Trash Talk: Mayor Declares Emergency, Hires Richard's Disposal

Jackson Lord Protector Chokwe Antar Lumumba issued the following statement. 

Today, Mayor Chokwe Antar Lumumba declared a local emergency as the Council has again refused to authorize a contract with the top-rated and legally-procured garbage collection vendor.

The declaration comes as the city’s garbage contract is set to expire April 1, and negotiations to approve the winning contract with Richard’s Disposal have been unsuccessful. A majority of the City Council has voted against Richard’s Disposal, who won the bidding process in accordance with the law, and have provided no reasonable or compelling reasons for doing so.

The refusal to approve the top-rated contract puts the City in legal jeopardy.

Waste Management, whose bids did not win out in the last two Request for Proposal processes, is currently the City’s provider after a separate local emergency was declared in September. 

Without a contract in place, the City will have no means to collect garbage from residences and businesses potentially leading to a public health issue. The failure to properly collect and dispose of garbage could expose the City to civil penalties of up to $25,000 a day and other legal action by the state environmental arm, the Mississippi Department of Environmental Quality.

The Mayor, who exercises the executive powers of the municipality, has the sole authority to issue an emergency order. 

“It is unfortunate we are at this point,” Mayor Chokwe Antar Lumumba said. “My administration has worked overtime to explain every step of the process in what is normally a routine contract bidding process.”

“There’s no dispute that Richard’s won fair and square and would also save the City millions of dollars over the course of the contract, retain twice a week pickup with a cart and bring good-paying jobs to Jackson,” said Lumumba. “The only question now is how much legal exposure the City could face.”

If an agreement cannot be reached, the City intends to pursue a separate contract for garbage collection until a new contract is legally procured. The emergency order is effective immediately and will be brought before the City Council at its next meeting.

Whereas, in order to combat the dangers to the public health that will arise if residential garbage remains uncollected for six months or longer (KF: six months?). while the City attempts to procure a contract for the collection of residential solid waste in accordance with Section 31-7-13(r), the Mayor intends to contract on an emergency basis with Ricard's Disposal, Inc. for the collection of residential solid waste beginning on April 1, 2022, continuing for period of one year or the procurement of a permenant contract complying with the requirements of Section 31-7-13(r).

If Richards "won" the contract it is likely because a subjective steerable request for proposals (RFP) was used instead of an objective bid.

This is what is commonly done at the airport, and other places, in order to influence those scoring the proposals into skewing toward who the board wants for whatever reason and hiding their role.

RFP - think Ouija Board.

In Richard's Disposal home of New Orleans, 24 out of 25 YELP comments gave them a 1 star out of 5, only because a minus 5 wasn't available.

Their typical comments included variations on: "Would not answer phone" "Finally answered phone, said they would come get neglected garbage, never did" "Richards ran over huge garbage can, never replaced it" "City said call Richard's, not the City because locked into contract", "Garbage workers are surly, rude", "Garbage was picked up two weeks late" ...

Imagine the horrors we are facing with a NOLA "Dick-n-Dump" crew.

According to this mayor an emergency currently exists, that is why Waste Management is still handling the garbage pickup, now he says an emergency exists again but now we need Richard's to handle garbage. It's the same emergency being extended, so why not extend Waste Management under the emergency declaration for one year until he can give Richard's another
bite at the apple? Obviously this mayor whose mantra is "transparency"
and "radical cooperation" is just another jive-ass politician who manipulates legal technicalities to suit his purpose. "The ends justify the means."

This order is dated February 10, which was the date the mayor was going to bring this contract before the council for the third time, but then pulled it from the agenda after coming back from executive session. In other words, the mayor was going to try to get council approval of the contract but then decided to issue this proclamation instead.

And another thing! Lumumba keeps claiming that Richard's "won" the bidding process, but if you look at the scores previously posted on 2/1, they reflect that Richard's came in dead last of all three bids in every single metric other than price. Last in "innovative approach," last in "plan for performing," last in "experience," last in "qualifications of personnel," last in "references," even last in "equal business opportunity." The only way they "won" the bid was by being cheap. Plain and simple. Even then, the only service category they "won" was the twice-per-week-plus-cart category with a score of 81.8, as compared to the 79.95 score of the company with the highest scores in experience, qualifications, and references, and the 81.09 score of the company with the highest rated innovating approach and plan for performing.

Why on earth is our major so hell-bent on changing to the least qualified and least experienced option, when garbage pickup is one of the only things in Jackson that isn't currently broken?

3:10, Richard’s also didn’t adhere to its contractural twice weekly pickup in New Orleans, to the point the city let an emergency contract to clean up what Richard’s didn’t, and now the City of New Orleans will begin charging residents the twice-per-week rate but provide only once-per-week service. Blown out roads, violence and mayhem, non potable water, dysfunctional 911 dispatch, and now impending collapse of the trash pickup system. It’s an awful situation in Jackson and hurts our entire state. It especially hurts the people who can’t afford to leave the city.

