Open carry rematch today. Gipson speaks.

Judge Kidd will hear arguments today on the temporary restraining ordered he issued June 28 against enactment of the new "open carry" law. HB2 author Andy Gipson (R-The Wild West) sent these thoughts about the legal scrum to JJ and gave permission to use them:


"The Amended Complaint filed with the Hinds County Circuit Court on July 1, 2013 alleges that House Bill 2 (which defined the term "concealed") is unconstitutional on three grounds:

1) "Unconstitutionally vague." House Bill 2 defined concealed as: "hidden or obscured from common observation." Moreover, examples are given as to what is not concealed such as carried in a holster open to common observation. HOW IS THIS VAGUE TO ANY COMMON SENSE PERSON???

2) "Overbroad." House Bill 2 narrowly defined the word "concealed" to ascribe to it a meaning that can be understood by most people. If you can seesomeon has a gun, it's not "concealed." If you can't see a gun, it is "concealed." IF ANYTHING THE LEGISLATURE GAVE THE TERM "CONCEALED" A NARROW DEFINITION, NOT A BROAD DEFINITION. HOW CAN THIS BE UNCONSTITUTIONAL???

3) "Arbitrary and Capricious." This is where it gets most interesting. The complaint alleges that the definition "is arbitrary and capricious in excusing persons who wish to openly-carry firearms from the license requirements imposed on persons who wish to carry concealed firearms." TRANSLATION: HINDS COUNTY OFFICIALS WANT TO REQUIRE GUN LICENSING AND REGISTRATION OF ALL GUNS BEING CARRIED BY MISSISSIPPIANS. THIS IS THE SAME LINE OF THINKING BEING PUSHED IN WASHINGTON D.C. AND NEW YORK CITY, RIGHT HERE IN OUR OWN BACKYARD.
"

Gun folks brought this on themselves. It was already legal, but the politicos wanted to score some points by passing some unnecessary clarifications. Now there will be "no firearms" signs all over town, regardless of what the judge rules.

(1) I don't feel safe in Hinds County without a gun.

(2) There are already too many guns in Hinds County, carried illegally by lawbreakers.

(3) Without a gun, I won't be doing any business inside the boundaries of Hinds County.

(4) Businesses that post these "Guns prohibited" signs in Hinds County is creating a further deterrent from doing business with the citizens of the surrounding counties.

(5) I'm not for or against the open carry law (I see both sides of it), but I am tired of people believing that they can choose to violate my constitutional rights that too many people died for.

(6) The open carry law will not help or hurt the problems plaguing Hinds County (Jackson in particular). The law will not create the Wild Wild West. . .the wannabe thugs in Jackson with their guns created the Wild Wild West in Jackson several years ago. Until the wannabe thugs have their guns removed, Jackson will continue to be a problem.

12:53....who else can you blame all of these new "no guns allowed" signs on? A lot of licensed concealed carriers will now have to decide between trespassing or taking off their gun or going somewhere else. Should have left well enough alone. And by the way, not sure where 12:33 is going to buy his beer now, I bet by the end of summer every retail store in the area will have the same sign.

I can think of few businesses that want people that are carrying a gun on their hip. I can think of a couple that wouldn't care: biker bar and rough juke joints. For those that say they won't patronize businesses with a "no guns" sign, you'll be eating at home or out of a paper bag a lot; having cocktails on your own patio, and buying your clothes out of the trunk of a car on a parking lot. Stupid bravado statements without a lot of substance.

I would be for open carry if a permit to do so required an IQ of 100,passing a hair folicle test for drug use and testing within the normal range on the MMPI. Passing an eye exam and hearing test would be nice , too.

I wish those requirements were also required to run for public office.

So, we are going to have people who barely made it out of high school, who abuse drugs or alcohol,who can't see or hear well, who are neurotic or crazy able to openly carry if they have yet to have a record at Whitfield or with their local police ( of course,( sealed juvenile records will mean the some policeman might know but can't do a thing about it).

And, of course, all those Haley pardoned can openly carry.

I expect those openly carrying will also have tiny feet.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
