Waste Management Sees & Raises Lumumba

 Waste Management fired back at Jackson Mayor Chokwe Antar Lumumba today after he declared a state of emergency yesterday so he could award a one-year garbage contract to Richard's Disposal of New Orleans.

Note to Waste Management: The lowest responsible bidder is the one legally entitled to the contract. Richards was lowest, not you. Chase Bryan is a good lawyer, but he won’t be able to get around the outcome determinative facts that Richards was low.

Because Choker Anter Lumamba is a elected black person, absolutely all companies and individuals which may oppose his digressive ideology, are therefore automatically racist. According to Mayor Adams (New York, NY), if you don’t look like him (having black skin), you can’t possibly interpret his understanding of the world. Choker has failed miserably. Not only has his legacy failed, but he has failed the very people who elected him. Unfortunately, most of those voters would never believe the truth. I think most of the first-go-round-voters simply never believed choker could run the city of Jackson so far down and create such a racists culture.

WM will most certainly be labeled racist. One can only hope that choker will be punished for his blatant abuse of power.

I think Wells Young hit the nail on the head. A mayor cannot declare an emergency because he didn't get approval for the vendor he wants. I think the mayor has been getting poor legal advice about his authority and power, and I think that if he pursues this "emergency" decree he will find that out in short order. But one thing I have noticed about the mayor. Every time he gets taken to court (the gun emergency decree) and then an earlier episode in this on-going debacle, he folds--quick. I think the mayor is all talk but can't take a punch, runs when he is confronted. I do hope the council, if not already fed up with this mayor's antics, will now see that the mayor's position is not only untenable but childish. I think the mayor is having a hard time understanding some basic things about government, such as checks and balances. I think he still doesn't understand that a mayor's authority is not nearly as broad and deep as he imagined.

FYI. Any vendor doing business with Jackson has to employ a minority contractor, if the entity is not minority owned to begin with. WM employs one owned by two African American, Jackson attorneys to collect Hinds Co. garbage. It's not a hidden arrangement. The mayor has to have a personal financial incentive to want Richards. Otherwise, it makes no sense.

That's right 9:20, you can always under-bid another company when you control the bidding process: "Let's see, Waste Management has doing an excellent job for decades, but they won't send a few bucks our way. Let's rig the bidding process to get a lower bidder who has proven to both New Orleans and Baton Rouge that they can't provide the service they contracted to do with those cities." WM is too good not to be punished for towing the "woke new city" line."

I look at their website and it says:

"With facilities in New Orleans, Baton Rouge and Mississippi, it’s our expertise and ability to supply the most discriminate equipment which has awarded us an increasing number of contracts."

You can pick over the lowest bidder if the company is not deemed to be a good fit as the Mayor likes to use or is Substandard to WM performance. Drop the Mic. @9:20 - that's a simplistic approach to how responses to RFPs are evaluated under Mississippi statutes. The rule states the "lowest AND BEST" bidder. There is nothing that says the "lowest" is the "best" and in the case at hand the one that the Mayor is presenting is not, in all evaluations, the "best" according to the evaluations that was established by the team that HE (our boy Mayor) appointed to do the evaluation.

With this request for proposals there were several options that required responses. Once or twice a week. With or without carts. Using those options, there were several ways to determine the "BEST" response. Your boy's submittal was based on only ONE of those responses, and even with that selection his chosen vendor was rated as the 'best' by a marginal percentage. If any of the other three options were selected, his "best" response was rated last among the responses.

Yes, the Mayor chose the one that gave him what he wanted. But - we live in a democracy where there are multiple parts to our governance. I realize you probably made it through elementary school where they taught that we have a three part government, and if they did you only understood it as applying to the federal government: i.e. the President, Congress. Supreme Court. But, it also applies to local government. The Mayor - as the Executive, cannot demand that his and only his way is the highway.

I'm sure you realize this and are probably one of his styphnates/appointees that have to defend his idiocy no matter what. But the Council members also represent the people and if they don't accept "his" opinion as to what is the best ------ damn it they get a say as well. Last time I checked, they represent the "people" just as much, or actually more, than he does.

If another one of the responses were considered - Richards would not be rated as being "THE BEST". There were other options- but your boy Mayor will not present them because he doesn't want that result. We don't know why he doesn't want the other choices, but for whatever reason it doesn't rise to the level of an emergency ---- just as it didn't last October when he tried this shit. There are other ways to ensure that the garbage will be collected, it just is not under the control of what HE wants. He was not elected as a dictator whereby he can insist on his way or the highway. The Council can, and it appears will, insert their voices into the discussion as well.

The question to be asked by those defending the boy Mayor is why he refuses - this time just like the last time - to not recommend either of the responses by the current provider (picked by a previous Mayor to provide this service) - when his personal preference was not accepted. Instead he has chosen to try to declare an emergency because he cannot get his way (kinda like my kids when they were 6 and 3 and playing in the sandbox and they didn't want to share their toys with the other.)

There is no emergency. The Mayor has multiple responses to the RFP that was advertised and received responses. He made a recommendation but it wasn't accepted or approved by the Council. Both sides of this argument have their reasoning; and each can defend why they made the decisions that they have made. But because the Mayor can't get his choice approved doesn't not rise to an emergency; there are other options available from this RFP (just like there was from the previous RFP) that will ensure that the city's garbage is collected.

This narcissistic Mayor is making noises that resemble our previous President - thinking that everything revolves around his on world and for his own benefit. Amazing that the two idiots seem to operate in the same world.

