Despite Judge Wingate's butt-whupping a few weeks ago, the Sisters of Rukia launched another attack on JXN Water Manager Ted Henifin yesterday as the Poor People's Campaign and People's Advocacy Institute filed a complaint against Jackson's water receiver with the EPA. The complaint is posted below.
The petition repeats many of the same demands made in federal court last month:
(1) immediate access to safe drinking water, (2) real-time information about the safety of their tap water, and (3) a role in the enforcement and development of a long-term consent decree that is responsive to Jacksonians’ current health and safety complaints. Earlier post.
The Tribe of Rukia charges "Jacksonians have no confidence" in Mr. Henfin's statements that Jackson's water is safe to drink. Oddly enough, the same groups supported Mayor Lumumba when he made the same claim while the EPA said the water system was falling apart but who's keeping score in Lumumbaland? It's all about the contracts, you see.
However, the petitioners aren't merely satisfied with ginning up an investigation against Jackson's water receiver. They want, no, demand a meeting with the EPA by September 8 to "discuss their concerns."
The petition predictably takes the Lumumba party line as to the causes of the collapse of Jackson's water system: White flight, failure to send additional funds to Jackson, establishing a 1% Sales Tax Commission, and HB #1020. No mention was made of Siemens, cutoff moratoriums, the failure to collect bills, and inability to staff the water plants.
The petition plays the blame game until the real target is revealed on page twelve. Sista Rukia's crew accuses Mr. Henifin of taking the "first steps toward privatizing the water system, which is against the wishes of Jacksonians." Would be such were true. The complaint complains about the hiring of Jacobs Engineering and other contractors that are operating and fixing the water system. If the system is privatized, they argue, Jacksonians can't hold politicians accountable. Left unsaid is how Jackson voters refused to hold any Mayor's accountable as fool after fool destroyed the system, current leadership included.
Unfortunately for Jackson, these clowns are more concerned with their "dignity" than actually fixing the water system. It's all about lining their pockets and getting contracts for their friends:

notices in Jackson which impact large parts of the city. Between 2017 and 2021, the system had 7,321 line breaks—more than triple the industry average benchmark.⁸² As a result, the City issued 750 boil water notices between 2016 and 2020 alone.⁸³ Despite the widespread and repetitive nature of the boil water notices, the City (and now JXN Water, Inc.) has not utilized best practices to ensure residents know when and why boil water notices are issued, particularly with elderly residents and residents who have limited access to technology.
Um, who was Mayor between 2016 and 2020? But who cares about truth when one is making up facts?
The petition makes the following demands:
* Order the Receiver to increase public access to information and data.
* Require monthly operating reports for both treatment plants, boil water notices, lead & copper rule compliance data, and other information. (p.35)
* Order JXN Water to "modernize the boil water notice system." Such notices should be delivered by text messages, automated calls, door to door canvassing, press releases, and social media posts. The EPA SHOULD also order Mr. Henifin to consult with Ms. Lumumba's community groups Um, yeah.
* Increase community involvement. Require JXN Water to hire an ombudsman to represent "community interests."
* Require JXN Water to have quarterly community meetings, led by the ombudsman.
* EPA must immediately created bottled water distribution to residents while "there is an ongoing imminent threat from microbial and lead contamination." The same threat that existed since Mayor Lumumba assumed the purple? Just curious. Did Sista Rukia's groups have any contracts with the city to distribute water?

Establishing water distribution centers is insufficient: Many Jackson residents cannot reach distribution centers or stand in (often long) lines to receive water, because they, for example, are older, have mobility limitations, are pregnant or caring for young children, or simply need to be present at work. While Petitioners request that EPA order stockpiles of water to be established in the City for ready distribution, the best way to distribute that water is via community delivery.
Here it comes:
Petitioners also request that the EPA designate a community organization, such as MRRC, to lead bottled water distribution, with the City of Jackson providing support as MRRC requests. Throughout the water crisis, MRRC has distributed over two million bottles of water to Jackson residents. MRRC has hired staff members trained and positioned for bottled water distribution, and has expertise and local knowledge to effectively distribute water to residents.* If there is any doubt where this is going, read this passage on page 41:

