Postman Killed in Chase

Updated with Jackson Mayor's statement.  

The Pearl Police Department issued the following statement. 

Pearl Police have arrested Brandon Andrews, 20 of Flowood, after a pursuit Thursday morning.  Pearl Officers attempted to make a traffic stop on a Toyota Camry for speeding westbound on Interstate 20 just before 11 a.m. Andrews failed to pull over and officers pursued. Andrews continued westbound on I-20 and onto I-55 south into the Jackson city limits. 

Andrews crashed into a U.S. Postal Service vehicle on Maria Drive just off McDowell Road. The Postal Service employee was injured and transported to UMMC and died due to his injuries.

The suspect fled the crash scene but was quickly taken into custody and transported to the Pearl Police Department and later to the Rankin County Detention Center and is facing numerous charges. The identification of the Postal Service Employee will be released by the Mississippi Highway Patrol pending the notification of the next of kin.

The Mississippi Highway Patrol, along with the Mississippi Bureau of Investigation and the U.S. Postal Service are investigating this crash at the request of the Pearl Police Department.


 

Jackson Mayor Chokwe Antar Lumumba issued the following statement. 

"First off, I want to send my condolences to the family, friends and co-workers of the U.S. Postal Service carrier who lost her life today in Jackson. The postal truck was struck by the driver of a vehicle who was involved in a police chase with Pearl police. As a result, the carrier died from injuries sustained in the crash.

According to a media release from the City of Pearl, the pursuit began after the suspect failed to pull over for a traffic stop. 

I want to reiterate that police pursuits that enter our City from multiple jurisdictions do not make us safer. There are often tragic outcomes like this one for minor traffic stops, and we have experienced it before. What often isn’t considered is the effect these pursuits have on innocent bystanders and it is something we believe needs to be changed.

We aren’t anti-pursuit. We are anti-pursuit for minor violations which often spillover into tragic consequences for our community. With the advent of new technology, such as a growing camera surveillance network and tag readers, we can apprehend suspects without endangering the public.

If our effort is public safety, it has to be public safety in every regard.

We renew our request to the state Legislature to restrict the offenses for which multi-jurisdictional pursuits can occur in the City of Jackson."

Read the comments on WLBT’s FB post and it is sickening. Many folks (mainly African Americans) are blaming the cops for chasing this 20 year old kid. What sick-twisted logic. So sick of this woke approach to policing and criminals.. cue Sir Choke to throw gas on the fire and offer some empty, race-baiting political commentary.

What 20 year old black driver speeding through Pearl would not try to run? I mean, if you read the news, nobody in the U.S. is prosecuting petty crimes and you never know what Pearl popo might do to you. At least, that's the narrative from the national media.

National media has some culpability in this. They created this monster. He was only doing what the 20 years olds in Portland and LA were doing.

I'm not being woke when I say this. There should be no high speed chases into residential areas for a misdemeanor. Yes, he was heading back into enemy territory where he could evade arrest for whatever he was originally fleeing. But they were chasing him for speeding. They should have run his tag and sworn out a warrant for reckless driving, fleeing a law enforcement officer, etc. He could have been tracked down, arrested by Rankin County LE, and prosecuted in Rankin County. And that postman would be alive. If they are chasing because of an active violent felony, then there is more justification. Cops know or should know that there is a high risk of someone getting seriously injured when they have a high-speed chase. They shouldn't do it for just speeding.

Victor Mason left the bar very high with that interstate bust of the guys hauling a million bucks in cash. It never got claimed. Went to the sheriff's budget. Now every Buford T. Justice sheriff has the interstate staked out. You can come through in your Ford Taurus at 90 mph all day long, but don't come through in a van or a U-haul.

Instead of why do the police chase people for simple traffic violations why not ask why do people run from the police for simple traffic violations? I'm sure the police issue thousands of these citations every day across the state without any problems. The people then pay the fine or go sit in traffic court to give their side of the case. When someone is willing to drive 100 mph to avoid a traffic ticket it appears they are avoiding something more.

Police chases will truly be a thing of the past (like hanging horse thieves) as soon as everyone is driving EVs with remote shut-offs like Tesla!

Also, this isn’t a race issue. A few weeks ago I got passed by a Siilverado being driven by a white meth addict who was being chased up Hwy 25 towards Carthage. He made it to Hwy 471 before the RCSO deployed their spike strips.

He killed an innocent because blue lights lit up behind him and he tried to run home. All you others that have sympathy for him can F/O. The Police did not kill that postal worker.

We desperately need a new super-hero.. one who is could quickly take care of crime/criminals so they couldn’t hurt innocent others who are in their path of terror. His/her name should be ‘VAPOR’ based on their immediate ability to ‘take the call’ & respond lighting fast to “vaporize” the culprit from the face of the earth… before inflicting further harm on innocents in their way.

It would eliminate the inconvenience and expense of litigating and warehousing one who was predisposed initially and certainly would be after release to harm our populace over and over again (as is evidenced in Jackson).