Just because he is black doesn’t make him a good mayor, nor would he be a good mayor if he were white. His color is irrelevant as to whether he is a good mayor or not. It is obvious he wants to game the system to award the garbage contract to his preferred bidder. The majority black council sees it for what it is, corruption. Richard's presents a cheaper option which would change the manner in which the garbage is collected. Richard's track record and ability is questionable. Waste Management presents a slightly more expensive option that keeps the manner of collection in it's present state. Their performance is very good and the city is generally satisfied with things as they are. The city council has rejected the mayor's preference for Richard's twice. WM stands ready to continue. What's the emergency?

The emergency is that Jackson has a mayor so determined to overturn the "status quo" and create his version of a radical's haven that he will ignore the interests of the people he is supposed to serve. If WM were creating a problem or performing substandard that would justify this mayor's actions, but the "problem" with WM is it's not part of the mayor's support team and therefore unacceptable.

When the fix is in, it doesn’t matter that WM was lowest (and best) bid and that they have a disposal site locally to haul the garbage to. The Mayor can choose the 1 category that Richards was low in, even if it forces a 96 gallon container on every household. So the Mayor chooses an option that guarantees garbage will be left on the streets if not in mammoth containers. With no transfer facility, or approval from mdeq for one, guess Richards will be paying a premium at Canton landfill, if there is capacity for all of Jackson’s waste. This will affect every registered voter in Jackson. Mayor May have chosen the wrong battle on this one. Either way, WM wins. I’m surprised at how generous they are being to jackson given the circumstances and treatment by the Mayor.

Here are the facts: Richards won the bid, fair and square and are millions cheaper than WM over the long haul. Richards has been in business since 1978 and has a good record. WM, on the other hand, has workers ready to strike on them and have inequitable service across our city.

Sure, WM will file suit, Chase will make a lot of money (good for him; he’s a good lawyer and guy), but they will lose. Mayor Lumumba is making the right call legally.

Richard’s ace labor management is what put so much garbage onto the streets of New Orleans the city had to hire an emergency contractor to clean up what the non-performing Richard’s staff did not. Wait for it here. Richard’s is the benefactor of an emergency then will cause another.

P.S. The self-described crowning achievement of the solidarity economy in the former Mayor Lamumba’s writings was passage of the “people’s” 1% sales tax. Yes. The big civil rights achievement was to take more tax money and still deliver third world water service to the underprivileged. What a win.

11:33 AM here's the REST of the facts. Richards did not "win" the bid - their proposal on one of the four options was deemed the lowest based solely on the price. But with the other four considerations, they were the worst rated of the three.

IF the only option that is deemed acceptable - as is the Mayor's position - is the one where we will all be supplied with 96 gallon carts, Richards' price is the lowest. And the reason for the carts? Normally it is so that the work can be done mechanically. But our boy Mayor has decided that a utility service should be considered a jobs program and dictated in the RFP that his office established that all trucks would be manned by two hoppers. With the recognized purpose of having carts is to eliminate the need for as much manpower, it would appear that the only real reason for the carts is so that some "unknown" company could provide them.

The Mayor's mouthpiece, COS Omeria, said that the reason is that the city would look so great with all those matching carts, with the city's logo emblazened upon them, lined up along the streets -- just think of how pretty that would be!! Bullshit. The idea of garbage cans matching making the City of Soul becoming beautiful is crap. There is obviously some other reason for the ONLY bid that was received that the boy dictator deems worthy of submitting to the Council is the one that requires the purchase of 50,000 96 gallon carts.

Richards did not win anything "fair and square". Mississippi law requires the selection of the lowest and best bid - not the lowest. And under the current administration there have been several contracts issued that were not to the lowest in price.

You have either bought the bait, or more probably, are on the Mayor's payroll - either officially as a city appointee or otherwise.

You can carry his water; you can carry his garbage. But trying to sell his garbage as fact doesn't carry real water.

Thanks for your thoughts although they ignore the statutory process. And since you are probably an attorney, aren't you restricted from presenting false facts as part of your argument?

No, KF - being "fair" to Richards, there were plenty of complaints prior to Ida. AND, a utility company, which is what a trash collection service qualifies as, is required to be prepared for an emergency. Yes, there can be some immediate problems with service, but the problems that existed after Ida related to trash collection continued well past the reasonable time allocated to natural disasters.

Yes, the city probably should have done more from their end, but when dealing with NOLA you should know to expect the same non-performance by the city as when dealing with the City of Soul here in Jackson.

Richards can be forgiven for a week or two after Ida, but not for the period that they failed to provide the required services. That is what they (or any similar provider) contracts for and agrees to at the time they solicit the work.

Hell, those folks can't get water to your house. Or shit out of your house to the treatment plant. They can't get a bill for the water, sewer, or garbage.

What makes you think that the City could perform this service? Idiocy?

The City of Jackson cannot: Provide Police Protection. Cannot provide water to its residents or commercial operations. Cannot make streets drivable. Cannot keep the sewage within the collection pipes.

Hell, they cannot even answer the 911 telephone lines when reporting someone in imminent danger, nor can they call an ambulance to the scene after they did not respond.

Turning garbage collection over to "staff"??

I truly hope you were kidding with your suggestion.

She even got someone from another city department to try and contact them and they couldn't get through. And you want to change garbage to that?

Let’s not forget. Richards Disposal has terrible reviews in current markets it serves. Also, it doesn’t even own the trucks it plans to purchase to serve Jackson. Do we truly believe they will be able to purchase and receive this equipment, hire enough to man these trucks in one month? All for a one-year contract? This smells like Metrocenter fiasco.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
