State Senator: Oxford House applicants made "material misrepresentations".

State Senator Will Longwitz charged that a loan application related to a house on Northside Drive made "material misrepresentations" in a loan application submitted to the Mississippi Department of Mental Health.   The house was leased to Oxford House for placement of recovering drug and alcohol addicts.  Senator Longwitz made these claims in a letter sent to MDMH Executive Director Diana Mikula on May 5.  The letter and supporting exhibits are posted below.


Senator Longwitz stated that the applicants claimed the house at 2230 East Northside Drive only had three bedrooms while the loan application claimed it had five bedroooms. He asked the department to "demand" that the recipients of the funds repay a $4,000 federal grant and place a lien on the home if repayment is not made.

Remember this is an apparent misrepresentation for Federal Grant money (seed money for the house) administered by MDMH and supplied by a division of the Federal department, HHS. The federal government does not treat such matters lightly. Neither should MDMH.

Instead of facts, such as "the house has 5 bedrooms", I will just act like I know everything and say "It has to have 3 bedrooms since that's what it was listed as".

I have been to the house since Oxford House moved in, and it had 5 bedrooms. MDMH also visited and inspected it. GUESS WHAT?? 5 bedrooms.

I would think this Oxford House or the home owners would sue Longwitz for material misrepresentation in his witchhunt or the blog owner for material misrepresentation in his.

First, according to various mapping programs, it is 1.5 miles to the intersection of Old Canton and Ridgewood roads... via the roads and it's 1.1 straight miles using a geo-mapping program.

Second, the blog owner states Longwitz alleges that the home owners made material misrepresentations, which is false. Rushes to judgement leads to rushed judgement

"week"?? Saying the house has more bedrooms than it does for the sole purpose of obtaining federal money is a little more than "week"....it is criminal. Think of it as fudging the numbers on your taxes to get a refund. Oh and Neal, I mean 1:22, hanging a sheet in the middle of the room doesn't count as 2 bedrooms, nor does turning the dining room or den into a bedroom. OH lied about the total number of rooms as well. The only reason they did so was to illegally obtain government money.

If you look carefully at the letter and the documents attached to the letter, it looks like there needs to be one correction to KF's description. The applicants are not the Stephens, although she is listed on the Application as the Landlord. The applicants are 4 guys with redacted last names with addresses it appears at other Oxford Houses (and listing also their problems), and thus it appears as as prospective tenants.

Remember, the houses came into the neighborhood with no notice or information to the neighbors even though the houses are advertised for 7 which requires a use permit application and notice.

Senator "Mr. Entitlement" Longwitz points out, possibly correctly but who knows, that there are violations of the application requirements for this group's receipt of the state/federal dollars.

Rules can be a bitch - but they are put there for all to follow if they want the benefits that go with the requirements.

Same concept ought to apply to the 'honorable Senator's' requirements. Check out his campaign finance filing disclosure, required to be filed with the SOS by the eighth of May. Those filing "require" that the date, name, address, and employer of all contributors of over $200 be disclosed. Same basic requirements for expenditures.

But Senator Longwitz, because I guess he is entitled to a government position, felt like he didn't need to comply with all those pesky little details. He only listed the names and dates of his contributions and of his expenditures.

Oh well. Rules are just made for the 'unentitled' to follow. Thusly, someone should tell the Senator that the entitled Stephens shouldn't have to worry about the pesky details of MDMH just as he chooses to ignore the requirements of running for reelection to his 'position'.

Longwitz may very well pester these people to pull out, but I have read all of the source material in these posts and have yet to see where OH has clearly violated any laws. I've known Will since law school. A legal savant, he isn't, but at least he's doing his job. If there was a real case, there would be a lawsuit or an agency audit.

The problem is the City of Jackson, and others across the country apparently, have poor codes and an eroding real estate market making them prime locations for these enterprises - lawful enterprises that no one complains about until they move in next door.

If you don't want these houses next door, don't move to places with weak codes. If you don't want to see your house plummet in value to attract these enterprises, get out at the first sign of a downturn. I don't ride stocks down the drain (anymore) and won't watch my house crumble in value due to normal real estate life cycles.

I will readily agree that many politicos, including certain repeat legislators, don't file accurate, timely or complete campaign finance reports. I know this because I spend a lot of time reading through them.

But - I expect legislators and other politicians to file an honest and complete report. The fact that some don't doesn't mean that I condone it. And I'm sorry to see that there are folks like you that do condone it - since "everybody else does it"!!

My comparison of the OH to finance reports and Longwitz has relevance. If it is 'wrong' to file an application for federal dollars that is incomplete or inaccurate - as Senator Longwitz says - why isn't it just as wrong for the Senator to file a form that is required as part of his job that is incomplete.

