Breaking: Investors sue SteadiVest, owner Wolfe, Travelstead, McRaney, Adcock, Harrington

WLBT story

Investors of SteadiVest filed a lawsuit in Rankin County Circuit Court yesterday against SteadiVest owner Marshall Wolfe, Attorney Patrick McRaney, Joel Travelstead, Investlink/TFS Income Fund, The Investlinc Group, and several John Does. The suit charges the defendants with the following counts:
Count I: MTW Fraud
Count II: Steadivest Capital/TFS Fraud
Count III: Steadivest, LLC Fraud
Count IV: Negligent Misrepresentation
Count V: Conversion
Count VI: Civil Conspiracy

The lawsuit seeks return of all monies lost, attorneys' fees and court costs, and punitive damages. The lawsuit claims the defendants defrauded the plaintiffs of over six million dollars through the sale of phony promissory notes, (remember Ed Peters and the Nasa case?), which defendants used to support a lavish lifestyle while lying to investors about the true nature of the financial state of Mr. Wolfe's companies.

I don't think Wolfe is going anywhere right now as he reportedly has not been seen for months.

Kudos to WLBT. Did a great job on story. keep in mind they only have two minutes to work with. Only correction is the BK was filed after the TRO request as a defense against the petition.

My prediction? This thing is not going away as there is more to this story. I would not be surprised at all if the authorities are not already looking into this matter.

Ok, let me spell it out. Pine Lake itself is not the issue here so any commments about the Pastor are going to be zapped. You want to talk about Wolfe and others using the church as a means to snooker others, fine, but that is not a reason to criticize the church itself. Most professional scammers will pass themselves off as very respectable people and that includes church. Churchgoers in some areas are a little too trusting and they count on that fact to further their schemes.

I didn't see where it specifically states what Travelstead, McCraney, Harrington and Adcock did. I see lots of wolfe, but not the others. Maybe I missed it, which is entirely possible. I understand that an atty is needed to conduct RE transactions, and I'm assuming that's where McCraney comes in. And somebody's got to work the financials so that explains Travelstead. But it never states (that I could find) McCraney did this, Travelstead did that. And who are Adcock and Harrington? Don't see bios for them in part 2. And what happened to Smith who was listed in the bio?

The companies were named and some of the defendants were owners or officers as well.

Also, in most fraud cases, the attorney is usually in on it as they tend to use the same guy over and over as the lawyer can usually spot the scam after awhile. In this case, someone was setting up all these little companies that were shuffling things back and forth not to mention conducting the real estate closings, trustee notices for foreclosures, etc, not to mention they were using Mcraney's office as an address for some of these companies at some point if I'm not mistaken.

Also, there were several exhibits in the file I didn't include as it would've cost me about 40 bucks to copy them. They included promotional materials, financial statements, and other items.

If you look at the last two pages of part 2 of lawsuit, you will see the bios I copied from one of the promotional items they supposedly used.

Keep in mind this is still developing and discovery has not taken place yet.

Adcock and Harrington were partners and in the office full-time. There were numerous daily meetings so they had to know what was going on. They were drawing salaries of $200k each.

You all need to stop assuming things and jumping to conclusions - based on what I have read, most of you don't have a clue. Do any of you know how much money some of the plaintiff investors actually made? Would you be surprised to learn that some of them made more than what they are claiming they lost? Some of you are going to be eating big fast shit burgers when it is all over because you don't know the facts. Mississippi only requires notice pleading, which means you don't have to allege any specifics. Most of the suit will probably be dismissed once the facts come out.

This type of feeding frenzy is disgusting and shameful - but then, isn't that the American way - folks who don't have a clue bad mouthing others when they don't have any firsthand knowledge of what actually happened.

Keep up the good work - your parents should be proud.

Ah, the counterattack begins. What took ya so long?

First of all, no one is feeding me anything. Second of all, I've backed up everything with public records. Someone from the defendants sent me a statement, I'd post it. As for plaintiffs feeding me anything, well, I don't take anyone's word for anything. Take the Bell case, I knew pretty much everything in those police reports but didn't say anything until I had hard copies of them.

