Jackson Fires at Gun Show (Updated)

Jackson Mayor Chokwe Antar Lumumba often expresses his desire to run gun shows out of town.  Unfortunately for the Capital City Gun Show, the Mayor quit talking and started doing as he escalated his war on Jackson gun shows this weekend.  The Jackson Fire Department surprised vendors at the gun show yesterday when the gun show began.  Accompanied by Jackson police, the Jackson Fire Department told vendors they had to pay a $50 "fire inspection fee" for each booth.   Needless to say, the vendors were not too happy about the sudden demand.  The word "extortion" was used more than a few times.

  

David Chancellor of Laurel operates the semi-annual gun show.  He said Jackson Fire Marshal Elliot Holmes notified the Washabi Shrine Temple Thursday that each vendor would have to pay the fee.  Mr. Chancellor asked Mr. Holmes to agree to a one-time fee for just the building.  The Fire Marshal would not budge as he said the 2018 International Fire Code allowed him to charge each vendor the fee. 

Several JFD employees and police officers popped up at the gun show yesterday morning.  JFD  gave the vendors a choice: pay the fee or receive a free JPD escort to the parking lot.  All vendors chose to pay.  JFD kindly collected the money and served up the fire inspection permit to each vendor even though it never inspected a booth.   JFD would not accept cards so most vendors paid cash.  

Mr. Chancellor said he operated Jackson gun shows since 2012.  This is the first time Jackson charged the booth "fire inspection fee."  The surprise fee nearly doubled the cost of the gun show for vendors as they must also pay a $75 exhibit fee to the promoter.  

There are at least thirty vendors at the gun show.  Mr. Chancellor collects sales taxes of $12,000 to $16,000 at each Jackson gun show. The next gun show is scheduled for November.  The promoter said he will probably not return to Jackson and is looking at venues in the Jackson burbs.  "I feel like I'm being attacked personally," said an agitated David Chancellor. 

Vendors were quite upset.  Several said they would not return to any Jackson gun shows if they have to pay the fee nor would they have come if they had known about the fee. 

Vendor Rob Watras said it is quite obvious the Mayor is using the so-called fire inspection fee to run the gun show out of town.  The retired Clinton police officer said it was very weird Jackson only charged gun shows the fee.  He wondered out loud why other events didn't have to pay the fee. 

Josh Hancock said he works at 50 gun shows each year and never saw such a fee charged to vendors.  He said he will frame his fire inspection certificate. 

Mr. Chancellor said he called WAPT and WJTV Friday afternoon but neither station covered the story.

Kingfish note: The Mayor is getting what he wanted: The exit of all Jackson gun shows.  The Mayor went this route, now he better stick to it. Isn't there a Black Business Expo? Every booth at the Expo should have to pay the "fire inspection fee."  Every booth at the Convention Center better pay that fee.  If  there is a arts & crafts fair at Lanier High School, every vendor should have to pay that fee. Job fairs? Tough luck.  Every employer at the job fair should have to pay that fee.  The Mayor started this crap, now he can live with it. The Mayor is very familiar with the equal protection clause. 

 Oh yes, let's not forget the JFD employees only took cash.  Hmmm... how much of that money will actually make it to the city of Jackson?  Right, Paul Perry?  

The Mayor is also begging the Legislature for some money to fix the water system.  Hmmm.... what do you think the reaction of some legislators will be to this little stunt?

I guarantee that it the gun show leaves Jackson, they won't happen in Madison or Ridgeland or flowood. Those towns don't want to host gun shows either, but were happy to let Jackson do the dirty work.

Good mayors try to encourage business revenue to generate sales tax. Lubumba's creation of the most radical city on the planet does the opposite.
I'm no fan of gun shows but it is a legitimate business enterprise. My business gets extorted by the fire department every year too. We have a small office in an office building yet we have to pay a "fire inspection fee." Inspection for what? There is one way in and out of the office and there is a fire extinguisher in the office building hallway. Some guy drops by looks around, demands a check and gives me the same "certificate" that Kingfish posted.