Let me be clear - I am against OH in every way possible. The process of the MDMH in approving it and allowing what is being done in OH's is wrong. I support the neighborhood and Senator Longwitz, and everybody else that is trying to get rid of it.

But - I also expect the same standard of applicants for my tax dollars through MDMH as I expect from my elected representatives. The fact that I was reading through finance reports at the same time I was reading this post on JJ made the hypocracy evident.

4:02 - Legislators are elected to legislate - granted many (at both the state and national level) have tried to convert their position into one of 'constituent services. Not picking on Longwitz for joining the same fray that other legislators do because it is now the "expected" role - just as you did. Frankly, fighting an agency is not the job of a legislator. Oversight of the agency is a role of a legislator before they decide to keep funding their operation.

There is no reason that a legislator should be able to get information from an agency that a private citizen cannot get. And with the same degree of effort. There is nothing in the legislator's job description that says they are a 'special class' of citizen.

The fact that they know 'how' to do it might make it easier for them. But I'll bet those in the neighborhood of OH have plenty of experience in dealing with agencies to 'know how' to get any information timely and have the dogmatic ability to get it timely.

Neither Longwitz nor anyone is trying to pester anyone. The neighbors are trying to find out through their Senator what is going on from MDMH after the absolute shock of the appearance without notice of a group home.

If you think that stronger City codes can do anything in the face of the Fair Housing Act (FHA) to stop OH, then I invite you to read the FHA, 42 USC 3604 and the cases behind it. Just search the words "Oxford House" and read the cases, or better yet just go to the OH website, look at the legal tab and read their summaries of their cases. Every town is vulnerable to group homes for "disabled" recovering drug addicts in the same way as long as MDMH chooses to apply for the federal grants and contract with OH to service them. Madison is no refuge. Neither is Ridgeland.

OH litigates with multiple jurisdictions every year. Look at their annual report online.

This will continue in MS with new houses, including the possibility of OH litigation with cities like Madison or Ridgeland or wherever their landlords want to land, until the MDMH decides not to do further business with OH.

Established OHs will seed new houses, on and on.

6:05 - If Longwitz, or Denny, wants to help these particular constituents, whether they are a majority or not, they should pass legislation denying MDMH (or any other state agency) from applying for and distributing these federal dollars. Or change the requirements in MS for use of the funds to eliminate the part of the program that 'the majority of their constituents" find objectionable.

Not defending Denny, but it appears to me that he is not grandstanding over his activities by putting out press releases of his letters to MDMH. But then again, Denny is not involved in a reelection campaign.

Your x = y concept of thinking is really quite interesting - questioning Longwitz means supporting Denny? Certainly appears that what is at play here is that you just don't like Denny. Was that because of his failure to pass legislation last year, or the year before, to stop this? Oh, that's right. That would condemn Longwitz as well.

I'm not really questioning Longwitz, cause I saw him get this involved when there was a 'youth camp' for disadvantaged kids going into Madison. Although there, he was for it before he was against it - when it was going into his neighborhood.

Definition of what constitutes a LEGAL bedroom may vary somewhat depending upon zoning and building ordinances, but the description typically includes:

*2 entrances - a latchable door and an escape window. Window must open to outside and be large enough for emergency exit. Door must not enter another bedroom.
* minimum 70 sqft. Not smaller than 7 ft in any direction.
* smoke detector in room.
* convenient access to full bath WITHOUT having to pass through a common area (i.e. foyer, living room, kitchen, etc).

Having a bed in a den, living room, dining room, storage room does not make it a LEGAL bedroom.

5:51, I invite you to explore the federal cases in the jurisdictions that have bested OH under the Act. The municipalities that have codes which require reasonable attributes be followed (eg, no closer than 900 feet of other residences) and can justify the rationale have won under the Act. They create barriers to entry without violating the rights of the disabled. These cases have been cited in comments to earlier posts.

A point was made: Senator Longwitz didn't file an accurate campaign finance report with the SOS's office. This is a fact. I just went and viewed it personally.
A point was made by Senator Longwitz that the application made for the house had a wrong number of rooms (I can't verify it because I've never been in the house AND NEITHER HAS SENATOR LONGWITZ!). However, let's just assume it's true.

The point is-the great senator wants to point fingers and blame others, yet he's doing the same thing!!! HE. IS. A. HYPOCRITE. This is obvious to anyone who has an IQ greater than 60. No, I'm not a member of the Stephens family. Never met them. Wouldn't recognize them if they knocked on my door. No, I'm not from Maryland. Been there twice-not to visit an Oxford house. Example: 1) OH isn't receiving the whole 1.1 million they are only one small part of the grant. 2) yes the house (ENside) was advertised as 3 bedroom, but it has since been converted to 5. 3) commenting on the character of the people in the house when he hasn't even bothered to meet them.

