$100,000 Bond for Accused Hit & Run Killer

Madison County Justice Judge Marsha Weems Stacey set bond at $100,000 for Belinda Marshall.  Marshall was arrested Monday for the a felony charge of leaving the scene of an accident that resulted in personal injury or death. 

 

Attorney Robert Walker was bicycling on Nissan Parkway on Sunday afternoon, enjoying the beautiful afternoon. Unfortunately, his trek with nature turned tragic when a vehicle struck the 75 year-old Walker.  He later died at the hospital.  The driver fled the scene.   

The suspect works at Nissan. She returned to Magnolia after allegedly striking Walker.  Law enforcement sources said her boyfriend took her vehicle to a mechanic for repair.  The mechanic contacted the Mississippi Highway Patrol.  It was just a matter of performing basic detective work before the police nabbed Marshall.  

A quick bond hearing was held this morning in Canton.  Several members of her family as well as friends of the deceased watched the proceedings.  Judge Stacey asked a somber defendant some basic questions before setting her  bond at $100,000.  The mother of four children does not yet have a lawyer.  She must wear an ankle monitor upon release from jail.  She has 14 days to request a preliminary hearing.

She's already evaded the consequences of her actions once, why would she not saw off that bracelet and haul ass again?

Nissan employees excessively speed on that Nissan parkway every single day. Law enforcement does NOTHING about it. Drive out there sometime right before or after a shift change. It's like a race track. Employees haul ass cause they know nothing will be done to them. It's a wonder more folks haven't been killed or injured because of the way many of the employees drive.

Bob was a good guy....he’d actually feel sorry for this lady’s children. He would be happy she was employed and presumably raising her kids.....he’d wag his big crooked index finger at her for running him over though. Thoughts for his doting wife and kids.

Stacey is highly educated and does have a law degree. Of the four Madison county justice court judges only Bruce McKinley and Stacey law degrees. Spivey and Griffin do not.

Stacey may have a law degree but as a practitioner in and around her she does not have the demeanor to be a judge.

She will not be around as one for long.....

You don't have to have a law degree to be prepared to set bond in court. It's called being prepared. The judge looked it up in the "How Much To Set Bonds For" book.
By the way, where are those democrats who protest parents being separated from their children?

The charge is a felony and will be presented to a grand jury and then most likely go to Madison County Circuit Court for trial. The Justice Court was involved only to set bond and potentially have a preliminary hearing in order to bind them over to the Grand Jury.

Most citizens do not know the difference between a Justice Court Judge (formerly called Justice of the Peace) and a Supreme Court Judge.

Hinds County has (5) Justice Court Judges and none of the 5 has a law degree or the basic legal knowledge to work on a felony murder case.

When I first read this I felt a bit of sympathy for her. She made a colossal mistake and hit a cyclist, killing him. Tragic indeed, but unless she was negligent (texting, speeding, cutting across traffic, etc.) it's an accident. One could maybe even make the case that she panicked when she fled the scene. It's still a crime, but her behavior is perhaps understandable given the overwhelming circumstances.

However, when she sent her boyfriend to fix her car to hide the evidence, that was calculated and cold-blooded. She wasn't in the heat of the moment. She was trying to cover up her involvement in the death of this innocent cyclist.

So I have great sorrow for the family of the attorney and feel sympathy for those four children of hers, but given her actions, especially after the accident, I have zero compassion for her. To be that heartless and to scramble to cover your tracks, knowing you killed a man and ran away...I have no words.

I agree with 1:42, Robert was a such a good guy he would probably want to forgive her.

I am not such a good guy.

I understand accidents happen, but her negligence robbed the world of an amazing man who contributed more good to society than she and her entire brood combined, likely ever will.

I am sorry for the loss in the Walker family and hope she is punished.
Just a sad loss for us all.

This lady is nuts. It takes a sick individual to run someone over and leave the scene of an accident. I'm willing to bet that she was sauced up, and her intent was to evade the DUI modifier. I had a family member that was killed in the same manner.

Surely they can throw the book at her boyfriend too for accessory after the fact, unless she told him it was a deer.

The death of the cyclist was indeed tragic. That said, when you put a bike lane immediately adjacent to a high speed roadway tragedies such as this are going to happen.

She is in her third term now. She was elected in 2011. I'd say 12 years on the bench qualifies for lasting long.

Nissan Drive, runs from Nissan Parkway to Old Jackson Road, where this tragedy happened is actually MHP jurisdiction. They worked this accident. Canton PD takes care of the Sowell Road bridge, exit 114 to Old Jackson Road split to Nissan Drive. They will not be there at shift change when they run about three persons a shift for the whole city. Yeah, it's a speedway. I've been passed by folks on I-55 North bound coming through Gluckstadt and they have to be near 90-100 at times. Is boyfriend getting charged with Accessory after the fact?

What sort of damage could a bicycle do that would cause a body shop owner to call the Po Po?

If she had just left Nissan at shift change, not much chance she was DUI. Where are the witnesses? If there were none, it's doubtful she can be charged as negligent. A 75 year old man riding a bicycle on a busy thoroughfare? So many questions.

Radar isn't what make MHP useless. Their job is basically just traffic enforcement and of course, looking sharp in patent leather. Not even State Police. Most couldn't or wouldn't do actual police work (Alarm calls, Domestic issues, robbery/burglary etc). But, they do look sharp while they blow down the road violating traffic laws and chasing ass, both sexes ass.

If you had been there you would have seen the bike condition and what it would have done to a car body and undercarriage. Mechanic probably heard of the accident and may have know where the owner worked at. I applaud his action.

It might help the verdict from 'the court of public opinion' if we knew whether the rider was in a dedicated cycle zone, what the time of day was, the weather conditions, whether the cyclist darted out into traffic, whether there were skid marks, whether the car entered a bicycle lane only and why there were conveniently no witnesses. Otherwise, why did Kingfish toss this one out into the Public Opinion Courtroom?

'Bob was a nice guy', 'Stacy has a law degree', 'he might have been thrown across the windshield', 'MHP is incompetent' and 'I hope she suffers' are all irrelevant comments. So...the thread has achieved its intended purpose.

Doesn’t matter by law if the cyclist was in the lane or not. He has the same right to be in the lane as the automobile. Had the driver stayed, it is unlikely there would have been charges. In MS, the biggest legal issue ( for her) is the felony - leaving the scene that involved serious injury or death. That charge will likely separate this mom from her kids for a while.

Two went after the judge and her family personally. Has nothing to do with post and not getting approved.

One comment talked about the appearance of the defendant. Really?

One comment referred to her kids as a litter of puppies? Disgusting.

THen there was the good ole blah blah blah, asking for a friend. I don't approve those much anymore.

Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time.