Why doesn't Lubumba encourage business? I'll confess it is my fault for not having gotten the business out of Jackson by now. At least I moved my residence away from this Marxist clown show.

When you add up all gun shows, you are probably looking at throwing out over $100,000 in sales taxes (to be divied up) out of Jackson.

KF, I am the original reporter. Thanks for confirming and publishing the details. I believe a certain 2A attorney in Madison will pursue this, but that's just informed speculation.

The Fire Marshall did tell vendors that he was just following orders from "city hall."

I would hate for state funds to support an antigun administration even if they claim it is for water infrastructure repair. If Jackson wants the state legislature to even consider funding their repairs they need to rethink how they treat citizens that can call state reps and senators and tell them how the city shook them down at a gun show.

Dead kids in the streets apparently are not enough to make Jacksonians understand that elections have consequences. Maybe a few more months without water will get to them.

Chuck, we will watching for these fees for other events. On another subject, how did those poor animals fair during the freeze while Chuck was blaming the water issue on global warming. Chuck has been a failure at every level while trying to create his new world order.

As if Mississippians aren’t getting fleeced enough. Perhaps the mayor believes that it’s really the guns that kill and not the people pulling the trigger, but I doubt it. This IS in the democrats manifesto, disarming the public then taxing the piss out of them to keep them poor. It’s been used in history from the Bolshevik Revolution in Russia in 1918. By Stalin in the 1940s. Mao Zedong in China in the 1950s and every other dictatorship since then. Their manifesto believes that armed citizens present a problem and sometimes cannot be controlled. They also have a reputation of overthrowing abusive governments. Unarmed citizens in countries that require it are no more than slaves to oppression. The good mayor is just carrying on the history of every other despot.

Since Mayor Lumumba is now so concerned about fire prevention, here is one of the amendments the city made to the International Fire Code when it adopted the Code on August 14, 2020:

"Section 903.3.3.5 Water supplies. Water supply as required for automatic sprinkler systems shall be provided in conformance with the supply requirements of the respective standard."

And Jackson's Code of Ordinances, Sec. 58-5(e):

"Any person who shall violate any of the provisions of such officially adopted code or fail to comply therewith . . . shall severally, for each and every such violation and noncompliance respectively, be guilty of a misdemeanor and, upon conviction, shall be punished by the imposition of a fine not to exceed $500.00 or by imprisonment for a period of time not to exceed 90 days, or by both such fine and imprisonment."

So, what about enforcing this part of Jackson's fire control laws?

The only relevant section of the 2018 International Fire Code that I could find is Section 3105.2, which only applies to Special Event Structures that exceed 400 square feet. I found nothing that applies to individual booths.

3105.2 Approval. Temporary special event structures in excess of 400 square feet (37 m2) shall not be erected, operated or maintained for any purpose without first obtaining approval and a permit from the fire code official and the building official.

KF, I can't believe you fixed your mouth to say that Baptist MC would host a gun show. No matter how they feel about hunting or self defense, there's no way in heck a gun show is happening in Clinton, and especially not at MC.

Like I said, Madison, Ridgeland, Clinton, they're all happy to let Jackson carry their water. If the gun show wants to move, it will be to someplace inconvenient to most, like Byram or Brandon. Sales will be a fraction of what they are in Jackson.

Now that flowood has almost built that conference center, they will need to do anything to fill it. Maybe a nice gun show, with advertising at the airport.

I don't know why, if you don't have to, anyone would spend a damn dime in Jackson Mississippi. As a Brandon resident, the last dime I spent a dime for anything there was on lunch at Dave's BBB on High Street....because that was a chicken fried steak with potatoes and greens that couldn't be beat. It's been closed for a while now. Just give Baby Chok what he and Kenny can agree on and move the gun show out of the City. And when gun crime doesn't decline in The City with Soul, ask Baby Chok why. Right?