When the smoke clears, all of this will be exposed (in litigation, I hope) as a scheme to sell garbage cans and reduce scheduled pickups to once a week. BTW, Richard's Disposal services only part of NOLA and Algiers and was unable to keep enough trucks and crews rolling to maintain the twice-weekly pickups called for in the contract. Just run an internet search for this outfit and you will see.

Travel deep into west Jackson on a Saturday afternoon and just look at the grocery store parking lots covered in trash and filth and note the dirtied diapers, among other filth. A certain demographic apparently isnt bothered by this. Totally content to wallow in filth and garbage. If this is "racist", well, then so be it. It is what it is. It's a "fact". "Fact check it" this weekend, if you wish. I occasionally do since I find it somewhat amazing.

The first bidding process was won by Waste Management. The mayor then unilaterally and illegally changed the contract term from six years to one year. The subsequent bidding process, therefore, was not "in accordance with the law."

With the water and sewer service already screwed up why not a campaign to "Flush dat garbage" and hand out FREE disposals for sinks. Of course there might need to be a FAQ somewhere on how to handle used tires properly, but maybe MDEQ can give them some input on that.

This is going to be fun! The mayor has declared an emergency because his choice was not approved. So, instead of submitting another bidder the mayor declares an emergency, sign a contract with the contractor voted down, and says that that contractor will be doing the work until the council approves a contract. You think the mayor is going to present a contact for any other bidder during the emergency. I think hopefully a judge will see what the mayor is trying to do. If a mayor doesn’t get his way he just declares an emergency so as either circumvent a council’s decision or force the council to reconsider. I just hope the council has the opportunity to vote on th declaration and vote it down. In any event, how much more does anyone need to see just how smelly this whole deal between Richards and the mayor is?

I believe when a motorist traveling I-55 calls 911 several times when he notices a young lady in the process of jumping off a bridge and the 911 calls he made ARE NOT ANSWERED, then that's a tragic emergency compared to a garbage contract emergency. If JPD doesn't have enough staff to answer a 911 call, then the Mayor needs to focus his attention elsewhere throughout the city instead of a bogus garbage contract that only he wants approved. Like others have previously stated in these comments, the garbage with Waste Management is the ONLY thing that is somewhat working in the Mayor's city. May that young lady rest in peace while the rest of the Mayor's city goes to hell.

Council can probably take the Mayor to court and argue that he doesn't have the authority to declare a state of emergency over his own creation.

Council cannot extend the current WM contract - or renew it - without the Mayor bringing the contract to the Council

But - the Mayor cannot act as a dictator, as he is wont to do, by just doing whatever he wants whenever he can't get four votes out of the seven member council. They have a role to play in this idiotic chaos, and are playing that role. Its the boy Mayor that doesn't understand that he can't insist on his way or the highway.

The interesting thing would be if council refused to approve the claims docket if and when Richards Disposal picks up some garbage, claiming the contract was not valid. The requirement that any payment must be approved by the Council does exist in this form of government - wonder if the Mayor has considered how those NOLA folks would react if they pick up his trash but don't get paid.

So the mayor is more interested in making sure he gets his kickback from Richard's, than working towards getting 911 restored to where someone will actually answer! Waste Management is doing a very good job now and doesn't need to be replaced.

A 15 year old girl jumping off a bridge because 911 would not answer makes the mayor look like what he is: someone who only wants the office of mayor to feel important, powerful, and able to work backroom deals. SHAME on you Mr. Mayor.

Last time I looked, the Miss. Constitution still provided for a State Auditor to “correct” problems like this. It will take some time, but it will be fun to watch.

Whoever 8:14 is,he needs to be re-schooled, because he clearly doesn't understand the definition of mayor: A mayor's duties and responsibilities may be to appoint and oversee municipal managers and employees, provide basic governmental services to constituents, and execute the laws and ordinances passed by a municipal governing body (or mandated by a state, territorial or national governing body).

This so called clown playing mayor strikes out on two of the responsibilities right off the bat.

Council should meet and vote the emergency down.

They did it before.

If the mayor objects and sues to enforce his edict then discovery can be had of all reasons for this contract.

Separately someone in the AGs office should begin to inquire of Richards and all terms which have been negotiated.

Extraordinary times call for extraordinary measures and chancery court allows for equitable remedies.

The guy doesn't have a humble bone in his body, he constantly doubles down on ridiculous subjects like the Zoo, and is the most arrogant prick you'll ever be around. It's a shame because he really is a bright guy, but he just won't let the arrogance go. The State Legislature would be way more apt to help if he would attempt to work with them, cut out the racism garbage every time they disagree, and have a serious working relationship. Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