This application makes no sense to me.

$200 for furniture? ( 4 beds, 1 table with for chairs for meals at a minimum) and $75 for cleaning supplies? ( does this mean there's no carpet?)

I can't imagine how this works so the living conditions are minimally acceptable and there is any realistic expectation of adequate maintenance on the house and yard.

Are the men going to be able to provide sheets, towels, blankets, pillows, cooking and eating utensils ,yard maintenance tools,
waste baskets and kitchen trash can ?

Are there window coverings on every window? Bath mats?

The point is that someone who has been in prison or on the streets, are unlikely to be arriving with many personal items. Some of them may have never used a washing machine or known the difference between cleaning a wood floor or tile.

This is , in most cases , going to be a literal " start up".

I can't imagine how this is successful with zero supervision.

You are putting 4 people who have a past history of not taking care of themselves in a living situation where they now have to also learn or re-learn to take care of a house and yard. Think of how just the materials used to " flip" a house have changed in terms of how you clean and maintain the floors and showers! Are the floors hardwood or laminate and can they tell the difference?

If calling a living room & dining room bedrooms isn't a misrepresentation then my house has 12 bedrooms. What could be wrong with counting closets & pantry as bedrooms? Since the cat sometimes poops in the laundry closet that could add another bed/bath suite.

You simply cannot dispute that OH is recruiting criminals from jails and providing NO supervision or drug testing. They admit this so if you state otherwise, you are either lying or have been misled. Considering how pissed off you seem to be, I would say that the environment you are in is not very conducive to a healthy recovery. There are other entities that can help which provide much more support than OH. Seek them out.

I can state for certain that in the home I live in there isn't anyone fresh from jail, but if there was they have paid their debt and deserve a chance. I work I pay taxes. Secondly yes it does upset me to be judged and lied about by people who haven't even taken the time to find out how we really live. Thirdly I have been randomly drug tested more than once while living here. And I have been sober almost a year and a half thanks to my hard work and the healthy living environment of this OH.

Look at their own "traditions" which provide for no supervision, no mandatory rehab or attendance at aa meetings, no drug testing (if those residents are receiving drug tests, it's not from OH or MDMH), and they are actively recruiting from jails. The northside house isn't even in compliance with OH's own guidelines. Residents' concerns are valid and are only bolstered by the defensiveness of those associated with OH. If you are neither a proponent nor a resident, then please keep your ignorance on the subject to yourself.

We want to be sober. We want to go to meeting. We want ri be drug tested. We want life. OH helps us do that. I've been in treatment. Treatment is great but when I was done I left with a bag of clothes and nothing else. Thanks to being in an OH I've got 2 jobs a car and am a voting tax paying citizen. I accomplished all this myself because I had a safe place to live

Interesting how the same pervasive selfishness that addicts demonstrate in their actions towards others, and how their actions affect the lives of their families, friends, and community is so clearly evident in the OH response on this blog. IT IS ALL ABOUT THEM. Their attempt to get sober trumps the rights of everyone else. Their sobriety journey is more important than any local zoning laws, neighborhood concerns, risk to the single family community, or the decline in property values associated with boarding houses in single family neighborhoods. Selfish behavior is the single character trait you will find in all addicts - and drunk, high or sober the selfishness comes through when dealing with others. At the core of this problem is that fact that OH and their participants believe their personal problems are more important than the rights of their neighbors or the community.

1:59 - I'm glad you have been successful in your recovery and no one wants those in treatment to be forced to live in an unsafe atmosphere. But its not like there are no other options. Surely, as one who has faced the demons of addiction, you can recognize the danger of relapse is very real and that many times additional serious mental illness accompanies addiction. Why are the rights of individuals who have made bad choices superior to the rights of families who have worked hard to maintain a safe and desirable neighborhood for their families? Why should my tax dollars subsidize the devaluing of my neighborhood? Is a person more or less likely to purchase my home with a group of unrelated addicted men living next door? Why is the federal gov't permitted to trample our zoning ordinance by defining independent, unsupervised, supposedly working adults as disabled?

I completely agree. I have never seen such selfish and arrogant people in my entire life. You call yourself "good Christians", but what do you really know? This senator is nobody. He is just doing the bidding of what these rich mean and pathetic neighborhood want him to. Period. Nothing else. he doesn't care about the people in this house trying to improve their lives, believe me. Longwitz is nobody's hero. These rich so-called "neighbors" are just pushing him out for him to do what they want him to do. Of course he's aggressive. They're demanding it. It makes me vomit. At least the other elected officials have the decency to let these houses work, from what I can tell.

