Kelly pleads guilty to conspiracy

Judge William Chapman dismissed all motions filed by Clayton Kelly today.  Kelly is submitting an open plea to conspiracy. Sentencing is next Monday at 9:00 AM.

One little fact ignored or forgotten by everyone.  Burglary convictions in Madison County usually carry a sentence (on average) of five years.  What sentence do you think he should receive? Standard sentence? Time served? House arrest? Probation?

I haven't seen a Conspiracy sentencing since House Bill 585 went into effect but I know that house arrest for burglary is basically off the table since HB 585. I would think he gets 5 years with 5 suspended and probation.

if he plead to conspiracy, the maximum is 5 years. conspiracy in this case is merely a plan and some effort to commit a felony.

open pleas in Madison County usually result in near the maximum being imposed. the circumstances of the last minute plea may not play in his favor, however, its possible Guest didn't offer this until to, or its possible he wanted to know the rulings on his motions before he took the open plea.

whatever the Judge does in this case will be fair. this idiot gets a felony conviction, but won't have to serve a lengthy prison term even if he gets the full 5, he'll be out on supervised release in a year to 18 months.

Conspiracy carries 5 years max. Even should he get the max, he'd only do about 20 months total. And he won't get the max. Max means no post release supervision. He will probably get either another year of house arrest, or 3 to serve and two suspended, which would mean he would almost be cut loose once he get classified at CMCF.

wrong 4:10. if he gets the full 5, he can still be placed on 5 years PROBATION which would begin running at his release, probably at least a year, perhaps a few months more from prison. since he has no prior felony conviction, he would not be subject to "post release supervision". sounds like splitting hairs, but there is a difference. a prior convicted felon is eligible for PRS, but not probation.

There is not nearly enough time possible for a blogger. ALL bloggers should be thrown under the jail for a minimum of ten, maybe 15 years, so that the bloggesphere will no longer exist once they get out. Kelly should be forced to share his jail cell with Brown from Cottonmouth, and of course, KF from JJ.

Kelly is obviously a simple tool that was egged on and encouraged by far more experienced politicos. I wish Guest had reversed this by using Kelly against the McDaniel supporters that probably caused all of this. I doubt Kelly had the guts or gumption to enter the facility without the politicos encouragement. Look at the photos of him in court today. They should put those photos in the dictionary to illustrate the definition of "patsy". Don't get me wrong, I think he needs to serve some prison time, but the State didn't need to aim an elephant gun at a gnat.

Hopefully, the judge will require Mr. Clayton to articulate a full allocation as to all of the facts, including the names of all of the co-conspirators. Otherwise, what's the point of allowing him to plead to a charge of conspiracy?

obviously Mayfield supplied the information of how to get into the facility based on his mother being a resident at the same facility. he was a material player, knew it, knew the law, and couldn't face the consequences.

its too bad he couldn't be a man, accept responsibility, and the consequences [conviction, short time in jail, loss of law license] rather than cause eternal heartache for his wife and family.

You have to take the deal in Madison county. They don't give you much choice by scaring the hell out of you with the book. It's a business they run with lawyers, judges and court services all in cahoots. Inflate the bond to the maximum, scare you into submission to have you sign up for every f'n class they think you can afford. Then show up for your hearing with your tail between your legs and get a good old fashioned tongue lashing. Nothing like a reality check. Been there.

I agree with KF, he needs to do some time so he and the nut jobs who don't understand he did something wrong will think before they contemplate similar stupidity.

More importantly, I want it to be harder for the naïve and mentally challenged to be easily recruited to do what others what they think they are " too good" to do or unwilling to risk for themselves!

He walked into a nursing home essentially open to the public at that time and took a picture of someone that was not harmed in any way by said photo. This is all political. And the swarming cops and huge bails set for all these folks was beyond ridiculous. Take a picture of me when I'm old and drooling and incoherent as much as you like. I won't care.

If he had broken in to take a picture of any other resident, this would be a non-issue. Nobody would have ever heard about it. If he had taken pictures of, say, nursing home abuse, then he would be a hero. All this was a waste of precious judicial time that could have been spent on a real criminal.

While I am first in line to say what the man did was wrong and outlandish, stupid, idiotic, childish and whacky.....I see no criminality unless he was clearly guilty of trespass or violation of clearly posted rules and regulations, neither of which was the case and neither of which could, by any stretch, be a felony.

And, for others, Mayfield did not 'give his personal pass' to anybody. He might have told others the code, as all of us who have people in these places have done. All that's needed to access doors at any of these facilities is a punched-in combination of numbers that typically relate to month and year along with a * or # symbol. It's almost as easy to walk INTO one of these places as it is to walk OUT OF a Hinds County Jail. If anything, the man at the gate-house and the facilitie's procedures need revisiting.

'Common Sense' tells me that nine months have been wasted on this issue while the state of the nation and of Mississippi languish in decline. One INTENDED consequence of the debacle's outcome is that Cochran was returned to a basement in D.C. to join Bernie Sanders in voting the Democrat agenda.

He went uninvited into a woman's bedroom and took her photo while she was in bed and incapacitated.

Please , any of you who feel this is acceptable, do get a fake security badge or misrepresent yourself and walk into any senator's wife's bedroom uninvited and see what happens. Hey, just walk into your neigbhor's bedroom without invitation and see what happens.

