Banks loses, Lackey tosses Election Commission

Karl Banks's efforts to use the Madison County Election Commission to overturn his two-vote electoral loss to David Bishop failed.  Special Circuit Judge Henry Lackey crushed the commission's efforts to change the results of the District 4 Supervisor election in Madison County.  The opinion is posted below.


The Election Commission certified the results after the November election in accordance with the law.  However, the District 2 seat flipped parties and Democrats had a 3-2 majority on the commission.  The commission immediately fired its attorney, the highly-regarded Spence Flatguard, and replaced him with Harold Evans, an attorney with no election law experience.   The commission tried to argue that mistakes were made in voting and tried to give more votes to Banks.  Judge Lackey held a hearing several weeks ago and issued his opinion today.

David (along with Trey and Sheila) has done a great job working for us to clean up the corruption and incompetence fostered by Banks, Griffin, John Bell Crosby, and John Howland. I am very grateful for his efforts.

It is outrageous for a person that works hard to do the right thing has to spend more than his annual salary in legal bills to fight off a corrupt challenger.

I encourage everyone to come together to help David pay off his LARGE legal bills. Getting Banks and Warnock out of our back pocket not only helps us District 4 taxpayers, but also everyone in the whole county.

It is ironic that Banks got in the 1st time after he won by 5 or 10 votes (before voter ID), and the Democrat controlled Election Commission voted along racial lines to refuse to allow a recount. It didn't work for him this time...............

@3:13pm, Banks may not get support from Bennie, et al., because Banks' beneficiaries were mainly the white crooks that returned the favor - Warnock and other assorted vendors, developers and swindlers.

About the only blacks Banks helped get rich at taxpayer expense was himself and his family. He didn't do anything to put money in his fellow blacks pockets.
The blacks I have talked with, including those that work for the county, think he is a jerk. Evans tried to use the race card in his presentation to Judge Lackey, but it went over like a pregnant pole-vaulter.

Hope it is OVER!!! Banks needs to go home. Madison County finally looks like an honorably lead entity. Let's keep it that way. There was no honor during most of Banks time on the Board and we, the citizens, spoke.

Henry Lackey is one of the wisest men in Mississippi. No matter how you feel about this case, there is no disputing his wisdom and the job he has done as Judge.

How much wisdom does it take to say 'the election commission appears to have done its job' and 'I don't think this is a matter for this court'?

@12:36AM & 5:14AM,,Well Dorsey, you can appeal it to the Supreme Court, but they won't waste their time hearing it.

There was NO evidence presented to Lackey that indicated the EC had NOT done it's job. The only "evidence" was testimony by Evans that he had found errors, but he quickly fell on his face when Lackey asked how he had come to his conclusion. Evans is a low level ambulance chaser, has NO expertise in election law, and was not there when the votes were counted with all the EC present. His only credentials are that he is a Democrat and a cousin to Ed Blackman........

This was not a matter for the court because once the election was certified by the EC and sent to the SOS, it was out of the EC's hands. Even if he wanted to, Lackey could not order the new hacks to go back and reshuffle the votes.

YES -- DITTO what 8:31 said-- Evans was not at the count or follow up days at Circuit. How does he know what happened accurately on behalf of the EC folks actions? He got it from those parties he wanted to "interview".

Now Bishop / DIST 4 supervisor has a vote in all motions regarding Election Commissioners.

Later this year, and even better Some members of the Election commission will be challenged in the Fall election.
....More change is coming..

No. Banks just didn't work hard enough to get votes out for him. Didn't need by a few - and the folks he got to vote didn't do it at the right voting place (lost those affidavit votes Dorsey keeps on claiming should be counted).

Cochran campaign could show anyone how to get voters motivated. Madison County voters who wanted to change were motivated. Cochran voters didn't want the crap that 12:39 and the McD crazies wanted to go back to. Get over it.

Banks is a crook and I am glad he was defeated. However, Bishop has taken the first step down that path. Only a different group shelling out the money in return for favors. Corruption usually starts with baby steps. Where will he be in a few years?

2;05 - many, many people agree. But the few that keep on wanting to drag out their loss want to dominate anywhere they can try to make their idiotic voices heard. Chrissy keeps on pushing - now he is trying to ride the Cruz train to keep him relevant. Sooner or later he might realize that he and his few follwers should klick their heels and go back home to OZ. Let the rest of us continue to move forward.

Question is - which idiot do we get rid of first? Obama or McDaniel?

Bishop's legal bills are indeed high.... because he hired Jim Herring, an overbilling dinosaur who should go to the house. Lets just say the Street Committee says the bill are the same as the price of a ranch home in NE Jackson and leave it at that.

Kingfish, Herring should do Bishop's legal work for a fraction of what he is charging him. Neither the Republican Party or Herring gave Bishop the time of day when he was running against Banks.

David won because we worked our asses off and hustled to wake people up to the tyranny of Banks, Griffin, Crosby, Howland and Steen. A dedicated core of supporters (who do not want any "favors") helped raise the money and helped David do the heavy lifting to send Banks' sorry ass into forced retirement.

We also worked to help remove Rudy Warnock's other Stepford wives (Crosby and Howland) from the BOS. Our work paid off. The new Supes are bringing Madison County back to the people. They have made a few honest mistakes, but they are working hard to do what's best for the county.

Well, Bishop was told by his backers who to use for an attorney and who not to use. Needless to say, Herring was not on the approved attorney list, for lack of a better phrase. So he supposedly got hit with a huge legal bill by Herring and the backers not exactly jumping out to pay for it.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