The leading petitioners made the same complaints and demands to U.S. District Judge Henry Wingate last month. JJ reported on July 24:
City Attorney Tori Martin, Rukia Lumumba, and members of the Order of the Sisters of Rukia accused Mr. Henifin of racism, only hiring white employees while picking white contractors, and having "transparency issues." They asked the Court to allow the Mayor to "advise" Mr. Henifin on picking contractors. They also wanted to see all communications between the Court and Mr. Henifin. The Water Manager is an employee of the Court.
The shenanigans began when Ms. Martin asked for a status conference to be held on July 7 to discuss these matters of great concern. Judge Wingate held the hearing and continued it to July 12-13 so he could hear from the "community groups" and Jackson Fire Department officials.
Ms. Martin acknowledged much progress has been made in repairing Jackson's water system but she said there were issues regarding communication and transparency regarding Ted Henifin, the water manager.
The attorney said several organizations are raising concerns with Jackson's elected officials regarding the stipulated order that placed the water system into receivership, how the order is implemented, and JXN Water provides information to the public.
She said the groups dispute Mr. Henifin's claim the water is safe to drink as they allege they are still experiencing discoloration and an odor in the water......
The Sisters of Rukia apparently used Judge Wingate's beatdown to fine-tune their petition.City Attorney Tori Martin asked for the July 7 hearing, claiming the city and several "community groups" had concerns about Mr. Henifin's "transparency." She said the Mayor should be able to influence Mr. Henifin's choice of contractors and have access to all communications between the Court and the Water Receiver. Judge Wingate said no to it all.
However, Judge Wingate gave the so-called "community groups" a chance to make their voices heard in court. Several "representatives" complained about water problems (pressure, discoloration, and odor), hiring a call center in Pearl, accused Mr. Henifin of overpaying white employees while of course hiring too many white employees. They said the water was not safe to drink.
It soon became clear that each group was a front for Rukia Lumumba after Judge Wingate questioned their "representatives."
Judge Wingate said he expected them "to come armed with quantifiable facts, fair assessments of progress thus far, and reasonable expectations for the foreseeable future." However, the Court soon found such was not to be the case as one gets the sense the Court was being professionally kind to the local idiots who thought they were experts:Not so! Overall, the presentations from Henifin’s critics were either uninformed, short-sighted, clearly political, well-intentioned but naïve, or (as earlier discussed) racist.They asked for more transparency but couldn't define what they thought it should be. The Court said Mr. Henifin spoke at 33 public events and granted numerous interviews to the media.

Perhaps we should form our own community groups and make our feelings known to the EPA as the Lumumbas hae done. Of course, the real question is will Director Regan give the same treatment to those who look like him as Judge Wingate did. One suspects such will not be the case as he will probably instead try to rig the investigation in favor of his favored few as he has done already. Remember that 180-day deadline for the NAACP complaint? Regan isn't about to go against this crowd if he can avoid it.

Don't think for one second their attacks aren't happening without the Mayor's approval. He has simply outsourced his war against the receiver to his sister. Don't believe the HindsCo Sup primary results out of Jackson precincts were an indication of an electorate pleased with the status quo. In fact the opposite. In other words, we concede that we have no viable cause of action to support an appropriate judicial appeal, so we hereby give Henry Wingate the middle finger and beg Director Regan to somehow strip the federal court of it’s exclusive jurisdiction.”
As if that’s how it works.
Here’s what needs to happen: 1. Mr. Regan needs to posthaste cut acknowledge the futility and absurdity of their bullshit; 2. Judge Wingate needs to stop being polite and cut them off at their knees. May I suggest (a) sanction the sisters (b) assess them with all costs and attorney’s fees; (c) issue a sua sponte cease and desist order protecting the ITPM from further harm and harassment; and (d) refer Tori Martin to the Mississippi Bar and the State Ethics Commission.
Given the deep racial animus in this country and the abetting of same by the Biden administration, I believe ultimately Henifen will have to go. We shall see.
It’s truly infuriating to see our own mayor’s sister continuously try to undermine the work of the ONE man who volunteered to come to Jackson and try to fix this mess. Sure he is well-paid, but not enough to put up with this BS. JXN Water has been 1000x more transparent than the City was, releasing detailed water quality reports and speaking at numerous community meetings in all areas of town. I learned a ton just watching the FB livestream of the “jacksonians 4 jackson” meeting he spoke at last week. Meeting was open to the public, Rukia.
If I were Ted, I would’ve said good riddance a long time ago. Instead, he’s realized what a mess our sewer system is (with hundreds of dry weather sewer overflows just sitting for years and the City not even paying the bills to get the sewer vacuum trucks out of the repair shop for who knows how long) and he’s volunteered to fix that too, without federal support at this point. The problem has never been white flight/a declining tax base, it’s been management of our resources. Just watch the budget presentations to the City council and you’ll see a lot of fat to be trimmed.

And Kingfish hit the nail on the head with that one - despite EPA’s own 180 day mandatory time period for investigating that NAACP complaint, EPA has done nothing - because they don’t want to say the facts cited by NAACP are not true.

