Censorship at Ole Miss?

Social media is abuzz after this Instagram video was posted that showed a student being thrown out of the Ole Miss game Saturday.  He is carrying a Mississippi state flag.  The flag was not attached to a stick or any other solid objects.  Accusations that he was ejected because he was holding up the banner are flying fast and furious.  See the video for yourself:





Keep in mind a 15 second video may only tell part of the story and in these videos, there is usually more to the story.

They have a stadium rule against having signs, flags, etc in stadium. Doesn't say anything about size or what sign says or what kind of flag. Doesn't matter what one thinks about displaying a particular flag, the security folks are charged with enforcing the rule.

Would you rather it allow any sign, or any flag, of any size? If not then have to understand and accept there reasonable rule.

And obviously this kid - and all the others that have been the subject of its enforecent - knew the rule but wanted the attention. With the help of crazy Christy he is getting what he wants. If he had forfeited his contraband he could have remained in the stadium. But what he evidently considered "principles" over weighed his wanting to see his vaunted black bears win over arch-rival Memphis State.

Whether you clowns like Ole Miss or don't like Ole Miss and whether or not you like 'brats' and regardless of what you think your tickets cost, there is something called a constitutional right to freedom of speech.

You might not know it, but if a rule or prohibition addresses one type of 'annoyance' that might get in the way, it must address all. If I can't wave a small flag, then YOU can't bring in a sheet of poster board in representing your sorority or your candidate for most liked. And if my small flag is prohibited, then your pom pons must also be prohibited. And so must your funeral-home sized fans.

We all know and understand that the liberal leadership of the institution is attempting to stifle symbols (including the verbalizing of songs and chants) that might be somehow associated with The Civil War Confederacy. What you clowns don't realize is that the Constitution's First Amendment sometimes trumps that wish.

Another person confused by what rights the First Amendment actually confer.

You have no rights to do or say whatever you want when in a facility that's not owned by yourself.

Also note that the student was not arrested for displaying the flag, only removed from that facility.

No first amendment issues were raised here. You might consider taking a class in constitutional law. I hear Obama was a good teacher of it at Univ of Chicago, and will be available again early next year.

What YOU don't realize is that YOUR (and other Ole Miss supporters of flag waving) interpretation of the First Amendment is not correct. Yes there is a right of free speech but that is not absolute and without condition. This snotty nosed kid paid admission (or his parents did) for him to enter the stadium. It was his choice to sit in an assigned seat. The permission that allowed him entry into this facility has conditions attached. He agreed to those conditions. If he wanted to wave his flag he could have done that outside the stadium under his First Amendment rights. But when he chose to enter the stadium his FA rights are trumped by that part that says his rights don't trump mine if I am sitting behind him.

also, the ticket you have to get in is a "license" that can be revoked for almost any reason; that reason is to violate ANY stadium policies. you leave a great portion of your free speech rights at the gate...

12:02, maybe we ought to send copies of that litigation to the wonderful constitutional scholar and protaganist, absolutist, Chris McDaniel - who first suggested that students should take this into their own hands and do whatever is necessary to protect their 'rights' and now has claimed that a student was 'arrested' for expressing his constitutional rights, with a suggestion that the legislature needs to solve this issue.

Thanks the good Lord that we missed the bullet on this idiot, but he just doesn't seem to go away and take his tin-foil followers with him.

But on second thought, I realize that he doesn't recognize court rulings when they are against his opinions. Don't waste the postage on sending that caselaw to him after all.

If that flag is bigger than 8.5x11 then it's just barely beyond said limits, and anyone here who is positing that the size of the banner is the issue is being disingenuous at best.

We can all play this game of "but the rules say..", but anyone with a modicum of awareness has to at least acknowledge that the Mississippi state flag, with it's prominent Confederate naval jack, is controversial to many.

The university is splitting some fine hairs here in setting up a circumstance to "ban" the flag while gladly accepting money from the state government which it represents. I doubt many here would abide giving foreign aid to a nation that bans the flying of the US flag and persecutes those who do so.

Looking at the way the young man was reacting to the guard makes me think it was more about his behavior than his banner. However, I tend to believe (purely my speculation) that a similar banner that read "Go Rebels" or "Go Tigers" or "Hillary for President" would not have generated a security intervention.

Mississippi State (and other SEC) fans should take a step back before gleefully piling on. Ask yourself if you are really committed to the alteration of the state flag and its removal from events, or if you're just "Me Too!"-ing because you don't like the football team.

And to the Steeltown Pussycat who talks about how great a teacher President Rock Star was, I'd love to see real evidence of that (not mere anecdotes from his fellow travelers). If you can post a link to a single document that was authored by Obama showing a clever and unique insight into the application of Constitutional law, I'd like to read it.

