M.A.C. Construction won't be getting paid for work on the North State Street project for quite some time. The Marcus Wallace company is a subcontractor for Neel Shaffer on the project. However, Madison County Circuit Judge Steve Ratcliff ordered Neel-Schaffer Tuesday to pay $39,713 Neel-Schaffer owed to M.A.C. instead to creditors Bankfirst and Hemphill Construction.
Judge Ratcliff awarded a $325,000 judgment to Hemphill in January. Earlier post on judgment. The insurance company required Hemphill to co-sign a bond for M.A. C. on Capital Centre Improvement Project at Jackson State University. Unfortunately for Hemphill, it was forced to make good on several claims. Hemphill sued M.A.C. and M.A.C. owner Marcus Wallace in 2016. The complaint states:
Once the Project began, subcontractors and/or suppliers to MAC Construction began making claims on the payment bonds issued by Federal alleging that MAC Construction had failed to pay amounts owed under the parties’ respective subcontract/purchase order.Hemphill claimed damages of $668,047 although the Court only awarded nearly half the amount. Bankfirst had apparently issued a loan to M.A.C. The loan payoff was $35,533.
8. As a result of the payment bond claims, Federal, MAC Construction, MAC & Associates and Hemphill investigated the claims, and agreed that certain amounts were in fact owed to each payment bond claimant. Since MAC Construction, MAC & Associates and Wallace failed and refused to pay the payment bond claimants, Hemphill did so, through Federal, pursuant to Hemphill’s obligation as indemnitor. Judge Ratcliff ordered Neel-Schaffer to satisfy Bankfirst's claim. All remaining funds will be paid to Hemphill. The Court will "establish" a payment plan for future funds received by Neel-Schaffer for M.A.C.

MAC is FAQ'd. He didn't have the skillset, capital, assets, experience or credit to do this type of work. This is what mandated DBE participation gets you.
Just think about the millions millions that were ripped off by making real contractors and business have to use fake companies that did zero work. All in the name of equal opportunity which was really a giant con game.There should be jail time for all concerned for all were part of a fake deal.
What in the hell is MAC doing as a sub-contractor to the ENGINEER for this project? Wallace has been getting away with selling his b/s claiming to be a contractor (which he nor his company is not) but what "sub-contracting" is being claimed that he is doing for a consulting engineer?
Of course, we know the answer. This engineering contract was awarded during the Tony Yarber administration with Ms Powell as the Director of PW, and I'm sure the message was given to Neal Shaffer that for him to get these $2 million plus projects, he had to pay Wallace a piece. Problem now is, MAC doesn't have the money he was probably required to share with certain folks in the administration. (Probably not a problem, though, since the mortgage got forgiven; don't need that cash quite as bad.)

Everybody knows and has known for twenty years that all of these minority contracting situations are nothing but illegal fronts for the passing around of money. I would think that under the RICO statute, this is money laundering.
This is, after all, the primary any black lawyer runs for public office.

This type of thing is so common place. Contractors get their wives to put the business in their name so they can bid. Having a minority women as the owner is considered the jackpot in contracting.
From reading all of this I cannot understand the relationship of the parties. On most projects an Owner would hire Neel Schafter to design a project and hire Hemphill as general contractor. MAC would be a subcontractor to Hemphill. Apparently this project is different. The court has already ruled on the case once so it sees no need to explain the contracts a second time. It would be helpful if Kingfish would take another crack at explaining the overall contractual relationships. (I worked in the construction industry for more than 40 years and can't make heads or tails of this).

The person that has now been unmasked a couple of times over the past few months - and with his local gravy train running dry, he is a Democrat candidate for Transportation Commissioner. Guess he figures he can screw the whole state from that perch, instead of just Jackson and Hinds County.
All you have to do is go look at the MAC website and read the guy's bio. Its all about how he represented professional athletes and promoted concerts. HA! And of course how much support he has given back to the community. Not a single thing about any construction qualifications.

I think your question is whey is Neel in the billing and payment loop for a construction contract between Hemphill and MAC. Of coarse we all know this is just a form of payoff or kickback so it does not need to make sense. Anyway you shake it up it is still crooked and all are are breaking the law.

A legitimate contractor has no chance there unless he joint ventures with a minority company. Saw it and experienced it with my own eyes and got caught up in the middle of this bull shit charade the government “hands out”. And you DARE not say a word or your called a racist. I don’t step foot in there anymore. Hardly any local contractors work there because of the “politics” involved. Neel Schaffer is getting in bed with shady subcontractors like MAC. Neel Shaffer is charging more per job thank any other engineer in Mississippi. Neel Schaffer has gotten greedy in Madison and Madison County and it looks like it’s the beginning of the end for them.
809, no. I understand the relationship between Hemphill and MAC, and that Hemphill finally got tired of being screwed and fought it.
But this case involves a payment from NS to MAC for work MAC supposedly did for NS. Hemphill's garnishment gave them a right to anything they could find of MAC's.
My question is just what is it that MAC was claimed to be doing for NS such that NS used him as his 'minority basis' to get thsee two engineering contracts ($4 million) from Tony Yarber.
We know MAC claimed to be a contractor when he was fronting for Hemphill. Just what did he claim to be (an engineer perhaps) when fronting for Neal Schaffer?

The requirement that a minority contractor be involved in a construction project is a kickback crime, i.e. a form of negotiated bribery…that’s been made legal by corrupt politicians.
Neel Schaffer uses minority subs to pay kick backs. That’s the only reason! FBI needs to start asking questions.
So, are there no minority contractors at all in the metro that are qualified for this work? It sounds like there are not any from the way posters here tell it.
