Whitwell proposes ordinance allowing public access gates.

Jackson Ward 1 Councilman Quentin Whitwell proposed an ordinance permitting public access gates in Jackson. The proposed ordinance (posted below) will allow Jackson residents to apply to the city for approval to install a public access gate. The appropriate departments must approve or deny the request within thirty days. If the request is denied, the reasons for the denial must be stated in writing. Approvals will be forwarded to the city council for final ratification. Denials may be appealed to the city council as well.

The ordinance also specifies who shall pay for the gate: "The parties requesting the public access gate shall agree to to assume all costs and responsibility for planning, installation, and maintenance of the public access gate, including repair or replacement if the public access gate malfunctions, becomes inoperable, or is damaged.

Mr. Whitwell said in an email to JJ "I am introducing this resolution because public safety is the most important issue in Jackson. We do not want to allow for potential criminal activity to fester. We want to be pro-active and we want to send a message that although streets are public, roads are not to be used to scope out potential criminal activity. Jackson is a great place to live and we are going to protect the property values of those people who choose to live here. Other counties and cities in the surrounding area have them. So should we. Authorizing public access gates is a great compromise that addresses the concerns of both sides of the issue. I hope to see my colleagues work with me to adopt this ordinance"

Hopefully the City Council will approve this measure regardless of Mayor Harvey Johnson's wishes. Northeast Jackson residents were frustrated in numerous attempts to obtain public access gates for their neighborhoods as the city denied all requests. Mr. Whitwell told this correspondent the city's position was they were not allowed since there was no law permitting their installation and use.

I mean, 'trying to keep a criminal element out' is a racist concept, right? Q said so himself about the Sandridge ad. But here, Whitwell is actually tryng to physically divide people. This is shameful and racist.

Its about discouraging crimes of opportunity. The gates don't keep anyone out, it just encourages them to go somewhere else to make an easy score or find something else to do.

Nice reach for the racism card....Seems to be nothing more than an attempt to stir the pot. Otherwise, leave your car unlocked, put your cell phone on the dash, laptop on the seat and go park it on the curb.

i like quentin.. so far. he has brought up issues that pertain to his precicnt and said it like it is and i wish this ordinance would pass.... but why on earth does quentin think this will pass.. imagine what is being said back and forth between chok-away, kenneff and harvey say when they are behind closed doors.. they say people are taught to hate... i can only imagine what chok-away teaches to his people behind closed doors

Communities everywhere are putting in "Public Access" gates... why not have them in Jackson. Maybe they would encourage some residents to stay instead of bolting to Madison and Rankin where most communities have them.

The State Legislature even passed "local-private" legislation this year allowing the Madison County Board of Supervisors to approve "Public Access" gates in the non-municipal areas of the County.

Why not approve everything that can improve the safety and welfare of the residents? I think all races want safe environments to live in!

The State AG has many opinions showing that municipalities can approve gates, stop signs, speed humps, etc., when they improve the general safety and welfare.

It is a different story for counties. They cannot approve "public access" gates.

I'm serious about the apartment complexes. I've seen premises liability cases where the plaintiff alleged that they were raped/robbed/whatever because the gates were defective. Esp. North Hill Square.

What really bothers me is that this proposal pits neighbors against neighbors, streets against adjacent streets and neighborhoods against neighborhoods. The fine definitional line between a residential street versus a collector street in a residential setting only primes the pump for disagreement, conflict and lawsuits.

I don't think this will pass. It certainly won't withstand Harvey Johnson's veto.

Twitterwell falls short of being precise here because his proposed ordinance creates two classes of citizens who may receive the benefits of gating deterrence. Regardless of the ability to pay his ordinance segments out only a subset of residents for special treatment.

There is no logic to the notion that because not everyone can afford to do something, that those who can should be barred from using the fruits of their labor as they choose. And, that a gate is only to keep out a race is racist on it's face.
This is the politics of creating emotional conflict where none should exist in an effort to manipulate voters.

I think its funny that very few people understand J Kevs excellent point. Twitwell called a recent ad by Madison County Sheriffs canidate Sandridge "racist" in the clarion ledger. The ad was about proptecting Madison County from the crime of jackson and twitwell called it racist. Now he wants gates to protect the people of his area from the crime of jackson. if the sheriffs ad was racist, twitwell surely is also. So know the facts before you try to smash on J Kev.

Quentin is a good guy. Big heart. Have known him for some time. Voted for him. Sometimes ego gets in the way and he goes temporarily tone deaf. This ordinance is an example. Does more big picture damage than the boost it gives in the ward. Gates don't bring people together. Could the timing be much worse vis-a-vis his published comments barely two weeks old about the Mark Sandridge ad? The predictable race agitators will have a field day with this in the press. Would you be okay if the people on Kaywood could do a gate but the people on Saratoga could not because it will undoubtedly be designated a collector street or road?

Should the properties behind a gate be subject to a higher valuation for property tax purposes since same would be worth more because they benefit from the added deterrence the gate provides?

No one gets it. People in jackson should have gotten out a long time ago. The only people i know who still live in jackson are the ones who can afford to or cannot afford to get out. My wealthy friends can afford alarms, gates and private schools and my friends who live in the worse parts of Jackson cannot afford to get out. It truely is a city of the haves and the have nots. The issue here is for the haves and is an outward sign of frustration because thee people are helpless in a lawless city. The middle class both black and white have bolted and for good reason.

I STILL don't see the racism. I think people like turning things into bigger issues than they really are..but, that aside, let's discuss the gates.

I, for one, am so for putting gates in Heatherwood. I think it would deter SOME crime....not all. Nothing is going to stop the crime 100%, but I do think gates help some. Heatherwood has entirely too many cut through roads. Close some off and add a gate to keep some of the criminals out. Now, me saying that does that make ME racist? Because I basically just said the same thing Quentin said- he wants gates up to keep criminals out. The word criminal isn't the color of someone's skin...
If I were to say "I want gates put up to protect us from black people"...then yes, that would pretty much make me racist. But instead, I want to be protected from C R I M I N A L S. I could care a less what color their skin is- white people, mexican, asian, black people....whatever they are...if they commit crimes then I want a way to try and prevent them from entering my neighborhood.
We are armed. We have an alarm system. But, they don't care. Criminals these days have ways around it all- they are not stupid. And majority of them do not want to mess Takes too much time. Are ALL gated communities safe? Well of course not. No one is 100% safe. But it would help...and I am 100% for it.
THAT isn't racist. THAT is wanting to be safe....

On another note...12:17- our house is for sale and we are moving this summer to get out of Jackson. Tired of it. I don't even feel safe going to Walgreens at night and you can forget Kroger! I hope Quentin can do some good things for Jackson...I am all for the gates Quentin so keep it up. But all the "he said/she said" racist remarks is bs. It sounds like Donna Ladd has hacked this blog. We pay slightly over $1000 per year to our HOA (outside Jackson) to have guards 24/7/365 at the entrance to the only road into out neighborhood. Happy to pay it too.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
