadly, it appears that she is no more than an ornament as a lawyer or politician.
Just don’t ask her to look into local police misconduct. She will swat that away in 24 hours. Suing a foreign nation state, however, times and resources are available and ready.
Say what you will, but at least Shad's escapades seem somewhat connected to reality. Suing China? Seriously?

Ms. Fitch, to put it mildly, is a waste of space.
Lynne Fitch would make an excellent vice-presidential running mate for Kamala Harris.
For the many lawyers who failed to have the default first entered, I shall not comment lest I appear unseemly. Perhaps none has ever sought a default judgment.

A lot of criticism that the AG is not a seasoned litigator.
That doesn't matter at all. The AG candidate just needs to be photogenic and be able to drop all the right buzzwords like a good politician. It's not like the voters examine the AG's personal and professional qualifications for the job.
Besides, it's not like she has any of that confederate belle segregation academy stuff in her background like Cindy Hyde-Smith.
The competent lawyering and litigating always gets hired out anyway.
The AG just needs to have some meetings with the state employed and outside toadies and sign the invoices.