This cops have no blame in this. If you flee, it portrays hiding something. Maybe he just committed another crime. Maybe there are others in the car against their will. Its tragic, but everyone on this blog would be praising the cops when they apprehended the suspect with no injuries. This is 100% on the perp and he should be tried for manslaughter.

Thanks to the republicans there is a $500k limit for any damages. Tort reform is great unless u r a victim. The postman who was killed could have been anyone on this blog or a family member. Negligence does not pick and choose who is killed. Reckon they would have chased a white kid who was speeding 15 miles ?

As long as Jackson is a safe place for thugs there will be some who will make a run for Jackson every time they are caught breaking the law. They know if they can make it back to Jackson they do not have to worry about the law.

Maybe if Jackson would get a few of the thugs and criminals off the street they would not have things like this happen. Other cities do not have the same policy as Jackson. Other cities expect the criminals to be caught and jailed. Jackson encourages their criminals to break the law and run from the cops. Some Jackson thugs think they can do the same things in other cities like they can do in Jackson. That is why Jackson has the highest murder rate in the U.S. Not many cities want to be known for the amount of crime committed in their city. Jackson, keep your thugs in the city limits of Jackson.

To all you "lawyers" on here, simply fleeing the police is not a felony. It has to rise to felony fleeing, which it may have in this case. But the folks saying that the moment you run from the cops it becomes a felony are wrong.

Mississippi Code § 97-9-72. Fleeing or eluding a law enforcement officer in a motor vehicle; felonies; sanctions; defenses.
(1) The driver of a motor vehicle who is given a visible or audible signal by a law enforcement officer by hand, voice, emergency light or siren directing the driver to bring his motor vehicle to a stop when such signal is given by a law enforcement officer acting in the lawful performance of duty who has a reasonable suspicion to believe that the driver in question has committed a crime, and who willfully fails to obey such direction shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine not to exceed One Thousand Dollars ($1,000.00) or imprisoned in the county jail for a term not to exceed six (6) months, or both.
(2) Any person who is guilty of violating subsection (1) of this section by operating a motor vehicle in such a manner as to indicate a reckless or willful disregard for the safety of persons or property, or who so operates a motor vehicle in a manner manifesting extreme indifference to the value of human life, shall be guilty of a felony, and upon conviction thereof, shall be punished by a fine not to exceed Five Thousand Dollars ($5,000.00), or by commitment to the custody of the Mississippi Department of Corrections for not more than five (5) years, or both.

Lewis v. City of Jackson, Mississippi Supreme Court (2014). Factors go into analyzing judgment of LEO as to if and when pursuits are reasonable and necessary. You gotta weigh the public safety interests against the interests of starting a high speed pursuit to stop a guy going 7 miles over the posted limit.

Police chases are a trigger issue.
More blacks in jails than whites are another trigger issue.
Whites moving to the safety of the suburbs is another trigger issue.
These speeders kill a lot more in traffic accidents then police chases.
Kids dying in Hot Cars kill more than police chase.
I'm glad the Pearl police go after speeders.
So, keep up the excellent work officers!

Just as easily as they decided to chase, they could have disengaged and put out an APB. They would have got him in 24 hrs or less. There’s no excuse for loss of life. I’m sure if you were burring your loved one unexpectedly your wouldn’t pat any cops on the back who swore to PROTECT and SERVE the community.

I made a turn around trip from Brandon to near Cleveland Ohio to visit a friend in the Hospital about a month ago. What I noticed near the large cities being Memphis, Nashville, Louisville, Cincinatti and Columbus were that the traffic was absolutely LAWLESS. Mostly chargers, camaros, mustangs, and of course the honda civics with fart can mufflers. Rolling through Cincinatti downtown interstate at 6:15 a.m. was like a Mad Max movie. There were absolutely NO cops enforcing the speed limit anywhere in my travel near the larger cities. Very rare to see them running speed traps in the rural areas as well. I think we've come to the point where most municipalities just let it go probably for reasons like what resulted in todays incident in Jackson. There's simply more serious crime going on nowadays than misdemeanor speeding. I think I'll use Chowke speak here and I'm sure he would agree with me: "Limited judgement was demonstrated by both sides today."

10:18 p.m. is correct about the multi-factor test discussed in City of Jackson v. Lewis, 153 So. 3d 689 (Miss. 2014). On its facts, however, Lewis was an extraordinary case.

In Lewis, the officer failed to abide by the City of Jackson's policies regarding police chases, which opened it up to civil liability. Plus, there was the following evidence, from paragraph 10 of the opinion:

"trial testimony of Sergeant Chuck Lee of the Jackson Police Department Investigation Division, who investigated Officer Jackson's pursuit of Butler. Sergeant Lee's report stated that Officer Jackson's conduct violated General Order 600-20(2)(b), (2)(d), and (5)(d). . . . Lee's supervisor, Lieutenant Greg King, agreed and wrote a memorandum concurring with Lee's findings."