As for the being married to two sisters deal, I think what happened is Travelstead is married to a Montgomery. I've no way of knowing if that is a sister to Mrs. Wolfe and wasn't going to speculate either as she has nothing to do with any of this. Someone said that in the comments.

As for me not getting my facts straight, well, I guess some of you are new to this website and don't know how we do things here. By the way, WLBT seemed to have no problem doing a story on this matter and I don't see any of you calling up the station to complain.

Was speaking in very general terms when I said as for plaintiffs feeding me anything. No one has fed me anything and I've uncovered everything through my own research. I was thinking of other cases when I wrote that and should've been more clear. Obviously if a plaintiff tried to feed me something I'd be suspicious as there would be an obvious agenda. When I first started this website someone fed me some stuff on MDOC. Turned out to be someone with an agenda and I got an email from Mr. Epps (We exchanged a couple of nice emails and he got an apology from me. It turned out that person was also shopping her lil ole story to the tv stations and other outlets), who clarified something issues and it also taught me a lesson about digging up everything myself. It came from someone I knew and trusted so the result is, I don't trust anyone when it comes to tips.

I haven't accused Mr. Wolfe of anything. I have stated lawsuits were filed, he filed bankruptcy, , and examined the circumstances surrounding these events. Now, as someone who has busted more than a few people for mortgage and real estate fraud, I know what to look for and have gotten to where I know such fraud when I see it and frankly, what I have seen on this case so far raises every red flag and sets off all the alarms.

One thing you defenders are also leaving out is that the same plaintiffs got the court to convert his 11 to a 7. Another thing, since some of you are obviously new to this website, I research the hell out of everything. Now when the defendants file their answers in court, they will be posted and given their fair amount of space on this website.

Allowing unsubstantiated comments that support your idea of what's occurred linger but immediately removing dissenting comments only serves the storyline you are trying to create.

Removing your and others' comments in a belated effort to sterilize now shows just how disingenuous you have been being.

It appears you want to propose the idea that you uncovered a bankruptcy filing for an unknown company the day before a civil suit was filed and that you are just that lucky or good. Don't worry though, I'm sure someone is compiling your comments before you go back and remove or alter them.

I have also left up quite a few "dissenting" comments as you put it. In fact, there are no dissenting comments as there is no official party line from which to dissent on this website. When I've zapped I've made it clear why I deleted a comment. You are plainly ignoring that fact and seeing just what you want to see.

as for uncovering it all at once, yeah I am that good. When I look up a company, I look up everything. That means I start with PACER. You do know about PACER, don't you? Then voila, I found a BK and read it. Then I called the circuit and chancery clerks in Rankin County as it was a Rankin business. Shazamm, there was a complaint filed in circuit court against them and a TRO request from several months ago. So I had it all at once but didn't spread it out over several days. Then because its real estate, I also did a property search online and from past experience, checked the deeds of trust. Pretty easy.

Allow me to make a correction to your comment. The civil suit was filed several months ago. The amended complaint was filed last week. There is a difference, not that you would know that of course.

Mark my word - Wolfe will go down and will more than likely serve jail time. I have seen his type on more than one occasion. There is way too much presented in the civil suits and the BK for any sound minded individual to see otherwise. I am assuming he has little finincial resources for legal defense. I think his best option would be to come clean now and life will be a little easier in the future.

The investors are guilty? How so? The old investor's "interest" payments were made with new investor money. Of course they had no knowledge of that at the time, and when the new investor money dried up, there was nothing for them.

