House approves Nissan bill by ONE vote. Black Caucus tried to kill it.

March 30, 2013 - House Approves Nissan Expansion Measure 72-45

Will Help Create Jobs at Nissan, Will Protect Taxpayers

FOR IMMEDIATE RELEASE

JACKSON - The Mississippi House passed a bill today that will enable the creation of 800-1000 new jobs at the Nissan plant in Madison County. The bill passed the House with the required 3/5 vote, but has been held on a motion to reconsider. It will likely come up again for a vote tomorrow. If passed and signed by Gov. Phil Bryant, It will allow the issuance of up to $100 million in "revenue-only" bonds to support expansion at and around the plant. The revenue from the bonds will come from lease payments that Nissan will guarantee, and only the bondholders will be liable for the debt. There is no recourse to Mississippi or Madison County taxpayers.

The bill's principal author, Sen. Will Longwitz (R-Madison) said the bill will help create jobs and will also protect taxpayers. "This a big win for Mississippi. Taxpayers are not liable for any of this debt, but it will create the right conditions for economic expansion and job creation at this facility. This is going to benefit people in Madison County and all over the state."

The bonds would be sold to private financial institutions, and are not backed by any state or local government. The new buildings will house suppliers that will work on the new lines of vehicles at the Canton plant.

Black caucus voted against it but look who else did: David Baria, Linda Whittington, Bob Evans, Steve Holland, Bobby Moak (D-Annandale), Oberhousen, and Cecil Brown.

You should have heard the anger and venom in Adrienne Wooten's voice last night on WMPR. She raised hell about projects like Kemper and how they were annexed or within city limits. According to her, it was because Canton is a majority black city and racism was in play. Um, Ms. Wooten, how about this: Canton has the highest tax rates in the area. Nissan didn't have to come here. Nissan could have gone to another part of the state or another state..... or another country. The problem with you and your friends, Ms. Wooten, is not racism but that you see every business like Nissan as something to be plucked, not something to be developed and grown. Its all about what you can take from them, not how they can help an area grow. You are definitely the enemy.

Message to Black and White Mississippians: Reps Wooten, Smith, Rogers, Warren and Blackmon (and the 40 others who voted against it) do not care if you have a job and a paycheck or not. They would rather run off Nissan altogether. They should be voting to expand one of the major job creating companies in Mississippi.

There is no defensible reason to vote against this bill, if you understand the bill.

First they vote to protect child rapists in their community, now this. Of course it goes without saying that they want to kill any bill that requires mastery of subject matter in order to advance in school. What else goes on this list of three? I'm sure there are others.

Recourse is defined as "The right to demand payment from the endorser of a commercial paper when the first party liable fails to pay."
So in this instance, because the industrial development bonds are not guaranteed by the state, nor are they guaranteed by Madison County, there is no recourse to either if Nissan fails to pay the lease payments. The lease payments are what is paying the private bond holders.

Wow 7:05; you're good with comparisons. But your talent in that regard is balanced by your inability to understand the guarantees of this type of bond. The Obama bailouts did nothing but grease the palms of constituents, friends, greenies and labor unions and in many cases screwed the taxpayer.

7:05 please educate yourself. The bonds are guaranteed by Nissan's lease payments, nothing else.
The CONSERVATIVE vote is to force more businesses to use this Nissan kind of financing, rather than getting the state to back their tax free bonds. With normal bonds, when the business fails, the taxpayer is liable for the money.
With the type of bonds Nissan is wanting, if Nissan were to go under and stop making the lease payments, private bond holders would get in line as creditors of Nissan.

Has anyone read from Section 7 down on this bill? Taxpayers not on the hook? That's a laugh if you read the bill:

Sounds like an economic or re-development agency with funds going back to the agency. Also, as far as the county issuing bonds without a vote from the people? The three notices time-frame doesn't leave the citizens much time to oppose it, or even know of it.

I also don't think it's fair to put the burden on the tax payers to stop raising taxes by having to gather a petition to stop it. We are busy people and have more important things to do than run around and try to get a petition to stop it -- there should be a vote required.

..and it takes taxed property out of the system, less revenue that taxpayers will have to make up for "Hence, any property owned or held by the Authority or under its jurisdiction under the provisions of this chapter shall be exempt from all taxation in the State of Mississippi."

1:20 This does not raise taxes. The bond is backed not by taxpayers, but by the lease payments from Nissan.

As far as Nissan paying taxes on the property, I would argue that it is better to create 1,000 new jobs so people can get paychecks and support their families.

I remember when J Jackson went to OR back in the 90's to meet Nike founder and owner Phil Knight. He told Phil he wanted him to start giving money to his foundation, Phil said NO. Jess then said if he did not he would start a national and then a global boycott against Nike.

Remember what Phil Knight said?

Has anyone seen a written agreement with Nissan --If so who is involved in the agreement and what guarantees does Madison county taxpayers have in not having to pick up the tab later--First, where is the written agreement spelled out on who is responsible for the debt???