Or, if you really think there's a difference, go to any nursing home or hospital and start going into the private rooms uninvited and photograph people and see what happens.

I'm sure if this were acceptable behavior and " just about politics", Clayton's friends would have taken photos all over town in the private rooms of nursing homes and hospitals and hospice care without worry they'd be charged . Why weren't they out proving this wasn't criminal?

This case was way over-baked from the start. The charges for possible burglary, 50 years sentence, etc. What a complete political hack. Yes they commited a crime, but 50 years..... Guest knew it and wanted no part of it because he doesn't want it to stain his reputation. Trying this case would have turned into a circus side show. This was never ever going to trial. And based on personal experience with this D.A.'s office, Kelly will not serve any additional time once he is classified. A few years ago, my identity was stolen by local folks. Trashed my credit report, etc. I kept forcing the issue with the DA to get prosecuted. The suspects were indicted and it was quickly pled away with short-term house arrest only. I had actual damage, and they had actual money stolen from credit card companies and the like. End result, short-term house and a easy plea. Guest's office had no desire to prosecute my case either which is why the defense attorney got what he wanted. I believe the same will apply here. Guest (and the Barbourmafia) wanted no part of the side show that was coming. JMHO

Mayfield's mother had recently died and was a resident of SCV. They tried to get him to go in the nursing home and take the picture but he refused to do so. He instead gave them information on the layout of the place and other useful information.

Kelly did something despicable but not really criminal. the excessive bond set meant he could not get out of jail and he lost his job as a result. His wife is incapacitated and he has a sick child. After his arrest, he and his family were evicted from their home. with an attorney involved in the incident, he probably thought this was legal. He was used and manipulated by people more mature and experienced than him. His life is ruined. How much more blood do people want?

The Mayfield family is blaming MPD for trespassing onto their property bc they were out of jurisdiction. The MPD officers who crossed the line just so happened to be Vicki Curry (lead investigator in Mayfields case) and another officer who took the lead in arresting Mayfield. Coincidence, i think not.

Mayfield was out on bond. He and his family were wealthy. He had already lost all his law clients over nothing. Mental anguish and facing actual prison time is what contributed to his death.

Mayfield knew that Club for Growth and Freedomworks were pouring money into the state to buy the Senate seat and saw a chance to make his law firm millions of $$$ by riding a man supported by the remnants of the old Ku Klux Klan into the Senate. Mayfield saw it as instant cash and then realized that he was about to be drummed out of business because it was clear he had violated the law. He was facing disbarment, total humiliation, financial ruin, and shameful embarrassment for himself and his family. Loss of hope is a major reason sane people commit suicide.

That is a bunch of crap. He was a real estate lawyer. He wasn't going to make millions. He also was NOT facing financial ruin. He had inherited alot of money when his mother died last year. He could have easily moved to another state or country where no one knew who he was and lived his live in comfort, ease, and anonymity. He was one of the nicest people you would ever meet. Had a personality that bordered on passive. He was not the instigator or prime mover in this episode. Not at all. They knew his mother lived there until her death so tried to use him to get the info on the place.

As for buying the Senate seat, please, you are a joke. Complete joke. Read the campaign finance reports, Sid. The money cartel in this state buys and sells seats on a regular basis. You can almost guarantee wins in this year's elections based on finance reports.

Whelp- this whole thing is just a microcosm of what the 2016 presidential elections will be like. A case study on why we need to get the dark money out of politics. The DNC is just as guilty if not more so than the GOP.

Just look at the GOP line up. Oh sure you have a variety of 'choices'. But, don't think for a minute these monied interests have your best interests at heart. The DNC is just as guilty if not moreso. Enjoy Obama while you still can. Trust me on that.

Oh and for the record, the beta version of the PPACA was implemented by Romney at the state level. Kinda hard to repeal your own law after a corporate democrat implements it on a national scale.

Not crap at all. He was planning to take his law firm to the top using his influence with MkkkDaniel to get him there. Owning a U.S. Senator (especially an idiot) makes for pretty strong credentials in Mississippi. Your protests that he wasn't facing financial ruin fly in the face of the fact that he was done as a lawyer. Saying he could have lived off his inheritance in another state where nobody knew the depths he was capable of is possible, but not likely. The proof is they way he handled it in the end. You can have your version, but his version explains it all.

As far as buying the Mississippi Senate seat, you apparently weren't keeping up with the radio blowhards who helped finance the effort. They thought they had bought it. Some of them still carry the water. There was no reason any in-state interests would have spent that kind of money to push an obscure ambulance chaser from Ellisville who was a failure in passing bills in the state legislature. The extremist whackos thought they had the money to hornswoggle dumbasses in Mississippi who couldn't pass a fifth grade civics test. At least now we know how many we have.

Mayfield had his eyes on moving into a COS position in the new Senate offices. Was debating with Yancy which one would get the top position and which one the second. Either way, he was riding the idiotic horse from Ellisville and the CFG dollars all the way to DC. His involvement in this escapade will never be known for sure to those of us not in McD's inner circle. Are you telling us what actually happened because you were a part of that brain trust?

Mark was a fine man, but dove too deeply into this charade of a campaign. When it got to the dirty tricks division, he was not in his normal league and we see where it lead him and others. While it is an absolute shame, his role in this stupidity cannot be dismissed simply by such edicts as you have repeatedly stated as fact.

Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