I don't think Rukia is helping her brother. But,frankly, I'm stunned that you and some of my GOP friends can't see the work improvements being done in Jackson. Maybe you just aren't riding around east of I-55 or State St often enough or else it's seeing only the bad and missing renovated homes and businesses that were in terrible condition for decades.
All I know is that northeast Jackson, except for a few remaining pockets is looking better. Homes have been renovated on Ridgewood and streets in either direction. State St looks better between Capitol and Meadowbrook. Fondren continues to hold it's own. The facades of Capitol St are vastly improved but in this STATE we will always have a problem with absent owners and slum lords. Our city council could do what Madison has done on zoning and codes. They are too busy squabbling and holding "venting" public meetings.
The FIRST and BEST thing any elected official can do is finding out how other places with the same general problems and description address problems. Madison's mayor copied Roswell, GA's ordinances and codes. I just wish she'd "kept up" with how they've be "tweaked".
And, it'd be great, on social issues dividing us if we could actually get a reasonable referendum option. God knows our last voting didn't make an impression and that gerrymandering has kept northeast Jackson from having any real say in elections. The GOP hoped, under the guise of diluting black vote, did the opposite. They instead diluted the educated/middle to upper class vote instead and got rid the few legislators capable of forensic accounting.

Isn’t there some way to make Henifin the mayor-in-deed and make Chokwe the ceremonial mayor? Ted’s function would be administering the day-to-day operation of what makes Jackson pretty close to a First World community; Chokwe would speak to elementary school classes about how important is his job as “mayor.”
As a Jackson resident, these things don't infuriate me anymore. Since Judge Wingate came in and laid down the law, every noise they make comes off as a futile complaint that discredits them more and more. There's something to be said for the perception of "quiet competence". If these idiots weren't making foolish assertions, I'd be more worried honestly. The EPA is seeing progress towards resolving these ongoing problems. They're barking up the only tree they have left and it's most definitely the wrong one.

@9:06 - Finally, facts from a fellow citizen in a non-trolling fashion. I will attest to these changes as well. We had a water main break up the street in the intersection. Jxnwater had it fixed within 10 hours. Another break occurred on the opposite end of the street and they had that one fixed in 5 hours. A geyser on State Street in front of 1st Baptist occurred this morning. Crews are already on scene breaking up the street to perform the repairs. Crews are all over the area surveying required repaired for the sewer system, and I mean I see them all over the place with some repairs having already been made since the order took place. I took some debris to the Madison dump yesterday morning and drove up Hanging Moss on my way. The homes are well manicured and quite attractive. Blight is being cleaned up with orders to remove more. I am seeing more and more action on the issues that have existed for years. While driving from Clinton last week, I took Robinson Rd to Ellis and on up to West Capitol. The streets have been repaved, sidewalks rebuilt. I was really surprised to see just how nice the area looked. This city is worth saving. I don't care what the trolls say.

I support Wingate and Henifin! Progress is already being made. These unhinged groups do not represent this community. From my POV they only seek to separate the people into color groups with the intention of creating their own segregated area. Haven't we fought against this for decades? We the people need to stand up and stop this. Please someone stand up and create an "assembly" called "WE the People", not black people or white people, but all people who support these two fine men taking on our broken city. They have wasted precious time answering to these radical, racist, wackcos, that should be spent focused on repairing the water and sewer. We the people need to show support for those not bowing down and giving into these shakedowns for contracts. You know that is the bottom line here. They lost the ability to be compensated for water distribution. Period, end of story! If Henifin would just throw them some money they would go away. I hope he, Wingate and the EPA holds strong and sees the reality of this. We the people, certainly do.

I'm just now getting around to reading this 57 page of ...... I'm not quite sure what to call it, but find it amazing that these folks could even bother to make this effort.
Haven't gotten through much of it yet while taking notes, but find the part on the 'lead' issue fun reading.
Page 19, after complaining that several years earlier there was found to be a possible problem with the treatment systems and pipes either in the system or within households - to which the City has done nothing to address, despite the EPA's multiple requirements for corrective action - the complainants (including, of course, the Mayor's sister and her clan) say that "only recently have the valves at the boundry been closed" which should have been step one in the corrective solution required. OK - the ITPM "only recently" has taken a simple step that the City (under Brother Chockwe's leadership) did not, or would not, take? The ITPM has been in position for less than a half a year, and during that time has "only recently" taken this first step to isolate these areas from this potential problem? How recently? This past month, or a few months ago after he learned about it for the first time? Inquiring minds want to know. But more importantly, inquiring minds want to know why this simple step wasn't done last year, or four or five years ago? Maybe Sister can tell us --- and the EPA in their follow-up paper, why.
And then, on the next page after continuing to discuss the "possible" lead issue - they point out that "the Study the CITY used was flawed". OK. So the ITPM used the study given to him by the City of Jackson when the Court handed this problem over to him, and they are complaining that the City's study (the study done by brother's administration, we should note) was flawed so it is the ITPM's fault?
If the entire 57 pages read like these couple of pages - Marvel ought to come in and see if they can get the copyright for this comedy production.

Mr. Henifin, you may have thought since you leaned liberal that you would have an easy go. I imagine you thought if you got the business folks on your side, you could do things like bill based on property value. Are you waking up yet? You've done a good job so far and thank God you report only to Judge Wingate. Are you understanding what is happening down here? Dont get caught up in the side crap. And don't put yourself in any position to "owe" anybody.