How smart is that? To push the beef plant that cost Mississippi taxpayers $55 million plus, but refuse to support the Nissan expansion bill that will cost taxpayers no money, and will bring us 1,000 new job.

The revenue bonds cannot even be issued until Nissan gives a legally binding agreement that they will guarantee the revenue stream. No institution is going to buy a bond without a guaranteed revenue stream.
It is impossible for the state or county government to obligate themselves on a revenue-only bond like this. Again: these are not general obligation bonds, and it's not possible to get to the taxpayer through them.
And, yes, the bond agreement will have everybody's guarantee of everything you mention. That's why agreements exist. It would not be possible to issue these bonds before all those agreements you put in capital letters exist.

Also - Chuck Espy voted 'present' which in this case was either him wanting to say 'yes' but couldn't buck the black caucus (no balls) or else it was a 'no' but at the last minute realized it wouldn't change the result so he was looking for campaign contributions for his mayor's race.

First let me be clear, I am glad that Mississippi is in line for more jobs. I am also glad that Nissan has seen the work ethic of the fine people of Mississippi.

But here is my problem. If Mississippi is going to help Nissan again, why can't we have a little say in where these suppliers go. Could we not put some in Lexington, Crystal Springs, Magee or other outlying cities so more citizens truly benefit from the Help Mississippi will give.

Again I am glad that we are seeing these new jobs, just wish they could be scatterd out some.

1) from what I've read here, the taxpayers aren't putting a nickel into this. the legislation allows Nissan to float bonds for which Nissan has the sole responsibility of paying back, with no contribution from the taxpayers.

2) Suppliers want to be near the customers; it increases efficiency, therefore it increases profits. Why drive 200 miles to deliver a load of batteries, or windshield wiper blades, or whatever, when you can locate 5 miles away? The customer also likes having them closer for emergency deliveries.

8:16 - these suppliers, and Nissan, are what is called "private businesses". They are going to make their own locational decisions. It is not the job of the state to decide where these businesses locate, nor is it the function of our 'esteemed' legislators to dictate where they are going to locate.

This bill is not the state "helping" Nissan or the suppliers. All the state is doing is allowing Madison County to issue revenue bonds so Nissan can borrow money - nothing but an accounting technique.

If Holmes County (for example, since you used Lexington) wanted to create a business friendly environment and at the same time offer the same support, maybe they could get some suppliers to locate there. But the state shouldn't be in the business of "telling them" where they can locate. That's not the process in our capitalistic society.

By the state allowing the sale of the bonds, Nissan is enjoying the states bond rating at no cost. So yes the state is in this. Also ask the folks in Senatobia, who would not be on the hook for the bonds sold for the solar power panel plant how they like now being on the hook.

If any type of Governmental entity is the one selling the bonds then the they are on the hook.

I know Nissan is not a start up company and the risk is better, but it is still a risk and the taxpayers are on the hook.

I understand tier 1 suppliers needing to be close but tier 2 and 3 do not have to.

So I again say lets help the WHOLE state and not just certain parts.

If I'm not mistaken, it's been stated in the bill or the proposal that a portion of the money will be used to actually 'centralize' suppliers, maybe under a single roof. If suppliers are spread out from Lexington to Magee, that would raise the cost of everything involved and guess who that cost would be passed on to.

Nissan (naturally) controls the benefits and wage packages at its suppliers as well as training and certification requirements of the employees and temps used by suppliers. That's standard operating protocol when it comes to major industries and their subcontractors/suppliers.

3:36, you are comparing apples to lumber. The Senatobia project funding has no relationship to this Madison project. They will not be benefiting by the State's bond rating - the bonds will be those of MCEDC and guaranteed only by the lease payments from the facilities.

You are just factually wrong about the state, or Madison County, being on the hook for these bonds. Don't you understand the term "no recourse"? Obviously not, just like you don't understand that the state doesn't dictate locational decisions of private businesses.

I am not factually wrong. The bonds in Senatobia were not to be paid by the city of Senatobia, yet when the plant did not make they were. Look when you are talikng millions of Dollars someone is on the hook. We failed to help the state the first time we attracted Nissan, when we did GIVE them millions of dollars and I mean MILLIONS, by not putting in the package that tier 2 and 3 suppliers would be locate 60 to 120 miles from the plant. I never said what cities I used some as examples.

Again as I stated in my first post I am not against this. All I would like to see is that when my tax dollar is used to land new jobs that I have a chance to benefit from it.

What would be the benefit of requiring suppliers to locate within '60 to 120 miles from the plant'? I can understand the state requiring a certain percentage of the suppliers to be located WITHIN the state. Some suppliers are critical and are outside the state and are not readily duplicated. But, again, requiring they be located here or there is nonsense. That would be like requiring Nissan use UPS as opposed to FedEx or that they shop only northbound via rail. Confucius say 'The more requirement you place on prospect the more likely prospect tell you to take flying damned hike'.

The benefit would be that those of us who are paying taxes, that are then given away to land industry would benefit directly from said industry locating here. This has been done in other states and has worked, can be done here also.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
