Jackson Mayor Chokwe Antar Lumumba refuses to issue another request for proposals for garbage collection even though the current contract with Richard's Disposal expires in a little over six months.
Ward 1 Councilman Ashby Foote asked when the Lumumba administration would issue another RFP for garbage collection. Mr. Foote said he did not want to see the city go without garbage service again as it did earlier this year. Ward 2 Councilwoman Angelique Lee echoed his sentiments, saying she did not want to "wait til the last minute" again.
Mayor Lumumba was absent but City Attorney Tori Martin said the administration had not even "discussed" issuing an RFP. She said the city could not issue another RFP because Richard's Disposal is suing the city over the current RFP in Hinds County Circuit Court. JJ reported on April 10:
Richard's Disposal filed a notice of appeal and complaint against the Jackson City Council in Hinds County Circuit Court this afternoon. The case is assigned to Circuit Judge Adrienne Wooten.
The New Orleans company asked the court to reverse the City Council's rejection of the company's proposal for garbage collection services. The complaint states:

The City Council's decision must be overturned because (1) the decision to not approve the contract between the City and RDI is not supported by substantial evidence in that Richard's submitted the most qualified proposal based on the factors in the October 2021 RFP; (2) The Council's decision was arbitrary and capricious as it violates clear statutory requirements; (3) the Council's decision was beyond its scope or powers in that it violates clear statutory requirements; and (4) the Council's decision violated clear statutory requirements for public procurement of garbage and solid waste services.
The complaint argues the Council voted for the "twice-per-week" garbage collection option at the lowest price. Mayor Lumumba selected Richard's Disposal for the new contract. However, the Council rejected the contract. The Mayor issued an emergency no-bid one-year contract to the company that was later ruled to be invalid. The contract expired April 1, 2023.
Richard's Disposal accused the Council of acting "arbitrary and capricious" in rejecting the contract.
Oddly enough, Ms. Martin said the complaint was a "Bill of Exceptions." The city was at the Court's mercy as he could rule on the case at any time, insinuating he could take as long as he wanted to adjudicate the dispute.
The opposing parties are skirmishing over the record of appeal.
A visibly frustrated Council moved on to the rest of the agenda.

If I recall correctly, the judge told the Council he could not give them the authority to issue a RFP but could order the mayor to issue one. I think this is what happened in the Hattiesburg case. So it appears the Council needs to head back to the judge ASAP and end the mayor's shenanigans. I thought the judge was basically telling them what they needed to do, but this Council hasn't shown much intelligence.

The mayor is the one who mentioned the word "lawsuit" so many times during the self-made garbage crisis that it probably encouraged Richard's to file this hail mary suit. The "complaint" is procedurally improper and should have been dismissed by now. The circuit court can't sit in appellate and trial jurisdiction at the same time, on the same case. It's either an appeal or it isn't.

Eventually Chokme may show up for a meeting and every single council member needs to ask what is being done. Do not accept that BS response that they have to wait for the judge. That is BS and everybody knows it. The council needs to keep this out in front of the public so the citizens can see that Chokme is doing nothing to prevent another garbage crisis.
If there is no money to hire outside attorneys, then cut the pay of Tori Martin and all the other attys that allegedly work for the city and use that money to hire a real atty.

I'm sorry to break it to some of you, but you've created an environment where you will NOT get competing bids from other than these two and I'm not sure about Richards.
Richards has been far better than Waste Management in my neighborhood. They do not leave garbage on the street or damage trash can by throwing them from the truck like WM did regularly. They do not leave limbs that meet the criteria on the street as WM did mine on 8 times until in frustration, I put a measuring tape in front of the pile. Of course, they suspected I had photographed what I'd done (they were right) and took it away. As I suspected, they took the tape measure as well!
I understand the personnel from route to route may not be as good as on my route, or as bad as WM was on my route, but good grief people! This is garbage, not rocket science. Jackson last RFP was a copy word for word of what other cities are putting in their contract competitions. You can actually pick a city you think is run well of comparable size and find out for yourselves.

Will disagree. RD service was decent in my area.... when it showed up. Too often it came a day later and I don't mean during the first month or two which is to be expected.
The second year has been different. They have missed days. Then there are the lies they told during the rainstorms. Lied about couldn't drop off garbage at WM transfer station when it stayed open. No one else lost garbage service as we did, not even Hinds County which is served by WM.
Oh, as for your precious limbs. If we cut shrubs, trimmed limbs etc and kept them to four feet or less, we could pile them neatly on the curb and WM would take them.

I think it’s time to have a serious discussion about changing Jackson’s form of government to Manager-Council. This mayor is clearly not equipped to run this city. Nor do I think there are many people left in this city with the competence or qualifications to be mayor (who are willing to run, that is). I think it’s worth a serious conversation. Unfortunately it would have to be citizen led, as I don’t see Chokme willingly ceding his power and authority voluntarily.

KF I believe you and so I believe we both must conclude the pick up is as good as the crew on the route.
I live in Leftover that also runs Eastover's route,I was told you live in Fondren. My route is only residential. I do not know if that's true of yours and how that may affect amounts of trash on the trucks (that, of course, should be considered by RD and WD in their routing).
So, it seems our focus should not be the companies but what we need to do find out why the route difference in service occurs and if that can be corrected by adding one or more trucks to routes.
If no one figures that out, no one can write an RFP that eliminates poor service to some. If there's no mechanism for evaluating service, how do we know what the service failures are and where they occur?
Perhaps, we could require cameras on the backs of garbage trucks so it'd help either company know what their employees are doing.
I suspect and I'm sure you do as well, that hiring good crews on the trucks may not be easy and perhaps, a wage incentive would help if included in the next RFP.
For all problems, there's the best available solution and I'm frustrated with the " let's choose up sides" "or "blame game" approaches rather that allow our elected officials to make our complaints political not practical. I drive by one complainer's house nearly every day. That person like some others overload their cans and aren't able to close the lid. They won't put excess in a bag or buy a second can. That wasn't the case in my area with WM or RD. With WM, their crew didn't walk all the way to the truck and threw cans from the truck to curb. Indeed, in many cities ,the fact that so many humans won't or can't afford to get adequate garbage containers is WHY the 69 gallon cans are required in many cities...some bought at city not contractor expense. They are a ONE TIME expense in the life of contracts. How long those cans are durable is a known.
I hate that our officials, particularly on the city council did NOT do due diligence. They did not bother to find out from other cities of the same size or larger, what works and what doesn't. The "Maynards" were controversial in Atlanta, but you'd be risking your life to take them away or not have replaced them now. God forbid we should learn from the successes and failures elsewhere.

11:54, as scared as I was when Chokwe Sr. was elected, it became evident pretty quickly he was trying to improve Jackson for all Jacksonians and I wished we could have seen what his father could have accomplished. Chokwe Jr. is in it strictly for himself. WM may be imperfect as you claim, but all I ask of a waste company is that when I put my trashcan on the curb in the morning, it’s empty that night. WM did that, Richard’s cannot. WM had the better proposal, as determined by the city council, but Chokwe and his cronies couldn’t get any kickbacks from them so here we are in this mess.