A minor traffic stop can always turn into larger situation that protects society from covicted felon, large drug bust or even stopping a driver under the influence of chemical substance. I do not blame Pearl PD Officer for this. I blame the driver for making the choice for not stopping at the beginning. Pearl PD should not be blame for the death of the postal worker the driver should be. He should be charged with vehicular manslaughter. This situation should be treated just like a driver who is under the influence that wrecks and kills a innocence bystander.

Mayor seems to hold a long-standing view that the police needed to be arrested for accessory to murder, or even murder, they caused the homicide. The reckless speeder would not have seen any pursuit continuing in that neighborhood, yet recklessly smacked the postal vehicle at high speed in that curve, anyway.

A witness said it took a minute for cop to get there, so sounds like cop had already slowed a minute earlier, otherwise he would have been at the wreck immediately.

I think the problem Jackson residents have with these high speed chases through residential neighborhoods is not the selection of the destination by the perpetrator but the location selected by the police. It may never happen, but until a high speed chase through the streets of Dinsmoor or through the Madison Country Clubs, etc. results in innocent death or serious injury, Jackson residents will continue to wonder if a policy of limited chase for misdemeanor offenses isn't already in effect....but only in effect for certain neighborhoods. Is it a racial issue, or economic, or just a false perception? We'll know when it happens.

Believe this young man will end up Felony Fleeing based on Section 2, "(2) Any person who is guilty of violating subsection (1) of this section by operating a motor vehicle in such a manner as to indicate a reckless or willful disregard for the safety of persons or property, or who so operates a motor vehicle in a manner manifesting extreme indifference to the value of human life, shall be guilty of a felony,". Used this in court before and got indictments.

Few commenters on this blog will admit it (even if they know it in their hearts to be true), but Kenneth Stokes was right.
If concerned citizens would have been on standby with bottles and bricks this tragedy could have been avoided.
You cannot possibly justify the loss of one single innocent bystander over a traffic violation. This man was simply trying to provide service to the public, and now he's dead. This is real life - not the Dukes of Hazzard.

1. There is no evidence that it was a "high speed" chase in a residential neighborhood. It was a chase through a residential neighborhood, and that's all we know.

2. For the apologist @1:39 AM he was a long way from Flowood in S. Jackson when he crashed and killed the letter carrier. That is even more suspicion that he was seeking sanctuary in the sanctuary city of Jackistan, at maybe a homies or aunt, or a crime partner, whatever.

3. We don't have all of the facts and really don't know if this was for speeding only. Maybe there were warrants associated with the vehicle tag, i.e. lots of possibilities. The local media frequently gets things wrong or incomplete, but you won't see a correction.

I hate this happened but Kennef Stokes ought to be held accountable....he encourages these lowlifes to commit felonies by fleeing. As soon as the violator doesn't yield the right of way and pull over as the law states, that violator then commits a felony by fleeing. Stokes has always encouraged these lowlifes to run from law enforcement (beer bottles and rocks!) PULL OVER, take your ticket and FIGHT it in court.....Don't say he ran because he was scare or the color of his skin...the violator didn't see the race of the officer I'm sure. That violator made a decision and fled. Law Enforcement has the right to pursue....the Supreme Court gave them that right, not Stokes Law. Yes the department will have to face civil suit at some point over this but damn....PULLOVER and quit FLEEING. This would've never happened

It seems to be either one or the other:

1. It's normal to expect that a young man will risk life and limb (his and others') to escape a traffic ticket by any means necessary.

OR

2. Anyone who flees a traffic stop is already wanted for a far more serious crime, and therefore will flee to avoid arrest.

This guy was either running from a speeding ticket, or he was running from a more serious charge. The idea that he ran because he was afraid the police would hurt him for no reason is just total BS.

The answer to the problem is one that is easily fixed. All law enforcement officers should immediately open fire on any vehicle that does not immediately stop when cops try to pull them over. No more high speed chases and most people would obey the speed limit laws. There would be less criminals on the streets. Less prisoners in our over crowded jails. It is a win win thing. We cannot loose.

What if the suspect was fleeing because he just murdered his girlfriend, and was on his way to her mother's house to kill her too? (which is not at all far-fetched) In that scenario, the officer(s) would have been saving an innocent life by chasing down the suspect.

Lamumble and Stokes are both to blame for the death of the postman. When they made Jackson a sanctuary city all of the thieves and thugs took notice. They already knew they would not be prosecuted for any crimes they committed in Jackson but learned they would not be prosecuted for crimes committed in other cities as long as they could make it back to Jackson. Now even thugs from other cities know to run for Jackson if they think they may be caught.

The person running is the one who hit the mailman. The cops didn't hit the mailman. If you run from the police you are liable. When you get your drivers license you should have to take a test on eluding the cops. Or not have a dl at all.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