I'll just point out a couple of MS and Federal laws that might get overlooked:

"TITLE 18, U.S.C., SECTION 242

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death."

"MS Code § 97-23-33 (2019)

If any person shall willfully and maliciously print, circulate or distribute, cause to be printed, circulated or distributed, or assist in printing, circulating or distributing, in any form whatever, any matter, the purpose and design of the contents thereof being to willfully and maliciously interfere with, or prevent another from exercising a lawful trade or calling, or engaging in a lawful business, or engaging in lawful use and enjoyment of his property, he shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment for not more than six (6) months in the county jail or be fined not more than five hundred dollars ($500.00) or both."

I sure hope everyone involved, from the mayor on down, knew precisely what law(s) allowed the collection of these fees (for a printed certificate but no actual inspection performed) in the face of police presence and has citations at the ready just in case. If some prosecutor wanted to, he or she could make things interesting for all officials involved.

And if this same fee, etc. isn't charged to all substantively similar exhibitors from here on out, there ought to be a number of other official asking some tough questions and actually acting on this.

My guess is this money will eventually be returned to the vendors. This apparently is unlawful, not to mention unethical and the mayor knows it. He will get what he wants and hopefully the show will find a new venue out of this God forsaken city and the taxes collected will better appreciated.

I would think that if there was an incident requiring fire/emergency service on the state owned fairgrounds, that the responding agency would be COJ... therefore they would be an/the authority having jurisdiction.

Did anyone ask if there was sufficient pressure to contain a fire? I can see several millions of dollars worth of inventory that was brought in. Also, the building needs sufficient wawtah pressha for the JF and D to fight the building fire. I was hoping someone may have brought up that point. But when you’re being extorted, I can imagine those things are not on your mind. Maybe an attorney can brief us on this. Also, I bet your life there is the absolute best security available for the vendors to protect their valuables. I would hate to be the dumb arse that tries to break in to that place. Oh, and by the way, JPD more than likely couldn’t find it since it’s a white mans place....I know...I got broken into not far from there and it took an hour to get an officer ( if that’s what you can refer to her as) to respond.

Examples such as how the CoJ treats firearm vendors differently than everyone else, the complete lack of care by city officials, and the more buearacracy by the CoJ compared to surrounding cities are some of the many reasons why when I scout for business property in the metro area I rule out the CoJ before I even start looking.

Never practiced law a day in my life, but this is such an easy case: First amendment violation would be extraordinarily easy to prove. Love to see Chokwe deposed on that one. I don't recall fire department ever requiring JLJ booths to "purchase" fire certificates.

By its own terms, the Operational Permit only applies to the property owner or the owner's agent, i.e., the person who rented out the space to put on the show.

"105.1.1 Permits required. A property owner or owner’s authorized agent who intends to conduct an operation or business . . . "

I still do not see how this can be applied to the individual booths at the show. I think this is a tremendous overreach to stifle lawful trade. The timing of the letter strongly suggests an ambush, providing inadequate opportunity for a response from legal counsel.

They have started hitting all the businesses in Jackson with this fee. I have always found it interesting that the fire extinguisher salesman shows up just a few days before the city fire inspector like clockwork. He charges for getting you in compliance and then the inspector charges you for being in compliance. Just another government racket nickel and diming the citizens.
And why is no one asking about the 1% tax his father instituted? Where is that going?

Anybody with half a grain of sense would know that each renter of 50 square feet in a building is not responsible for adherence to any applicable fire code. The owner of the building has that sole responsibility.

Can we expect Chokwe to assess a 'riders fee' on every participant in the black rodeo (sanitary dookie-patrol fee) or everybody who sets up a table at the convention center's two annual events? What about every vendor who sets up an 8 ft table at all those Hilton events? Those who sell T-shirts and CDs at concer....wait, we don't have concerts any more in Jackson.

John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
