Bailey Ballot Exam Served Stampsburger

It appears State Representative De'Keither Stamps and Public Service Commissioner Brent Bailey are going to the mattresses.  Mr. Stamps beat the incumbent in the November 7 election by 2,134 votes.  However, Mr. Bailey notified his opponent that he intended to conduct a ballot examination.  Mr. Stamps said not so fast my friend as he asked Hinds County Circuit Judge Faye Peterson to stop the exam.  The petition states:

The Petitioner, DeKeither Stamps, the Democratic nominee for the office of Central District Public Service Commissioner, through his undersigned a,ttorney, hereby petitions the Court to issue an order enjoining and prohibiting the Hinds County Circuit Clerk from allowing examination of the ballot boxes and contents used in the November 7, 2023 general election in Hinds County, by his Republican opponent, Brent Bailey, scheduled to take place at the office of the Hinds County Election Commission at 10:00 a.m. today, under the direction of the Circuit Clerk, who is the custodian of the ballot boxes. As grounds for this petition, the Petitioner states that it is unlawful under Mississippi Code § 23-15-911 to allow this examination to take place because Mr. Bailey has not afforded the Petitioner with at least three (3) days' notice of the time, date and place of this examination, as expressly required by the statute. The Petitioner does not have an adequate remedy at law and will suffer irreparable injury if this injunction order is not entered. Documents pertaining to this matter are attached.

The Petitioner prays that this Honorable Court will issue order enjoining the today's 10:00 a.m. ballot box examination.

Stamps attorney Samuel Begley delivered the petition to Hinds County Circuit Judge Faye Peterson in the Second Judicial District of Hinds County.  Judge Peterson granted the petition:

AMENDED ORDER Granting Petition filed by DEKEITHER STAMPS. The Court, having reviewed the emergency petition, finds that said PETITION FOR INJUNCTION AND PROHIBITION REGARDING BALLOT BOX EXAMINATION should be and is hereby granted. Reviewing shall besuspended until Monday, November 27, 2023. No further written Order shall issue from the Court. Signed by Judge Eleanor Faye Peterson on 11/22/2023.

No hearing was held on the petition.  Mr. Bailey has not yet filed a response.

Yo Stamps, what do y'all have to hide?

Anonymous said...

'Irreparable Harm'? Please explain.

I assume that means Miss Lumumba, in concert with the petitioner, won't have sufficient time to gather her 'ladies squad' and work up some posters accusing Bailey of racism.

Someone got sumthin’ to hide….

Stamps doth protest too much, methinks.

Where are the precinct totals for Hinds county?
Does Hinds county circuit clerk even have those available?
Will that elected official publicly share that content?
Bet the answer is in those precinct totals as compared to eligible voters count.
Oh and a few more completed ballots added in boxes or bags.
Follow the seal verification log….where is that log??

Good luck Mr Bailey!

So, Brent didn’t follow the law. Not surprised.

Well…Willie Simmons, the Central Mississippi Highway Commissioner has pretty much done the same as the mayor and is running that Department into the ground, so I suppose Stamps has a plan to do the same? Am I hitting on something here? That’s a very powerful position to have for someone who has no understanding of what the job entails. Wasn’t he a Jackson Council Member? There ya go. And that’s all you need to know my friends.

Looks like Stamps has figured out how to be a card carrying race mongering Democrat.

Anonymous said...

How is Willie Simmons running the DOT into the ground when 2 of the 3 commissioners are republicans? Quit making stuff up.

Vern Gavin and David Archie already claimed the Hinds election process was flawed. Both got shot down. What new news does Brent have?

10:24, have patience, as Stamps is apparently worried about his 4 year high PERS meal ticket.

Is there really anyone that still thinks there has been an honest election in the U.S. in the last 50 years? I am 74 years old and never have seen an honest election in my life. If a person runs for any elected position or if any person votes in an election they should agree with any results of that election. If they did not win it is because they didn't have enough money to buy the election.

Mississippi has the best politicians that money can buy.

"the Petitioner states that it is unlawful under Mississippi Code § 23-15-911 to allow this examination to take place because Mr. Bailey has not afforded the Petitioner with at least three (3) days' notice of the time, date and place of this examination"

doesn't matter which candidate you like, if this is true, then judge did the right thing.

@ 11/23 9:47 To be fair, I’ve seen a lot of necessary projects programmed by MDOT throughout all of Willie’s district, not just his favored areas.

@12:24 pm and @12:31 pm
True!

@10:22 and 12:31, have either of you driven or attempted to navigate the interstate system within the Jackson City limits with all of the road work needing to be done and rubbish laying in the roads and beside the roads or does just the areas outside of Jackson concern you? Anyway, let’s get back on topic about Stamps. What qualifications does he have for being a part of the PSC? You still don’t see where I’m going with this now do you?

Anonymous said...

1:54, about the same qualifications as our former bank teller Governor and our deputy Fife previous governor. What President, dem or Republican has done anything to be “qualified” for public office other than previously holding public office?

Anonymous said...

6:02 Let me enlighten you on the CFA designation. It is far more respected than a CPA designation. Harvard MBAs leave that crown off in favor of CFA. Tater may be a jerk, but he is far more than a "former bank teller."

The only person truly qualified to run for statewide elective office in this state in the past 50 years was Kirk Fordice. Please redact the word 'statewide'.

Yes 1:54 PM we see where you are going and what you've been implying since your first post. Its fairly obvious. And your argument is BS.

Why do CPAs makes more than CFA ? My firm employed both.

12:24 - you would be correct IF Bailey had not provided a three day notice in accordance with 23-15-911. BUT, he did. Stamps even acknowledged it in several statements to the press on Saturday, and on Clay Edwards show on Monday. The required three day notice was given to Stamps on Saturday.

The intresting thing here is that Stamps, and also his attorney evidently, added their own choice of words to the statute that don't existhat and they found a gullible (or whatever adjective one wants to apply) that didn't bother to read or comprehend the written statute and signed an order without discussion.

Yes, it would be a good ruling ---- BUT.............

Kingfish is so adept at manning the censorship radar that he can't pay close enough attention to not having the same post twice in a row.

I lost the election for homecoming queen in high school. I didn't get enough votes. Can we recount those votes? I still want to be queen.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
