State Auditor "disappointed"
Theodore DiBiase, Jr. walked out of the federal courthouse today a free man with his head held high after a jury acquitted him. The docket for U.S.A. v. Dibiase states:
The Jury found the Defendant NOT GUILTY as to Counts 1-13; therefore, was released from all conditions of his bond.
A federal grand jury indicted Dibiase for conspiracy to commit wire fraud and theft of programs receiving federal funds, wire fraud (6), theft concerning federal funds (2), and four counts of money laundering.
State Auditor Shad White issued the following statement:
While I’m disappointed in the result of the trial, nothing changes the fact that seven people have already pleaded guilty to state or federal charges because of the welfare scandal. My hope now is that the state’s lawyers will be able to recover as much of the misspent money as possible in civil court so hard-working taxpayers can see some accountability for what happened here.
Now that the Dibiase trial is concluded, Nancy New, John Davis, Chrsiti Webb, Brett Dibiase, Jake Vanlandingham, and Zach New can be sentenced.

Will any high-level persons be held accountable for misdirecting federal funds? (with this verdict, very unlikely, that's sad).
The core of the issue is the Fed's use of "block grants" with little or no control. It's taxpayer money regardless of the source.
Maybe now all of you jackholes whining about who is not being prosecuted can take an honest look at your many hours of impotent rage and try to do something more productive.
Anyone can speculate about who may or may not have done something shady or unethical. Obtaining a conviction is a different matter.

This trial was a waste of tax payer dollars.
I think the charges here were a bit of a reach. Prosecutors were going to have to prove that DiBiase was knowingly participating in the scheme, which is going to be hard to do when you don’t control the money. When Nancy New said on the stand that DiBiase always did what was asked of him, it is difficult to prove it was a no show job.
A contract is only as good as the enforcer, and the enforcer was more worried about being a friend than a boss. You can be contractually obligated to perform a service, but if you are never required to deliver… eh. It’s breach, yes, but the person who was in charge of enforcing the terms and conditions wasn’t all that interested in results.
That being said, the misuse of welfare funds is disgusting, and those running and directing the scheme should be severely punished. You’ll always have a problem tying the beneficiary to the crime. It would be akin to charging a USM volleyball player for playing at Philbilly-Favre Volleyball Welfare Arena.
"Not guilty" is not the same as "innocent." It just means that the government did not prove their case.

In the pro wrestling parlance, Teddy Jr. found him a money mark and he did what he had to do to keep the money mark throwing money his way. While ethically questionable, for sure, it wasn't him throwing the money at himself.
It seems you can commit fraud and have no consequences. Sounds like more people should get in on the new money making venture. Just need to establish a shell company before deciding which Ferrari I will be buying first.

The AG’s office signed off on the use of TANF funds for the volleyball arena, It’s disgusting that the funds were used for that purpose, but there is nothing to prosecute. USM should have refused the money once this was known, as they could have easily raised it.
The only issue with Favre is paying interest on the funds he possessed for doing nothing. He already repaid the funds, just not the interest that State law says he owes.

But if they do there is nobody to protect them. The law is not meant for them. However stealing from the rich will get you in some serious trouble. The law is to protect them. That's fact. I'm shocked, but not all that surprised. If i were on this jury, and had to keep showing up for a week here, and a week there, only hearing testimony for a couple of hours a day, I would be, umm, perturbed, to say the least and just want to be done. I dont think the prosecution did a good enough job of showing that "the contract says he was required to do A, B, C and D, yet he only did C and got paid exorbitantly." If they can't show that he didn't complete the scope of work or there was no scope of work; then there's no crime.

Lots of posters obviously only wanting a head to roll. Why not this defendants'. The answer to why not is that he did not knowingly participate in this fraud and that was shown to the jury. He did what he was told to do. He, like others, felt confident (who wouldn't) if the grant holder, the agency head, the Attorney General and the Governor were all signing off and glad handing these disbursements of grant money, then it was fine.
The rest of you can keep salivating and disregarding the evidence presented in court.

I’m pretty sure that the other defendants who were pressured into pleading guilty wished they had waited. Shad’s witch hunt to protect his benefactor and try to prove he is governor material, was shot to hell. Good.
Sounds like you should never sit on a jury. I suppose when a crime happens to you, you would be more interested in the jury wanting to hear the evidence instead of just wanting to get out of there.
Remember wrestlers have brains that have been scrambled a bit. The state couldn't prove that DiBiase had any criminal intent.

This was a "sweetheart" contract, or a "Good old boy" contract.. Call it whatever you like, but there was no review and approval clause for services rendered. If that had been included in the services contract, then Ted's work would have been reviewed before payment and the fraud might have been avoided. As the contract was written, Ted did whatever he wanted and submitted bills that were quickly paid. In court, he successfully defended his work, pitiful as it was and showed that "Technically" He met the contract requirements. Slick work if you can get it. Whoever wrote the contract needs to spend time in Jail. Ted simply proved the old "You knew I was a snake when you picked me up" line of defense is technically true.
Shad White should be in jail. If the civil trial gets going now, he just may end up there.