8:09 - you are dead wrong - it wasn't a ponzi scheme - when the economy was going strong the money being used to pay the investors came from good loans - i.e., origination fees and interest payments being made by the borrowers - later it came from other revenue generated by the companies - I have no personal knowledge of the last 6 to 12 months, but before then you are absolutely not correct - just wait and see what comes out of the lawsuit - some of the plaintiffs made as much in interest payments as they are claiming they lost - and they damn sure were not complaining or whining then - they were begging for more - why, because they are as greedy as anyone you are currently blasting on this site -

The problem with the companies was how they were structured - not how they were run or operated - they financed their operations with debt capital, i.e., notes that required monthly interest payment to be made, rather than with equity capital - i.e., stock - if they had sold stock rather than notes, you all wouldn't even have anything to talk about - this is exactly why the Chicago Cubs and Chicago Tribune are being sold right now by a billionaire - because of too much debt capital - not because of fraud or poor operational choices - and no one is excusing him of fraud - the economy simply tanked and revenues have fallen for print media and the companies can therefore no longer make their interest payments ...

With equity capital they could have suspended the dividend, etc., etc. to help with cash flow and could have tried to work through it - you all need to go take a finance class or shut up.

When the economy imploded on itself and the borrowers stop making their interest payment - and the value of the collateral fell off a cliff since they were financing renovations in less then pristine neighborhoods, the revenue stopped coming in and the companies couldn't keep making the interest payments - they also couldn't foreclose and sell the assets, i.e., houses, in most cases to even get back the principal - which gets us to where we are today -

With a bunch of idiots that know absolutely nothing about finance or business or the law or anything that they are talking about blabbering on here like they actually know something.

Wrong about the economy imploding. Mr. Wolfe has clearly stated that "based on the subprime crisis..." "the demand for rents has skyrocketed..." In other words Wolfes business model was using the bad economy to its advantage. Sources have told me that within a week preceeding his BK filing he was throwing his sales pitch around trying to obtain investors. One does not need a degree in economics to figure this one out.

By the way, some of Wolfe's defenders claim the real estate market declined and that caused the losses.

I thought according to his video and presentations he wasn't going more than 65% LTV on properties. I wasn't aware real estate values in Jackson declined 35% in the last two years. Of course, that is 35% just to reach that LTV, would be even more to actually cause a loss.

KF -- I thought that Ray Montgomery was an owner of MTW from its inception. Can you check with the secretary of state to see when he became an owner and when he was no longer an owner? Being an owner (or former owner) how can he claim that this was a ponzi scheme (as the complaint does)? If it was, wouldn't he be a part of the scheme? If he was part of scheme should he sue himself?

He and Tracy Wolfe were members of the LLC when it was first formed but a couple of years later their names were taken off.

As for the asinine comments just made, I would take down the same comments if made about Mr. Wolfe or any of his colleagues.

NOW why don't tell me why these liens being placed on these properties are not a clear-cut case of bankruptcy fraud.

KF -- you are mistaken. The filings on the secretary of state's website list Ray Montgomery as an owner effective February 27, 2004 and being an owner until April 20, 2006.

The questions raised above remain. Being an owner of MTW (especially for such a long period of time) how can Ray Montgomery claim that this was a ponzi scheme (as the complaint does)? If it was, wouldn't he be a part of the ponzi scheme? If he was part of the scheme should he sue himself?

How can Mr. Montgomery even be a plaintiff? Something fishy is going on here.

12:37: Keep going. You are sounding really stupid. The only exhibits were the ones attached to the complaint in rankin. You do realize the plaintiff's are using them in support of their complaint. I think its funny you would want them posted. Since you are SO worked up over it why don't you put your money where your mouth is and go copy and email them to me. Do that and I'll put them up here. They are promotional materials and supposedly financial statements Wolfe gave to investors.

By the way, when it comes to defamation, you are clueless. If you knew anything about the law, you would know that placing these types of liens is usually barred by federal law and reversed by the BK Court when discovered. I also asked you to tell me why they weren't BK fraud. I asked you a question. That is not defamation. Try again.

Being part owner of a company for a long period of time has no bearing on what happens after you are no longer an owner - with respect to how the business is ran.

This would be like saying I sold my car I have owned for 10 years and the new owner gets a DUI in it and it's my fault.

I believe the business structure/model of MTW changed after Mr. Montgomery was out.