It's revolting to see the residents get shamed on this site. 2:47 and 2:49, the residents have rights under the Federal Fair Housing Act. The Supreme Court said so. Get over yourselves. You got a problem with that? Take it up with your congressmen to change the Act. Or, better yet, sell your damn house and move to another area of town. Hell, you'd improve MS if you'd take your hate filled households to another state altogether. Otherwise, keep your venom in your own shameful homes. Disgusting.

I haven't been supportive of the way the OH has developed in the neighborhood, or how OH itself operates in general. But - the comments made on this site by a few have almost converted me! The generalization made about the residents - with no specific knowledge - followed by the personal attacks on them when they should "dare" to post themselves makes me agree that I would rather have them as my neighbor than some of the idiots attacking them.

(1) I live in NE Jackson
(2) I have never met the Stephens - had never even heard of them until this mess started
(3) I would prefer that any program designed for the purposes proclaimed by the fed dollars be managed in a manner that it wasn't all about the profits for the landlords and groups such as OH
(4) I hate grandstanding politicians
(5) I hate bigotry. And I have been accused of being an old, white bigot way too many times in my life by many that don't like my partisan politics and equates the two
(6) Having had to deal with recovering addicted family members -as have many folks in NE Jackson - I do recognize the possibilities expressed by the OH residents

My question: Why didn't these high priced lawyers and our noble Senator get so involved when the other Oxford Houses were established in NE Jackson last year and the year before? Understand that the lawyers didn't have them next door - but one was down the street. But to the Senator - why didn't you have the same concerns for those constituents that you are now expressing during your reelection year?

If the answer is that you didn't realize that there were other Oxford Houses in the neighborhood, doesn't that speak loudly that they aren't all bad?

People in the neighborhood want to protect your home values? Quit telling everyone in the world that your neighborhood has gone to hell because of recovering addicts moving in down the street. Do you realize how many of these things there are in 39211? I haven't seen a drop in property value where the neighbors have kept their mouths shut. You all are your own worst enemies.

4:41 - It's not like the halfway houses will remain secret if no one discusses it. Who buys a house without inquiring about the next door neighbors? No one. People want to know who lives next door for any number of reasons; older folks that may not want to be around kids, young families hoping for playmates for their kids, singles looking to socialize, or to make a judgment about the stability of their investment.

First of all our rights are equal to yours no better no less. Second OH has been in Jackson since 7/2013 and neighborhoods they are in have not decreased in value. Thirdly in all this time no one has been hurt. Also I wouldn't call us the selfish ones. We are just defending ourselves from the bigotry and hate put upon us.

For God's sake! I am from Clinton and have no dog in this hunt, except to see what the house looks like, and imagining it being in MY neighborhood.

I drove by there at 3:02 this afternoon. This house is SMALL, and if it is a 5 bedroom, then there is snow in hell. There is NO WAY this ruse was pulled off without cheating. Period. Drive by there. Look for yourself.

Shame on the owners and SHAME on our government that would allow a LIE to hold water, if scrutinized honestly.

I appreciate your comment which is correct, except EVERYONE has a dog in this hunt. There are portions of Clinton, Ridgeland and Madison that allow rental housing. Wherever people are allowed to rent, and the price per sq. ft. is not too high, an OH might come to roost, backed by the special class protections of the FHA. So most everyone has, or will soon have, this issue for their families and children in R1 neighborhoods.

So it's small. These guys need extra roommates to have more money for expenses after the rent is paid, and it's easier to stay sober when five other guys are watching over you. If you snobs are really worried about your safety and property values, show even a sliver of evidence that one of the other Mississippi Oxford Houses has caused any safety or property value problems. The real problem is that a few people are pissed off at an arrogant couple who ran this in on them without asking permission first, and an even more arrogant corporate guy who doesn't give a rat's ass how they feel about it. I feel for you, but if arrogance was against the law your Senator would have been put away a long time ago.

The two entrances are:
(1)a door/not just a doorway, and (2)a window.

A window is considered an emergency entrance/exit--such as in case of a fire. it must open (no solid plate glass window) to the outside/not another room and it must be large enough for a person to get through.

I hope this more clearly explains the 'two entrances' requirement.

I firmly believe that whomever wrote "5" bedrooms on the loan application for the OH East Northside house intentionally gave false information. Also of importance in this matter is that whomever gave approval for this loan did not do due diligence verifying given information. Not good.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