Pitt Panther - You may want to revisit the constitution yourself. First amendment rights apply when the government attempts to stifle public speech. This is a state institution and is therefore, 'the government'. Not sure how things work in Pennsylvania, but this is Mississippi.

In the "OMSports.com" rules (I guess OM has a fulltime flag and PC symbol monitor?) it was (and still is as of today):

"Banners and Poles

Policy:

Banners may not be hung and poles may not be brought into Vaught-Hemingway except those approved by Ole Miss Event Management.

Reason:

Banners or poles in Vaught-Hemingway can obstruct the view of other fans. Also, Ole Miss must ensure that it honors its corporate sponsors regarding signage in Vaught-Hemingway."

So, either refer them to those rules or be sure to get an 8" by 10.5" flag.

They "changed" the rules in the middle of the season and still don't have their ducks in a row. For good reason, since it's banning a state flag at a state college.

Since they can't outlaw ANY flag, they have to play games with size, stick, etc.

Sew it on or wear it.

Cause the "spokesperson" is lying: "Ole Miss Senior Associate AD/Communications and Marketing, Michael Thompson, said, “I don’t know what was on any of the signs. I just know all signs were removed. It’s a non-story. Stadium rules ere enforced like they have always been.”

Thompson added, “For years stadium policy has been no banners or signs allowed in the stadium. It doesn’t matter what is on the sign – they block other people’s view.”

No, it hasn't been "for years" and still is not and cannot be (no signs or flags), under the Constitution.

It's total bullshit to claim 'but the rules say...' and 'you agree when you buy a ticket...'. The fact remains, in American jurisprudence, that you cannot sign away your rights. One does not 'sign away his legal rights at the gate'. Sorry Charlie. Years ago you might have purchased a ticket that required you to sit in the balcony of the movie theatre and you see what happened with that one.

Just as employers might (illegally) get employees to sign away their right to overtime, purchasing a ticket, regardless of the fine print, does not require that you abandon the US Constitution.

If there is a flag rule that is selectively enforced, it can, should and will be challenged. Especially if the enforcement is based on religion, race, political thought or expression.

And to the knuckle-head who said 'he wasn't arrested - He was only removed', the constitutional prohibitions on controlling free speech don't address arrest as opposed to other sorts of control. He could have been hosed, beaten, arrested, removed, sprayed or had his mouth duct-taped - still an agent of the state controlled and violated his free speech rights if there is a rule and it is not enforced equally.

The only reason the challenge failed years ago was because the challenge dealt with flags and the rule dealt with sticks.

Can I take a handkerchief to the game? What about a terrible towel like they have in Pittsburgh? they are not signs and they don't have a stick. I think they are content neutral. I know I have seen people with those pompoms or whatever they are. How can they shake those and I con't shake a piece of cloth imprinted with "Ole Miss" or an image of the state flag or whatever?

I think the flag ought to go if it offends people (and it does), but not if it is at the expense of the first amendment. Let the little puke have his flag. This isn't real life, it is a football game.

And who exactly owns the facility in question? For some reason I thought it was us taxpayers who pay for it.

Since it is a state property it is also subject to the US Constitution (although Mississippians have seemed to have trouble grasping that concept in the past).

The Republican Party needs to show some leadership and get rid of the flag. There is nothing "conservative" about keeping the flag. This state has nearly 45% minority population (black, hispanic, asian, etc.) which means Democrats will be within striking distance in future election cycles. If the GOP wants to keep control for much longer they need to start running some moderate candidates statewide in 2019 and rid themselves forever of these hate issues.

The Constitution also gives the power to the Supreme Court to say what the Constitutional language legally means.
There are limits on freedom speech such as not being able to yell " fire" in a crowded theater when there is no fire. You can't threaten other citizens. Your rights end when they infringe on the rights of your fellow citizens.
There are limits on how you can protest. Or have you not noticed the police on television controlling and arresting protesters who violated the rules of their permitted protest and dealing with non-permitted protesters? Did you not notice candidate's security removing protesters from inside their venues and controlling the protest to areas outside their venues?
You have the right to be wrong and to be ignorant. I just wish you would try to understand why the rule of law is what prevents anarchy.

Fans were trampled under the weight of others who scattered and bolted from the bleachers. Water cannons were at the ready as the constabulary responded quickly to radio calls reciting section and row.

The flag that flew over a nation that embraced slavery long before the Civil War? The flag that flew over the White House when the president said 'Send them all to Haiti'? The flags that flapped from the bow of ships headed for England, laden with cotton? Or the flags that unfurled in gentle breezes as slave ships entered the port of New Orleans in 1855?

No flag of The Confederacy existed back then. I'm just trying to keep these flags separate if you don't mind.

Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time.