Mr. Montgomery was not an owner when he invested the amounts listed in the complaint. Why would Mr. Montogmery knowingly invest $750,000 in a ponzi scheme.

Thanks for the comment 1:03. That makes some sense about MTW not being a ponzi scheme from inception. I can only assume that MTW and the other companies remained legitimate when Mr. Montgomery re-invested or he wouldn't have done so. Any fraud must have occured sometime after that.

Zapped those because those were unsubtstantiated allegations criminal charges were filed against someone. Provide me with a police report or case number and the jurisdiction and it stays up. Had nothing to do with who the subject of the allegation was just like I took down the ones about Mr. Wolfe.

What is funny is I've never met Mr. Montgomery and never gotten any info from him yet you people seem fixated on him for some reason. Stay focused on him if it makes you happy cuz I really don't care about him one way or the other.

I think we know who these "trolls" are.

They have yet to answer my questions about the liens or I should say so-called liens.

All I will say is I'm going to have the last laugh on this one.

Now about the last comment, lets get something straight: I'm not accusing them of a ponzi scheme. I reported the investors filed lawsuits and posted some of their claims. Its a lawsuit and I think everyone knows there are two sides in court. When Mr. Wolfe presents his defense it WILL be posted and the document linked so you can read it. Now the lawsuit might accuse them of one but that is for the courts and lawyers to decide.

As for the liens, I uncovered that myself and stand by everything I wrote about them. These liens were created right before bankruptcy by another company owned by Wolfe. No one has yet to explain why this is not an attempt to get around the BK Court. Instead they want to focus on the brother in law, instead of discussing these liens or the more than 20 investors that are creditors and plaintiffs.

Have you ever thought that maybe others don't jump to conclusions and claim fraud when they knowingly (and admittedly in your case) do not have a complete picture or all of the pertinent information.

2:08 pm You can be identified several ways. I can list a few, but one is the digital fingerprint called your IP address. Unless you went to great lengths to cover your tracks, it's pretty easy to narrow down the location, provider, and if you put any personal information on a network the IP is hosted on, an identity. Additionally, Google Analytics can provide a wealth of information, location, keyword, etc. And finally, c'mon, you sound obvious and very close to this situation. Most of here are just following a story, don't know the actors, just know when something is amiss, this community is a great place to discuss the issues. Just my $0.02.

I must say that I haven't had time to read all the posts so far...but that ones the majority of the ones that I have read are not about the real issue of KF's post.

As to KF, himself, I can honestly say he is just not going to believe a story because someone came whining to him about so and so.

I am talking about blog owner when talking about possibly having the IP address of an anonymous poster. Not sure if the capability is there with this blog, just sayin' it is possible to do. I don't run a blog, or this blog, but know enough about the Internet to know you have to go to great lengths to remain truly anonymous. Like block trackers, randomize keystrokes, encrypt keystrokes, etc.

K, that makes more sense. Thought there was some way for just your average bear to pull up the ip on this blog, without having admin rights. If this website did have that feature (don't really know of one that does) it would be VERY cool for us to check out who's posting as anon (myself included, obviously). Until then, I'll just keep guessing on who's posting for the defense.

Unless KF wants to publish those ip's?? That would give this bored housewife something fun to do.

The man gets his shit straight, and if in the case something wasn't exact, he'll be the FIRST to say 'sorry guys,' and then follow up with exactly what the facts are on anything he found out. In this case, he has simply reported of some records, and we readers smelled the fraud ourselves because it stinks to high heaven. It's easy to read the fact that KF has jumped to conclusions, had a story about this made up in his mind and didn't bother to gather all of the available facts because they didn't meet his need for the plot of his storyline.

As for the questions at hand, the liens may be a real issue in the case. Someone please explain. Also, if Ray Montgomery left the company in 2006. Why? and how much did it cost the investors for his departure? Could it be Montgomery is suing a company for money that was paid to him by that company with investors money, the same investors he now stands with and demands justice?

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
